One of the problems I encountered stemmed from VSO's and their limited knowledge about how the system works. My initial rating came back a combined 60%. I was pleased to have gotten anything at that point because I expected nothing. After talking with other Vets who deal with similar issues, Vets who received high ratings, I again went to a couple of local VSO's and was pretty much told "you get what you get." This happened several times. Finally I became aware of a local attorney who specializes in VA benefits. Following a consultation I was assured those who determined ratings had 'low balled me.' The attorney told me this was not at all uncommon. He further stated his belief those low-balled are so pleased to have gotten something they often will never challenge the rating. That sounded very plausible. Had I not spoken with other Vets I'd had been in that group. The attorney then filed the required paperwork, made arrangements for independent evaluations and suddenly (well, not so suddenly because this took about 18 months) I was at 80 percent. Great, I thought. A few weeks following the increase I stopped by the attorney's office to thank him for having helped me. Imagine my surprise when he told me he wasn't finished. That's when I first learned of TDIU. My post-military service employment history has be sketchy, at best. During the 40 years since leaving the military I've had dozens of jobs and long periods of unemployment. I'm talking in one instance over 7 years out of the work force. Additionally, all the jobs held were typically low paying. This got worse and worse and worse. Instability is not a trait employers are willing to reward with higher wages. I always felt trapped.. I t took about another year for the VA to process the TDIU claim, but it was successful. Today, between the little I receive from SSI, and what I receive from the VA my resources are greater than at any other time in my adult life - except for prior to military service. My only regret is I wait for over four decades to seek what was owed me as a result of what I experienced. I had joined because I believed serving and defending my country was both a duty and an honor. I paid a huge price. Many years later I'm being somewhat compensated. No matter how much money I may receive it will never actually equal what my service has cost me over the years. But, something is a whole lot better than nothing. I tell all Vets that if you believe your service has cost you anything beyond what is considered the norm, do all you can to get whatever you can, as much as you can. I tell them it will take time. It may take finding those with the knowledge necessary. The thing is those people exist and really aren't that hard to find. Once a claim as been decided, denied or given a rating, there are many attorneys more than happy to do all the leg work. Their fees are also set by law. They are limited to 20% of whatever might be due from the date of the original claim to the time the challenge is decided. If you get nothing the lawyer gets nothing. Lawyers don't work for free. So, if a lawyer is will to take on you case you can be almost certain you've got a legitimate winner. My advise to others is this: Don't wait. Don't accept 'No' for an answer from anyone, especially yourself. If you served, if you suffered as a result, do whatever it takes to get what is due you.. I know what I'm talking about.
most vsos only want to do paperwork and dont want to comment. i caught my vso knowing what i need to put for tdiu but conveniently not saying a thing about it til after the fact. I found it very frustrating.
Hello brother I was in the same boat you was in it took me 30 to 40 years to decide or realize I could get something, and here it is 55 years later I'm still fighting this but I do have a hope since I have found an attorney that would work it's looking better but now I'm 80 years old I should have been getting compensation long ago Brother tell me if if you know what is beefy a lawyer can charge you to file your claim thank you

I was just recently awarded TDIU, permanent and total, with special monthly compensation. This was all due to Hill and Pontons excellent attorneys. In the award letter sent by the VA it said I have "TDIU, permanent and total". I live in Texas where 100% disabled veterans pay no property taxes. In my county, the "gatekeeper" they have posted at the counter has no idea about TDIU, and says I need to be 100% disabled to be granted this benefit. Of course, I am receiving 100% disability benefit, but this clerk (gatekeeper) at the county tax assessor office has been told, or just assumes, that if the VA letter doesn't say in writing "100%", that it's not good enough to accept. My Hill and Ponton attorney has graciously sent a letter to the VA requesting the VA send me a letter that spells out that 'TDIU, permanent and total is a 100% disability', so I can get past the roadblock that this gatekeeper has thrown up in front of me. Hopefully I will find that in my mailbox sometime soon! Thank you Hill and Ponton! Y'all are the best ever!
@@TheTotalConcept- after about a month, I did receive a letter from the county stating that they have approved my tax exemption. I was also told that they were going to refund the taxes I had already paid back to the effective date of my TDIU (2 years). But, my Hill & Ponton attorney is appealing the effective date, and we're asking for 2013 effective date. (The date I had a heart attack while I was in the VA hospital for an unrelated issue - (hip replacement).
I had a great DAV representative which helped me all along my compensation journey, as soon as I hit 60 percent he filed for IU ON my behalf, and shortly after that I had a comp examination, and shortly after that I was awarded 100 percent P&T.
You are very lucky as I tried to get DAV to help me and the disability I asked about to them was answered with "you cannot get paid for that" and that was in 2010 and so i went with TVC and lo and behold today I am at 80% with no help from DAV. The thing I asked them about has gone through 2 surgery procedures. You are lucky!
The DAV is my VSO now after hearing about how great they are. That has not been my experience. Their process is as obtuse and black as anything the VA can hand out. I was disappointed in my state VSO. Now just a different disappointment. America loves veterans! Thanks for the heads up H&P. I am finally getting my head around the VA process'.

Might possibly have something to do with everyone and their brother that served 3 years as a cook assistant thinks they deserve 100 disability, and the people that deserve it have to fight the system.
I have fought with the VA for over 50 years. Every single claim I have ever submitted has automatically been denied, last year up hired attorneys to do my claims they requested my records and after reviewing them had told me that the VA rated me only for PTSD and put me in a special category where nothing else gets rated. I am currently rated at 70% for PTSD and they filed a claim for unemployability I just recently got paperwork back from the VA denying that claim. Even though I have 50% hearing loss in both ears which the VA had hearing aids issued for me I have a lower back injury and upper back injury from a rollover accident that I had in the military on duty I have been diagnosed with degenerative cervical disc disease and arthritis in my lower back this causes pain through my hip and down my left leg my right arm is weak and tingles all the time all of those claims were denied. In reading the paper they sent back denied but it gives no reason why. When I first got out of the military the VA was less than helpful to the veterans Lotus down with paperwork that we had no idea how to fill out and there was no help out there to do it. Over the years that has changed and it is a little better. I have had vso's and numerous other people telling me about all the delays that the VA has oh, well I'm here to tell you those delays have been there since the early 70s if anything they have gotten worse. My married life has gone down the tubes I've been separated for nine years and right now I'm on the verge of being on the street again but yet the VA keeps dragging its feet I'm tired of being treated like nobody, the US government had no problem sending me to Vietnam for a year all the while making promises that they would take care of me when I came back so when are they going to start. As I see it now the only thing they are trying to do is trying to get the veteran so frustrated that he gives up oh, this is no longer acceptable
Update finally got my hundred percent since I was 70% already for PTSD they approved the unemployability claim so out of about 15 claims that I had in four different problems that occurred in service they finally approved me as unemployable for PTSD
Jim Thornsbury - Keep your chin up. I've been fighting the VA since 2013. I'm also Vietnam Vet with Ischemic Heart disease. Got to 80% using a VSO. I hired Hill and Ponton after all the years of fighting the VA. I also just turned 75 in May 2022. Make SURE you tell the VA when you turn 75. My TDIU, permanent and total, with special monthly compensation added was approved within two weeks of my 75th birthday. You move to the "top of the pile" of claims at 75 years old.

@@hernandezcordovajanice6140 well I don't consider it Brave but my temper got the best of me and I sat down and decided I'm going to fight them till the day I drop dead I also found out something else too when you hit 100% if you're a California veteran you can go in and file a paper and you get an exemption on the registration for your car I had a lady at DMV tell me that and she even gave me the paper now I just got to take it out and have my doctor sign it that's the only break that I know that the state of California gives us I've got an old 2004 Mercedes that I got at a lien sale and they was trying to charge me $757 just to get it registered and in my name but once I take this paper in I don't pay nothing if you're in a state other than California you might want to check with your DMV and see if they give you a breaks on your registration I know in Nevada they give you a break on your property taxes if you're a veteran
Folks, I have been referring Veterans to seek the help of Hill and Ponton, P.A. to their website, whenever they have an issue with their Veteran Affairs claims. Neither party on each end of the spectrum do I get paid or get favorable treatments; I just want to help my fellow-Americans for serving their country. Do the same for another veteran that deserves these types of professional attorneys that understand the law and jargons of the VA world. Thank you, H&P for taking care of us.

