    I claimed anxiety and depression secondary to tinnitus . I followed your advice and turned in a DBQ !!! Bam I got it approved in 45 days @ 70% . The key is the DBQ people . Try to avoid their doctors !!

      Bro I have severe anxiety and depression and anger issues. My tinnitus is really bad too. Right now I only got the 10% for tinnitus. But if my doctor don’t wana write a nexus or DBQ how did u get ur own DBQ? U went to a private doctor and got one from him??

      @jasonsmart3141 Don't stop fighting I got 70% for MMD from a 10% tinnitus rating last month. It took me 6 years got my backpay. I wanted to give up at a point.

    The VA SCed my migraines secondary to my tinnitus and actually wrote in my decision letter "is likely caused by" my tinnitus and said studies show a connection between the two. As you stated, I guess it depends on the rater.

    I'm working on apnea now as a secondary to my tinnitus. Definitely showed up when my tinnitus started. Just did a sleep study.

    Time to file for that secondary of Sleep Apnea. Already have the 10% for Tinnitus. And got the SA diagnosis through the VA Community Care Primary Care Physician with VA approval for the in lab study. CPAP plus oxygen should be a fairly straight forward tie in to my benefit ratings.     I had the same thing happen to me when I went for migraines. Gotta keep fighting them and point out where they messed up. They didn't look at HALF the evidence I gave them (Migrain buddy logs and reports, personal statement, and Nexus letter...yeah, Nexus letter wasn't used for my rating consideration).

      If you are in a C&P and they are typing up the DBQ as you’re speaking (you’ll know) Don’t leave out the verbiage because that is what is being sent back.

    I claimed migraine as a secondary. When I had my exam I told him I get migraines once a month sometimes for 4-7 days long or other times 2-3 times a week or it’ll be for days then nothing for 2 weeks then 4-7 days but it’s constant been like that since I was in navy.
    Got 50%

      Where you diagnosed or service connected in your treatment records for migraines? How did you get to the c p exam. Did you have a migriane log or personal statement? Jw ty!

      I did not have a journal I did not have it on my medical records while active duty. I claimed it as a secondary to the tinnitus when going in to my exam he asked how long have you had it did you have migraines while active duty , I remarked yes while on carrier and the ringing I get migraines 2-3 times a week maybe 10-24 hours sometimes 2-6 days effects my work gotta call in cannot function
      If I needed a nexus letter my sister and my job could have written statement ,,, cannot look out in light , hurts over my left eye feels like it was a pun trying to burrow inside out sharp pain. I verbally told him all this. But it was connected with my time in pursuant gulf Asia pacific pin 93 I was there. Got 50%

      I agree. I know the man’s got a business to run, but I really don’t know how he makes any money, because he provides so much information for FREE! That speaks a lot for the guy. I’ve gotten to 90% on my own… No lawyers, No “Insiders”, just going by what he puts out in his videos. Thanks KMD

I've done FREE events in the past for veterans and they never show up to get FREE information. Also, I've been doing events and Q & A's for non-profits for years for FREE.     When I went for my sleep apnea c&p exam, the examiner said that tinnitus has nothing to do with sleep apnea after I told her that I had tinnitus. At the time, I wasn't claiming the sleep apnea as secondary to tinnitus. My VSO never said to do it that way even though my tinnitus is service connected. The sleep apnea claim was denied and after being treated the way I was during my c&p, I gave up. I deal with chronic pain every day from injuries not related to my service so it's very disheartening when an examiner at the VA treat veterans like they just want a free handout.

      How do you actually claim sleep apnea secondary to tinnitus? I’m SC for tinnitus and just had a VA sleep study. The sleep study resulted in severe sleep apnea and a CPAP was issued. I was denied service connection for sleep apnea in the past so how can I prove the connection.

      @DewayneKimble $100 to almost $200 a month? That's a lot of money for someone on SS disability. Then you have to pay someone else for a nexus letter. Everyone wants money and some of us just don't have it.

      @deewal1896 my first experience with a claim, which was for tinnitus, was a bad experience. The c&p examiner could care less about anything I tried to say beyond answering her questions. That claim was initially denied, but I had a good VSO that didn't give up. I never heard of filing claims for disabilities until maybe 15 years after I separated. A VSO was invited by a fellow veteran to speak about tinnitus to veterans at my place of employment. It was only about 2 years ago that I had finally filed a claim. To have a second claim in a row denied and treated like to be treated like crap left me feeling like the VA just wants to find reason's to deny. I have another claim that's in step five and if that one isn't denied, I'll file the sleep apnea secondary to that one. I have two more claims for what should definitely be service connected but I want to get a current diagnosis. One of those should then lead to a secondary.

