I appreciate the information, but I'm not clear on the secondary conditions. I thought I heard somewhere that we could not file for secondary conditions anymore.
Thanks DeWayne for all you do! I’ve learned so much from your videos! I’ve been retired from the U.S. Navy for 25+ years & dealing with the VA for that long! I retired with 20-years of service and was initially rated at 20%….. Now I’m 90% looking at finally getting to 100% P&T! During my journey it’s been a STRUGGLE to say the least! The VA these days is so much easier to file & get rated! Plus, retired military can now draw BOTH Military Retirement Pay & VA Compensation Pay which is huge compared to back in 1998. Hope some of these younger Veterans read my comment and realize just how GOOD they have it now! Be safe & be smart! Keep doing what you’re doing! Thanks again!

Amen! I wholeheartedly agree, although I ran a different race. In Nov 2000, a VA volunteer reviewed my service treatment records while I waited to see what I can claim for VA disability and he couldn't find any conditions. I had complaints of lower back pain (4), rhinitis and sinusitis (over 20), and several complaints of knees, left shoulder, headaches, buions, and a diagnosis of flat feet. I thought that was some bs and I needed to get educated. I retired from the Air Force in 2001 after serving 30 years and immediately receiving 30% disability the same year with very little assistance from the VSO. Thank God, we could start receiving both military retired pay and VA Compensation in Jan 2004 after receiving 50% of more. I started receiving 50% in Feb 2007 from a secondary claim that was appealed in Feb 2007 and granted in Aug 2015 (RO, BVA Traveling Judge, remanded to RO, and C&P exam), yes 8.6 years. I got more educated while waiting for over 8 years. I filed another secondary condition OSA and rhinitis in 2012 after reading Chris Attig's website a veteran, and VA attorney. The C&P examiner provided the nexus statement and rationale; which I noticed after receiving my C-File in 2014, thanks to Chris' info. I filed for TDIU in Jan 2014 and received 100% P/T. I probably would not have been a VA volunteer for the last 12 years, if not for God and Chris Attig. I learned so much to assist others. Now, we have various social media platforms to educate the masses. I waited for a long time to find someone that worked for the VA as a rater and we are blessed to have Dewayne! Thank you very much for your post and I know you have a lot more to share.
Amen brother! That’s been my experience too! Retired in 2000 after 24yrs with 50%. I had no idea we could be reevaluated until last Sep. became rated at 80% in Mar and now 100%P&T last month. Game changer for sure. This new VA is focused on Veteran Health now like never before.
I just had a C&P Exam this past week for a shoulder and feet injury. It went well based on your and others' tips on how to conduct myself in the exam. Just waiting for the rating to come back. I will have a few other issues 'service-connected' as well. Thanks for all that you do to help us vets get what is due to us.

12:03 When people get outside Nexus letters and DBQ from private doctors…A C&P exam is still scheduled for the VA Doctor to complete a DBQ also? There seems to be so much push with people giving advice for filing claims, to obtain an outside DBQ. I want ask you, because you seem to be only of the only people mentioning the VA not preferring those being done by private doctors. I appreciate your guidance and expertise being so honest and transparent. Thank you!
That happened to me as a VA rater and I refused due to the training the VA provided me on when not to schedule a C & P exam when we have a sufficient DBQ and nexus if needed. There are some VA employees that are using the private DBQ's when they are completed per the VA guidelines and others are not. It will be up to the veteran if they want to fight that battle if the fall in that area. I’m going to attempt going the DBQ/Nexus route and follow your brilliant advice to include in my statement the references in the regs and my requesting that this be rated based on submitting an actionable DBQ with evidence. My hope being that especially with their quotas they’ll not see that as me being non complaint but rather me trying to help them help me by completing the most efficient process. I will be ordering your book immediately on the first! I’ll start there. Getting close to my intent to file deadline expiring so I really want to get this right. Trusting bad advice from a terrible VSO (at the State level at that, so disappointing!) has essentially cost me not only the rating I deserve, but well over 6 figures in backpay! I simply must get it right this time. I quite literally almost didn’t survive my last claims experience, nearly gave up in more ways than one, as too many of our fellow brothers & sisters tragically have. It’s taken me 11 years to muster the strength and mental fortitude to face this fight once again. I simply cannot thank you again enough!