I am marine disabled veteran at 90% I have been on state disability since 2018, still havent been able to get my 100% with the va. I have a physical doctor at the va clinic in my county who says I had an accident, he doesnt help at all with him vietnamese. He doesnt help any of his patients that I have talked with. I got my Unemployability in 2013 but it wasn't made P&T until my ptsd exam 5 years later in 2018.. remember there's a difference for Unemployability and TDIU.. because you may be paid at 100 per cent but not yet made permanent..that permanent status gives your educational benefits ..
I also just wanted to add that once I found your videos it explains a lot to me and it gives me Avenues that I never knew I had believe it or not there is no one out there from the VA that is willing to help a veteran anymore
I am over all 80%. I have 20% each shoulder 30% somatic system disorder and 10% for thoracic spine myofasical pain. I also have 30% Migraines and 10% tinnitus. I will be getting with you all for sure.
I was denied unemployability for bipolar the VA said I can work in a supervised setting, but gave me 100 percent scheduler non p and t. Go figure. Isn’t every job in a supervised setting lol.
Brother I would have saved you the money. Go to a local Disabled American Veterans they'll help for free its vets helping vets and if you need a lawyer they got you covered. But I hope you see this there are ways to increase it as well. I'll get back to you if you reply. Sgt E USMC
It took me 3 years appeal after appeal, I went thru Dav, Pav, and 4 others, each advanced it a little then they stopped, went to another organization until it went to the final court of appeals in Washington. 100% PTSD 40% for back injury, USMC 1968 - 1971, You know where I was, keep fighting!!
Im 90% service connected im still waiting for unenployability decision since 2007 I have lawyers from a veterans group handling the appeals all i get is that i have to wait my combine ratings chronic depression ptsd Migranes im total disable from Social Security I dont know what else I can do but I feel this is unfair having to wait all these years for a decision
Individual Unemployability would be my last resort. I would go for 100% p&t. IU limits what you can do. With 100%PT you can work and make as much as you want.
I filed for service connected disability 2 years ago and received 50% PTSD, 50% migraines, 10% Tinnitus, 25% for both knees. I was working at the time but am no longer working and can’t work because of these. I also didn’t file for SSN disability because I didn’t know I could. Waiting now 5 months for the VA to decide if I get the unemployability.

Politicians like clean streets, low homeless, and ZERO rejected vets. This has been my experience. I even stopped one cnp where within 2 minutes she threatened me with a turn down, RUDE! I changed it, two weeks later, 15 minutes. DONE
@@pete7326 oh yeah, you need to go see the Dr at the VA so you have your NEXUS (DIAGNOSIS). Obviously you have a rating, I'd want to make sure your wearing the VA out for help/treatment.

@@nevergiveupfitness4710 Maybe, a good course of action, i would throw in a tdiu claim if not actively working and work the other claims/secondary claims. In fact i would throw migraine and sleep apnea under ptsd as secondaries as that would pretty much already establish service connection.
I've been gainfully employed since leaving the military. I've been recently rated at 70% and as my disabilities increase I had to leave my job, it was too painful to work.
I am 62 years old and recently awarded TDIU P&T. The VA Nutritionalist put me on a low carb and calorie diet. I was rated 0% for high blood pressure which may improve which is good but the secondary conditions caused by BP are service connected and static. Should I be concerned about a VA reevaluation.
The issue I have run into being rated at 70% for PTSD, I am currently employed, but I have a letter from my General Manager breaking down the daily issues that he and the other employees have to endure and how it is not a good environment for anyone when I am there, but I maintain the job even through the struggle and he keeps me there all because I don't want my family to be homeless and neither does he because he is compassionate towards veterans. This is the reason I have been denied over and over again. Should I let my family be homeless? Should I end up in prison? Is this what they want? VA system is so broken. They REALLY DONT take a look at the VETERAN individually.
In the same boat as you man, I’m about 2 no’s away from eating the barrel of my 45 and blowing my brains out in the lobby of my hometown VA with a sign around my neck telling them this could’ve been avoided.
@@sporillasanchez1648 please, don't do that. Get some help. Then, open up an IU claim due to your PTSD. My husband walked out of his job due to his PTSD in 2018. He opened a new claim for PTSD (he was 50%). He took the paperwork (when you open a claim online on ebenefits in 2018, it provided paperwork to fill out by your doctor) to his counselor and they wrote he can't hold a job due to his PTSD. He filled out the IU paperwork as well and submitted both claims at the same time. His PTSD was raised and IU was granted. Don't be discourage. He had two claims opened at the same time in 2018. The second was PTSD. They closed it along with the first claim without acknowledging the PTSD claim. He opened an intent to file in Nov 2018. When he went to submit his intent to file the week prior to the deadline (it took 1 1/2 yr to get his medical records from the VA. He received it the month prior), the intent to file was gone. In Feb 2020, he opened another intent to file. In Jul 2020, was when he submitted both claims (to include the paperwork the counselor filled out in 2018). In Feb 2021, both claims we granted, PTSD was raised and IU put him at 100% permanent (IU is normally temporary). You might want to try a weighted blanket for PTSD. I use a weighted blanket to sleep and has helped me stay asleep and ideations decreased by about 80-90%. It was 100% for about 6 months. Good luck!
You file for 100% rating based on unemployability. I think that you must leave this job first, or see if they can let you go. Once that happens you need some documentation of the things you said in your statement above. And you having co-workers that are witnesses gives you a good case. Having an attorney like the ones in this video would get you a win, in my opinion.

Hi I originally filed for disability through the VA in 1991 when I was living at the VA in the homeless domiciliaries. They instantly denied my disability and sent me on my then in 2012 I got raided 20% . Then I received 80=100% unemployability in 2015. My lawyer filed a CUE motion. That they have acknowledged. And is going through the whole VA system as we speak it's been 4years sofar. if they find it they did make the mistake by not doing the due diligence in the 90s. Doesn't that mean they show me retro pay all the way to 1991 To 2012 my original approval of 20% that in then was bumped up to 100%. We're talking twenty years here. 20 years that I was homeless off and on because I was unemployable due to my disability
My name is Eric I have been awarded 80%disability for PTSD and Migranes headaches I received a ratings from the doctor who did my PTSD stating I can no longer work and I am being told I have to retire because of my ratings. I am under the FERS retirement plan. Any advice you can give me would be greatly appreciated.
I received 20% for hearing with service related cause. Then went for agent orange exposure when the cancers started. Arms, melonma on my back, and finally prostate cancer surgery. I received 60% for cancer, combined 20% and 60% = 80% by any third garden arithmetic. Ended up with 70%. My vso had me apply for unemployability. Hard to work when you spend the day cleaning the piss that runs down your leg. I now receive 100% on an 70% claim. Took 3 years, the best advice I can give any vet, get a vso that knows their job or a attorney and don't give up.
My husband has PTSD and was working had to go out for knee surgery and since that surgery he can’t get job back at warehouse due to his knee surgery he’s been out of work for 1yr now and his PTSD is worse VA has denied employability

My question: I'm currently rated at 70% for major depression and 10% tinnitus. I work as a substitute teacher and do not pay into social security. How would this work for TDIU? I don't know if others would have this same question, but it's something I'm curious about now.
Great content! I am 100% disabled due to a surgery mishap on a bulging disc at the C-5. I am currently classified as a SCI C-5 ASIA C Incomplete Tetraplegic. I also am also classified as unemployability. However, I did not get classified as permanent and totally disabled but believe I should have been. I was also told that I am only getting about two thirds pay because I should be rated as a R-1 or R-2 (which ever is higher). I tried to find info on the R-1 or R-2 ratings but could not find them. Can you help me figure out how I can get this fixed?
I am currently collecting Disability Social Security and have a combined 90% rating from VA Disability. I realize at 39:59, there's discussion about Veterans who receive both Disabilities and it's fine. But just double and even triple checking that my Social Security Disability is NOT at risk for reduction (even though I may collect both) if I apply for TDIU (Total Disability Individual Unemployability) 100% with the VA. Does the SSA take into account my income from the VA? Currently my SS Disability isn't affected by my VA Disability but am concerned if I convert to 100% TDIU, it may reduce my SS Disability. Any other military veterans out there collecting both? Please respond. I'd love to hear from you, please.

