Looks like someone failed their civics classes in school. He's not running the ATF now. The definition of "assault weapon" will be what the legislators like Kennedy decide it is when he takes office. Under the separation of powers, if he's appointed as head of the ATF, he will be part of the executive branch. It is the legislative branch's responsibility to define the term, his duty is to enforce the laws the legislators enact. Kennedy should know this, and the fact that he doesn't should be of concern to everyone.

What I think he’s saying, and yes I am a gun owner, is that he will uphold whatever law is passed, as he should. And the fact that he isn’t able to define an “assault rifle” in 10 seconds should make you happy, this means that in court, they won’t be easily able to restrict your ownership. They won’t say “yep, we think that is an assault rifle, turn it in”, there will be a lengthy process to determine the legality of every type of weapon, because as many gun owners know, many non-assault rifles, handguns, shotguns, etc., are just as deadly as an “assault” rifle

The point he was making is that as a government employee you have to enforce the law that the Congress and the President make. You are also bound by what laws and policies are developed by those entities per the laws. Your own definitions and viewpoints have to be suspended while you are on the job. This is not a "puppet master" situation, laws and policies are developed with a great deal of public input. Legislation does not appear out of nowhere, it takes a huge amount of public pressure for those two branches of government to start an effort to write a bill. The real trouble in that process is that the public or the average person affected by a law aren't armed with a lot of money, but lobbyists and large corporations are. The so called "Citizens United" Supreme Court decision caused this situation to go from very bad to worse. Passing laws to address this is proving extremely difficult.

A)The ATF shouldn't even exist because the NFA and Hugh's Amendment shouldn't exist.
There shouldn't even be a registry in the first place because it's nobody's business what anyone else has, and it would be difficult or unenforceable because most people would either build their own or refuse to register. B)It'd essentially be an add-on charge when someone does get pinched for something else.
C)he says he wants things like an AR to be an NFA item but won't say what he has publicly. It means he probably has at least one (or some other actual NFA items) but thinks only monied people like him who can afford to waste an extra $200, wait months on end to get approved, yada yada. It's elitist and hypocritical.
D) Criminals aren't following the laws on the books, so these new laws will only punish people trying to do things the right way.
