Is it mandatory for Dr to write down stitches/number of stitches on MLC. There is MLC against me without mentioning any stitches/ number of stitches and it is fact that no stitches were given to self generated wound. But in 164 of claimant he says 4/5 stitches were given. Is it sufficient for discharge in addition IO has changed/forged date of MLC which is easily visible. We are going for discharge. 164 was done after 2 years of actual date of FIR.
Sir out of 5 type of injuries u mentioned to make a case of grievous hurt which injury must be present? Also if police does not do MLC or doctor claims no injury marks visible in mlc done after several days then how can victim make out his case of beating?
320. Grievous hurt.-The following kinds of hurt only are designated as “grievous”:- (First) - Emasculation. (Secondly) -Permanent privation of the sight of either eye. (Thirdly) - Permanent privation of the hearing of either ear, (Fourthly) -Privation of any member or joint. (Fifthly) - Destruction or permanent impairing of the powers of any member or joint. (Sixthly) - Permanent disfiguration of the head or face. (Seventhly) -Fracture or dislocation of a bone or tooth. (Eighthly) -Any hurt which endangers life or which causes the sufferer to be during the space of twenty days in severe bodily pain, or unable to follow his ordinary pursuits. If police does not do mlc then atleast get medical done through a private hospital so that you have reports of doctors. Visible injury marks not necessary if the conditions of section 320 fulfilled Even if no injury marks or doctors report then try to prove your case by leading oral evidence of self and witnesses
