Not only did she chastise him, she found him in contempt for not showing up, then pledged to report him to the bar for misconduct. And there isn't any record of her being reprimanded for her misconduct. Today, May 19, 2024, she is still presiding over court cases. Should have been immediately removed the day this happened.
Vote against incumbent judges when and where you can. Even if you like them the power is too much for even a good man to hold onto for long. I truly believe it shouldn't be a career.
This. Anyone with brains sees this and that attorney needs to know that he shouldn't worry about his reputation. Especially when he's trying to recover from something so serious.

I had 2 strokes! at first you don't even know where you are or recognize anyone can't even go pee by yourself can't even swallow your brain can't even communicate with its body shame on this judge ! one rarely even survives
@justinejackowicz3043lol this is old but the lawyer has to prove it to the court, not the internet. And if those emails never surfaced, they would have definitely said something publicly. The fact this quietly died down leads me to believe the attorney proved it. And even if the emails didn’t get sent because of a breakdown in his office, there’s not much you can do when you’ve had a stroke. The court had breakdowns in communication all the time and expects the public to except it. They have to be understanding when it happens to others.
I once had a Judge “rail” at me for being late to Court, I was 15 minutes late after being sideswiped by a Truck, reporting it to Police, giving a statement, providing a copy of my rear and dash cams. Phoning the court to have my case delayed. I should note, it was the same Judge who criticised me for “wilfully” allowing the Judge to ask a leading question of a witness, putting words in the mouth of the witness, who I then re-directed to show the answer put in the mouth of the witness was wrong. Some people should never be appointed to the Bench, increasingly Judges are ill educated oafs with insufficient experience.
The lawyer is fortunate he was still able to process and communicate after a stroke, what if he hadn't been in a position to inform his client? Hope he gets well soon.
Hopefully he comes to court everyday in a wheelchair as a reminder of the stroke. I'd be p'ed if I was a juror and saw that and hold it all against the judge.
Goatcha, what if he died and not been able to inform that goofball judge? Would the judge then go to the funeral home and drag him out of his casket to bring him into the courtroom?
I was being sued and the day before the first court appearance I got a phone call at 5:30 supposedly from the court clerk telling me that the hearing was postponed. This just sounded suspicious. I googled the caller ID number and the call came from the opposing lawyer's secretary's home phone. I'm sure they were expecting the court to find in their favor because I didn't show up. The look on their faces when I walked into court the next day was priceless. They were totally unprepared.
That call should have been reported. Secretary should have suffered some repercussion for agreeing to pull that shady stunt for the lawyer (her boss), the lawyer's butt should have been put in a hot place for trying to orchestrate you not showing up, etc. Sanctions , suspension, disbarment ..... something.

First thing to have come out of my mouth when it was my turn to speak would have been the telling of the tale of the phone call, supposedly from a court clerk and then my discovery of the telephone number being that of the suing attorney's office. However, I would not have been going into court without my own legal representation, so actually the appropriate thing to have done would have been to immediately call my attorney ...... and, in the case of me having my own lawyer involved, he/she too surely would have/should have received a matching bogus phone call.

