      If employee doesn't serve the notice period then the company will not provide the settlement money _ they don't credit the money.

      You can always ask the next company to compensate. It works out just fine. You can show the salary slip.
      On the other hand try to quit on a good note. It’s a good thing to do you never know when you might need help from them.

      It's not completely true. Companies can do things and employees may have to pay compensation.
      Cool dikhne ke liye ashneer jaise log kuxh bhi bol denge but apna bhi dimaag use kiya karo.

      @@kiptepetuk Final settlement is Salary pending and bonuses left with the previous company. You can claim unpaid salary (from the previous employer if you want to) in the labor court in future, But if the next opportunity covers that loss within one month, it is better to change the Ship. Three months notice is absurd! Which employing company will wait for three months for a prospective employee. Opportunity doesn't wait for long, someone else risk taking fellow would take it. 🤔

      Gratuity, full and final settlement, leave encashment aur bohot saari cheeze rehti hai which you may loose out. Unless the joining bonus can cover all these better serve the notice period and negotiate for lesser duration.

      If you don't want to get employment, not serving notice period shouldn't be an issue.Your next company will always ask for the final relieving letter or experience letter from previous company. You can't hide it if they have deposited PF in your account

    Yes, one can leave if they want to. Basically abscond without serving the notice period.
    But there is another problem to this. The hiring company always demands and needs an experience certificate which one receives only after serving notice period. I'm pretty sure if one leaves the next day, the present company won't provide any certificate and that could cause an issue.

      If the employee abandons the sompany abruptly it is a shock and is detrimental especially for companies with less number of employees.
      Parting ways should always happen by both parties keeping the other party in mind.

      @AbhijeetKundu 3 months notice period no company wants to hire , So how to give resign its way too risky? In india right to livelihood is just not there unlike U.S. where notice period max to max is 15 days.

      ​@@Bunny-ec4dp I have done this, the thing is they don't give you experience letter and when the new company calls previous company to verify the employment they don't give good feedback or sometimes they say they never employed you. It has happened with me. So if you are absconding a company make sure you are going to deal with many problems, ofcourse bank statements are going to be there to prove your employment but negative review does impact on your hiring procedure. I am still unemployed now after absconding companies. So don't make such silly mistakes, because this is a system and if you go against this system, this system will eat you. A lone individual cannot win against this system, so if you want to get inside this system and live inside this system then you have to follow their rules, simple as that. And if you want to do your own business then don't care about these companies you can leave.

    This is relevant in two cases -
    1. You don't want to continue to work... probably wish to start your own company
    2. The next company you want to join is not looking for your exp. certificate. However, if the next company needs you so badly, then they should consider the buy out option.

    Everyone knows those clauses are not legally enforceable, but companies don't give seperation/experience certificate and may give negative feedback and that's why employees still stay for 3 months. In no other countries, the notice period is so long. In most places it is 1 month for permanents and 2 weeks for contractual employment. These same companies in India when there is a downturn, lay off by backdating resignation by 3 months so as to prevent losses and if employees don't agree, threaten to mention they have been fired in seperation certificate. India needs strong labour laws to prevent this practice.

    I did the same. I was served legal notice after a week by company through a lawyer stating I violated 90 days notice period and I signed three years contract. I had studied law and my dad is a lawyer as well. So I drafted legal reply and sent to his lawyer through my dad. They never replied back.
    The point is if company has invested money and resourced on you and then you violate by leaving them without serving sufficient notice period, which universally is 14 days but can be stretched to 30 days in good faith, then they can claim from you in court. But that is also highly unlikely given the time it takes for court to bring a case to judgement and the expenses the company will incur they don't find it feasible.
    So don't be afraid to resign. Do it now. 😂

    We consider the experience letter and background verification process, especially its strictness when applying to large MNCs. The UAN number plays a crucial role here. In 2011, I encountered a similar situation where they threatened legal action but never followed through. Back then, the concept of UAN numbers didn't exist, and since I didn't require the experience letter, it didn't pose any background verification issues

    As I business owner, we have a policy of 1 month. The problem with 3 months notice is, his/her mind will be already out of the office and at the end they will spoil the environment by negative talk. It is better to send them home as soon as possible, may be before one month if possible. We have send many within one week.

    My friend got an offer from a competitor firm. Because there was no clause with the current company that you can't choose to work with competitors after resigning, he quit without serving notice period. In order to get the experience letter he had to pay two month's sal to his present employer which again the competitor firm paid on his behalf. End of the day, he got the experience letter and a better job.

    I agree 3 months is too much however this justification also isn't good aswell. If seeking a better job is one's right....The company being left also deserves a smooth transition and handover. 15-30 days should not be too much of an issue. I am sure Mr. Grover also had his employees sign notice period documents. Stage pe punch line Dena is glamorous but not sustainable.

    Issue isn't about enforcement by court. The issue is without service notice period or paying in lieu, they create problems is issuing you the experience letter or complete the FFS.