I’m currently 70% service connection 60% for pituitary cyst on brain and 30 % for migraines currently I have a claim in for insomnia secondary to tinnitus I have a military nexus from service showing proof of all of my treatment records for everything that I claimed also periods of treatment and records after service I got out in June 2021 after have been receiving treatment and medication since and I still haven’t been able to maintain gainful employment I was wondering if I should file for IU or TDIU or wait. Im currently at rating step 5 of the va process as of September 12 2024

I recently had hlr for several issues. The main issue was changed quickly but the other issue was previously heard in hlr so person said can't change but will hear my argument off record and give advice. Funny enough I was happy with this hlr but then hlr called me back 10-15 minutes later told me some updated changes to conditions in my records that could benefit me and get me over hundo club. With change I'm sitting at 94 now. Or maybe it was just the wind whispering things in my ears .

@@DewayneKimble Yes. Rater harrassed examiners with "clarifying questions" for months until finally telling them that a positive opinion did not meet va guidlines for my situation. It's unlawful to "steer" any other licensed professional. HLR just rubber stamped the previous decision without even looking it seems.

I just filed for tinnitus on 09-24-24. And I am currently at 10% for left knee osteochondroma. I applied for increase way back in 2011. And mind you this was after I had knee surgery at the VA hospital in Los Angeles. Well long story short I was denied an increase and I’ve been at a 10% rating for years now. If I don’t get approved for my tinnitus then I’m just going to give up on the VA
Since the surgery was at a VAMC, you can still go back and claim it but it's not for an increase. It's for paragraph 29 or 30. I have a video on my channel explaining the difference between the two and evidence needed. (thus, the name "I go a video on that). I was at 50% from 2000 until 2023. I got rated Increases in Mar to 80% and then 100 last month. I owe my increases and Secondary claims success to videos like this one and to VA Claims Insiders

HI, Mr. Kimble, I have already got 100% P&T in 1999 due to major depression, and I have also got 0% as secondary for ED caused by anti-psy medications. Furthermore, I have got 10% for bone issue. Should I file a new SC secondary condition for GRED? I have been taken medication from the VA clinic to treat GRED since 2018.

Talked to DAV VSO about GERD secoundary to meds for depression and NSAIDS for pain from arthritis caused by a fracture to my foot. Both the depression and foot are SC. He asked if I had GERD while in service, I said no just heartburn. That the GERD was diagnosed 3 years after I left, and I was recently was diagnosed with a Hiatal hernia. That the meds that I was prescribed by the VA upset and aggrivate the GERD. He said I will never get SC connection for the GERD because the meds did not cause the GERD, just having them aggrivate the GERD and upset my stomach is not enough and they won't give SC for it. He literally talked me out of claiming it has a secoundary.
I would never say what one will not get. File the claim the correct way, evidence of diagnosis and be able to explain it to the examiner. Do you recommend when writing a personal statement, you write 1 statement at a time for each claim? I have multiple claims I'm awaiting rating on currently. Or, should I do 1 statement for all 6 conditions at once? Thank you in advance.

I only have one doctor visit for headaches in my STRs. Here I am 4 years later and starting the process of a current medical diagnosis for migraines, personal statement, Migraine Buddy, etc. Would I be better off trying to get my headaches (adequate for a rating) connected as a secondary or still possible for a direct service connection? My current service connected disabilities that I would tie headaches as a secondary to are: Asthma, Sleep Apnea, Rhinitis. Thank you for your time and all your responses!