She was a former Clayton County Commissioner and owned a family law and personal injury practice. So ambulance chaser to bureaucrat to Judge at age 41. Judge Shana Rooks Malone let the power go to her head !
It doesn't matter how serious the stroke is. Even a minor stroke needs you to be in hospital *immediately* so that they can make sure the minor stroke doesn't turn into a major one. Even a "false" stroke where you feel weak in one arm and your eye twitches (but it turns out not to be a stroke at all) should be assessed properly and have you in hospital to be checked out **just in case**. If there's any sagging or slurring going on, that's an ambulance call. The judge was utterly wrong to call this out - if she had concerns it wasn't genuine she should have notified the lawyer to come to chambers as soon as he is fit to do so to discuss the matter privately, and preferably to reassign the case to either another member of the law firm or to the next public defender on the list depending on the case in question to minimise the delay involved. But not to call the lawyer out for a potentially lethal or career ending medical issue. The same would go if the lawyer has to phone up *5 minutes before check in* to say they've had a heart attack and are in the back of an ambulance.
@GentlemenGhidorah Lots of symptoms could be referred to as a "false" stroke. My mom was having an ocular migraine ..... the symptoms could have been a stroke ..... but she did end up in the ER and then admitted and put thru a battery of tests and scans to determine if it was a stroke or not. I had a bout of vertigo, I suspected it was vertigo, but my doctor put me thru a battery of tests, etc. to rule out a stroke. In both instances, I heard the phrase "false stroke".
I have to wonder what would happen if they did and a complication killed him because of the delay to get him back into the hospital. Part of why he'd be recovering in the hospital rather than at home is so they can act immediately if there was more wrong that wasn't detected yet.
That's like the collage professor that made my friend leave her finals test because she couldn't/ wouldn't stop fidgeting. Thing was she was 9½ months pregnant and started having contractions 10 minutes into the test. She didn't want to leave till she finished her test. They disagreed ant the teacher pretty much called her a liar. Then she stood up and her water broke.
When I was teaching Wills & Trusts at a law school, I knew one of my students was pregnant and due near finals time. I hoped I did not have to prepare a make-up exam but knew it was likely. The best I remember, she delivered the child the day before the scheduled exam.
@@notabannedaccount8362 It would not have mattered to me. I think she was, but do not remember. Most of the time, my class was a mix of Caucasians, African-Americans, and Asians. Sometimes, there would be someone from the middle east or India/Pakistan in the class. Law school exams are graded without knowing who the student is. The student has an exam number and answers the questions on a laptop. The answers are uploaded to the school's computer and printed out by the school all on the same paper using the same font.
Judges like this should NEVER be in such a position of power over anyone! Not even a ham sandwich! Judges like this are the purest most disgusting form of bully and there should be laws in place to punish judges that do things like in this!
I have a very close loved one on parole. He was in a horrendous car wreck. He was in the hospital in a coma. The parole department charged him with missing his parole appointment. The judge then dismissed it. Then to add insult to injuy while he was in a coma he was transferred by ambulance to a medical center nearly 145 miles away for more intense medical care. Then parole charged him for being over 50 miles past the county line. Again, the judge dismissed it but REALLY, he's in a coma and parole knew it!
I was in a county lockup and missed a court date. A warrant was issued and I was eventually transported 300 miles to the other county jail. Went to court and that judge was furious with the magistrate and sheriff. She actually doubled the number of days I was (illegally?) held and knocked it off my sentence. I would have preferred to be free that 21 days rather than having 42 days knocked off my house arrest.
This is so beyond cruel I can not begin to understand the inhumanity. Why the judge commented let alone on nationwide media is definitely a breach of professionalism ! It is possible the judge did not receive the message but still the inhumanity is amazing ! I hope he never has to be in her courtroom ever again as this judge is not impartial. I too would be concerned that the defendant would not receive a fair trial.
Shall I give you a piece of information to help you understand? All the news reports about this situation left out a key detail that changes everything about why the judge did what she did: This attorney had a history of "failing to come and comeon time" to her courtroom. The judge notes that in the video but all the news reports leave that part out. So in her mind this attorney who has a history of not showing up, didn't show up again and told his client he had a stroke but... not the court. In that situation, most people would be skeptical. It just so happened this time he legit had an issue. This is a boy who cried wolf situation

Steve, have you ever heard of a judge who missed a trial with no excuse? I dated a girl in college whose father was George Warner, a Mississippi Chancery Court judge. One time he set a trial date on the schedule, but didn’t get the word to his clerk to put it on his official calendar. So, the day that trial was set to occur, he had taken the day off to go fishing and he didn’t show up for trial. He found himself in contempt and fined himself $100, then went directly to the clerk and paid it.
I have personal experience that demonstrates that courts can be dysfunctional. A judge vacated a case against me decades ago and the clerk never bothered to contact me to let me know, so I showed up for the next trial date for the ruling a couple of months later only to find out that there was no hearing scheduled for me that originally was. I knew the date and time. I walked into the courtroom to try and find out what was going on when I could not find my case on the paper schedule posted. The judge was not too happy with the clerk who was supposed to notify me immediately. The clerk shrugged and had an expression on her face like, 'who gives a $hit?'