    I'm in the process of trying to get in increase for migraines, and I think the secondary to tinnitus might help. I'm 10% tinnitus, 0% migraines, and I got denied back in July. I missed and rescheduled 2 exams, guess why?? Migraines!
    Cant make this stuff up. Thanks for the video.

      Yeah dude me too. I got 40% for some TBIs while I was in but 0% for migraines. They’ve been kicking my butt this year, guess I’ll look into a supplemental claim after my current claim for tinnitus comes back. My C&P person also said that I should go looked at for possibly CAPD (Central Audio Processing Disorder) and I was told that’ll be a big payout if I get anything. TBI & Tinnitus have to be on your record to get a test scheduled though since it’s through the VA directly. Wish me luck guys, how’s it going for you? I’ve been waiting for this claim to finish since August now

    The examiners can find that information. But, they don't want to use anything that helps the veteran. Sad but true.

    Love your channel and your advice. I claimed Migraines secondary to Tinnitus and it was denied even after, personal statement, migraine log, my neurologist statment in my VA medical record notating the documented link of Migraines and Tinnitus. Initial C&P examiner notated Migraines and Tinnitus are not and will not ever be medically linked as a statement in the notes and the rated took that as gold in the decision on the initial denial. Went to HLR with the support of my local Legion DSO and they found DTA in my favor, but its still sitting stagnant for about 6 months now after they sent it back to C&P for a record review again. One thing to note, for this claim the evidence that was listed as reviewed was missing everything that I sent in and even my VA medical records. so frustratiing to be suffering from disabilities that you have been diagnosed with, that are linked to service and getting nowhere.
    In talking with my DSO she noted that the Second C&P person didn't do a good job either and she sent up a letter to the reviewer and likely the rater notating that nothing was answered with that re-review of the record that was missed. Expecting I will have to do a supplemental on this one.

    I just denied because the C&P examiner said it was not related because her text book said it was not. the text book was updated in 2018. She also wrote a negative BDQ for it to be service related on its own. Trying to figure out how to proceed from here. Last thing she never considered my Nexus letter or any out side VA evidence from my civilian PCP.

      @@DewayneKimble Secondary to tinnitus is how I claimed it, but the C&P examinar was relating it to a time in 1996 that I fell off a tank at ntc during training. Not sure why she did that.

    I got the tinnitus claim, but they denied me for everything else. Migraines, sleep apnea, depression, etc. They didnt even me anywhere to get checked out for any of my other problems. Flat feet, ankle, knee, back pains, etc!

    Another way to look at tinnitus is to convert the tinnitus to another disorder like Meniere's syndrome which can reach up to 100 percent. That combined with other disorders can possibly move a Veteran even higher up the SMC ratings. For instance if you have a back condition leg or feet condition that cause a lack of use of feet that could move you into the R1 territory without amputation. Though this direction is not always easy.

    I filed depression secondary to migraines last year with a 46 page nexus, dbq and at the end of a 5 month wait they put me in for a CP exam. I knew this was that okee dokee va move they do to deny you so I refused it, complained to va about it and called the White House hotline about it but as expected they denied me. I now have it on appeal to the board.

    I was rated for 50% migraines second dairy to my service connection to tinnitus to later receive a letter from the Va stating I no longer have the rating due to no records of in service complaint

    i was an 0811 for 3 and. a half yrs. We fired thousands of rounds and im lucky to say i dont get migraines. Other guys in my unit say they do. I find that very very strange.

    Hello and thank you. Can I claim hearing loss as a secondary to tinnitus? I received hearing aids through the VA Hospital after my hearing exam, also had a C&P exam supporting there's substantial lost of hearing.

    Hello Dwayne. I have the constant ringing and I'm working on getting tinnitus service connected during my time as infantryman in USMC. I was diagnosed with vertigo ( Menieres ) but did not see it listed in the video. I've been diagnosed with this condition from my private ENT doctor last year but now going to a VA doctor to establish an updated medical report. Is vertigo still considered a secondary?

    Pursuing my secondary claim for gad/mdd right now. They denied the first go and didn’t even give me a C&P exam for it… I have been diagnosed and am now filing my appeals. So frustrating that they just denied it.

