I'll tell you something, but it's going to be extremely frustrating. Blair does not think she's done anything wrong, and she absolutely believes that SHE is the victim. And there is nothing you could tell her that would make her see it any other way. That's the type of narcissist she is.

Not a lawyer but I’ve worked in the courts for 2 decades and in my opinion all her allegations should be super easy to prove or disprove. I don’t see this working out in her favor.
Hopefully the fact that its so obvious this lawsuit is retaliatory will result in a dismissal with prejudice so she can't keep trying.

Markie, "actual malice" does not mean the same thing in a legal sense. Being malicious (robbing a bank, destroying a car, shooting someone) is not "actual malice". Actual malice refers to deliberately lying about someone in an attempt to hurt them reputationally and financially. This is an oversimplified definition, but essentially it's a modified version of libel.
To add on to this. She needs to prove actual malice in this case since, due to her fame and youtube channel, she would be considered a "celebrity". If the plaintiff is a celebrity in the eyes of the court, they need to prove actual malice unlike a private citizen who just has to prove that their reputation was damaged due to the spread of false information. She probably didn't even think to bother trying to claim she wasn't a celebrity. The bar can be VERY low sometimes, and she probably clears it by a mile.
It's not a modified version of libel, it's a component that needs to be proven for defamation specifically for public figures.

I know it’s different for certain states, but most workplace NDAs are for a year after you’ve left the company. Anything longer is non-enforceable.
And even personal NDAs are void when there is a trial going on besides current spouses in most cases.
Yes and in general workplace NDA terms between employer and employee, that go beyond protection of true proprietary information, walk a line between illegal and unenforceable in the US.

100% She is definitely frightened; all of this is directed at Oz all the way back in May. She does not want Oz to speak out, Wonder and Felix are just collateral damage in the suit.
Oz was her partner, and apparently she entangled him in her efforts to hide embezzlement. That means criminal charges and possible jail time, depending on the amount taken and the lenience of the judge. If she can keep it quiet until the statute of limitations for embezzlement has passed, she doesn't have to face those charges, hence the 25-year NDA. She was just smearing people until there was a real threat of criminal charges; now she's taking it as a legitimate threat, and I'm hoping that the full extent of the law comes down on her.
I cannot wait for her to get her butt handed to her in court. People like her never realize that you can start all of the drama you want online, but a legal system sees through the BS in a second. Countersuits for everyone and bankruptcy for her! ❤

Actual Malice is a legal term and is one of several conditions you have to meet to prove defamation in the US. You have to prove the statements are false, that the person who made them knew they were false, and did so with actual malice (AKA the intent to cause harm to the party claiming defamation). Meeting all three conditions, especially the second one (the defendant knowingly made defamatory statements against the plaintiff and was not stating an opinion or genuine belief) is incredibly difficult.

Another thing to note as well with NDA's is that they don't stop you from speaking about anything illegal going on. Lots of people use NDA's and their signing as a threat to keep people silent in the face of crime.
The NDA also seems to say they can't discuss work place stuff and none of them did. Just talked about their personal interactions with her as a person not an employer. The car one is even sillier. Contract signed on 29 June. First payment due 15 July. She says 'in July' Wonder went to Texas. Doesn't she know when? She turns up on the 28th. What's the bet he arrived on the 27th or something close? It's got to be seen as fivolous.

The framing of certain things in the lawsuit, like "never returned", and something i remember Oz media saying about her always framing herself as better than others, are classic red flags. Making things seem way worse than they are so you can place yourself above other people. It's something that's hard to pickup on in thr heightened emotions of the moment.

In US defamation law, "actual malice" does not mean "being mean". It's not really like what people think of as malice at all.
Actual malice is a reckless disregard for the truth. Lying, or repeating things when there is a good reason to doubt that they are true.
15:05 - "Actual malice" when it comes to defamation actually has a very specific legal definition (under the US Supreme Court case "Times v. Sullivan"). It isn't that she's claiming they acted maliciously, but rather they said what they said KNOWING FOR A FACT that what they were saying wasn't true, or that they were acting with massive reckless disregard in not checking to see if it were true first.

The only thing worse than her filing this frivolous lawsuit in the first place is the fact that she found a lawyer who's greedy enough to even take the case. I'm willing to bet other attorneys turned her down because it's flimsy and meritless, and now she's just wasting a ton of money (and the time of the court system) on something that she has no shot of winning.
Just so it's said, she doesn't have to produce proof in this document, she does have to provide clear statements of actionable harm(s). Her evidence comes during discovery phase if she goes to trial. However she doesn't want to release evidence she doesn't have so she is vague and incomplete in her claims. My opinion is, she really doesn't want to go to trial because she doesn't want to release what she'd have to release during discovery. Unless she got the entire trial record sealed, it all would be public. What she's hoping for here is for a judge that lets this vague claim go ahead, so she can use the threat of a trial to force a settlement out of court. Thankfully I think the guys are set for funding, and ready to go forward if they have to, so her threats won't carry much weight.
Another thing to note- The near total absence of mention of Click. If Blair were confident in her case he'd be mentioned as a co-conspirator/associate that is only not named as a co-defendant because of his foreign citizenship.