It should be relatively easy to prove he called or emailed her office. I suppose the irony is that attorneys have to maintain accurate records amd respond to filed notices all the time. Apparently judges are allowed to be sloppy and miss things.
I don't know how the judge qas contacted. One report says the defendant told the judge, but it was probably his office and hell yeah they would do it by email to have that paper trail.
This happened in Clayton County, GA in metro Atlanta. Those of us who live in the metro area can attest to the imcompetence of too many metro courts and judges.
Power tripping management. I had to deal with this issue one Monday I was out and let a supervisor know but I didn't call her *personally*, instead her subordinate supervisor let everyone know why... My husband died from heart failure the day before and I found him. I was so hysterical that the first responders asked for a person they could call. I gave them the supervisor's number and she took me to the ER as I was out of my mind and they didn't want me to see him being taken away. She was a friend too. I found out the manager was talking crap and feined ignorance and that I better be back Tuesday. I called HR and lost it. Did I really need to be dealing with this petty crap NOW? I got an apology phone call and 2 weeks leave.
Most likely she was grandstanding in front of the cameras and afterward did not want to change her view. I saw her little speech, no judge should act like that.
I once had a co worker who was injured on the job, tip of his finger got sliced off, the boss called him at the emergency room and ask how much longer until he gets back. he didnt come back for two weeks, put his twoo week notice in and the boss didnt understand why and worse he was sooooooo pissed off about it
That is almost anywhere now. I had to bring something from the funeral home when my father passed and I needed 5 days for it due to travel time. I think I just brought the little pamphlet that the funeral home does for pretty much every funeral. In my work it was because we had people at one point having 5 and 6 grandparents die and they decided that they couldn't trust people not to take advantage of the system anymore.
Almost an opposite thing happened to me. I was the plaintiff. Attorney in Houston called and gave me the court date. I gathered witnesses and drove down from Dallas the night before and put everyone up in a hotel. Everyone shows up in court and the judge asks why we are there. Trial is a different date. Attorney was wrong. And he had the balls to try to charge me for coming to court on the wrong date!
Steve, the irony of this particular case is that the stroke attorney's client who chased down and shot the "hit and run driver" actually shot a driver who had some sort of a confirmed diabetic stroke himself, and was not running from the accident ... but was unaware of it. To further complicate matters, it was reported that the elderly driver with the medical issue was confused and frightened by this young woman, gun in hand, trying to pull him out of his vehicle and then shooting him! Talk about truth being stranger than fiction!
My grandpa had a few strokes before he passed away and after the first one he was never the same. Strokes aren’t something to take lightly, so even if you aren’t having a stroke but you think you might be, it’s still best to get checked out. Not getting checked out can be the difference between life and death.
Too many judges are on a power trip, being used to have people bow at their feet and have become not only inhumane but godlike in their own eyes. Someone should be monitoring them.
That example you gave at the end of what you went through is nuts. $500 barely seems like enough to make up for your client taking time off work, having to now take additional time off in the future, and the inconvenience for all the witnesses.
yeah, $500 feels like a slap in the face tbh. probably should have been more like $5000 with the expectation of that being used to reimburse not only the attorney, but the client and witnesses as well, for their time.
I'm sure some might do something shady. All you need to do is call an ambulance and say you feel faint. Plenty of politicians have "breakdowns" and find someone to name their condition to try and garner sympathy.
My wife and I were served papers once giving us a 5 day notice that we would be found in default if we missed another date. Turned out our attorney was in the hospital and could not communicate. She was a style practitioner and left a lot of clients just like us. We were fortunate that we found an attorney in a day and the new attorney was awesome.
I'm pretty sure that the cops would have backed off, immunity doesn't cover removing someone from direct medical care there. Cases with trying to drag a patient out of an ER or similar where they're dealing with that sort of thing can shift to homicide charges for those responsible if anything gets worse or if it means that they can't recover as well. Not always involving judges, but I did end up witnessing some of that when I'd ended up in the ER, a cop was trying to muscle in on one of the other rooms and I could hear the shouting match between the cop that showed up to try to arrest someone for an OD and the docs about it...removing them from needed medical care comes under negligent homicide at best there.
This defendant is a liar. Remember she said the man shot himself with her gun. Do you believe a person can shoot themselves in the chest several times?

