I had an informal conference just a few days ago. The guy I spoke with seemed to be really helpful and friendly. He said all the right things but he seemed rushed. I barely had enough time to explain my side. He said it would take about a week to make a decision. My claim is for a pretty obvious injury on duty. Wow ok so I thought I was going to file a higher level review with new and more evidence like buddy letters and medical imaging plus doctors notes not in appeal ? So if I can’t ad evidence and I already filed a review what is my options to ad evidence and re submit?
Although there is no new evidence allowed for a Higher Level Review, my HLR is due to an examiner lowering my rating from 70% to 50% that also affected my TDIU claim that was part of the C&P exam. Now, I'm at 90% of the same conditions that were originally lowered (I hope that makes sense). You know if the VA will take into consideration these last two C&P exams that were raised from the lower rating that are the same my HLR pertains to? Meaning, although the one examiner lowered my rating, stating I "improved" only to see two examiners afterward (two different C&P examins) that acknowledged with evidence my conditions are worse?
When you appealed did they give you new C&P exams? I had a similar thing happen to my most recent claim. They tried to say my condition improved. I also applied for I.U.
My HLR definitely helped me with my claim. My HLR reversed all my claims that got denied. It's an excellent way to help❤
How long did it take for decision?
My HLR worked for me. I got approved for tdiu in November 2023 after being denied in January 2023. 100 p&t
I always want an in person hearing for any denial, and I have never lost a case in a hearing...

It's just amazing how long hlrs take. It's been a year for me no decision. It's baffling why it would take this long.
I did a hlr and the hlr said the Va is correcting an error letter in March/2023. I’m still waiting. Is there a time limit?
Me too, Mine was filed around July 2023, still waiting. Lawyer spelled everything out too. Still takes to much time.
i files mines in march 2023, duty to assist error identified june 2023, new c&p examine in august 2023, and no movement since.

I am 50 to 100% at this time but I have other questions about how to get compassion for other issues

do a supplemental claim. higher level reviews only look at evidence the VA already has. You can file for an increase that way.
About how long after your informal conference can you expect some sort of decision? It’s been weeks for me.

Can you submit your points in a statement ( no new evidence) and upload it?
I put mine in January, my claim says VA is correcting an error "2 compensation issues" any advice on what happens next?

all my hlrs have been denied now going to a judge
