I know of someone who recently got EB-1 approval while still doing her MBA in the US. She doesn't have a prior advanced degree except the one she's about to acquire. Is this allowed as well?
EB1 is more competitive than EB2, but if the person has exceptional achievements and awards to show for it; then it’s possible to get it without advanced degree. But for EB-2 you really need atleast a masters degree

(2) I was in the USA last February on a B1/B2 visa, Is it possible to file EB1 or EB2 while in the USA as someone with B1/B2 Visa (Multible entry ) then once form I-140 is approved proceed with adjustment of status? (3) Showing immigration intent while on a non-immigrant visa (b1/2) . How can this affect the final decision if i decide to file 1-140 form while in the USA ?
Hi! 1. EB1 has more proof burden, and more competitive, EB2 is more accessible. 2. Not advisable. Dates are no longer current as it used to be. It might take about a year from getting I-140 approved before you’re eligible for I-485. You obviously can’t stay on b1/b2 for that long, and the last thing you want is to be out of status. 3. If won’t affect your form I-140 as long as you don’t file that form within 90 days of entering the country, if you do, it shows you have preconceived idea of adjusting your status and you’ve abused the b1/b2. In general, I’ll advice that you don’t initiate the process while you’re visitors visa, do the processing from outside of the country, or move to j1 visa or some other reliable visa category. Visitor visa is not a very reliable visa to do anything unless you’re married to an American or something

I think OPT applies to everyone regardless of whether they’re in STEM or not. STEM people get 2 years and non-stem people get 1 year of OPT.