Even with the initial legal eagle stuff, the tide turned against blair after her own "iilluminaughtii exposed" video, which i would argue is provable, based on all the coverage it received after it was released as a measurement for public sentiment against her. By the time the subsequent videos were released she had already been bleeding subscribers, and if anything hers was the most defamatory of all the videos released by ex-sad milk members.
I can say I unsubscribed from her channel after watching HER video on the situation, way before I even saw anyone elses' videos. The moment she brought up Wonder's mental health issues she had crossed a serious line and I could never support her or her channel.

NDAs generally cover information about ongoing projects, proprietary processes or systems, and things that competitors could use to gain an edge in their shared field. Think big research labs and the like. Other versions can be things like an actor's involvement in a project. Such as Andrew Garfield when set photos were leaked and he could not confirm he was part of No Way Home.
NDAs do NOT stop someone from saying they had a horrible boss or coworker.
That would be more defamation than a breach of an NDA.

That section that's quoted from the NDA smacks of a non-compete clause to me, and those are generally unenforceable in Colorado unless related to corporate espionage and trade secrets. I'm genuinely unsure how they're planning to argue this with any chance of success.

The fact that an employer thinks that she is special enough to require a 25-year NDA and is currently suing three of her ex-employees is all the judge is going to need to see. I don't think any of the guys have a thing to worry about other than the headache that she's currently causing them.
The opposing counsel only need cite the 'and other claims' to show that the filing is incomplete. What lawyer would miss a golden opportunity for billable hours 🤔

A thing to remember about Particulars of Claim is that they are a particular type of legal document. So the format, and contents, may seem a bit strange to lay people. But in essence the purpose of POCs is merely to set out all the facts (and only those facts) that IF TRUE would mean you win your claim.
The rules specifically prohibit any references to actual evidence or legal argument at this stage.
So they can seem like bare assertions without any supporting material; but that's exactly what they are. All that stuff comes later with disclosure/discovery and the exchange of witness statements/exhibits etc.
I assume that you have some sort of legal background, and can maybe shed some light on this. While she may not need to provide supporting evidence, doesn’t she at least need to say “On this date, defendant said “this”, which caused “this bad thing” to happen?” Otherwise, how does the defendant try to refute the claim?
@@philospher77 Yeah. The idea is that the Defendant should know exactly the factual basis for the cause of action being brought against them. So you provide all the *necessary* detail so they can identify the case they have to meet. The skill in drafting pleadings is to put in just enough to meet that burden but no more. It's a bit like how a recipe is not compete when there's nothing more to add but when there's nothing left that can be taken away. The level of detail required will depend upon the nature of the tortuous actions. Generally you have to give dates; although the courts recognise its not always possible to be spot on. So "some time in the summer of 2019..." for example. But if claimants/plaintiffs dont put enough defendants can apply to strike out the claim for 'lack of particularity'. Or if they are being more cooperative, make a request for 'further and better particulars'.

There is one huge glaring problem with her lawsuit. She posted the dirty laundry one her channel first thus opening the door to response videos. Pretty sure any lawyer worth a grain of salt can get this thrown out on just on that fact. She herself broke the NDA she created.

As a former US Gov employee, the information I handled can't be talked about and afaik there is no expiry date for me, but it's data that will be considered public domain eventually (it's protected purely for privacy reasons of the people it was collected from and is not classified or anything like that)
In the lawsuit, the Click isn't even named in the charge against Felix. He's referred to as a "TH-camr". This is more than likely because of the fact that trying to serve a lawsuit against Click will be a non-starter.
You don't know that the contract is valid and legally binding until it gets tested in court. California decided non-compete agreements were illegal and right up until then they would have been described in a lawsuit like this as "valid and legally binding."
Unless she claims in court that acting like a horrible person is a proprietary business practice of hers, then the NDA argument is worthless.

@king-of-swing Theoretically that is definitely possible, I have no idea for certain tbf - though there are some things IIRC that can't be put under an NDA - like allegedly abusive behavior (though the person claiming it should have burden of proof, of course) (IIRC didn't Harvey Weinstein try to use NDAs to cover his behavior/it got shut down in court? I need to look that up again), and things like pay - so many companies try to claim that it is a firable offense to discuss your pay, or claim one's salary is proprietary information when that usually is illegal / has been since 1935. It's a clusterfuck for sure.
Idk about other states, but usually of there's a first payment default (aka miss the 1st payment) repo processes can start, outside of that, its usually around the 60-90 mark that the process starts. It sounds like WonderStruck just did 1 payment and Blair decided to take it back anyways

Blair needs to go to prison for so much damage she’s done for bullying so many people over the pettiest things imaginable. Instead of taking accountability, she just seeks revenge and put her victims through a living hell even further. This woman is an absolute menace and I hope karma will make her pay the ultimate price one day, but I doubt she’d learn from that either.
Given that she’s still egging bad faith actors on to harass others means she’ll probably be on the defendant side of a lawsuit soon enough

Supposedly this court document she's submitted admits tacitly to structuring (Blair presenting herself and the company she runs as separate entities both personally aggrieved to arbitrary damages) and I know I at least submitted complaints with the Colorado Attorney General and IRS regarding her.

