Land not passing a mining claim is not removed from mineral entry, rather it is held in limbo until all time has passed for the original claim patents filling of any appeals. This is because the federal government does not want to become involved in civil law suits between two claimants on the same land. Also, this protects the federal government from civil law suits from either claimant.

Some States are different also, Some you must go to the County recorder first, others you must go to the B.L.M. first. Always know your local laws / rules.

People filing claims for a couple weekend outings a year doesn’t sound like a successful mining venture to me. Stop claiming up every inch of river, you guys are the worst.
