Yes....but then you will have to confront it with the other statement which witness has contradicted

It depends upon the relevant facts and circumstances of the case.
1. Understand What is mental torture within the meaning of medical jurisprudence and medical experts' opinion
2. What telephone messages have been placed on court records to prove mental torture and those criteria meet the ingredients of mental torture, as explained in medical jurisprudence or medical evidence on record.
Rest all depends upon the outcome / depositions of the chief and cross exmination of the concerned witness

AGAR Cross is an art to Saval likh kar kyon rakhna, point note Karna thik hai, agar questions likh ke rakhenge to habbit aise hi ban Jayegi...maine kai seniors ko observe Kiya hai wo log directly file padh Kar Sidha cross examination Start kar dete hai aur bahot badhiya cross Chalti hai.
Cross examination slowly slowly aati hai....till one gains enough experience I feel one should make points or write their questions....after a certain point all flows freely....but it don't mean that senior advocates don't make mistakes while doing cross....they also make mistakes but nobody knows about it except the advocate himself or the judge....

Do we have to rebut the Voluntary Statement of a witness as well or mere suggestion is enough?
Definitely Suggestion should be given....if there is any evidence then it should be rebutted....

What if i put suggestion to a fact and the witness started explaining i.e giving voluntarily statements adding more facts to it. Do i have to rebut those new facts again via suggestion as well? Cose rest it will be considered my admission and will be the part of the other/adverse party's pleadings right?
सर क्रॉस मे सजेशन दो धारी छुरी की तरह होता है,गलत सजेशन खुद को भी नुकसान पहुंचा सकता है,,जैसे एक वकील साहब ने सजेशन दिया की देखो अज्ञात लोग तुमको मार गए या अमुक व्यक्ति तुमको मार गया, और तुमने आरोपी से खुद की पूर्व दुश्मनी के कारण द्वेष भाव से उसे फसा दिया।इस सजेशन डिफेंस का डिफेंस पर क्या असर पड़ेगा।
मेरे विचार से यह एक खराब बचाव है क्योंकि इसमें घटना को बचाव पक्ष के द्वारा स्वीकार किया जा रहा है
I am a student of law and i have appeared as a eye witness before court of session in connection of a criminal case.
The defence consel asked me that :- in night how much long i can see.... I replied that as long as a normal human can see the same is applies on me... But presiding officer insisted to answe in meter or feet then ultimately i replied that :- If there is sufficient ligh are available then i can see from 2 to 6km ...... Now i think i said this in nervousness because it is not possible for a human being to see this extent.
What would be legal consequences of this answer??
Your entire evidence will be studied not just one line....if other answers are ok then this won't effect much....

Suggestion are always negative and therefore not asked....if you feel it's reply can be positive then don't give suggestion instead as it as a question...
