    To be fair, the original A.A. Milne Pooh did actually wear a red sleeveless vest that is held together by a single button, but he only wore it in the winter, when out in the snow. You see him wearing it in the third chapter of Winnie-the-Pooh, as well as the first chapter of the House at Pooh Corner. Disney basically just took the red sleeveless vest from the books, turned it into a red t-shirt, and just had him wear it all year round, indoors and outdoors.

      The original illustrations by E.H Shepard were in black and white. Before Milne's death in 1961, he consented to the rights being used by a handful of people, including a man named Stephen Slesinger, and it was he who gave Pooh his iconic red shirt in the first-ever colour illustration of the characters on a 1932 vinyl cover. When adapting for film in 1966, Disney of course used the red shirt. In 1973, when a new edition of the original book with colour illustrations by E.H. Shepard, he also coloured the vest red, as you say. And yes, pretty sure that design is still copyrighted by Disney although technically they didn't create it.

      @@robbiewalker2831 it would be a trademark not a copyright. So Pooh in that specific red shirt would be out, but a lot could still be out depending on what trademarks disney still has over Pooh

    Finally, we got Winnie the pooh in the public domain! It's also a great opportunity for other studios like Warner Brothers to make their own version of the character! I wondering, what other studios versions of Winnie the pooh is going to be great?

      I'm not so sure we are going to see other movie studios releasing movies about the Pooh for a long time. The reason is that Disney has trademarked this character in all kinds of ways, and trademarks don't expire as long as they are being actively used. I checked a trademark registration database and discovered that Disney has even obtained trademarks for "Winnie the Pooh" which cover "motion picture films in the nature of adventure and comedy" and "computer game programs and computer software, featuring children's educational software, music and stories." That is going to make it really difficult for anyone other than Disney to release their own commercial movies, games or merchandise featuring the Pooh.

      @@gachagav_gc yeah. It got ported to mobile and is being ported to console. They had to remove all the copyrighted assets for these versions though.

    Although Winnie the Pooh is now a public domain, it is still remembered that the trademark of Winnie the Pooh still belongs to Disney, which once acquired the rights to Pooh in the 1960s and in every year they renewed those rights. In other words, even though Winnie the Pooh could now be used freely, only in theory, it is still controlled by a giant company who fears that its trademark and one income source will be threatened.

    ACTUALLY, fun fact, there is one illustration in A. A. Milne's book of Pooh wearing the red shirt, meaning the red shirt is also part of A. A. Milne's version of Pooh and not exclusive to the Disney version. Also, wonder how many people know that Pooh's real name is actually Edward Bear.

      Well technically we'd have to wait for that specific book that had that specific illustration to go into the public domain, and we'd need to make sure we were drawing it based on that drawing and not the Disney one

      @@SourBoy Yep, that colour edition of the book didn't come out until after the first Pooh Disney film. Though the red shirt Pooh first popped up in merchandise in 1932, before Disney owned the rights, we'd either still have to wait for that to become public domain or it's likely that Disney already owns the very concept of Pooh wearing a red shirt nonetheless because it's so ridiculously iconic. Just by seeing the colours yellow, red, yellow, almost anyone would equate it with Winnie the Pooh :)

    To say that this is big news would be a MASSIVE understatement; I didn't think any of us would live to see the day where Pooh would enter the public domain, but I guess anything's possible in this day and age.
    Remember folks, it's the original version of Pooh that's now free to use, NOT Disney's version. Just don't give him the iconic red shirt and you should be fine.

      That's one thing that I find particularly interesting; the idea that the "red shirt Pooh" can be claimed by Disney but not the classic pre-Disney era one. I'd imagine that Disney's argument in claiming ownership over "red shirt Pooh" would naturally have to center around the fact that it's a derivative work of the original, so why wouldn't the public be allowed to use a character that's a reiteration of one that's in the public domain?
      If I make a Winnie the Pooh cartoon where he's wearing a top hat and a eye monocle, could I sue people if they try to make money off of this Winnie the Pooh caricature I invented?

    A reminder that the original design of Oswald the Lucky Rabbit is also soon to be public domain. Also, one of Disney’s lesser known characters, Julius the Cat, is public domain since the first short will be 100 years old this year.

      True. Many people forget or aren't aware of Oswald's significance, but if it weren't for him, Mickey Mouse probably wouldn't exist as it was when Disney lost the rights to Oswald to Universal, that that was what forced and inspired him to create Mickey Mouse in the first place!

