This is so true. I filed for a claim that literally ended my time of service before my separation date. I was in a near fatal car accident while on duty. I went to numerous specialist, chiropractors you name it until I was kicked out. I filed a claim for the condition in 2002 and I was denied, filed again same result, I appealed the decision until they told me I needed more evidence. The case had closed and finally I reopened the claim in 2014 and it's been on appeal every since and finally last Monday I had my 1st C&P exam for the condition and the examiner was flabbergasted about why I was never service connected and why it took over 20 years to get a C&P exam.
I had to have 5 feet of small intestine removed (a result of a long going issue while I was on active duty,) and they can't seem to find any record of it happening. Convenient
The PACT Act has failed me miserably. Congress may have had good intentions but once the process goes to the inept bureaucrats with personal agendas you can forget about it. I also suspect that the Evidence Intake Center in Janesville, WI will not always relay your evidence to the examiner in the VA Regional Office who is actually reviewing and adjudicating your case. This is especially true when you mail your evidence instead of sending it electronically. Not everyone has a scanner. When the VA case status is stale and keeps asking you for the same evidence that you have sent them several times it's suggestive that a Janesville Intake Center employee was just too lazy to convert your mailed material to electronic form to send it forward. God, who can save us from this monster! 
I experienced this failure to assist problem last month, the C&P exam was supposed to be a Shoulder Secondary to Cervical exam and it was a stand alone Shoulder C&P exam even though there was nothing in the records for the shoulder. How do I counter their error when it comes back?
Congratulations! You found out actually what happened to me! Failure to duty to assist was found at the Higher level review. In my case, the VA contracted Reviewer Ignored the CMP Examiner who agreed with me, and an independent medical exam by my doctor.

Attorneys - I had to get ALL medical records and submit claim. VA never assisted...