As an update, the defendent in this case was convicted. Because of another high profile case involving a fatal citizen arrest here in Georgia, the State Legislature passed and the Governor signed a bill that very narrowly limits citizen arrest.
I was a juror on a trial that was supposed to start on a Monday. But the defense attorney was in a car accident on the way to court and broke his arm. We were told to go home and call in to see if the trial was to begin. The trial started two days later on Wednesday with the defense attorney's arm in a cast in a sling.
Seems like a good idea there, car wreck and broken arm, probably, also, means that the docs had him on pain killers for a bit as well for recovery which would have, likely, meant that would not have counted as competent council there either

I have known people that had strokes and they come out of them a mere shell of who they were. Not only is it bad he was not available, he may not even know the extent of the damage yet. That judge needs to be reprimanded.
Obviously that judge does not follow what the evidence shows to make a judgement, but his own opinions. He should not be in a bench deciding cases, because the outcome will be dependent on the mood he is in.
Intemperate behavior in a judge is unprofessional and unacceptable. The judge clearly jumped to conclusions without any evidence whatsoever. The rule of law is based on facts. The judge should be removed or disciplined.

Reminds me of a case with the National Labor Relations Board around 2011, think it was Dayton OH area. A sole proprietor landscape business failed to respond to requests to negotiate employees unionizing, less than 10 employees. The estate attorney informed the NLRB the owner did not respond because shortly after the request, the owner had died. NLRB said it was no excuse for not responding.
I had a friend who was stalked around a wal mart while he was exchanging a defective nintendo ds or something like that. And after he left he was walking to the bus stop that was in front of a wendys and in the parking lot in the wendys someone hit him in the head and tried to take his game. Which went really really badly for them. They got their jaw broken and head bounced off the asphalt a couple times. The cops showed up and arrested my friend after they pulled him off the guy who was still fighting and trying to hit him. The people in the wendys came out and said no this dude was minding his own business and the guy on the ground came up and hit him in the head and tried to take his stuff. The manager showed the cops the recording and one of the cops told my friend that tenchincally what he had done was like false imprisonment because he held the guy down unless he claimed he was making a citizens arrest, which could do because what happened qualified for that. So thats what happened. They hauled the guy off to the hospital for his rearranged face, and then to jail. At which point he tried to press charges against my friend for aggravated assault. Which was dismissed. He tried to cililly pursue it and it didnt get picked up. He ended up going to prison because he was found guilty of attempted strong arm robbery and agravated assault because he also spit on my friend while they were fighting. My friend is a black belt in karate, so it turns out it is useful in a street fight.... I mean they were feet from the street, and they were fighting. And my friend never once let go of his ds.
When I first saw the video of the judge making these comments, I was surprised that the judge would use the opportunity to advise the defendant to seek new counsel. From what I've always heard, judges are hesitant to engage directly with a defendant when their attorney isn't present.
As someone who has had at least 2 strokes it is unreal that a person should not be believed about such a medical emergency. After my first one I was a mess for years. I had no insurance and no medical care. It was horrible. I felt like I was going to die. I'd had a bad seizure also and chewed my tongue up also my whole body hurt so I was in bad shape for a long time.
If that judge didn't not offer, but actually do an honest public apology.. I'd ask for him to be removed.. it's clear that getting anything fair from him is long since left the station at this point. Not to mention maybe a complaint lodged with the state bar assn too... I'm sure you agree, as an officer of the court.. that crossed a few lines..
My favorite lesson in cyber security has always been on the principle of digitally signed emails for non-repudiation. Non-repudiation is the assurance that someone cannot deny having sent something and the other party cannot deny having received something.
I had the same sort of thing happen to me. I was detained, DETAINED IN THE OKC COUNTY JAIL FOR 11 DAYS!!!! Because a traveling small town judge did not clear my case and not guilty verdict judgement handed down. If not for the kindness of a cellmate who agreed to let me use his phone card I might still be sitting there. That's how screwed up Oklahoma can be. I paid the cell mate back by bailing him out of jail because he did not have $300 for bail. The look on his face when he saw me waiting to give him a ride was more than worth it. I wasn't a big philanthropist or anything I knew he'd show up for his case and I'd get my money back because he'd already served his time and then some.
When my son was a baby he scratched my his mother's eye. She had to get emergency treatment. I worked at Walmart and my manager said "you know you need to put time off requests 3 weeks in advance" and I was like. Next time I'll tell my son to give 3 weeks notice to scratch his mother's eye.
I was on a jury and the day the trial was to start the Lawyer for the Defense didn't show up they sent us to lunch and when we got back the Judge told us they are still trying to get a hold of him. They sent us home and 3 hours later the Judge called me and said that the attorney had a medical problem and he said he called a mistrial.
Legal profession today is very good troubling with rulings and actions so bizarre it can't be ignored. Rulings affect everyone's daily lives. Most obvious errors can take decades to change.
In your story about the lawyer who contacted you at 5:30 to ask for an adjournment - once the judge realized that he had called to adjourn without your consent, and LIED TO THE COURT by saying that he had your consent, why wasn't the lawyer sanctioned for perjury, as an officer of the court?
I figure my attorney raised his hand, same as I, when he was sworn in to be licensed before the Court. Thereafter, he is deemed ‘always sworn in.’ That, plus his education and passing of tests, places his bar higher, and his responsibility greater.
Judges that show this much bias, contempt, tyranny and lack of compassion should not be trusted to pass judgement on anyone.