Im currently going through the process of getting my rating increased. Im at 50% right now for one disability. Im not receiving anything for PTSD, DEPRESSION, ANXIETY, HEARING LOSS IN LEFT EAR, and Vision. Until the accident, I had excellent vision. Now wear glasses and eyes are light sensitive. Haven't been able to keep a job since 2009. I'm hoping I will get rated enough to bring me to 70% which I'll then try for unemployable. My VA psychiatrist is on my side. Have already made 2 of the 3 Dr appointment they have scheduled me. I can only hope.
I am confused as to why people have such a hard time getting rated by the v.a. it took me less than 30 days to get my rating of 90 % after I was discharged and they automatically jumped it up too 100 percent under individual unemployability . plus they added in the housebound rating .
Wow! I was rated a combined 90% with 70% PTSD in 2018. I just applied for Individual Unemployability and I am scheduled for my C&P on Wednesday. It certainly was not automatically. I have not worked since 2014.😒
@@KaribeCuebas Maria I am not 100 % up on va law but I think mine might be a little different than most cases thst and we hear about on these post . As a navy corpsman with 17 years in I knew I was screwed . When I woke up in Germany and not Iraq. The medical board at Portsmouth naval hospital gave me a 90 percent rating when I was separated and as soon as I filed with the v.a. they bounced it to 100 percent and added in the housebound rating. The director of the Hampton v.a. center told me that I may not have my legs and only 1 arm but they would always take care of me and I have to say that they have lived up to that promise he made that day. The v.a. paid to have my house redone so I could get around in my chair and they also paid to have a van I purchased refitted with a lift and all the hand controls so I could drive.

This is why I have you guy's. Mathew put me in for 100% unemployability right off the bat. I was told it would take approximately 3 to 5 years. The 8 th of April this year in a few days it will be 5. I read a rule that the benefit of the doubt always goes to the veteran. I'm totally disabled and was put on S.S. disability in 1998. I had a dream job making $157.000 a year. Believe me I would rather be working. I will only get a fraction of my salary for waiting 5 years. 😢

Early on it was you can work. Now they say I’m too old. Either way I was screwed. I got mine to 70% but was told I’d never get higher. So I lost my teeth. But younger I could never sleep right and almost lost my job because of it. When my job went to Mexico I was 54 haven’t been able to work since. Where is your practice? I’m central Penn.

Get depression or anxiety connected as a secondary condition to you physical condition. Find a psychiatrist who can connect the two, make sure he provides the DBQ and nexus letter. After you submit your paperwork contact the VA and request that they do not contact you for any C&P exams. It took 2 months and my anxiety was approved at 100% (connected to my tinnitus) in under 2 months
@@MrBundy15 I have been getting tests done for my stomach problems and they found out it was all stress now I take 8 pills a day for anxiety this Tuesday I have my exam for depression linked as a secondary disability. I’m confident after talking to some people that I will go from 80% to 100% after this however I will keep you guys updated. As this is all happening now.
30% disabled due to a knee surgery I got before I EAS’d. I have anxiety, “symptoms of PTSD”, depression, and at this point, I’m sure other things that haven’t been uncovered. Every time I walk into the VA, the sheer level of convoluted hoops to jump through makes me unable to accurately focus on filing or finishing claims for things. I don’t have a clue where to begin, and I’m in a financial situation that makes time my enemy. I don’t know what to do. Every time “time” gets brought up in the video, I get more and more worried about how I can even begin to proceed. I already know it’s my fault for allowing my anxiety to prevent me from even going to the hospital. These hoops and timeframes are just worsening my mental state. (TMI for a TH-cam comment but it is what it is)
Have you worked with a VSO - Veterans Services Officer, usually from your county? They offer their service free or charge. Working the VA circus by yourself is not advisable as the system is rigged for you to give up. My VSO filed everything for me. He used to be with the VA and was the person who rec'd the Disability applications so he knows the proper verbiage to put on the paperwork. The first level of reviewers are trained just to look for specific keywords and if they don't find it your application gets rejected. It took me 3 years to get the full monty resolved but they retro pay you. Believe me, persistence pays. Good luck.
I've been trying to increase my benefits for hearing loss down in the boiler plants. Watched one do a dance for us, 1200lb boilers usually blow up then. Thank my heavenly father for not letting that happen, but still remember it like it happened. Tried getting a boiler job, but get to nervous around them, affraid of them, dreams wake me a lot about it finishing me off. These things are as big as some houses. The asbestos fright came about 2 weeks before my discharge, space suits and all. I served from 76 - 80 active. Have never been able to hold a job for long, now on SSDI and 10% tinnitus. Living at poverty level sucks. Oh another issue that keeps plaguing me is when I was almost thrown overboard out at sea during a test refueling exercise from an aircraft carrier. They needed extra hands to help seat the fuel connector, and of course they called on B-division. I didn't hear the call to let go of the rope, would've been a good video of man playing superman. Flew thru air, then a high speed tumble across the deck. If I didn't open my arms wide, I'd have been shark bait, have regular night and daymares of that too. But when I menttion them incidents, they just get blown off. I sometimes get mad at God for saving me, it's a groundhog day thing, it won't leave me. Now to top it off, my breathing has been getting worse. King of like being tortured, slowly. Haven't got the evidence in order to get PTSD and the VA doesn't seem to give a damn. Too much paperwork, just boggles my mind.????
Great video!!! I am curious on yall's interpretation on a specific issue. A veteran cannot work any longer because he has bad knees and a back back. He meets the minimum requirement of the 70% because his knees are secondary to his back and he also has lower extremity radiculopathy. Is the law clear about the veteran not needing to find another job that he could do such as sedentary work. The base question for this scenario is: can the veteran get IU because he cannot work at his chosen career due to his service connected disabilities?
My VSO just got me approved for TDIU after getting 70 percent for PTSD. Which makes sense seeing as I've been on social security disability since 2016 for the same reason. I've been reaching out to the VA on my own for YEARS now, and have even had to call the crisis line a time or two when things got more rough than I thought I could handle. Now, I'm glad I'm finally being taken care of, but in all honesty I should be getting a giant backed check dating back to discharge. Oh well... I suppose I need to see that no matter how badly I was screwed, I'm still more fortunate than many others that have come before me. I suppose... I'm sure my kids would beg the differ lol. Edit: Also, I've been discharged since 2005.
My question is this, I was rated for back injury with radiculopathy in both legs. Back %50 radiculopathy %10 l/L radiculopathy %10 r/L Combine total of %60 Am I qualifed for TDIU I have not worked since 2005

Have you asked about a Veterans advocate? This is someone who works for the VA to assist veterans who apply for SSDI. I have heard that social security administration is a lot quicker to approve applicants for SSDI if the veteran has an attorney or VA advocate assisting them. I had one and I had zero issues getting approved. Contact your local Veterans Service Officer and ask them about it. If you feel that VSO is not a good one, ho to a different one or contact your Regional Office. Good luck
I am in that process right now, as well. I am on TDIU, and starting the process for SSDI. The way I have come to understand it, SSDI deny everyone on the first round, automatically and no matter what. Then you start the appeals process, and during the appeals process, your VA disability rating comes into evidence. There are attorneys in every town that handle this stuff for a living. Get one. They charge you nothing up front, nothing if they lose, and just a small percentage of your back pay if you win. No point in you trying to guess your way through it. They know the game better than you or I ever will.
I was recently denied TDIU. The C&P examiner said I could find a sit-down job. I told her I'm not trained for any sit-down jobs. I was a medic and operating room tech. After that, I went into electronics and computers where my jobs demanded that I be on my feet all night and lots of walking. My smartwatch showed from 10,000 to 14,000 steps a night. I can't even stand up for 10 minutes. I did get one of my knees changed from 10% to 30%, but it didn't change my total compensation.

I am rated at 90% and my TDIU claim plus additional Service Connected disabilities is deferred out to December after filing my claim last December. Every disability is well documented in my military medical records and diagnosed by the VA health care system. My claim remains stalled by endless additional information requests by the VA. As soon as I provide the requested documentation another request is made further pushing out the claim. This has happened several times. The problem is because my disabilities are linked to tactical herbicide and chemical exposures verified by thousands of pages of documentation and military environmental studies but are still outside presumed dates and locations for South Korea. This can take forever when there is a controversial factor involved.