I’m 100 P and T. I filed all my claims myself. I’m trying to help my husband reach 100 percent but most of his are secondary conditions and I am having a hard time learning how to connect things. My C and P examiner did all my nexus work for me. But for his claims, I am afraid to rely on the C and P examiner. We don’t have the money to fork out for private nexus letters. Say I file headaches as direct service connection and it gets denied. If I wanted to file it as secondary to Tinnitus or Asthma, would I file it as a supplemental and state I want it secondary to a S/C condition or would I file a new claim for headaches and list it secondary the 526EZ?
On the 0995 in the instruction section, it shows when to use that form. When you are denied and want to re-open that claimed condition, you have to use the 0995. Hello Dewayne, your channel has been so helpful. I really appreciate it. I am currently 100% for neck cancer and I am turning 54 years of age in August. I have two secondary condition nexus letters for anxiety and degraded dental quality from the chemotherapy and radiation. I don’t want to poke the bear, but I’m I suspect the VA will stop compensating me at 100% at some point in the near future because the cancer is in remission from the treatment. Should I get ahead of the game and get a DBQ done from my personal doctors and submit the same Nexus letters from my personal doctors to the VA, or should I wait for them toreduce my benefits from 100% and then submit. The VA granted me 100% in February 2024 and backdated it one year.
When the cancer goes into remission, it will be reduced. Confirm when they have the next C & P exam, it should be six months. If you are still taking treatment or the cancer is active, submit that evidence before the exam, even if you haven't received a request to attend. You want it on file and then when they request you show up, you take that same evidence with you and show the examiner. That's how you stay at 100 percent for the cancer if it is not in remission or you are still under treatment. That was a HUGE nugget. @@jamaalh1280 yeah that’s what happened to me. The dentist during the exam sat me down and showed me a slide show about TMJ or sometimes called “TMD”. It’s the jaw muscle that actually causes the grinding of teeth. You may have to claim that as well. I did.

I have NASH secondary to Cirrhosis two VSOs put me in for cirrhosis both denied but the second denial letter from VA stated Favorable, Toxic exposure, GulfWar veteran and South West Asia and it was noted by the C&P Examiner that had Cirrhosis. I did not have a Nexus letter on either claim. I feel the VA is trying to help me but Cirrhosis is not a presumptive disease for 91 and 2003 Gulfs War Veteran. Any recommendation?

What im running into is my va dr is giving me meds for gerd because of motrin use. I have been diagnosed with planter fasclitis. I have osa sleep apnea va gave me a machine. But no doctors here are afraid to write nexas letters linking to things I have been rated for. They don't want to anger the va.

Even if you have all the evidence to link secondary conditions, it will also depend if you get a knowledgeable rater. Have not been impressed by these last 2 denial letters I have received. Barely any explanation/mention of private DBQ + medical nexus letters that were submitted. Hope the HLR will reverse the denial....

I like that so many of our black veterans have 100% disability and work for the VA. We owe them that even if they did not serve in combat or were in the infantry for what this country did to their ancestors.

Thanks DeWayne for all you do! I’ve learned so much from your videos! I’ve been retired from the U.S. Navy for 25+ years & dealing with the VA for that long! I retired with 20-years of service and was initially rated at 20%….. Now I’m 90% looking at finally getting to 100% P&T! During my journey it’s been a STRUGGLE to say the least! The VA these days is so much easier to file & get rated! Plus, retired military can now draw BOTH Military Retirement Pay & VA Compensation Pay which is huge compared to back in 1998. Amen! I wholeheartedly agree, although I ran a different race. In Nov 2000, a VA volunteer reviewed my service treatment records while I waited to see what I can claim for VA disability and he couldn't find any conditions. I had complaints of lower back pain (4), rhinitis and sinusitis (over 20), and several complaints of knees, left shoulder, headaches, buions, and a diagnosis of flat feet. I thought that was some bs and I needed to get educated.
I retired from the Air Force in 2001 after serving 30 years and immediately receiving 30% disability the same year with very little assistance from the VSO.
Thank God, we could start receiving both military retired pay and VA Compensation in Jan 2004 after receiving 50% of more. I started receiving 50% in Feb 2007 from a secondary claim that was appealed in Feb 2007 and granted in Aug 2015 (RO, BVA Traveling Judge, remanded to RO, and C&P exam), yes 8.6 years.
I got more educated while waiting for over 8 years. I filed another secondary condition OSA and rhinitis in 2012 after reading Chris Attig's website a veteran, and VA attorney. The C&P examiner provided the nexus statement and rationale; which I noticed after receiving my C-File in 2014, thanks to Chris' info.
I filed for TDIU in Jan 2014 and received 100% P/T. I probably would not have been a VA volunteer for the last 12 years, if not for God and Chris Attig. I learned so much to assist others.
Now, we have various social media platforms to educate the masses. I waited for a long time to find someone that worked for the VA as a rater and we are blessed to have Dewayne!

