    I think the officer fired at her vehicle because he was angry. His entire attitude was indicative of someone who is not in control of their emotions. Theresa was wrong not to cooperate and driving away from the officer with her car door wide open was reckless and malicious. But shooting into the back of her vehicle as it was driving away from him is like shooting someone in the back.

      He would be allowed to ask them what they were doing, but she wouldn't be obligated to answer. I don't think he had probable cause to ask her out of the vehicle, because she wasn't committing a crime. In fact if she had found her keys sooner, she probably could have just driven off. The cop would've been pissed but it's not a crime to drive away if the cop hasn't detained you yet and you are not commiting a crime, thus it isn't considered fleeing.

    Seems like some officers will take the barest pretense of someone violating the law and once you’re over that line, they feel fully justified in taking your life. It’s like they completely forget the context they’re in. She wasn’t kidnapping someone or wildly trying to run people over. At most, it was simple trespass.
    Sounds like his ego couldn’t afford to let her go even though it was the safest, most logical, least problematic approach.

They’re simply stating that even if the officer *believed* he had grounds to approach and question Theresa and her passenger because he concluded that they were trespassing, engaging in an abusive and disproportionately confrontational way to intentionally escalate the situation and then opening fire on someone as a result are not the actions of someone who has any business being in law enforcement!

    That Cop escalated that situation from the start and he is 100% responsible for the outcome! If he had grounds to remove her from her vehicle than he should have frisked her and cuffed her then secured passenger till other officers arrived or he could sort the situation out! Then he would have her keys and she would not have tried to leave! I don’t blame her for trying to leave, unless she had dealt with that officer before it would be very easy to think he was a fake cop!

      I do blame her for trying to leave. Although, the officer was not in control of his emotions; she would have likely lived, if she had taken a ticket or been arrested. Driving away is never a good idea.

      Both were wrong. He was wrong for his conduct as an officer was & was overly aggressive - but she was uncooperative & tried to flee the scene when he told her to take a seat. She also hit him with her car door when shr reversed, which could have been critical to his life.

      The entire interaction from beginning to end was completely unprofessional on his part. He should have led with his name and badge ID and informed them of his bodycam. I don't know if those are rules cops have to follow but I think it's the very least a cop can do in any interaction. Second, he should have dealt with the alleged trespasser and the paintball gun. Teresa was hardly the potential threat at that point. The cop should have called in his supervisor or some higher ranking cop to assist and he could have radioed that in whilst walking to the other side of the car. I don't buy the argument that he only had seconds to make a decision. He had many minutes to make many decisions that could have led to a different outcome. Instead, he decided to overcompensate for being a bicycle cop by power tripping with people who posed little or no threat to anyone. I appreciate Dr. Grande's neutrality, but this is hardly an outlier in any police department. This kind of behavior is encouraged from the moment recruitment begins.

      Yeah car-side manner is a requisite of the job. You rile people up and you’re initiating an extreme & negative outcome, it’s the officer’s responsibility to diffuse tension as much as possible. This didn’t need to escalate as much as it did- he’s responsible for that

    A personal experience that I think relates to this incident: I worked at an Italian restaurant on Cape Cod for many years. Popular place and the owner befriended all the cops in the surrounding towns, so on any given night there would be several police officers having a bite to eat. As a side note, Cape Cod is a real “Old Boys’ Network”
    and insular place.
    One night while I was finishing up closing, two undercover detectives who were big buddies with my boss were casually chatting about what a quiet night is was - so they decided to go up the street and start some fights with folks coming out of the bars at closing. I was pretty shocked, although I’d heard some really corrupt stuff over the years. I mentioned to them that harassing and threatening people who’d had a few drinks was bound to result in a fight and you’re dressed in plain clothes, so the bar patrons you start punching aren’t even going to know they’re hitting a cop. You guys are effectively going to destroy some guys’ lives when they get arrested for assaulting a police officer.
    The snide grin on their faces was chilling.
    There are so many dirty cops who love to bully people and abuse their power. Real psychopaths.

      My experience of cops on the Cape is they are courteous and reasonable.
      The Rangers however have a different culture and mindset, they might bother people who did nothing wrong.

      When I was in Boston going to college, I went to the Cape to check into summer jobs.
      It seemed cold and unfriendly. I was kind of put off.
      Felt more comfortable in the city.

      I've been cursed out by cops before for literally doing nothing but existing. Rednecks who get off on bullying tend to talk and act like that, and there are a LOT of those in police forces across the US. We do NOT hire the best and brightest (or pay enough to attract them) and white supremacists (the trashiest trash of all) have had a strangle hold on many departments since the beginning of policing in the US.