I am at 100% V.A. disability with a priority group (1) - Unemployability), which allowed me to get military I.D. for my wife & I, to utilize medical facilities through the military, as well as having all the same privileges as a military retiree. I am retired from the Justice Dept., so I received both my retirement & V.A. disability with no interruption. I have not used the military benefits, since I still have my medical insurance through Justice Dept (private practice). All the benefits I am eligible for were told to me by the V.A., when I was given my 100% disability years ago.
Got service connection for my drinking and chirosis off my liver. Went from 50 to 70 percent on my major depressive disorder. Ptsd sleep apnea 50 percent service connected. Truth be told however I could make a lot more money if I was able to work. Got ssdi at 45 on my own .
Hello I have a 50% rating for PTSD combat related, 50% for obstructive sleep apnea and 10% for a right rotator cuff strain. Everything equals to 80% disability. Should I try to get the PTSD increased before going for TDIU for unemployability?
My path was rocky! I was not aware that I had neuropathy my original claim was denied because it was not filed with in one year of returning from Vietnam from agent orange exposure. I went to woods and woods and theVA kept rejecting my claim with different reasons. Finally I was rated at 100% and not able to work. They never stated anything about agent orange even though my exposure was very high in Danang when working in the open. This was a terrible!
I got unemploymenability, and having been on it for going on 3-4 years now, at a younger age (I'm 26 now), it can be both a blessing and a curse, as I can't work a regular job anymore do to this rating. I wish the best of luck to anyone seeking this type of filling though, as many people could use this.

Yes, 6 months before you turn 62. you will be applying for social security retirement. you can also apply for SSDI to give you your full disability at the same time. The amount that will receive will be what you would get when you turn Full Retirement age (66+). And when you turn your full Retirement age (66+) it will become your regular Retirement amount of the full amount.

Yes but then you CANT WORK AT ALL, even part time, or you will lose SS benefits and create a mess. You can still work part time with VA TDIU but not over poverty threshold for your household size
@@mattnorcia5593 I am fairly sure you are mistaken. What i have read, on V.A.; i can make a million a year and not effect my V.A. If you report your income to SSA, most of the time, they just take dollar for dollar unless you make too much.
So, if I was blown the hell up 15 times..thrown in the air by a couple rockets and and and blah blah..4 years of serious death and contact every week minimum...AS an Arabic linguist for the U.S army..then I joined the army...and almost three years in..my heart and body started acting up and couldn't finish my 3 years..and never worked a job since I got affected...palpitations, daily chronic headaches, neck pain, weakness in legs..dizziness and breathing problems and just can't sleep my nights at all..IBS and Gerd...what do you call that ? Tough situation, but if they can argue that your conditions were pre- existing your actually joining the army (I’m guessing your were making some serious contractor fees during your linguist time), which is nothing against you, but they look at service connection. Meaning it happened to you in your officially sworn in military time. This may be the challenge you are hitting. I have no good answer or you. I hope these folks can help you.

I believe they can not argue that I had pre exisiting conditions before joining the army due to army(peers) witnesses were with me in Iraq and saw how I roll and take care of everything and anything at anytime, all the problems started when I switched branches from National Guards to reserves to get a Job in an active duty slot ( 35 Papa )..I was placed in a homeless shelter by SFC. Davenport while in the service waiting on a O.K from a CSM to live in one of the 10 thousand empty rooms on a PA base. The shelter manager advised me to call the news as she was told by SFC. Davenport ; We just need you to keep him here for three days and we will get him as he is an asset to us and one of our own..then I was stuck there for 6 months..I called the news (Fox five ) I was given some name from Aljazeera English channel to call and do an interview. I said no..then I caught the palpitations very bad and things just went down hill for me health wise. About my interpretation/linguist work sir. No, I was not making even minimum wage as compared to any N.J cheap worker (USD 7.25). It was them U.S D.O.D linguists who used to make 12 K or 8 K and even 25K a month..and when things get real, they fail and the Battalion commander and CSM. Used to call me to fix their mess and take charge of sensitive meetings, interrogations , propaganda input... Etc. On paper my salary was 5K a month. But the TICKS at Global Linguist solutions, L3 Communications and Titan services Used to cut 4 K and pay us 950 USD a month 😂. While most U.S D.O.Des ( Arabic and Iraqies as well ) cannot do 1/10 of what I used to do and the proof was many many missions/ raids and meetings the U.S. army higher ups refuse to take anyone else on a mission but me. I honestly don't have any Interest in even applying for the benefits because I am just very tired inside ....I have accepted All my losses and I pray to the lord to somehow fix me and grant me peace and relief from all or some of my daily multiple pain. Recon 19 Delta - no, nothing in appropriate in your reply. You are getting/were getting screwed. I urge you to get in touch with these folks who put this together or a similar advocate. These attorneys are looking to make a cut, but in the end, you will win out if they can get your SC for the things that you have started experiencing since joining. You have spent enough time around the military to know that sometimes the enemy is wearing the same uniform you are. But it isn’t everybody. Hopefully there are some goof people who will help back you up. Very wrong that you were screwed out of most of the money you should have been making as a contractor. If you have been overseas since you officially joined and saw any hostile action, with any luck this can be done. Keep in mind that they love to cite pre-existing condition when they deny you SC. While your job was anything but a job, to the VA you were working at a convenience store prior to swearing into the military. That is the day your experiences and health start counting. Part of what these organizations count on is wearing you down. Which isn’t that hard because when you are suffering from PTSD/Depression, you already worn down. I do hope you can get assistance. But if you are screwed, the only solace I can offer is that you are far from alone, and some things get easier over time.
Recon 19 Delta - I just re-read your reply. If you were in Iraq with the NG as a sworn in soldier, then you need to get help to fight for your benefits from the VA. SSD - honestly, I know tons of people who are 100% per the VA system who get denied by SSA for disability. It makes no sense whatsoever. Either way, if you have been not making any progress with what you have been doing for 8 years, you need better advocacy. THere are several youtube groups I’ve seen who are about getting the most out of your VA claim. Find someone who can work with you. I just sincerely hope you have a service ribbon from Iraq or Syria for your enlisted time. You are likely an honest and upright person who tries to do the right thing. Dealing with the VA and sometimes the military requires a mindset shift to down and dirty. This probably isn’t how you think, so nothing like an attorney or other person who is comfortable with down and dirty to pick up the fight for you. The other catch you are fighting is that the injuries/illnesses sustained must have occurred when you are on active duty. It looks like you were NG and tried to go AD with the Reserves. Again, I wish you the best.
I received a 10% for Tinnitus, 30% for PTSD in 2016 and within the past month 40% For depression (all service connected). I filed a 8940 form but am thinking that I should also submit for a increase for PTSD. I would appreciate knowing if I am on the right track or not. Thanks
No, but you may be able to receive other things such as SSDI. Individual unemployability is only granted if a Veteran has proven they cant work but do not qualify for a 100% rating on their own. Another thing to look at if you are already at the 100 percent rating is do you have Chapter 35 DEA, also known as permanent and total, eligibility.

If you mean to work again then it will be temporary, soon as you report back to the workforce you will pay back to VA what you received from them after the date of the new employment.
@@Peakfreud you don’t get reviewed unless your trying to file other claims. You cannot make more than your family size according to the national poverty rate.
@@Peakfreud I worked at the national call center. It’s just like SSDI. You can also file a claim for SSDI if you are IU. You can still work too but cannot receive more than what the poverty level is for your household.
I've got several service connected issues. They add up to 130% service connected disabled. The VAs math adds this up to 90% 🤔🤔🤔 I have one claim still pending and its come to a screeching halt due to this bogus Rona crap! My VSO seems to think if the claim gets approved, the VA math will add up to 100%. Should I wait and see or immediately file for unemployability?