I once heard a judge angrily lecture a head of cardiology that his job was not as important as jury duty. Some judges are dangerously narcissistic.
In the judges defense, its supposed to be a jury of your peers, not a jury of people with inconsequential jobs.

That judge needs to be reviewed. And the lawyer needs to get her removed from the case, and sue the judge for defamation.

First thing to have come out of my mouth when it was my turn to speak would have been the telling of the tale of the phone call, supposedly from a court clerk and then my discovery of the telephone number being that of the suing attorney's office. However, I would not have been going into court without my own legal representation, so actually the appropriate thing to have done would have been to immediately call my attorney ...... and, in the case of me having my own lawyer involved, he/she too surely would have/should have received a matching bogus phone call.
i had some of (what i thought was my family) send me a probate notice for my wealthy half brother who died suddenly *in some ignorable junk mail envelope*. they aren't the only scum out there.
My grandparents are all dead but Steve is like a grandparent-in-a-bottle and I can always pop the cap for stories.

It doesn't matter how serious the stroke is.
Even a minor stroke needs you to be in hospital *immediately* so that they can make sure the minor stroke doesn't turn into a major one.
Even a "false" stroke where you feel weak in one arm and your eye twitches (but it turns out not to be a stroke at all) should be assessed properly and have you in hospital to be checked out **just in case**. If there's any sagging or slurring going on, that's an ambulance call.
The judge was utterly wrong to call this out - if she had concerns it wasn't genuine she should have notified the lawyer to come to chambers as soon as he is fit to do so to discuss the matter privately, and preferably to reassign the case to either another member of the law firm or to the next public defender on the list depending on the case in question to minimise the delay involved. But not to call the lawyer out for a potentially lethal or career ending medical issue.
The same would go if the lawyer has to phone up *5 minutes before check in* to say they've had a heart attack and are in the back of an ambulance.

@GentlemenGhidorah Lots of symptoms could be referred to as a "false" stroke. My mom was having an ocular migraine ..... the symptoms could have been a stroke ..... but she did end up in the ER and then admitted and put thru a battery of tests and scans to determine if it was a stroke or not. I had a bout of vertigo, I suspected it was vertigo, but my doctor put me thru a battery of tests, etc. to rule out a stroke. In both instances, I heard the phrase "false stroke".