      That same standard is true for law enforcement. He had her information and could have proceeded peacefully and reasonably after that fact. If you are in the presence of an armed person berating you and threatening you with bodily harm, such as a taser being presented to coerce you out of your vehicle under duress, your fight for your life begins long before the legal proceedings. Any agreement with the practices shown in this video only lead to violence and horror. If you agree with any of the actions taken by this officer in this instance you are morally broken and numb to the loss of life of this innocent woman and thousands of others slaughtered by police before legal proceedings can ever begin.

    I have watched many officer/motorist interactions. The vast majority of them swear like sailors. I couldn't interact with customers like that on the job. I find it disgusting and highly unprofessional that public servants conduct themselves this way.

    Well, the bottom line is someone trespassing, even if true, isn't an immediate violent threat that would justify use of deadly force....and getting bumped by the car door isn't justification either.

      I question this also. If she “almost” bumps him with the car door and drives away, how is he ever in lethal danger? If a private citizen instantly shot someone who bumped them with a car door while backing up, would that be justified and lawful?

      He was a just a bomb ready to explode. The countdown reached its end with this woman, sadly. Nothing he did was justified. A mentally stable cop would either go up & tell them to leave with a warning, or at worst issue a ticket/citation for whatever law they think they broke.
      And in ideal circumstances the driver could fight to get it dropped in court. I think sometimes willingly giving cops information like "He has a paintball gun" is a bad idea and sets the tone for a downhill encounter. Just tell them if you have a weapon WHEN they ask if you have one. Only give them necessary information. And if they're dead set on arresting you, wait to talk to a lawyer. This lady mixed up when to cooperate and when not to. Telling the cop "he has a paintball gun" yet refusing to give her name, or exit the vehicle, can make the officer think something shady is going on. I have to watch the full footage to have an idea of why she made these decisions, but regardless, she never deserved to be shot.

    Brushing against an officer with a door is not justification for murder. That is unreasonable. The officer was extremely unprofessional. The threat was over when he fired. She clearly was just trying to leave. Who can blame her, he was looking for trouble. 8 years on the force and he was still on a bicycle? He clearly was a sub par officer. He was on the "D team". I think he should be charge with 2nd degree murder.

    Some people have trauma in their past, I'm pretty sure being verbally cursed at in the middle of the night by a hostile police officer has the potential (in some individuals) to provoke all sorts of irrational emotional responses.

    Great analysis again and your humour is brilliant. I agree with you that he is guilty of manslaughter. My opinion is that the officer had personal anger issues. There was no need for such swearing from the officer which also indicates immaturity, lack of self control and serenity.

    Sadly, this cop represents the exact type of temperament departments look to hire for their doughnut dumpster patrolmen. They intentionally avoid intelligent, well-grounded personalities who could deal with people. We'll never see another Sheriff Andy Taylor, but a whole legion of the love children of Barney Fife and Eugene Tackleberry. They have Fife's temperament and Tackleberry's desire for gunplay.

      In Florida my son is being put through an extensive series of aptitude tests, psychological testing and many interviews to join the police academy. They are making certain to not hire anyone who is unstable, unethical or a prior criminal. The bad ones that are clever at appearing solid and are good manipulators manage to slip through I'm sure but they do try hard to prevent this.

      I learned recently that, in New Zealand, there is an IQ test for police college acceptance. If you are over a certain I.Q level you are deemed unfit and are not accepted... They actively only want morons.

    Did she need to cooperate though? If she wasn't suspected of breaking any laws, was it even a lawful detention? If it wasn't a lawful detention I believe precedent was set recently that you can leave. That one guy dragged police with him as he left because they were detaining him without reason.

    Absolutely inappropriate use of lethal force, hopefully he goes to jail. But I think an attorney can make an argument that she tried to run him down since the car door was open which itself could be presented as lethal force/vehicular assault. But he shot her while she was fleeing. He was way too wound up for no reason in the interaction. Probably power tripping or taking out his life stresses on her.
    People, when youre stopped by police, just do what they say and the chance that anything bad happens to you is almost zero. Damn near every case that ends like this, the victim is resisting or fighting the officer in some way. Just leave your hands 10 and 2 and keep the convo robotic and pleasant. If you think you are being wronged, fight it in court. Dont get yourself actual legit charges or put yourself in danger cuz some cops are just not right in the head. I can only remember one case where the victim was doing every single thing the officer said and still got shot and it was before the era of bodycams. Not victim blaming, I'm just saying dont give them an excuse.