One of the problems I encountered stemmed from VSO's and their limited knowledge about how the system works. My initial rating came back a combined 60%. I was pleased to have gotten anything at that point because I expected nothing. After talking with other Vets who deal with similar issues, Vets who received high ratings, I again went to a couple of local VSO's and was pretty much told "you get what you get." This happened several times. Finally I became aware of a local attorney who specializes in VA benefits. Following a consultation I was assured those who determined ratings had 'low balled me.' The attorney told me this was not at all uncommon. He further stated his belief those low-balled are so pleased to have gotten something they often will never challenge the rating. That sounded very plausible. Had I not spoken with other Vets I'd had been in that group.
The attorney then filed the required paperwork, made arrangements for independent evaluations and suddenly (well, not so suddenly because this took about 18 months) I was at 80 percent. Great, I thought. A few weeks following the increase I stopped by the attorney's office to thank him for having helped me. Imagine my surprise when he told me he wasn't finished. That's when I first learned of TDIU. My post-military service employment history has be sketchy, at best. During the 40 years since leaving the military I've had dozens of jobs and long periods of unemployment. I'm talking in one instance over 7 years out of the work force. Additionally, all the jobs held were typically low paying. This got worse and worse and worse. Instability is not a trait employers are willing to reward with higher wages. I always felt trapped..
I
t took about another year for the VA to process the TDIU claim, but it was successful. Today, between the little I receive from SSI, and what I receive from the VA my resources are greater than at any other time in my adult life - except for prior to military service. My only regret is I wait for over four decades to seek what was owed me as a result of what I experienced. I had joined because I believed serving and defending my country was both a duty and an honor. I paid a huge price. Many years later I'm being somewhat compensated. No matter how much money I may receive it will never actually equal what my service has cost me over the years. But, something is a whole lot better than nothing.
I tell all Vets that if you believe your service has cost you anything beyond what is considered the norm, do all you can to get whatever you can, as much as you can. I tell them it will take time. It may take finding those with the knowledge necessary. The thing is those people exist and really aren't that hard to find. Once a claim as been decided, denied or given a rating, there are many attorneys more than happy to do all the leg work. Their fees are also set by law. They are limited to 20% of whatever might be due from the date of the original claim to the time the challenge is decided. If you get nothing the lawyer gets nothing. Lawyers don't work for free. So, if a lawyer is will to take on you case you can be almost certain you've got a legitimate winner.
My advise to others is this: Don't wait. Don't accept 'No' for an answer from anyone, especially yourself. If you served, if you suffered as a result, do whatever it takes to get what is due you.. I know what I'm talking about.
most vsos only want to do paperwork and dont want to comment. i caught my vso knowing what i need to put for tdiu but conveniently not saying a thing about it til after the fact. I found it very frustrating.

I was just recently awarded TDIU, permanent and total, with special monthly compensation. This was all due to Hill and Pontons excellent attorneys.
In the award letter sent by the VA it said I have "TDIU, permanent and total". I live in Texas where 100% disabled veterans pay no property taxes. In my county, the "gatekeeper" they have posted at the counter has no idea about TDIU, and says I need to be 100% disabled to be granted this benefit. Of course, I am receiving 100% disability benefit, but this clerk (gatekeeper) at the county tax assessor office has been told, or just assumes, that if the VA letter doesn't say in writing "100%",
that it's not good enough to accept. My Hill and Ponton attorney has graciously sent a letter to the VA requesting the VA send me a letter that spells out that 'TDIU, permanent and total is a 100% disability', so I can get past the roadblock that this gatekeeper has thrown up in front of me. Hopefully I will find that in my mailbox sometime soon! Thank you Hill and Ponton! Y'all are the best ever!

@@TheTotalConcept- after about a month, I did receive a letter from the county stating that they have approved my tax exemption. I was also told that they were going to refund the taxes I had already paid back to the effective date of my TDIU (2 years). But, my Hill & Ponton attorney is appealing the effective date, and we're asking for 2013 effective date. (The date I had a heart attack while I was in the VA hospital for an unrelated issue - (hip replacement).

I had a great DAV representative which helped me all along my compensation journey, as soon as I hit 60 percent he filed for IU ON my behalf, and shortly after that I had a comp examination, and shortly after that I was awarded 100 percent P&T.

You are very lucky as I tried to get DAV to help me and the disability I asked about to them was answered with "you cannot get paid for that" and that was in 2010 and so i went with TVC and lo and behold today I am at 80% with no help from DAV. The thing I asked them about has gone through 2 surgery procedures. You are lucky!
The DAV is my VSO now after hearing about how great they are. That has not been my experience. Their process is as obtuse and black as anything the VA can hand out. I was disappointed in my state VSO. Now just a different disappointment. America loves veterans! Thanks for the heads up H&P. I am finally getting my head around the VA process'.

i think the problem is , is that many lie and abuse the system making it harder for those that really need it .
Might possibly have something to do with everyone and their brother that served 3 years as a cook assistant thinks they deserve 100 disability, and the people that deserve it have to fight the system.
I have fought with the VA for over 50 years. Every single claim I have ever submitted has automatically been denied, last year up hired attorneys to do my claims they requested my records and after reviewing them had told me that the VA rated me only for PTSD and put me in a special category where nothing else gets rated. I am currently rated at 70% for PTSD and they filed a claim for unemployability I just recently got paperwork back from the VA denying that claim. Even though I have 50% hearing loss in both ears which the VA had hearing aids issued for me I have a lower back injury and upper back injury from a rollover accident that I had in the military on duty I have been diagnosed with degenerative cervical disc disease and arthritis in my lower back this causes pain through my hip and down my left leg my right arm is weak and tingles all the time all of those claims were denied. In reading the paper they sent back denied but it gives no reason why. When I first got out of the military the VA was less than helpful to the veterans Lotus down with paperwork that we had no idea how to fill out and there was no help out there to do it. Over the years that has changed and it is a little better. I have had vso's and numerous other people telling me about all the delays that the VA has oh, well I'm here to tell you those delays have been there since the early 70s if anything they have gotten worse. My married life has gone down the tubes I've been separated for nine years and right now I'm on the verge of being on the street again but yet the VA keeps dragging its feet I'm tired of being treated like nobody, the US government had no problem sending me to Vietnam for a year all the while making promises that they would take care of me when I came back so when are they going to start. As I see it now the only thing they are trying to do is trying to get the veteran so frustrated that he gives up oh, this is no longer acceptable
Update finally got my hundred percent since I was 70% already for PTSD they approved the unemployability claim so out of about 15 claims that I had in four different problems that occurred in service they finally approved me as unemployable for PTSD
Jim Thornsbury - Keep your chin up. I've been fighting the VA since 2013. I'm also Vietnam Vet with Ischemic Heart disease. Got to 80% using a VSO. I hired Hill and Ponton after all the years of fighting the VA. I also just turned 75 in May 2022. Make SURE you tell the VA when you turn 75. My TDIU, permanent and total, with special monthly compensation added was approved within two weeks of my 75th birthday. You move to the "top of the pile" of claims at 75 years old.

@@hernandezcordovajanice6140 well I don't consider it Brave but my temper got the best of me and I sat down and decided I'm going to fight them till the day I drop dead I also found out something else too when you hit 100% if you're a California veteran you can go in and file a paper and you get an exemption on the registration for your car I had a lady at DMV tell me that and she even gave me the paper now I just got to take it out and have my doctor sign it that's the only break that I know that the state of California gives us I've got an old 2004 Mercedes that I got at a lien sale and they was trying to charge me $757 just to get it registered and in my name but once I take this paper in I don't pay nothing if you're in a state other than California you might want to check with your DMV and see if they give you a breaks on your registration I know in Nevada they give you a break on your property taxes if you're a veteran
Was awarded back TDIU for over four years. Was already rated 100% and with two very nice back pays plus was awarded SMC.
Folks, I have been referring Veterans to seek the help of Hill and Ponton, P.A. to their website, whenever they have an issue with their Veteran Affairs claims. Neither party on each end of the spectrum do I get paid or get favorable treatments; I just want to help my fellow-Americans for serving their country. I am marine disabled veteran at 90% I have been on state disability since 2018, still havent been able to get my 100% with the va. I have a physical doctor at the va clinic in my county who says I had an accident, he doesnt help at all with him vietnamese. He doesnt help any of his patients that I have talked with. He says the patients are chronic complainers, doctors like this in the va system doesnt help any veteran. Thank you for your video. Stay safe.
I got my Unemployability in 2013 but it wasn't made P&T until my ptsd exam 5 years later in 2018.. remember there's a difference for Unemployability and TDIU.. because you may be paid at 100 per cent but not yet made permanent..that permanent status gives your educational benefits ..