I have to wonder what would happen if they did and a complication killed him because of the delay to get him back into the hospital. Part of why he'd be recovering in the hospital rather than at home is so they can act immediately if there was more wrong that wasn't detected yet.
That's like the collage professor that made my friend leave her finals test because she couldn't/ wouldn't stop fidgeting. Thing was she was 9½ months pregnant and started having contractions 10 minutes into the test. She didn't want to leave till she finished her test. They disagreed ant the teacher pretty much called her a liar. Then she stood up and her water broke.

When I was teaching Wills & Trusts at a law school, I knew one of my students was pregnant and due near finals time. I hoped I did not have to prepare a make-up exam but knew it was likely. The best I remember, she delivered the child the day before the scheduled exam.

Law school exams are graded without knowing who the student is. The student has an exam number and answers the questions on a laptop. The answers are uploaded to the school's computer and printed out by the school all on the same paper using the same font.
Judges like this should NEVER be in such a position of power over anyone! Not even a ham sandwich! Judges like this are the purest most disgusting form of bully and there should be laws in place to punish judges that do things like in this!
I have a very close loved one on parole. He was in a horrendous car wreck. He was in the hospital in a coma. The parole department charged him with missing his parole appointment. The judge then dismissed it. Then to add insult to injuy while he was in a coma he was transferred by ambulance to a medical center nearly 145 miles away for more intense medical care. Then parole charged him for being over 50 miles past the county line. Again, the judge dismissed it but REALLY, he's in a coma and parole knew it!
I was in a county lockup and missed a court date. A warrant was issued and I was eventually transported 300 miles to the other county jail.
Went to court and that judge was furious with the magistrate and sheriff. She actually doubled the number of days I was (illegally?) held and knocked it off my sentence.
I would have preferred to be free that 21 days rather than having 42 days knocked off my house arrest.

This is so beyond cruel I can not begin to understand the inhumanity. Why the judge commented let alone on nationwide media is definitely a breach of professionalism ! It is possible the judge did not receive the message but still the inhumanity is amazing !
I hope he never has to be in her courtroom ever again as this judge is not impartial. I too would be concerned that the defendant would not receive a fair trial.
Shall I give you a piece of information to help you understand? All the news reports about this situation left out a key detail that changes everything about why the judge did what she did: This attorney had a history of "failing to come and comeon time" to her courtroom. The judge notes that in the video but all the news reports leave that part out.
So in her mind this attorney who has a history of not showing up, didn't show up again and told his client he had a stroke but... not the court.
In that situation, most people would be skeptical. It just so happened this time he legit had an issue.

Steve, have you ever heard of a judge who missed a trial with no excuse? I dated a girl in college whose father was George Warner, a Mississippi Chancery Court judge. One time he set a trial date on the schedule, but didn’t get the word to his clerk to put it on his official calendar. So, the day that trial was set to occur, he had taken the day off to go fishing and he didn’t show up for trial.
He found himself in contempt and fined himself $100, then went directly to the clerk and paid it.
I like this judge.
I have personal experience that demonstrates that courts can be dysfunctional. A judge vacated a case against me decades ago and the clerk never bothered to contact me to let me know, so I showed up for the next trial date for the ruling a couple of months later only to find out that there was no hearing scheduled for me that originally was. I knew the date and time. I walked into the courtroom to try and find out what was going on when I could not find my case on the paper schedule posted. The judge was not too happy with the clerk who was supposed to notify me immediately. The clerk shrugged and had an expression on her face like, 'who gives a $hit?'
She's a government employee, it isn't as if incompetence is a threat to her job.

I don't know how the judge qas contacted. One report says the defendant told the judge, but it was probably his office and hell yeah they would do it by email to have that paper trail.

This happened in Clayton County, GA in metro Atlanta. Those of us who live in the metro area can attest to the imcompetence of too many metro courts and judges.
Power tripping management. I had to deal with this issue one Monday I was out and let a supervisor know but I didn't call her *personally*, instead her subordinate supervisor let everyone know why...
My husband died from heart failure the day before and I found him. I was so hysterical that the first responders asked for a person they could call. I gave them the supervisor's number and she took me to the ER as I was out of my mind and they didn't want me to see him being taken away. She was a friend too.
I found out the manager was talking crap and feined ignorance and that I better be back Tuesday. I called HR and lost it. Did I really need to be dealing with this petty crap NOW?
I got an apology phone call and 2 weeks leave.

