Absolutely. But when a cop murders a civilian, law enforcement always paints the victim as a bad guy so that the cop gets off. If you've ever gotten a traffic ticket you're painted as some kind of criminal mastermind who deserved getting killed.

Because he was otherwise a completely upstanding member of society and his community. An incredible young man that just liked to partake of something less harmful than alcohol. But because it's currently illegal in Texas outside of for medical purposes, it's the only thing they can say was wrong about him.
But everyone knows that it wasn't actually wrong, so it prompted a huge backlash last month. Plus, it was only found in his apartment after a search (which wasn't really necessary), so Amber could never have known that he had it - thus it couldn't have been relevant to the crime.

He was shot 1 in the mouth and another in the chest. If someone shoots at the mouth, it's to show that the guy was a snitch and this is what happens to snitches...This is too crazy, how do you Americans live with this?
Edit: This was a tweet by Lee Meritt, Judge Clay Jenkins tweeted said it's thigh and back. Several witnesses have some differences of back and buttocks. Police confirmation from 3 hours ago, only said LOWER BODY. Apologies for the misinformation.

That was one of the key points in the trial that she was able to leave. She could have left the apartment and if she had nobody would have died. Step out, call the police or backup or whatever and then they arrive at her actual apartment or they defuse the situation.

There’s a lot of disturbing things about this story, many of which Trevor brought up.
However, from my non-American perspective, the thing that has struck me about this story is the repeated comments from American media of how “you should feel safe to not get shot in your own home”. Because, really, that’s how low your bar is now? Shouldn’t you be able to feel safe to not get shot REGARDLESS of where you are, REGARDLESS of the colour of your skin? Shouldn’t that be considered the bare minimum?
You shouldn’t be upset that a black man got shot in his home by a white, off-duty police woman; you should get upset that a black man was shot at all. The fact that the only place one should expect to feel safe is in your own home is a sad indictment of American society.

It does, but I do actually think that in specific cases where that "excuse" is believable it should be taken into consideration during sentencing (but NOT convicting).
Why? Because situational awareness is hampered in distress.
People say "didn't she recognize the furniture??" well no not necessarily.
Do you seriously think that if you walked into your house and found an intruder you would check the furniture surrounding you? NO, you wouldn't. You would see the potential threat because that is just how human nature is.

Black folks have been brainwashed to such a COMPLETE degree! It makes me very sad and mad!😡😔No one wants to be hated by the predominant group; to be on the bottom. Please see the "Willy Lynch Document". As a young boy, I remember watching Shirley Temple 📺 👩🏼bossing old Black folks around and, my sisters being presented with blonde Barbie dolls👧🏼 by relatives. MOST of the cartoons, kid shows and, movies I saw as a child, featured a "cute" little blonde girl or, "beautiful" blonde young lady being coddled, catered to, sought after or, rescued. Black Americans are the most despised people on Earth! We serve our country in the millitary, work in our communities as public servants and, even provide "the entertainment"😁☻ 💃🏿🎤🎺🎶🎷🎸for the comfort of "the mainstream" (you know who)! Yet, we are STILL the pararia of humanity. MAN, I just don't know anymore...smh😫😖😔We've done LITERALLY everything a people can do to gain acceptance or, at LEAST be "allowed" to live in peace. There are STILL those of "them" who hate Kappernick for starting the "kneeling thing", and STILL don't understand why he did it. May the good Lord grant the Botham AND Joshua Brown family solace. May He protect "Bunny" (the sista who sent the original footage📱 of 👮🏼‍♀️after she🔫☠Botham). Her story can be seen on African Diaspora TH-cam channel (formerly "The Advice Show"). I'm curious to see how my comment will haunt me in future; probably loose a job or something!😅 Peace, people! 👨🏾‍⚕️🏃🏾‍♂️👨🏿‍🏫

I am not or ever have been a police officer but I am licensed and trained to carry a gun, concealed or not. But if I have the option to flee and call the police that is what I am doing. Who shoots someone in the heart while they sit on a couch eating ? She was the one by the door with a clear chance to flee. The castle doctrine shouldn’t apply because she wasn’t home. It doesn’t matter if she said she thought she was! Now anyone can use that defense and reference this case. ‘I was sleep walking into wal mart and shot a cashier because I thought I was home and I have the right to protect my home’ WTH how about ‘I got drunk and went to my exes house but thought it was my house and I shot him and his new girl because I though i was home!’ Oh Lord - the can of worms this dumbass judge opened up!

The judge isn't responsible for the way the lawyers argued the case. Defense attorneys point to castle laws, and stand your ground laws in these trials and try to warp them to cover the actions of their clients. They've been using them that way long before this trial came along, and since the defense lost with a unanimous jury conviction, I don't think many defense lawyers will use this trial as precedent in future trials. I think what you said about being a licensed gun owner but choosing to flee is really interesting though. Most gun owners I know tend to brag about what awful fate awaits any hypothetical intruders that would dare to enter their home. They often say stuff like 'I ain't going nowhere. I'm dropping his expletive.' I've always thought this case was more about a trigger happy cop who lacked a realistic view and value for life than just a racist white cop. I've always felt that Botham would have still been murdered had he been a white man and this chick had walked through his door.

Lawyers don't have free reign to say whatever they want to the jury. The judge decides whether the jury can hear certain types of arguments, depending on what other implications it has on the case, to try to present it with minimal prejudice. This is their most important part of the job in a jury trial.
For example, the judge could have disallowed the lawyers to present this law pertaining to specific scenarios of people shooting while in their own home (this being a key factor), based on the fact that she....was actually in his house, and not her own....ya know?

You won't see black or white folks getting away killing unarmed white folks in their living room or anywhere else using that lie, oops I mean excuse. DL Hugely had already made the claim years before Amber Guyger murdered Bothem in his home with no remorse, until she was facing up to 99years, which most people with a clue knew she'd never get. While I agree with everything Trevor says here, the real difference in this case is not only the race difference, but also the profession of the murderer. I think the fact that she was a police officer at the time of the murder, is ultimately what reduced her sentence. As a white male firefighter, I am also one of those that believe the sentence was way too lenient. Mistake or not, she still took an innocent man's life, and I believe the sentence provided to her, should reflect that.

Second, allowing that kind of self-defense defence when you're NOT in your own house. Third, allowing that awful and implausible excuse for a trained police officer, a so-called professional. Even without being trained you must be extremely intoxicated to mistake the house of somebody else for your own. Fourth, how did she get in there? Fifth, the non-threatening circumstances under which he was shot. Sixth, the witness being killed almost immediately after trial - despite her mild sentence. Taken everything into account it takes an astonishing level of naivety or bias to accept this made up story.
This stinks in so many ways that it's not a stretch to think there's plenty of people having dirt on them. Without knowing the details but are any of these illogical things addressed during the trial? The murder of the witness calls for a thorough investigation into everything (including the judge in this trial) AND a new trial of this woman. Shameful, once again

She's out in 5 years, with good behavior.
Won't be surprised if she's out sooner than that. They already murdered the neighbor who testified AGAINST her.
Of course, the brother forgave her. Probably was intimated with his own life to convince for her to get the least amount of time.

if she ws drunk i could even in the "slightiest" try to understand ... but to shoot him!? did she even asked who is is while pointing a gun at him? why she didn't followed the cop protocol and cal backup! why she didn't even tried to talk! yet on the same side we have a bunch of histories where people kill someone by accident and get life in prison ...while that kid playing wrestling with her cousin , they put him in jail FOR LIFE...