Amen brother! That’s been my experience too! Retired in 2000 after 24yrs with 50%. I had no idea we could be reevaluated until last Sep. became rated at 80% in Mar and now 100%P&T last month. Game changer for sure. This new VA is focused on Veteran Health now like never before.
I just had a C&P Exam this past week for a shoulder and feet injury. It went well based on your and others' tips on how to conduct myself in the exam. Just waiting for the rating to come back. That happened to me as a VA rater and I refused due to the training the VA provided me on when not to schedule a C & P exam when we have a sufficient DBQ and nexus if needed. There are some VA employees that are using the private DBQ's when they are completed per the VA guidelines and others are not. It will be up to the veteran if they want to fight that battle if the fall in that area. I’m going to attempt going the DBQ/Nexus route and follow your brilliant advice to include in my statement the references in the regs and my requesting that this be rated based on submitting an actionable DBQ with evidence. My hope being that especially with their quotas they’ll not see that as me being non complaint but rather me trying to help them help me by completing the most efficient process. I will be ordering your book immediately on the first! I’ll start there. Getting close to my intent to file deadline expiring so I really want to get this right. Trusting bad advice from a terrible VSO (at the State level at that, so disappointing!) has essentially cost me not only the rating I deserve, but well over 6 figures in backpay! I simply must get it right this time. I quite literally almost didn’t survive my last claims experience, nearly gave up in more ways than one, as too many of our fellow brothers & sisters tragically have. I’m currently 70% service connection 60% for pituitary cyst on brain and 30 % for migraines currently I have a claim in for insomnia secondary to tinnitus I have a military nexus from service showing proof of all of my treatment records for everything that I claimed also periods of treatment and records after service I got out in June 2021 after have been receiving treatment and medication since and I still haven’t been able to maintain gainful employment I was wondering if I should file for IU or TDIU or wait. Im currently at rating step 5 of the va process as of September 12 2024

I recently had hlr for several issues. The main issue was changed quickly but the other issue was previously heard in hlr so person said can't change but will hear my argument off record and give advice. Funny enough I was happy with this hlr but then hlr called me back 10-15 minutes later told me some updated changes to conditions in my records that could benefit me and get me over hundo club. With change I'm sitting at 94 now. Or maybe it was just the wind whispering things in my ears .

@@DewayneKimble Yes. Rater harrassed examiners with "clarifying questions" for months until finally telling them that a positive opinion did not meet va guidlines for my situation. It's unlawful to "steer" any other licensed professional. HLR just rubber stamped the previous decision without even looking it seems.

I just filed for tinnitus on 09-24-24. And I am currently at 10% for left knee osteochondroma. I applied for increase way back in 2011. And mind you this was after I had knee surgery at the VA hospital in Los Angeles. Well long story short I was denied an increase and I’ve been at a 10% rating for years now. If I don’t get approved for my tinnitus then I’m just going to give up on the VA
Since the surgery was at a VAMC, you can still go back and claim it but it's not for an increase. It's for paragraph 29 or 30. I was at 50% from 2000 until 2023. I got rated Increases in Mar to 80% and then 100 last month. I owe my increases and Secondary claims success to videos like this one and to VA Claims Insiders

I have already got 100% P&T in 1999 due to major depression, and I have also got 0% as secondary for ED caused by anti-psy medications. Furthermore, I have got 10% for bone issue.
Should I file a new SC secondary condition for GRED? I have been taken medication from the VA clinic to treat GRED since 2018.
That would be up to you if you want to file a new claim. Just know what you are doing when you file that claim.