A co-worker once had to take time off for her grandmother's funeral. My A-hole boss asked her to get a note from the funeral director. She quit.

That is almost anywhere now. I had to bring something from the funeral home when my father passed and I needed 5 days for it due to travel time. I think I just brought the little pamphlet that the funeral home does for pretty much every funeral. In my work it was because we had people at one point having 5 and 6 grandparents die and they decided that they couldn't trust people not to take advantage of the system anymore.
That judge should be made to apologize on that same national television, spelling out exactly what they did wrong as they do it.
Almost an opposite thing happened to me. I was the plaintiff. Attorney in Houston called and gave me the court date. I gathered witnesses and drove down from Dallas the night before and put everyone up in a hotel. Everyone shows up in court and the judge asks why we are there. Trial is a different date. Attorney was wrong. And he had the balls to try to charge me for coming to court on the wrong date!
I would have demanded the attorney pay the fees for the hotel. Absolutely ridiculous
Steve, the irony of this particular case is that the stroke attorney's client who chased down and shot the "hit and run driver" actually shot a driver who had some sort of a
confirmed diabetic stroke himself, and was not running from the accident ... but was unaware of it.
To further complicate matters, it was reported that the elderly driver with the medical issue was confused and frightened by this young woman, gun in hand, trying to pull him out of his vehicle and then shooting him!

My grandpa had a few strokes before he passed away and after the first one he was never the same. Strokes aren’t something to take lightly, so even if you aren’t having a stroke but you think you might be, it’s still best to get checked out. Not getting checked out can be the difference between life and death.
They're huge. A coworker of mine had several and couldn't get doctors to look into it. She was never the same after that

That example you gave at the end of what you went through is nuts. $500 barely seems like enough to make up for your client taking time off work, having to now take additional time off in the future, and the inconvenience for all the witnesses.

My wife and I were served papers once giving us a 5 day notice that we would be found in default if we missed another date. Turned out our attorney was in the hospital and could not communicate. She was a style practitioner and left a lot of clients just like us. We were fortunate that we found an attorney in a day and the new attorney was awesome.
Imagine if Judge had call him in contempt and police would arrest him in hospital
The cops would have been very happy to handcuff him to his bed and stand guard as if he were a hardened, violent criminal.
I'm pretty sure that the cops would have backed off, immunity doesn't cover removing someone from direct medical care there. Cases with trying to drag a patient out of an ER or similar where they're dealing with that sort of thing can shift to homicide charges for those responsible if anything gets worse or if it means that they can't recover as well.
Not always involving judges, but I did end up witnessing some of that when I'd ended up in the ER, a cop was trying to muscle in on one of the other rooms and I could hear the shouting match between the cop that showed up to try to arrest someone for an OD and the docs about it...removing them from needed medical care comes under negligent homicide at best there.

As an update, the defendent in this case was convicted. Because of another high profile case involving a fatal citizen arrest here in Georgia, the State Legislature passed and the Governor signed a bill that very narrowly limits citizen arrest.
Well, let us hope that judge never gets ill, for ANY reason.
I was a juror on a trial that was supposed to start on a Monday. But the defense attorney was in a car accident on the way to court and broke his arm. We were told to go home and call in to see if the trial was to begin. The trial started two days later on Wednesday with the defense attorney's arm in a cast in a sling.
Seems like a good idea there, car wreck and broken arm, probably, also, means that the docs had him on pain killers for a bit as well for recovery which would have, likely, meant that would not have counted as competent council there either

I have known people that had strokes and they come out of them a mere shell of who they were. Not only is it bad he was not available, he may not even know the extent of the damage yet. That judge needs to be reprimanded.

Obviously that judge does not follow what the evidence shows to make a judgement, but his own opinions. He should not be in a bench deciding cases, because the outcome will be dependent on the mood he is in.

