Rera is a toothless tiger. It does not have any proper mechanism for execution of order. Rera gives extensions at will to builders. My flat possession date was 2017 in Clancity project but to buyers shock builder was given an extension by 5 years till 2021 then further extension due to Covid, Now Rera has again given extension till March, 2024. Booked in 2010 but still Rera has given extension after extension to the builder, even though the builder has stopped work at site since last 7 years. Builders office and site office are closed. Useless body for buyers, atleast the consumer court is/was a better option but then the court takes its own sweet time in giving relief. Poor buyers are always the sufferers. Govt. is providing housing for all under poverty line citizens but poor middle class buyers who have put their life savings for a shelter to his family, does not get remedies easily even after paying 97% of consideration, bank interest and high legal fees to lawyers. Getting justice is difficult for hapless and troubled flat buyers in our country.

Most of the buyers are not in a position to fight might of the builder. It is also known that local authorities and local politician are connivance. The penalty clause should be a default provision and in case builder does not pay compensation voluntarily, he should be liable for double penalty and his new projects should not be approved for three years.
What if there is a force majeaur clause which only talks of no compensation to be given on happening of such events and does not include any extension phrase and simultaneously there is also a sunset clause which states automatic termination of contract after specific period and that too expressly is not subject to either force majeaur clause or any grace period. Then in that case will the contract automatically terminate or extension can be given? And can the judiciary rewrite the contract to include extension phrase?
I booked a flat in Dec 2019 under Kolte patil life republic, the rera date was 31 Dec 2023 along with same agreement date. They extended it 31 Dec 2024. Still waiting for the flat. Paying rent along with EMI is getting difficult.

Hello Sir, There’s no grace period mentioned in my Agreement with the Builder. The Possession date was 30th September 2023 and now it’s already over 4 months delayed. Can I ask for compensation or should I consider additional 6 months grace. The building has got Occupancy certificate in the month of Oct 2023. According to builder the possession is getting delayed due to pending work from MSEB to provide Electrical supply. Please guide

Punjab rera is most dormant and seems to be hand in glove with builders lobby. In Punjab, especially in mohali... Many fraud developers have launched the projects as pre launch... Though they do not have the registration of land... They have no approvals, but demand 25 percent to 50 percent of the payment before rera... Thus people have to raise the voice... And i request you sir to cover the Punjab Rera reluctant attitude. .

I bought a flat from Godrej Properties, with a RERA date of 15 Jul, 2022. They had 2 extensions, and their last extension expired in Jan 24, and they are no longer able to get an extension. I have paid 90% of the instalments, with the last being a month ago. Is the interest due from 15 Jul 2022? Is it calculated on pro-rata basis, in a construction linked plan? Also, I am wondering, can we claim the interest after we have have the possession, so the fight with the builder doesnt impact the actual possession?

Sir in our case in agreement date was completion date 2021 but builder took extension till june 2023, still not giving possession giving reason that they have applied for electricity meter and it is pending from authorities...! I read carefully agreement...there was an exception clause for penal interest if electricity permission is pending....should i go in rera n complaint or due to mentioning exception clause they are safe...!

The builder is saying they have documents of RERA extension and they will share those documents only after I pay remaining booking amount of 1 lakh, but on RERA website its not showing. Writ petition before the High court to challenge the extension. Also the extension doesn't excuse the agreement terms

Simply, bank should waive off the emi if the extension is granted and builder is not paying the penalty....

Check what is written in your agreement. Builder is most unlikely to deliberately write a date prior to RERA completion date.
Rera is there for extension, not ensuring fund utlilization is correct, adherance to contract terms and Rera is for builders generally

Then "reasonable period" i.e. 3 to 5 years from the date of your registration is to be deemed as your possession date.