    **Informal or Reasonably raised claims and Granting of earlier Effective dates**
    During a 2016 C&P exam for tinnitus, which resulted in a 10% SC, Veteran reported that tinnitus was also causing him headaches. This was documented on the DBQ under the Functional Impact section: "Tinnitus is annoying, I get headaches." Veteran was never notified of potential entitlement to benefits for headaches, a C&P exam was never initiated, nor was the condition adjudicated as required by 38 CFR 3.155.
    In 2024, Veteran filed a claim for headaches secondary to tinnitus and was awarded 50% rating. Given these facts, is there a valid argument for back pay to 2016 based on a reasonably raised or informal claim, and which 38 CFR provisions could support an earlier effective date for reasonably raised claims?

    I got major depressive disorder 70 without a Secondary. But only 0 for migraines denied twice for them. But got IU First time up took only 80 days for decision: 8/2024

I've been waiting on my claim for Depression and Anxiety. (Secondary) I'm hoping for that 100%. What do you think my chances are at getting a 100% ?

      How did you get Sleep Apnea service connected? I had a privite over night sleep study done and teh sleep Doctor prescribed a CPAP machine and the VA denied me.

      @@phototec My sleep study was done in 2019 through the VA at my local hospital. I was diagnosed with sleep apnea and prescribed a cpap machine from the VA.

    I filed migraine secondary to tinitus and have been denied 3 times. I submitted a diagnosis letter, Nexus letter, migraine log, and medication list. I have recently submitted it again for the 4th time. Had my second C&P exam last week with the same doctor as the 1st C&P exam.. He was surprised to see me again. He stated that his previous report supports my claim and it should have been granted. He looked into it and said that he believes that if I had done secondary to mental health or toxic exposure, it would have been approved. When I initially filled, my VSO said I could only file secondary to ONE service connected disability and he suggested to attach it to tinnitus. I have submitted a personal statement explaining the situation. Any thoughts?

      If this migraine claim goes through, it will put me at 100% and also include almost 2 years of back pay. I do not want to resubmit. Attaching it to a different service-connected disability as it would turn it into a brand new claim and I would lose out on the back pay. I'm wondering if I should get an attorney or if there's a possibility that the VA would understand the situation and Grant it.

      First get treatment for tinnitus. Hearing aids that submit noise for tinnitus and a pollow wirh speakers that do the same. I went to my local va non profit that sent me to a doctor that examined me for depression, anxiety and insomnia as a second to tinnitus. Took their documents and submitted to va showing I had clinical/professional proof.

      I got anxiety / depression at 70% secondary to tinnitus . Remember what he always say TURN in YOUR OWN DBQ !!! I got mine approved in 45 days with no exam from them . Sometimes you might have to do a exam but it’s best to try and avoid their doctors

    I have ptsd and tinnitus both service connected. I have been going to the VA for 10 years over my migranes, I have an appt every other month. I get at least 2 prostrating migraines a week. I get all kinds of meds and shots. Go to my CP exam and he writes down that I dont have any migraines and he doesn't care what the VA says. Denied. Filed a complaint and was supposed to get a new exam..NOPE. told me to do a supplemental and get over it

    Let's see . I'm 50 for primary OSA.. not secondary but primary service connected have connection for 10 tinnitus.. a few other joint problems .. I have diagnosis from psychogist that is a VA doctor for depression.. been on meds for years and see them every month mostly.. I got denied secondary connection and of course the doctors won't right nexus letters..

    I have 70% from PTSD. I filed a secondary claim for headaches (for PTSD) and recently received a 0 rating. I’ve been seeing a doctor the past year, who diagnosed me with Migraines caused by PTSD. Would you recommended a write a supplemental with the evidence or request a higher level hearing? Lastly, would I be able to use the line (for 50% headaches rating) for PTSD, or is that only for secondary tinnitus?

    I have 10% tinnitus.
    I applied for sleep apnea they denied. Proven hearing loss, denied.
    Was 87-90 non-wartime.
    Currently use bipap machine for the last 15 years. Plantar fasciitis that was denied. Can you recommend someone to file again? I have no insurance. No dr other than the va itself.

    Can you help me? My husband serve in Vietnam. He was out in the jungles where agent orange was dropped on him, vegetation and rivers. There us no question of this. At just 55 he was diagnosed with stage 4 last stage colon cancer. He died no help threw a 5 year struggle to get medical help. I did apply to v.a. this case. Financially as a wife I have not been able to except that there is nothing for his family.