I was denied unemployability for bipolar the VA said I can work in a supervised setting, but gave me 100 percent scheduler non p and t. Go figure. Isn’t every job in a supervised setting lol.
I came home from Desert Storm in 1992, the VA diagnosed me with PTSD but said it was NOT combat related, so they gave me nothing!!!
None combat related or non military related. Many Vets have ratings for non combat related PTSD.

Brother I would have saved you the money. Go to a local Disabled American Veterans they'll help for free its vets helping vets and if you need a lawyer they got you covered. But I hope you see this there are ways to increase it as well. I'll get back to you if you reply.

It took me 3 years appeal after appeal, I went thru Dav, Pav, and 4 others, each advanced it a little then they stopped, went to another organization until it went to the final court of appeals in Washington. 100% PTSD 40% for back injury, USMC 1968 - 1971, You know where I was, keep fighting!!

Individual Unemployability would be my last resort. I would go for 100% p&t. IU limits what you can do. With 100%PT you can work and make as much as you want.

IU depends on an individual. Some people should file for TDIU and others should go for a scheduler rating.

I filed for service connected disability 2 years ago and received 50% PTSD, 50% migraines, 10% Tinnitus, 25% for both knees. I was working at the time but am no longer working and can’t work because of these. I also didn’t file for SSN disability because I didn’t know I could. Waiting now 5 months for the VA to decide if I get the unemployability.

@@nevergiveupfitness4710 Maybe, a good course of action, i would throw in a tdiu claim if not actively working and work the other claims/secondary claims. In fact i would throw migraine and sleep apnea under ptsd as secondaries as that would pretty much already establish service connection.
A 70 percent combined rating permanent and total. With unemployability receive 100 percent comp pay. The rating remains at 70 percent

I am 62 years old and recently awarded TDIU P&T. The VA Nutritionalist put me on a low carb and calorie diet. I was rated 0% for high blood pressure which may improve which is good but the secondary conditions caused by BP are service connected and static. Should I be concerned about a VA reevaluation.
The issue I have run into being rated at 70% for PTSD, I am currently employed, but I have a letter from my General Manager breaking down the daily issues that he and the other employees have to endure and how it is not a good environment for anyone when I am there, but I maintain the job even through the struggle and he keeps me there all because I don't want my family to be homeless and neither does he because he is compassionate towards veterans. This is the reason I have been denied over and over again. Should I let my family be homeless? Should I end up in prison? Is this what they want? VA system is so broken. They REALLY DONT take a look at the VETERAN individually.
In the same boat as you man, I’m about 2 no’s away from eating the barrel of my 45 and blowing my brains out in the lobby of my hometown VA with a sign around my neck telling them this could’ve been avoided.
@@sporillasanchez1648 please, don't do that. Get some help. Then, open up an IU claim due to your PTSD. My husband walked out of his job due to his PTSD in 2018. He opened a new claim for PTSD (he was 50%). He took the paperwork (when you open a claim online on ebenefits in 2018, it provided paperwork to fill out by your doctor) to his counselor and they wrote he can't hold a job due to his PTSD. He filled out the IU paperwork as well and submitted both claims at the same time. His PTSD was raised and IU was granted. Don't be discourage. He had two claims opened at the same time in 2018. The second was PTSD. They closed it along with the first claim without acknowledging the PTSD claim. He opened an intent to file in Nov 2018. When he went to submit his intent to file the week prior to the deadline (it took 1 1/2 yr to get his medical records from the VA. He received it the month prior), the intent to file was gone. In Feb 2020, he opened another intent to file. In Jul 2020, was when he submitted both claims (to include the paperwork the counselor filled out in 2018). In Feb 2021, both claims we granted, PTSD was raised and IU put him at 100% permanent (IU is normally temporary). You might want to try a weighted blanket for PTSD. I use a weighted blanket to sleep and has helped me stay asleep and ideations decreased by about 80-90%. It was 100% for about 6 months. Good luck!
You file for 100% rating based on unemployability. I think that you must leave this job first, or see if they can let you go. Once that happens you need some documentation of the things you said in your statement above. And you having co-workers that are witnesses gives you a good case. Having an attorney like the ones in this video would get you a win, in my opinion.

Hi I originally filed for disability through the VA in 1991 when I was living at the VA in the homeless domiciliaries. They instantly denied my disability and sent me on my then in 2012 I got raided 20% . Then I received 80=100% unemployability in 2015. My lawyer filed a
CUE motion. That they have acknowledged. And is going through the whole VA system as we speak it's been 4years sofar.
if they find it they did make the mistake by not doing the due diligence in the 90s. Doesn't that mean they show me retro pay all the way to 1991 To 2012 my original approval of 20% that in then was bumped up to 100%.

I received 20% for hearing with service related cause. Then went for agent orange exposure when the cancers started. Arms, melonma on my back, and finally prostate cancer surgery. I received 60% for cancer, combined 20% and 60% = 80% by any third garden arithmetic. Ended up with 70%. My vso had me apply for unemployability. Hard to work when you spend the day cleaning the piss that runs down your leg. I now receive 100% on an 70% claim. Took 3 years, the best advice I can give any vet, get a vso that knows their job or a attorney and don't give up.
My husband has PTSD and was working had to go out for knee surgery and since that surgery he can’t get job back at warehouse due to his knee surgery he’s been out of work for 1yr now and his PTSD is worse VA has denied employability

My question: I'm currently rated at 70% for major depression and 10% tinnitus. I work as a substitute teacher and do not pay into social security. How would this work for TDIU? I don't know if others would have this same question, but it's something I'm curious about now.

Great content! I am 100% disabled due to a surgery mishap on a bulging disc at the C-5. I am currently classified as a SCI C-5 ASIA C Incomplete Tetraplegic. I also am also classified as unemployability. However, I did not get classified as permanent and totally disabled but believe I should have been. I was also told that I am only getting about two thirds pay because I should be rated as a R-1 or R-2 (which ever is higher). I tried to find info on the R-1 or R-2 ratings but could not find them. Can you help me figure out how I can get this fixed?
I am currently collecting Disability Social Security and have a combined 90% rating from VA Disability. I realize at 39:59, there's discussion about Veterans who receive both Disabilities and it's fine. But just double and even triple checking that my Social Security Disability is NOT at risk for reduction (even though I may collect both) if I apply for TDIU (Total Disability Individual Unemployability) 100% with the VA. Does the SSA take into account my income from the VA? Currently my SS Disability isn't affected by my VA Disability but am concerned if I convert to 100% TDIU, it may reduce my SS Disability. Im currently going through the process of getting my rating increased. Im at 50% right now for one disability. Im not receiving anything for PTSD, DEPRESSION, ANXIETY, HEARING LOSS IN LEFT EAR, and Vision. Until the accident, I had excellent vision. Now wear glasses and eyes are light sensitive. Haven't been able to keep a job since 2009. I'm hoping I will get rated enough to bring me to 70% which I'll then try for unemployable. My VA psychiatrist is on my side. Have already made 2 of the 3 Dr appointment they have scheduled me. I can only hope.

I am confused as to why people have such a hard time getting rated by the v.a. it took me less than 30 days to get my rating of 90 % after I was discharged and they automatically jumped it up too 100 percent under individual unemployability . plus they added in the housebound rating .
Wow! I was rated a combined 90% with 70% PTSD in 2018. I just applied for Individual Unemployability and I am scheduled for my C&P on Wednesday. It certainly was not automatically. I have not worked since 2014.😒
@@KaribeCuebas Maria I am not 100 % up on va law but I think mine might be a little different than most cases thst and we hear about on these post . As a navy corpsman with 17 years in I knew I was screwed . When I woke up in Germany and not Iraq. The medical board at Portsmouth naval hospital gave me a 90 percent rating when I was separated and as soon as I filed with the v.a. they bounced it to 100 percent and added in the housebound rating. The director of the Hampton v.a. center told me that I may not have my legs and only 1 arm but they would always take care of me and I have to say that they have lived up to that promise he made that day. The v.a. paid to have my house redone so I could get around in my chair and they also paid to have a van I purchased refitted with a lift and all the hand controls so I could drive.