    You don't need experience certificate if the job was a useless one. If you worked for less than 6 months then you don't need an experience certificate. Also your salary/ payslip is also a proof of your experience.

      Bro Legally speaking, any bond that any organisation signs with an employee stands null and void as per the Constitution of India. The company might stop your relieving letter at the most for the 2 months tenure which I feel has little or no value even if you get that.

Nowadays every multinational companies is spending money for background check of every employees. I have worked with US , Chinese and Korean companies. As you are saying that if any employee is good then company will not go for background check then you are 200% wrong.     Legally they may not do anything but they will create pressure via emails and phone calls. They will write absurd things about you in the email, blaming you for anything and they will keep other big people of the firm in CC to create more pressure. In all these scenarios even your co-workers will speak against you..but trust yourself and face everything with courage and patience. At these times, don't say or write anything abusive and then, they cannot do anything to you.

    The rule itself is stupid. Here in Australia it is mostly 1 month notice period. If you have worked there less then year, then notice period is 1 week.

    It doesn't work like that. The cino😮will not issue relieving letter and then when you join the next one you wouldn't be able to show it during background verification, thus losing future jobs.

    If employee doesn't serve the notice period then the company will not provide the settlement money _ they don't credit the money.

    Keh to sahi raha hai. I quit Religare within the training period let alone notice period. They sent me notice to pay the amount for the cost to company. I didn't pay a penny. No acton was taken.

    What a joke- if you leave without serving notice period then companies don’t take you to court, they will delay your exit letter. And without exit letter you can’t get a job in another company

    Except for Bonded labour everything else is legal. So much so it sounds cool.Try this only if you plan to start your own venture or if the next company agrees to wave off your experience certificate and you plan to stick with them your entire life or you are planning to become a crusader for all employees. Sure, no company can legally stop your letters but the state of law is such that your case will take atleast 2-3 years to compel the employer to give you your experience letter. It is always wise to have a discussion with HR. Either request or make sure the company who is asking immediate joining buy's you out from the notice period.

      Can you please help me in this. I joined for a company for just 10 days after that i wanted to leave and joined other company but the previous company wanted to me to do notice period for 90 days. I said i don't want experience letter and said them to keep me in absconding. The HR agreed during that time but now they are asking me pay notice period pay. Why i should pay because i was not even assigned to project and i didn't provided any background check also? I am working in the other company for 8 months . But i am still scared about the previous company which i have left and they didn't gave any release letter as well. What should i do in this?

      1. Ensure that you have not given any original certificates like degree certificate, passport, 10th marks card etc.
      2. Just don't go to office and block their number and if they keep calling you tell them that, they can go to court if they want. If they go to court tell them that you will also file a harassment case against them. Return the id card and laptop.

      @@sandeshtg3289 I didn't provided any physical certificates of my final degree and last year memos. Actually they stopped sending mails. I only mailed them that why i should pay and all. They never called me as well. I have kept the resignation request in July. And I got a mail saying i need pay for notice period in Nov. After that they haven't mailed me anything. I only replied to them recently why i should pay and all. And I don't have ID and Laptop as well. Because I literally wanted to leave after joining the company for 10 days and it was still in onboarding process only. In the notice pay they mentioned 9th sep as my leaving date. But they didn't gave me any release letter.

      Contact your lawyer kuch nahi hoga bas company ki koi property jaise laptop ya kuch hai toh wapas kar de they cannot force you to serve notice period.

    But experience or reliving letter nhi milta h Bina pura notice serve kare chale jaaye to aur abscond bhi ho jata h ....ab itne saal kisi company me jhak maraya h to Bina experience letter ke sab barbad thodi na kerde. Ye baate bolne me aur fekne tak hi sahi h but reality kuch aur hi hoti h.

    Well I did the same and company could not do anything. They even pay me for 1 month and after that they beg me to return the laptop which I did.

      u still cannot force employee to work , buy it's possible that employee may have to pay a reasonable amount due to violation of clause.

    He is technically right but not practical. Any organization you work is a part of industry, when industry has set some norms and it dedicatedly holds those norms then you have no choice but to comply else, you may behave the way he explained but be ready to receive backlash from the entire sector. So bring a ceo and entrepreneur he may take things lightly but being an employee who is a little short of being a slave, will need to consider ever variable, direct or indirect, while dealing with an organization.

    bakwaas...one of my friend's career nearly ended and lost a lost of money for this notice period..company went to court in the name of Job Abandonement..He has to shell a lot of money to fight. Sabki mat suno, real time experience me paise kharche honge

    Final settlement is Salary pending and bonuses left with the previous company. You can claim unpaid salary (from the previous employer if you want to) in the labor court in future, But if the next opportunity covers that loss within one month, it is better to change the Ship. Three months notice is absurd! Which employing company will wait for three months for a prospective employee. Opportunity doesn't wait for long, someone else risk taking fellow would take it. 🤔
