  • California’s largest business and labor groups have recently come together to strike a deal on one of the most controversial laws in California: the Private Attorney General Act, also known as PAGA.
    "Attorneys fighting with companies, companies fighting back. A lot of people realized how much money they could make from it. And it became this billion-dollar industry."
    When the law was passed in 2004, it was meant to deter employers from violating serious labor laws: "Wage theft, minimum wage violations, government is not doing very much about this, you can file a claim with a government and it can sit there for three years or more without it being attended to."
    In today's episode, we'll look into how the PAGA law works, its growing controversy, and the recent agreement between the California Legislature, business, and labor groups to reform it. We also discuss what this new reform means for California workers and employers.

    your local government has more power over your day to day existence than the State or Federal Governments ever could.
    We have got to rebuild our local governments from the very lowest levels first and then and only then should we start to work our way up from there.

      My family and I ALWAYS make sure to vote local elections and also the presidency elections because local elections definitely do make a huge impact. But in California as soon as Newsome came in I think elections are probably not what they should but I definitely vote

      Good admonition. Unfortunately, we need to do both. For example, the State deprived counties of essential property taxes by increasing how much of it was handed to the state. Yet the state requires the county to pay more from their budgets to accomplish state ideologically based mandates. For example, the state is closing state prisons and expects counties to incarcerate long term serious offenders with additional services. The state wastes so much money but the citizens suffer the loss of county services.
      But I agree, it's good to be educated on one's local systems, know who one is electing and be proactive in local governance. How much is trickle up I don't know.

    this is crazy! i use to have a business and during that time we were warned by other business owners that there was a wave of lawyers using a person with disabilities to go find businesses who did not have their property up to code with handicapped parking etc. they would threaten to sue and the business owner would settle for thousands. lawyers were making alot of money! they mainly targeted mexican restaurants

    As someone who has worked retail, I Often needed to work for a 5 (Sometimes 4) hour shift, where I needed to Take a Lunch in the 4th hour, but never really wanted to.
    5 Hours On-Shift, = 5.5 Hours Actual Shift bc a 30m Lunch.
    IDC about a Lunch on most days, I can eat after my shift, it's only 5 hours.
    I've literally worked for a bus and took a 4 hour extra shift day, and needed to take a lunch before coming back to the yard...
    I could have been back at the yard in 30 minutes, and eaten anywhere I wanted, but no, I had 7-11 and Jack in the box in my area, and hit 2pm traffic on my way back adding an hour to my extra shift, pushing me really close to my 60 hour limit, and making me miss something I really wanted to go to. (This was a forced extra shift, mind you.)

    They did the same with the ADA disabilities act. Kaiser got hit hard with it, but they did have some facilities that were not ada accessible, I worked on getting them in compliance...but they also went against mom and pop stores and they don't have the money Kaiser does.

    Wage theft is still a problem and softening PAGA is a bad move. The only people that were against it were scummy bosses that would either commit wage theft or put employees at seriously safety risks for corporate profit. Don't get me started on Labor Unions. Some are good but many just cozy up to bosses. Controlled opposition

    So the reason for it taking so long & it being so hard to get changes is so clearly because the state is the biggest beneficiary of all the lawsuits. Even more ironic is the supposed reason for creating the PAGA policy/law is due to the state not doing their job of protecting the people who filed claims but those claims sat for years. Seems silly these guys went thru so much work & spent so much time to get what’s needed for it to get on the ballot & ended up giving in to politicians & state hustlers for a few small changes & the state only giving up 10% of the money they see in any lawsuit or settlement. When this PAGA first came to be, did it clearly relay the percentage the state would take from any of these cases? Or was that changed over the years? Honestly, I don’t remember voting on this nor hearing about it. And we had a family business during that time. Why would the state be entitled to anything other than court fees or filing fees? Just sounds crazy.

    At 11:16 key point, don't improperly treat the employee and you will not be punished. Good employers are not being punished, also in the beginning of the interview. it is not hard to find and retain employees if you are a good employer.

      You can search the state bar website for attorneys in your area. That site also shows if an attorney has had violations before so you can avoid those ones.

      @@probablynot1368 I've worked fur a company that actually said we couldn't go out drinking at bars even though we wouldn't be in uniform and it's on our own time. They felt we still represent the company. I don't think it was actually enforced, but it was in the employee handbook.

      No one was dissing valid class action lawsuits. The point is companies getting sued over technicalities that did not hurt employees, and no redress for employers to correct it once it was brought to their attention. Case in point, an employer fined for giving a welcome basket to a new employee with a new $1 scratch off ticket in the welcome basket.
      Try keeping up on an 1100 page labor law manual.
      I think California loves its big payoffs, yet that money doesn't seem to cover enforcement or justice.

      @@ScreamTatumRiley I've been aware of the fifth hour rule for as long as I have been working after college. Most employers will allow an employee to waive the meal penalty as well if you want to work more than 5 hours.

    There are some inaccurate statements in this video. Employees deserve to be paid and take breaks and lunches. Employers aren't innocent in every scenario.