      He still is theirs.. They own everything winnie the pooh from 1926 onwards... The only book that has entered the public domain is part 1 of 2 as Part 2 was released in 1928 and introduced Tiger... Disney still own everything and all rights to the character from 1926 onwards...

    An odd thing I'm still wondering about, is when a cartoon enters the public domain, yet stars a character whose copyright is still actively being refreshed and updated, like Bugs Bunny, Daffy Duck, Porky Pig, Woody Woodpecker, Mickey Mouse, Popeye, etc. Obviously the cartoon itself would be in the public domain, but if it were used in a major way (like that brief clip of "Bimbo's Initiation" in The Wrath of the Spider Queen), would there be legal trouble regarding the still-apparent presence of a character whose copyright hasn't yet expired?

      @@FinnManusia Mickey Mouse won’t really enter the public domain, not the one with red shorts, you still have to get through trademark and everything, you can make a Mouse with a black and white color scheme and make him be the captain of a steamboat and be bullied by a cat-like creature, but you can’t call him Mickey Mouse. It’s also like how Oswald has been in the public the main since the ’50s, but you can’t make a character that’s a rabbit with blue shorts and call him “the Lucky rabbit”. All this legal mumbo-jumbo also lead to “the great Gatsby” being in the public domain 20 years later than when it should have been originally.

    I had to give a presentation in my media law class last year about copyright infringement, and I added the situation with "Winnie-the-Pooh". I obviously added the "Blood and Honey" part of the entire situation as an example to to what happens for when copyright expired, but I also added that the Disney Pooh had a copyright of his own, so I was like, "if you want to use Winnie-the-Pooh for something, don't give him a red shirt!"

    Si if we use the book version, are the other characters like Piglet, Tigger, Rabbit, Christopher Robin ect owned by the public domain too?
    Also does this mean we can switch things like Pooh wearing a blue or green shirt instead of red, or no?
    Someone please let me know

      all the characters from the first book are free. i don't know if piglet, tiger etc. are there
      basically disney only owns the red shirt version of Pooh now. any other version is free. if you come up with a new version of Pooh, you own that version, the same way disney owns the red shirt version.

      @@aresgood1 Pooh wearing the red shirt did actually appear briefly in A. A Milne's version too though, before Disney, though I think it was only in one picture. Can't remember if it was in the first or second book though.

      Christopher Robin was a real person though, the author's son, so saying he's either in public domain or belongs to Disney feels kinda odd.

    Along with not being able to use Pooh’s “red shirt” design, you also won’t be able to do things like re-upload the cartoons with him in it as those are also owned by Disney.

    Ok so when I was young, about 6 or 7, I had this game idea for the ultimate game crossover. It was a Mario 64 collectathon with the first world being the Hundred Arce Woods. Don't remember a lot of the idea but my brother hated the concept because well it wasn't original. So today, when I learned about this, I went to me brother and him about this. Overall it's like a dream come true I didn't know I wanted nor thought about for over 13 I think.

      Yeah, I remember, but it wasn't until the 20 year copyright extension had already become law in 1998 that I first heard about it. That was before social media existed, so there wasn't much ability at the time to organize any kind of online campaign. Back then, the main resistance to the copyright extension bill came from people like academics and librarians, because the general public was not looped in to what was happening in Congress and they didn't find out until media outlets finally said something _after_ it was already law. At least this time if Disney tries to push another copyright extension, social media could be used to organize protests and a letter writing campaign to our politicians long before any proposed extension can become law.

    I remember when I was a toddler I really liked Winnie the Pooh and go to the ride at Disneyland. I like how the original Winnie the Pooh is now in public domain. However, the Disney variation isn’t, since that version is trademarked not copyrighted. The original one didn’t wear a red shirt.

    Pooh is my childhood. My dad used to read his copies of the Pooh stories to me and my sister. Plus I loved the Disney shows about Pooh. and I saw some of the Pooh films.

      You'll have to wait till 2024 to use Tigger as he did appear in the original Winnie The Pooh book, but in another one in 1928, which will lose its copyright in 2024.

    Winnie the Pooh has been my most purest form of childhood entertainment since I first got its DVD at the age of 6, and I still love it to this day. There’s no hidden meaning, no adult humor, no political or overbearing reality checks. It’s just about the wholesome adventures of a clumsy yellow bear and his adorable friends.