Talked to DAV VSO about GERD secoundary to meds for depression and NSAIDS for pain from arthritis caused by a fracture to my foot. Both the depression and foot are SC. He asked if I had GERD while in service, I said no just heartburn. That the GERD was diagnosed 3 years after I left, and I was recently was diagnosed with a Hiatal hernia. That the meds that I was prescribed by the VA upset and aggrivate the GERD. He said I will never get SC connection for the GERD because the meds did not cause the GERD, just having them aggrivate the GERD and upset my stomach is not enough and they won't give SC for it. He literally talked me out of claiming it has a secoundary.
I would never say what one will not get. File the claim the correct way, evidence of diagnosis and be able to explain it to the examiner. I only have one doctor visit for headaches in my STRs. Here I am 4 years later and starting the process of a current medical diagnosis for migraines, personal statement, Migraine Buddy, etc. Would I be better off trying to get my headaches (adequate for a rating) connected as a secondary or still possible for a direct service connection? I’m 100 P and T. I filed all my claims myself. I’m trying to help my husband reach 100 percent but most of his are secondary conditions and I am having a hard time learning how to connect things. My C and P examiner did all my nexus work for me. But for his claims, I am afraid to rely on the C and P examiner. We don’t have the money to fork out for private nexus letters. Say I file headaches as direct service connection and it gets denied. If I wanted to file it as secondary to Tinnitus or Asthma, would I file it as a supplemental and state I want it secondary to a S/C condition or would I file a new claim for headaches and list it secondary the 526EZ?
On the 0995 in the instruction section, it shows when to use that form. When you are denied and want to re-open that claimed condition, you have to use the 0995. How do you make sure the VA knows it is secondary to something, is there a separate form or do you state it on your C&P exam.
I'm claiming migraines secondary to my S/C tinnitus, I'm claiming sleep apnea secondary to my S/C PTSD, these are a couple of examples. When you get to the exam, you can explain to the examiner how you are claiming it. Also, you can provide medical studies that have been performed after you have done your research online and found them. Hello Dewayne, your channel has been so helpful. I really appreciate it. I am currently 100% for neck cancer and I am turning 54 years of age in August. I have two secondary condition nexus letters for anxiety and degraded dental quality from the chemotherapy and radiation. I don’t want to poke the bear, but I’m I suspect the VA will stop compensating me at 100% at some point in the near future because the cancer is in remission from the treatment. Should I get ahead of the game and get a DBQ done from my personal doctors and submit the same Nexus letters from my personal doctors to the VA, or should I wait for them toreduce my benefits from 100% and then submit. The VA granted me 100% in February 2024 and backdated it one year.
When the cancer goes into remission, it will be reduced. Confirm when they have the next C & P exam, it should be six months. If you are still taking treatment or the cancer is active, submit that evidence before the exam, even if you haven't received a request to attend. You want it on file and then when they request you show up, you take that same evidence with you and show the examiner. That's how you stay at 100 percent for the cancer if it is not in remission or you are still under treatment. That was a HUGE nugget. Hey Dewayne. I had a question about bruxism. I applied bruxism secondary to PTSD. They awarded bruxism BUT they lumped it under PTSD without a separate percentage. Is there anything that can be done to get bruxism separated so I can get dental treatment?

@@jamaalh1280 yeah that’s what happened to me. The dentist during the exam sat me down and showed me a slide show about TMJ or sometimes called “TMD”. It’s the jaw muscle that actually causes the grinding of teeth. You may have to claim that as well. I did.

I have NASH secondary to Cirrhosis two VSOs put me in for cirrhosis both denied but the second denial letter from VA stated Favorable, Toxic exposure, GulfWar veteran and South West Asia and it was noted by the C&P Examiner that had Cirrhosis. I did not have a Nexus letter on either claim. I feel the VA is trying to help me but Cirrhosis is not a presumptive disease for 91 and 2003 Gulfs War Veteran. Any recommendation?

DeWayne, whats ur opinion; seems like its hard to claim plantar fasciitis (only stated wrong fitted shoes in bootcamp, but was on sickbay for a day) and trigger finger(middle finger-had Dr. visits and VA docs injected cortison shots. No other record for both, my mos was 0331 machinegunner USMC. Do I just need to find a Dr. whos willing to nexus this? but seems difficult. Thx!

What im running into is my va dr is giving me meds for gerd because of motrin use. I have been diagnosed with planter fasclitis. I have osa sleep apnea va gave me a machine. Even if you have all the evidence to link secondary conditions, it will also depend if you get a knowledgeable rater. Have not been impressed by these last 2 denial letters I have received. Barely any explanation/mention of private DBQ + medical nexus letters that were submitted. Hope the HLR will reverse the denial....
