These same companies in India when there is a downturn, lay off by backdating resignation by 3 months so as to prevent losses and if employees don't agree, threaten to mention they have been fired in seperation certificate. I did the same. I was served legal notice after a week by company through a lawyer stating I violated 90 days notice period and I signed three years contract. What about probation period?
experience letter kaha se aega bu ye bata do....
Yaha Mera ek question hai agar hm notice period serve nahi krte hai or ese uthke chale jata hai to then company kya hmra experience letter and fnf hold kr skti hai ?
Mujhe 8th month k pregnancy me resign karne ko bola...kyu ki unke pass project nahi thi....maine seedhe bola mai jaungi labour law me....chup chap next day se ML pe chali gai , 6 months baad de di resign
Dude If you leave early the hiring company will not entertain, all the companies are in sync with each other and will only play this as per their terms
Aur experience letter kon dega???
Legally they may not do anything but they will create pressure via emails and phone calls. They will write absurd things about you in the email, blaming you for anything and they will keep other big people of the firm in CC to create more pressure. In all these scenarios even your co-workers will speak against you..but trust yourself and face everything with courage and patience. At these times, don't say or write anything abusive and then, they cannot do anything to you.
What about relieving letter.. in this condition we'll get some negative comments thr.. just my concern to ask only. Which will impact on background verification, even on joining required documents and new joined company's background verification team will definitely take this as nagative.. 😕
yeah correct thats what i was thing.. background verification will be impacted.
cool b toh banna hai bhai agar simple answer kr dega ki 3 mahine hai kr le or kaam toh cool nahi lagega na

90 days notice period should be mandatory on politician.
Yes sir I am facing the same problem company has given me court somon for 2 months salary sir I am facing this problem
Contact your lawyer kuch nahi hoga bas company ki koi property jaise laptop ya kuch hai toh wapas kar de they cannot force you to serve notice period.
Question ye hai ki lukhea kyon rahe hain?
Jo enforcable nahi hai by law wo agreement me bhi nahi hona chahiye
Aur agar koi company force kar raha hai to us par legal action hona chahiye.
Bhai lekin notice period complete nahi kiya toh experience letter nhi dete
It's all about experience letter nhi to koi fark nhi padta
It doesn't work like that. The cino😮will not issue relieving letter and then when you join the next one you wouldn't be able to show it during background verification, thus losing future jobs.
90-day notice period is terrifying ..
Hello I have been Absconded from my last company they said that I have done biching about the company and they have terminated me and now I'm facing issue in getting job what should I do????
Except for Bonded labour everything else is legal. So much so it sounds cool.Try this only if you plan to start your own venture or if the next company agrees to wave off your experience certificate and you plan to stick with them your entire life or you are planning to become a crusader for all employees. Sure, no company can legally stop your letters but the state of law is such that your case will take atleast 2-3 years to compel the employer to give you your experience letter. It is always wise to have a discussion with HR. Either request or make sure the company who is asking immediate joining buy's you out from the notice period.
can they refuse buyout?

What about experience letter & relieving
& the penalty they will ask for??
But experience letter bhi to chahiye hoga to uska kya kroge

Experience letter chahiye bhai next company ke liye, court mein enforceable nhi hai wo to pata hai, most companies have no power in court, there power is other companies
Experience certificate, Full & Final Settlement, Background check ka kya hoga?? Company bolegi ki ye employee absconding hai. Bhai wrong information de ke logo ko gumrah nah karo. Bharat pe banaya hai aapne lekin ab Bharat ke logo ko chutiya mat banao 🙏🙏🙏🙏
Bro Legally speaking, any bond that any organisation signs with an employee stands null and void as per the Constitution of India. The company might stop your relieving letter at the most for the 2 months tenure which I feel has little or no value even if you get that.
Thoda prospective bhi badhalo apna , agar skillful ho toh ye batose samne wale company ko koi frk nai pdega , ha bt agar golmal admi ho toh bat alag hai ,
@@Pinciple bro it seems you are running your own business that's why you are not aware about the importance of relieving & experience certificate. Nowadays every multinational companies is spending money for background check of every employees. I have worked with US , Chinese and Korean companies. As you are saying that if any employee is good then company will not go for background check then you are 200% wrong. Rules are same in every company for every employee whether he is talented or not.
@@XStranger6013 i think this notice period should be reduced to maybe 1 month , it will be win win situation for both empliyee employer
@@XStranger6013 one negative BGV can ruined someone's career....
If employee doesn't serve the notice period then the company will not provide the settlement money _ they don't credit the money.
Flaws: Relieving letter, FnF settlement, BGV of next company with previous company will give negative remark etc
In short he is saying to follow his path and ruin your career as well.
But company will not give experience letter
What about experience certificate?
You don't need experience certificate if the job was a useless one. If you worked for less than 6 months then you don't need an experience certificate. Also your salary/ payslip is also a proof of your experience.
Unless the new company doesnt do a background verfication
Sir.. they just don't give the Release letter. Thats it. Simple
Can you please help me in this. I joined for a company for just 10 days after that i wanted to leave and joined other company but the previous company wanted to me to do notice period for 90 days. I said i don't want experience letter and said them to keep me in absconding. The HR agreed during that time but now they are asking me pay notice period pay. Why i should pay because i was not even assigned to project and i didn't provided any background check also? I am working in the other company for 8 months . But i am still scared about the previous company which i have left and they didn't gave any release letter as well. What should i do in this?
If you don’t need exp letter ignore them if they told you they will go to court ask them please go
@@chebellipavankumar649 you need to do 2 things
1. Ensure that you have not given any original certificates like degree certificate, passport, 10th marks card etc.
2. Just don't go to office and block their number and if they keep calling you tell them that, they can go to court if they want. If they go to court tell them that you will also file a harassment case against them. Return the id card and laptop.
@@sandeshtg3289 I didn't provided any physical certificates of my final degree and last year memos. Actually they stopped sending mails. I only mailed them that why i should pay and all. They never called me as well. I have kept the resignation request in July. And I got a mail saying i need pay for notice period in Nov. After that they haven't mailed me anything. I only replied to them recently why i should pay and all. And I don't have ID and Laptop as well. Because I literally wanted to leave after joining the company for 10 days and it was still in onboarding process only. In the notice pay they mentioned 9th sep as my leaving date. But if we not serve notice relieving letter he will not give then new company will not hire???
The rule itself is stupid. Here in Australia it is mostly 1 month notice period. If you have worked there less then year, then notice period is 1 week.
but what abt the experience certificate ?
Keh to sahi raha hai. I quit Religare within the training period let alone notice period. They sent me notice to pay the amount for the cost to company. I didn't pay a penny. No acton was taken.
Did you found any issues getting a new job?
reply de doosri job mili
Baat sahi but relieving letter ka kya...wou yo milega nhi naa?
Why India still needs experience / relieving letter?
Haan to main agr mera resignation accept hone k baad notice period serve na kru, Then what about getting an experience certificate, remaining salary, pf n all ???
The employee will be tagged as absconding and in future his background verification will become very tricky
Hawabaji mat kar.. relieving letter and Full and settlement bhi Lena hota hai.. usi ke liye log serve karte h notice period
even background verification can be impcated.