The thing people often don't seem to understand is that just because you put something in a contract, that doesn't necessarily make it enforceable. A judge absolutely can and will throw out a contract if they think the terms are unrealistic, or that the contract is inequitable to both parties and slanted heavily in favour of one part over the other. For NDAs in particular, there's pretty specific criteria that an NDA needs to meet in order to be legal and enforceable, and one of those is simply that the terms of the NDA must be reasonable - e.g., not for 25 years or in perpetuity. NDAs are also unenforceable if it's clear the purpose of the NDA is to prevent someone from talking about abuse, harassment, illegal activity, or other misconduct. NDAs also have to be very specific about what types of information is covered, and why. You can't just have an NDA that says "you can never say anything to anyone ever that has anything to do with me or my company." In short... I highly doubt Blair has a leg to stand on here.
Honestly, I would love for a judge to look her in the eye and tell her she has no legal ground to stand on. It would be amazing for her to realize that even with all of her manipulation and attempts at silencing, she's legally failed. She was too ignorant to realize the limits to her "rights" and how they do not supercede the rights of others, but I doubt she will ever truly understand that. The closest thing to that would be for her to be told that the courts won't support her lawsuit, at least to the extent that she believes they will.
I do feel bad for Blair to some extent. To be so unable to admit that you may have done something you shouldn't have to the point that you have to victimize yourself constantly sounds like a miserable way to live.

In regards to the plagiarism issue, Blair would be smart to just not touch any of that with a 100ft pole.
Just as a starting point, she'd have to file a suit in the UK which means hiring new lawyers in the UK. That's going to be expensive and a hassle, especially because most solicitors would look at her case and see so many red flags, they'd probably think she's a damn matador.
Then before the case can even go to trial, she has to establish that the "defamatory statement" has caused serious harm to her reputation or character, or to her business if she's suing as a business, in which case, she has to prove financial loss. And good luck proving that because yeah, serious harm is probably being done to her considering uh _everything_ but you've got to prove a direct link to HBomberguy alone. That link also has a temporal facet to it which she can't prove because his video is just the latest in the series of "holy god, this woman is awful and unhinged".
There's also the fact that, as of 2013, the vast majority of defamation lawsuits in the UK are overseen by a judge not a jury. If the law is not on your side, you're pretty much guaranteed to lose. You can paint yourself a victim as much as you want, but if the evidence isn't there, the judge isn't gonna be swayed.
You've also got the fact that _she would absolutely lose that case_ because 1) HBomberguy wasn't lying as she demonstrably did quite a lot of plagiarism, 2) he goes out of his way to say that it's his honest opinion multiple times in the video, and 3) the subject matter is very much of public interest. All of which are three effective defenses. His side of that lawsuit would be a cakewalk for law students, let alone actual solicitors.
Plus, she'd just be opening herself up to a lot more scrutiny this way in a lot of ways. HBomberguy would likely gain access to even more damning evidence during discovery which is why Wakefield dropped his suit against Brian Deer as HBomberguy himself has pointed out in a video. Also, if companies didn't know she was plagiarised their stuff, they're probably gonna find out now, and if she lost that case, she'd have basically offered herself up on a platter as an easy lawsuit win to all the people she plagiarised.
Her best option is just ignoring that side of it entirely because she's already lost it in the court of public opinion, there is no point losing it in an actual court.
Can I just say, the contracts that they are trying to enforce REEK, of non-enforceable.
The counter suit should definitely seek disbarment for her lawyers, and attorneys.

I'm assuming she's going by Colorado law, in which she can file a notice of right to cure after 10 days BUT from what I've also read you then have 20 days to catch up on payments and stop the repossession (according to a Denver law office). She got the car 13 days after the first payment was due. She is absolutely in the wrong and there is no way I can imagine her claims will stand.
Blair is the most absolutely delusional person I've seen (in my opinion)...I really hope the judge in this case puts her in her place and gives full credence to any counterclaim, which I really, really hope Oz, Wonderstruck and Felix go full tilt for. This is beyond ridiculous.

Wonder and Oz (because Blair wasn't talking to Wonder at the time, and Oz was known to be her frontman) were discussing Wonder driving the car back to Colorado so that he could give it back to Blair and pick up the rest of his stuff. And then Wonder would sign an amended contract to pay the depreciation value of the car for the time that he had it. What, in that chain of events, made it an urgent necessity for Blair to fly down and repossess the car in the middle of the night?

happy birthday also, for a hot minute I got confused about NDA and Non-compete. the latter are not enforceable. I think the NDA would be time limited and blair would have to prove that anything they said by breaking the NDA was actual company secrets that caused lost of profits to the company. If this suit is being filed because they said things about her behavior, this is a slapp lawsuit and there are laws against that. Finally, these suits are one side's story. nothing else. they still have to respond. Also, this suit uses legal terms (like "actual malice") which have legal bars to reach. It's not EASY to prove actual malice. that is a bar that needs to be cleared