Intemperate behavior in a judge is unprofessional and unacceptable. The judge clearly jumped to conclusions without any evidence whatsoever. The rule of law is based on facts. The judge should be removed or disciplined.

Reminds me of a case with the National Labor Relations Board around 2011, think it was Dayton OH area. A sole proprietor landscape business failed to respond to requests to negotiate employees unionizing, less than 10 employees. The estate attorney informed the NLRB the owner did not respond because shortly after the request, the owner had died. NLRB said it was no excuse for not responding.

I had a friend who was stalked around a wal mart while he was exchanging a defective nintendo ds or something like that. And after he left he was walking to the bus stop that was in front of a wendys and in the parking lot in the wendys someone hit him in the head and tried to take his game. Which went really really badly for them. They got their jaw broken and head bounced off the asphalt a couple times.
The cops showed up and arrested my friend after they pulled him off the guy who was still fighting and trying to hit him. The people in the wendys came out and said no this dude was minding his own business and the guy on the ground came up and hit him in the head and tried to take his stuff. The manager showed the cops the recording and one of the cops told my friend that tenchincally what he had done was like false imprisonment because he held the guy down unless he claimed he was making a citizens arrest, which could do because what happened qualified for that. So thats what happened. They hauled the guy off to the hospital for his rearranged face, and then to jail. At which point he tried to press charges against my friend for aggravated assault. Which was dismissed. He tried to cililly pursue it and it didnt get picked up.
He ended up going to prison because he was found guilty of attempted strong arm robbery and agravated assault because he also spit on my friend while they were fighting. My friend is a black belt in karate, so it turns out it is useful in a street fight....
I mean they were feet from the street, and they were fighting. And my friend never once let go of his ds.
Everyone needs to ask a how many times this attorney had already cried wolf and if he had missed dates before.

When I first saw the video of the judge making these comments, I was surprised that the judge would use the opportunity to advise the defendant to seek new counsel. From what I've always heard, judges are hesitant to engage directly with a defendant when their attorney isn't present.
As someone who has had at least 2 strokes it is unreal that a person should not be believed about such a medical emergency. After my first one I was a mess for years. I had no insurance and no medical care. It was horrible. I felt like I was going to die. I'd had a bad seizure also and chewed my tongue up also my whole body hurt so I was in bad shape for a long time.

I had the same sort of thing happen to me. I was detained, DETAINED IN THE OKC COUNTY JAIL FOR 11 DAYS!!!! Because a traveling small town judge did not clear my case and not guilty verdict judgement handed down. If not for the kindness of a cellmate who agreed to let me use his phone card I might still be sitting there. That's how screwed up Oklahoma can be. I paid the cell mate back by bailing him out of jail because he did not have $300 for bail. The look on his face when he saw me waiting to give him a ride was more than worth it. I wasn't a big philanthropist or anything I knew he'd show up for his case and I'd get my money back because he'd already served his time and then some.

True. Typically in a situation like this, the Supreme Court will issue the offending judge a public reprimand after holding a hearing.
Unfortunately the judge is a black female diversity hire, so will immediately play the racism/misogyny card if anything is said.
When my son was a baby he scratched my his mother's eye. She had to get emergency treatment. I worked at Walmart and my manager said "you know you need to put time off requests 3 weeks in advance" and I was like. Next time I'll tell my son to give 3 weeks notice to scratch his mother's eye.

I was on a jury and the day the trial was to start the Lawyer for the Defense didn't show up they sent us to lunch and when we got back the Judge told us they are still trying to get a hold of him. They sent us home and 3 hours later the Judge called me and said that the attorney had a medical problem and he said he called a mistrial.
My Grandma had a stroke she shouldn't have survived, she did and fought back but lived another 10 years

Legal profession today is very good troubling with rulings and actions so bizarre it can't be ignored.

I figure my attorney raised his hand, same as I, when he was sworn in to be licensed before the Court. Thereafter, he is deemed ‘always sworn in.’ That, plus his education and passing of tests, places his bar higher, and his responsibility greater.
