Hi Atty. Abt Art 87, destierro. How do judicial authorities ensure that convicts sentenced with destierro follow the 25km to 250km radius? Do they have a tracker? Thank you
Unfortunately, wala pong tracker. So hindi po natin maseseguro kung susunod ba ang convict sa penalty of destierro na ipinataw ng korte.

Question po Atty. about Art. 29, on the part of preventive imprisonment shall be deducted from 30 years. Is it after 30 years of imprisonment the deduction is applicable or before 30 years?
Let's say the period of his preventive imprisonment plus GCTA has reached 24 yrs. For purposes of art. 29 in relation to art. 97 (as amended by RA 10592), such period of preventive imprisonment plus GCTA will be credited in his favor by deducting it from 30 years. Hence, 30 minus 24 = 6 yrs. The convict will be serving 6 yrs more na lang.

Ma considered po ba na penalty Yung indemnification?
Hindi po sya considered as a penalty. The only penalties are imprisonment and fine. Yung indemnification po is part of the civil liability of the offender.