This is why I have you guy's. Mathew put me in for 100% unemployability right off the bat. I was told it would take approximately 3 to 5 years. The 8 th of April this year in a few days it will be 5. I read a rule that the benefit of the doubt always goes to the veteran. I'm totally disabled and was put on S.S. disability in 1998. I had a dream job making $157.000 a year. Believe me I would rather be working. I will only get a fraction of my salary for waiting 5 years. 😢

Early on it was you can work. Now they say I’m too old. Either way I was screwed. I got mine to 70% but was told I’d never get higher. So I lost my teeth. If you have had a rating for longer than 5 years it can not go down
Get depression or anxiety connected as a secondary condition to you physical condition. Find a psychiatrist who can connect the two, make sure he provides the DBQ and nexus letter. After you submit your paperwork contact the VA and request that they do not contact you for any C&P exams. It took 2 months and my anxiety was approved at 100% (connected to my tinnitus) in under 2 months
@@MrBundy15 I have been getting tests done for my stomach problems and they found out it was all stress now I take 8 pills a day for anxiety this Tuesday I have my exam for depression linked as a secondary disability. I’m confident after talking to some people that I will go from 80% to 100% after this however I will keep you guys updated. As this is all happening now.

30% disabled due to a knee surgery I got before I EAS’d. I have anxiety, “symptoms of PTSD”, depression, and at this point, I’m sure other things that haven’t been uncovered. Every time I walk into the VA, the sheer level of convoluted hoops to jump through makes me unable to accurately focus on filing or finishing claims for things. I don’t have a clue where to begin, and I’m in a financial situation that makes time my enemy. I don’t know what to do.
Every time “time” gets brought up in the video, I get more and more worried about how I can even begin to proceed. I already know it’s my fault for allowing my anxiety to prevent me from even going to the hospital. These hoops and timeframes are just worsening my mental state. (TMI for a TH-cam comment but it is what it is)
Have you worked with a VSO - Veterans Services Officer, usually from your county? They offer their service free or charge. Working the VA circus by yourself is not advisable as the system is rigged for you to give up. My VSO filed everything for me. He used to be with the VA and was the person who rec'd the Disability applications so he knows the proper verbiage to put on the paperwork. The first level of reviewers are trained just to look for specific keywords and if they don't find it your application gets rejected. It took me 3 years to get the full monty resolved but they retro pay you. Believe me, persistence pays. Good luck.
I've been trying to increase my benefits for hearing loss down in the boiler plants. Watched one do a dance for us, 1200lb boilers usually blow up then. Thank my heavenly father for not letting that happen, but still remember it like it happened. Tried getting a boiler job, but get to nervous around them, affraid of them, dreams wake me a lot about it finishing me off. These things are as big as some houses. The asbestos fright came about 2 weeks before my discharge, space suits and all. I served from 76 - 80 active. Have never been able to hold a job for long, now on SSDI and 10% tinnitus. Living at poverty level sucks. Oh another issue that keeps plaguing me is when I was almost thrown overboard out at sea during a test refueling exercise from an aircraft carrier. They needed extra hands to help seat the fuel connector, and of course they called on B-division. I didn't hear the call to let go of the rope, would've been a good video of man playing superman. Flew thru air, then a high speed tumble across the deck. If I didn't open my arms wide, I'd have been shark bait, have regular night and daymares of that too. But when I menttion them incidents, they just get blown off. I sometimes get mad at God for saving me, it's a groundhog day thing, it won't leave me. Now to top it off, my breathing has been getting worse. King of like being tortured, slowly. Haven't got the evidence in order to get PTSD and the VA doesn't seem to give a damn. Too much paperwork, just boggles my mind.????
Great video!!! I am curious on yall's interpretation on a specific issue. A veteran cannot work any longer because he has bad knees and a back back. He meets the minimum requirement of the 70% because his knees are secondary to his back and he also has lower extremity radiculopathy. Is the law clear about the veteran not needing to find another job that he could do such as sedentary work. The base question for this scenario is: can the veteran get IU because he cannot work at his chosen career due to his service connected disabilities?

You can get 100% based on unemployability. That 70% rating already there is exactly what you need and get the rest for unemployability.

My VSO just got me approved for TDIU after getting 70 percent for PTSD. Which makes sense seeing as I've been on social security disability since 2016 for the same reason. I've been reaching out to the VA on my own for YEARS now, and have even had to call the crisis line a time or two when things got more rough than I thought I could handle.
Now, I'm glad I'm finally being taken care of, but in all honesty I should be getting a giant backed check dating back to discharge. Oh well... I suppose I need to see that no matter how badly I was screwed, I'm still more fortunate than many others that have come before me. I suppose... I'm sure my kids would beg the differ lol.

Have you asked about a Veterans advocate? This is someone who works for the VA to assist veterans who apply for SSDI.
I have heard that social security administration is a lot quicker to approve applicants for SSDI if the veteran has an attorney or VA advocate assisting them.
I had one and I had zero issues getting approved.
Contact your local Veterans Service Officer and ask them about it. If you feel that VSO is not a good one, ho to a different one or contact your Regional Office. Good luck

I am in that process right now, as well. I am on TDIU, and starting the process for SSDI.
The way I have come to understand it, SSDI deny everyone on the first round, automatically and no matter what. Then you start the appeals process, and during the appeals process, your VA disability rating comes into evidence.
There are attorneys in every town that handle this stuff for a living. Get one. They charge you nothing up front, nothing if they lose, and just a small percentage of your back pay if you win. No point in you trying to guess your way through it. They know the game better than you or I ever will.
So sad , had to go to different lawyers in which they took me right away and you didn’t want to bother, they helped me tremendously

I was recently denied TDIU. The C&P examiner said I could find a sit-down job. I told her I'm not trained for any sit-down jobs. I was a medic and operating room tech. After that, I went into electronics and computers where my jobs demanded that I be on my feet all night and lots of walking. My smartwatch showed from 10,000 to 14,000 steps a night. I can't even stand up for 10 minutes. I did get one of my knees changed from 10% to 30%, but it didn't change my total compensation.

I've been waiting a very very long time for just a court date. I got a paper saying we received your paperwork and will let you know a court date, that was well over a year ago
I am rated at 90% and my TDIU claim plus additional Service Connected disabilities is deferred out to December after filing my claim last December. Every disability is well documented in my military medical records and diagnosed by the VA health care system. My claim remains stalled by endless additional information requests by the VA. As soon as I provide the requested documentation another request is made further pushing out the claim. This has happened several times. The problem is because my disabilities are linked to tactical herbicide and chemical exposures verified by thousands of pages of documentation and military environmental studies but are still outside presumed dates and locations for South Korea. This can take forever when there is a controversial factor involved.

I am at 100% V.A. disability with a priority group (1) - Unemployability), which allowed me to get military I.D. for my wife & I, to utilize medical facilities through the military, as well as having all the same privileges as a military retiree.
I am retired from the Justice Dept., so I received both my retirement & V.A. disability with no interruption. I have not used the military benefits, since I still have my medical insurance through Justice Dept (private practice). All the benefits I am eligible for were told to me by the V.A., when I was given my 100% disability years ago.

Hello I have a 50% rating for PTSD combat related, 50% for obstructive sleep apnea and 10% for a right rotator cuff strain. Everything equals to 80% disability. Should I try to get the PTSD increased before going for TDIU for unemployability?

My path was rocky! I was not aware that I had neuropathy my original claim was denied because it was not filed with in one year of returning from Vietnam from agent orange exposure. I went to woods and woods and theVA kept rejecting my claim with different reasons. Finally I was rated at 100% and not able to work. They never stated anything about agent orange even though my exposure was very high in Danang when working in the open. This was a terrible!

Keep reevaluating your claim and trying to add things on so you can get a 100% rating without TDIU. Then you can work again
You can do volunteer work at any veteran organizations like American legion,DAV,NABVETS, or others.

Wonder if i can increase my rating a bit to include TBI since i was Field Artillery 🤔.
Im at 90% and to get an 100% is so hard. I files for unemployability and was denied. I filed and appeal and then I got it.
I got unemploymenability, and having been on it for going on 3-4 years now, at a younger age (I'm 26 now), it can be both a blessing and a curse, as I can't work a regular job anymore do to this rating. I wish the best of luck to anyone seeking this type of filling though, as many people could use this.