I went threw the whole miltary service and after for 42 years of marriage. To now realize my husband had serious mental challenges, and health issues that were because of his time in Vietnam i and our children are slowly realizing. The financial situation was not good.     How can you connect sleep apnea to be service connected when I got out in the 70s and went to two sleep studies in the last 8 years and had a CPAP prescribed for me. I was diagnosed with severe sleep apnea and currently use a CPAP. I’m confused as to how to connect it with the service. Thanks.

    I have 5 or 6 pages of documented migraines in my STR and frequent migraines marked on my out process paperwork!! I got meds from the VA, but no actual diagnosis from them!! Is that enough evidence or a actual diagnosis still needed?

    I have migraines all my evidence pointed to a 50% rating, but I did a 10-minute c&p call and that dr. said my migraines where less than likely cause by tinnitus but my dr said they were more than likely cause by it. And they said I only had 1 a month when all my evidence said I had 3 to 5 per month, and they gave me 30% I filed for a HLR with conference they have not called yet. But I thought if 2 doctors have one favorable and 1 not, that the va would side with the veteran? What's up with that? I will point it out in my HLR the no exam c&P lied! I had both a dbq and nexus favorable to me from my doctor.What can i do to help myself? Please help I dont have the money to hire an attorney or anything.

      You are S/C for migraines, you are over the hump. What I didn't hear you say that in your statement for migraines, you listed the 50 percent criteria, and you obtained a copy of the exam to see if the doctor marked the 50 percent criteria.     I have 0% migraines secondary to tinnitus. However, I am 100% for PTSD for social anxiety and impairment. My question is, could I have apply for an increase to my migraines citing the VAs previous findings about my PTSD to help with the increase even though it’s currently linked to another service connection?

      You are already service connected. The question is, do you have evidence that shows you meet the 10, 30, or 50 percent for migraines. I have a video on how to win your claim for migraines.     Well Dwayne I wished you were my rater because it seems like they are doing their own thing now...38 cfr thrown out of the window.
    I submitted my GERD claim with all symptoms listed in personal statement, my cnp examiner gave favorable results and had all of my symptoms listed but forgot to check a box and they gave me 10% instead of 30% what my symptoms are. HLR denied my appeal. I brought out the point of my personal statement and the doctor's statements. The person conducting the HLR stated but that is just what the veteran is telling the doctor not really medical 😮???? Isn't that is what everyone does, tell the doctor what is ailing you????? He DENIED MY CLAIM

      I'm here now and my videos give you the blue print. I agree, it seems some are doing their own thing outside of the VA. If you used the wording in your personal statement, you can use that on a HLR if you elect that route. They can use subjective and objective evidence, and the argument could have been made for reasonable doubt if you added the 30 percent in formation in your statement.     I assume this is for people already SC for Tinnitus. It has become Very hard to get anyone connected with Tinnitus lately. And the Secondaries are getting wiped out as well. How are you getting these done today? Has anything changed? We do IMOs often and most of the Vets still do C&P exams. So are you arguing with the VA and telling them to refuse C&P exams? Thanks!

      I'm not telling anyone to go or not to go. When I rated I used the 38CFR that states no further exam is needed. As someone trained by the VA, I rated hundreds of claims with DBQs submitted by the veterans without a C & P exam. The vet will have to determine if they want to make the VA follow their own regulations. I told the other VA rater that received the same training as I did, follow our training.

    Hello brother, I have a PACT Act question. If i was denied a respiratory claim do to burn pit exposure back in 2014 and because of the pact act everyone now rates it. Is it possible to get my Chronic Sinusitis and Alergic Rhinitis effective date 2014.

    If you miss your C&P exam for Tinnitus and get denied, can you just HLR and say you somehow missed your exams and if you can get rescheduled? There were 10+ conditions claimed and hearing test slipped through the cracks.
    Is 2nd option submitting a supplemental with a personal statement saying I missed the exams?

    Just got approved for tinnitus. VA said because I have an OTH I probably would not get it because the VA considers an OTH Dishonorable. The DOD and VA are different. Do I need an up grade to get benefit.

    My C&P examiner said that Tinnutis can not cause migrans..... even after i did a supplement with VA approving it in court cases and still denied...

      Thank you for your comment. I want to clarify that nothing in this video encourages false claims. My message is simply about ensuring veterans understand the process and only file claims for conditions they may actually qualify for. Veterans should never file claims for conditions they do not have, but they should also not miss out on benefits they are entitled to. It's about being informed and filing correctly. GO ARMY