    I watch an unhealthy amount of body cam videos and i've seen many police officers deal with dangerous suspects in much much more respectful and logical manners. this officer clearly had external influences affecting his ability to be a calm, sensible and reasonable human, and that is not a quality people who use guns for work should ever have. police need to regularly psych and stress test officers or something coz people don't derserve to die over what is essentially a middle-aged man having a tantrum.

    What about Teresa fearing for her life? This officer threatened her with violence and treated her with no dignity. He told her he was going to make her life a living hell. She asked not to be touched. Maybe in her mind, she thought she was just going to be another person killed by the police. I am a special education teacher who has taught emotionally disturbed students. I have been trained annually not to escalate a situation when a student is in crisis. You speak in a calm reassuring manner. You remind them that they are safe. I have been trained not to physically restrain a student unless the student is a threat to himself/herself or others. I have been punched, kicked, choked, and bit when a student was in meltdown. In these situations, I had to physically restrain them using non-violent MANDT guidelines. When students had to be restrained, they were put in an isolation room that is padded for their safety. People in crisis have a predictable patterns of upset. You do not engage them until they have fully de-escalated. In my 33 years of teaching, I have never touched a student in violence. Why can't officers walking around with guns be taught to avoid conflict rather than escalate it too? I believe it actually help them be relaxed and be in more control. My biggest disappointment after George Floyd was murdered is that there has not been any national standard for training police officers not to escalate and try non-violent tactic first in encounters especially with motorist. At least they should be reminded that every human should be treated like their life matters. It is heart breaking.

    He definitely scared her. She was probably in fear for her life. Cops are overly aggressive, they lie, they do not care about anyone's safety but their own, they exaggerate everything, and most are not very smart. The door barely touched him and I am sure he would have cried and try to charge her with assault on an officer. Why can't they just be nice, respect people when their rights don't align with what they want someone to do, and do their job peacefully? The "us vs them" attitude and assuming everyone is a criminal has got to stop. He basically shot a woman in the back. She is probably a mother and that officer most likely ruined the lives of many people including children. He should be charged in the same way he would charge someone. With as many charges they can possibly come up with. What a horrible situation.

      The order of God does put women beneath men, but you shouldnt treat them poorly just because of that. These cops see people die and that type of activity can make you a little irritable, might make you angry and say stuff and talk to people sideways.     In my personal opinion there was no reason for this officer to ask this woman to exit the vehicle. He could clearly have asked all his questions with her sitting in the car. I would be reluctant to get out of my vehicle especially at night without a reason such as I am under arrest.

    Thank you as always for your analysis of this encounter. I think that the officer wanted to dominate the situation and the use of the expletives was his way of doing so. The lady clearly pushed all his buttons which is maybe why he focused on her. He should NEVER have stood in a position where the vehicle could have caused him harm. He should have stood away from the open door. I wonder if his anger and frustration with the lady made him overlook other more serious matters hence her sudden desire to depart. It’s very sad what happened. Thank you again for your excellent analysis.

    At no point was the officer in any danger. He was NOT hit by the door, he even stated that himself! A car driving at that speed would not have hurt him even if he was standing infront of the door. The eagerness of american officers to pull the trigger on innocent citizens is mind blowing. Aren't the cops supposed to protect citizens? They have become a danger and citizens have to fear for their lives when they see an officer. Wtf.

    I have never heard that you could only visit during a certain time frame and if that's true there would be a sign telling you that. I also believe that maybe she was scared because of a priar interaction and she was afraid of him. I hope at the least he gets fired.

    New Mexico is always bringing the crazy. I’m not a fan of cops on bikes unless it’s in highly populated areas. Las cruces is not highly populated at all. The cop seems to have several issues but mostly impulse control

    Thank you for spreading the word about these monsters. It helps keep powerful law enforcement in check. He was looking to kill somebody period he couldn’t wait could he. Gross. And terrifying

    This shouldn't be hard to figure out. US police are US citizens just like everyone else, and are subject to the same laws. They aren't elevated to a different set of rules because of the job that they chose to do. If it is illegal for someone to shoot at another person from behind as they drive away, and are no longer a threat, then they should be charged just like anyone else.

    As much as I and many others I’m sure think he shouldn’t, he may slide through the hands of justice. Police are allowed to shoot people that are fleeing if they just committed a felony. The backing up while the door was open could be seen as vehicular assault, a 4th degree felony in my state. But he’s a murderer what ever the outcome.

    I agree that the officer is guilty & should be charged but not of homicide or even manslaughter (at least not in the first degree or whatever the statute might call it where they are). I feel like this is more along the lines of reckless homicide & he should never be allowed to be a police officer or armed guard.