@@clintondrummond4301 you can work as long as you’re under the marginal income which is like 12,000 ish. Same rule that applies if you apply for TDIU while you’re working.
All veterans need help because the VA will not help you or comply unless made to do so. . Keep up the good work

@@jjarcast well you've been lucky then because I've been all over the country at different VAs and I always have problems with doctors etc etc. Your individual situation doesn't cancel out the obvious problems with the VA. You think 23 veterans are committing suicide due to combat ptsd ?
I am IU total and permanent, can I apply for Social security benefits when I turn 62?
Yes, 6 months before you turn 62. you will be applying for social security retirement. you can also apply for SSDI to give you your full disability at the same time. The amount that will receive will be what you would get when you turn Full Retirement age (66+). And when you turn your full Retirement age (66+) it will become your regular Retirement amount of the full amount.

Be prepared to give ssa all your VA and civilian medical records.
Yes but then you CANT WORK AT ALL, even part time, or you will lose SS benefits and create a mess. You can still work part time with VA TDIU but not over poverty threshold for your household size
@@mattnorcia5593 I am fairly sure you are mistaken. What i have read, on V.A.; i can make a million a year and not effect my V.A. If you report your income to SSA, most of the time, they just take dollar for dollar unless you make too much.

So, if I was blown the hell up 15 times..thrown in the air by a couple rockets and and and blah blah..4 years of serious death and contact every week minimum...AS an Arabic linguist for the U.S army..then I joined the army...and almost three years in..my heart and body started acting up and couldn't finish my 3 years..and never worked a job since I got affected...palpitations, daily chronic headaches, neck pain, weakness in legs..dizziness and breathing problems and just can't sleep my nights at all..IBS and Gerd...what do you call that ? I can't work PERIOD..I CAN'T BE AROUND PEOPLE MORE THAN 2 HOURS...I feel I wanna pass out and can't look the hell straight at them.....and the Social security denied me a disability and benefits ...what's that called????

I am just physically sick and yet the diagnosis is not serious as the hospitals yes HOSPITALS say....I see disabled ppl evey few days and I can't do 1/4th of they can do.

CHRONIC PTSD ( FROM REAL WAR ).
G.A.D.
CHRONIC IBS.
CHRONIC SINUS.
CHRONIC GERD.
INDUCED ASTHMA. AND NOW ALL MY JOINTS HURT..MY RIGHT ARM GET STIFF AND MY HANDS, FEET AND BACK HURT.
SOMETIMES I CANT USE MY HANDS....AND I AM ONLY 35 ...LIKE WHAT THE HELL.....ALL OF THIS AND IT IS NOT A DISABILITY?!!!???!!!!

Tough situation, but if they can argue that your conditions were pre- existing your actually joining the army (I’m guessing your were making some serious contractor fees during your linguist time), which is nothing against you, but they look at service connection. Meaning it happened to you in your officially sworn in military time. This may be the challenge you are hitting. I have no good answer or you. I hope these folks can help you.

I believe they can not argue that I had pre exisiting conditions before joining the army due to army(peers) witnesses were with me in Iraq and saw how I roll and take care of everything and anything at anytime, all the problems started when I switched branches from National Guards to reserves to get a Job in an active duty slot ( 35 Papa )..I was placed in a homeless shelter by SFC. Davenport while in the service waiting on a O.K from a CSM to live in one of the 10 thousand empty rooms on a PA base. The shelter manager advised me to call the news as she was told by SFC. We just need you to keep him here for three days and we will get him as he is an asset to us and one of our own..then I was stuck there for 6 months..I called the news (Fox five ) I was given some name from Aljazeera English channel to call and do an interview. I said no..then I caught the palpitations very bad and things just went down hill for me health wise.
About my interpretation/linguist work sir. No, I was not making even minimum wage as compared to any N.J cheap worker (USD 7.25). It was them U.S D.O.D linguists who used to make 12 K or 8 K and even 25K a month..and when things get real, they fail and the Battalion commander and CSM. Used to call me to fix their mess and take charge of sensitive meetings, interrogations , propaganda input...
Etc.
On paper my salary was 5K a month. But the TICKS at Global Linguist solutions, L3 Communications and Titan services Used to cut 4 K and pay us 950 USD a month 😂.
While most U.S D.O.Des ( Arabic and Iraqies as well ) cannot do 1/10 of what I used to do and the proof was many many missions/ raids and meetings the U.S. army higher ups refuse to take anyone else on a mission but me.
I honestly don't have any Interest in even applying for the benefits because I am just very tired inside ....I have accepted All my losses and I pray to the lord to somehow fix me and grant me peace and relief from all or some of my daily multiple pain.

Recon 19 Delta - no, nothing in appropriate in your reply. You are getting/were getting screwed. I urge you to get in touch with these folks who put this together or a similar advocate. These attorneys are looking to make a cut, but in the end, you will win out if they can get your SC for the things that you have started experiencing since joining. You have spent enough time around the military to know that sometimes the enemy is wearing the same uniform you are. But it isn’t everybody. Hopefully there are some goof people who will help back you up. Very wrong that you were screwed out of most of the money you should have been making as a contractor. If you have been overseas since you officially joined and saw any hostile action, with any luck this can be done. Keep in mind that they love to cite pre-existing condition when they deny you SC. While your job was anything but a job, to the VA you were working at a convenience store prior to swearing into the military. That is the day your experiences and health start counting. Part of what these organizations count on is wearing you down. Which isn’t that hard because when you are suffering from PTSD/Depression, you already worn down. I do hope you can get assistance. But if you are screwed, the only solace I can offer is that you are far from alone, and some things get easier over time.
Recon 19 Delta - I just re-read your reply. If you were in Iraq with the NG as a sworn in soldier, then you need to get help to fight for your benefits from the VA. SSD - honestly, I know tons of people who are 100% per the VA system who get denied by SSA for disability. It makes no sense whatsoever. Either way, if you have been not making any progress with what you have been doing for 8 years, you need better advocacy. THere are several youtube groups I’ve seen who are about getting the most out of your VA claim. Find someone who can work with you. I just sincerely hope you have a service ribbon from Iraq or Syria for your enlisted time. You are likely an honest and upright person who tries to do the right thing. Dealing with the VA and sometimes the military requires a mindset shift to down and dirty. This probably isn’t how you think, so nothing like an attorney or other person who is comfortable with down and dirty to pick up the fight for you. The other catch you are fighting is that the injuries/illnesses sustained must have occurred when you are on active duty. It looks like you were NG and tried to go AD with the Reserves. Again, I wish you the best.
I received a 10% for Tinnitus, 30% for PTSD in 2016 and within the past month 40% For depression (all service connected). I filed a 8940 form but am thinking that I should also submit for a increase for PTSD. I would appreciate knowing if I am on the right track or not. Thanks

No the va hates veterans
No, but you may be able to receive other things such as SSDI. Individual unemployability is only granted if a Veteran has proven they cant work but do not qualify for a 100% rating on their own. Another thing to look at if you are already at the 100 percent rating is do you have Chapter 35 DEA, also known as permanent and total, eligibility.
@@heathercox2930 I'm rated at 100% permanent and total disability and tried to get SSDI and the Dr that did me said I'm too young and boom they denied me.
i have that 100%, what i want to know is if will they try to take my benefits if i apply for what they wont give a rating to or cover ie a back injury. or at least are there circumstances that might damage a claim for drawing both at the same time?

If you mean to work again then it will be temporary, soon as you report back to the workforce you will pay back to VA what you received from them after the date of the new employment.
You can still work while having individual unemployability. You just cannot make above the annual poverty amount.

You can look up what the poverty amount is for your family size. You cannot make over that with IU.

@@Peakfreud I worked at the national call center. It’s just like SSDI. You can also file a claim for SSDI if you are IU. You can still work too but cannot receive more than what the poverty level is for your household.
I've got several service connected issues. They add up to 130% service connected disabled. The VAs math adds this up to 90% 🤔🤔🤔
I have one claim still pending and its come to a screeching halt due to this bogus Rona crap! My VSO seems to think if the claim gets approved, the VA math will add up to 100%.
