Thank u for telling this. It needs to be told. When I applied they said no u can't. My ex was dead, divorced . But I kept telling them. Married 25 years. An yes I got it
I am Emmas son. I had went down to a location in Brooklyn NY and they were absolutely wrong. They were so confidently and proudly wrong and just brushed me off and said “sorry ALL transactions must be done at this certain location ONLY” …. which was incorrect.
Yes, my son went down to a Brooklyn, NY location to bring his dad's birth certificate. They had two different dates for his birthday, so they told me over my phone meeting, if I was still in contact with my ex, to have his original birth certificate brought to any social security office. I am in Yonkers, my son is in Brooklyn, near my ex. I was told drop offs did not need an appointment. But in Brooklyn they refused drop offs, except downtown. In Yonkers, NY, they still allow drop offs, for me to bring marital and divorce papers. I then had to go back to the Yonkers location with my ex birth certificate...which he trusted me to do. Downtown Brooklyn could have been a deadend or very crowded The whole thing was nutty, too. They expected me to get my ex to bring his birth certificate I said, "What if I had lost contact with him." They said then it would take time for them to track him down, and keep requesting he brings it into an office, and if he had lost it, he had to get a new one. He would have to do this, even if he was not yet going to collect. Mama Mia. Divorce often means you are no longer in contact with an ex. They make seniors who often are not well to have to go through loops. And the hardship waiting for the money, too.
Thank you for blessing many people, a high percent are women who were the lower earner and end up in poverty as seniors…I hope many will get a higher benefit due to your efforts and practical approach.

So he acquired a job for 20 hrs. Then SS took his Foodstamps and disqualified his disability as he was working. Hes 😢 fighting the mess with an attorney. People must get info signed in print or taped in certain states to protect their benefits. 😢
One of my good friends was unaware she could draw her ex-spouse’s SSI. I let het know about this when she was 65. That is what she is drawing from now. I’m so glad I told her about it!
I had a friend who told me that her divorce decree forbade her from filing on her ex-spouses SS record. That is absolutely not legal. An ex-spouse or decree cannot prevent you from filing on their record. There is no mechanism in social security to record such a decree or report anything to an ex-spouse. An ex-spouse will never know if you file on their record.
That is simply malicious as filing on an ex's SS does not impact the ex's benefit at all. I question the legality or validity of such an agreement too. What kind of idiot did your friend have for an attorney? I think this should be actionable back to them.
I went through that same ordeal at a dss office in SC. I wanted to apply for Medicaid and the lady at the window told me that if I didn't have kids I wasn't eligible. Shortly after I was hospitalized and assigned a case worker who applied for my Medicaid. When I told her what the lady at the dss office had told me she just shook her head.
Something you said reminded me of when my wife was qualifying for disability. There was no doubt she would qualify buy we still had to go through the process of being rejected and appealing and paying part of her backpay to a lawyer. Once she finally got in front of a judge it took less than five minutes for him to rule in her favor.
Thanks for sharing this info with your viewers. I learned this years ago and share it with my friends getting ready to draw. I do not have the audience you have.
Missing out on SSI! I can not get SSI to answer their phone! The natio number, 120 minutes wait. The local number, record message abruptly ends mid dialogue. In person, not allowed, tells me to call THAT office number, with the bad recording. Next week will take 3 cross city buses to try another office in person. I have met ZERO people who have been able to get through on the phone.
There’s a mistake on mine that I have to have corrected before I can file. Was finally able to round up everything they needed the week of Christmas… I haven’t been able to get through either. I’ll be making the 78 mile round trip before the end of the month to see if I can set an appointment in person.
It can take 8 hours to get thru on phone. I would do two things. #1) Contact your local Congress person's office for help #2) Reach out to media #3)Write directly to head of SS in Washington DC
This is so sad but so true. I called the IRS and got a very rude person who spoke like she was so uneducated after holding for an hour. I called back and got a professional but I don't think she knew what she was talking about either. One thing that made me uncomfortable was I asked if I could write to them for my issue and they each gave me 2 different addresses so if they can't get that right, how could they get more complicated things right. But it's not just government employees, it's everywhere. When I was working, I always was detailed and asked questions to learn the correct thing to tell the customer. I felt like I was looked down upon because I took longer. Employees who just whizzed through things and completed tasks fast without asking questions got treated better and promoted. Corporations value speed over accuracy and good customer service.
I didn't know that I had to file a separate form to get my ex's social security, and I got backpay. I'm not sure that someone will lose the money unless they never file to get it.
There is a spousal calculator on the SS website you can use to figure out if yours or half your spouses is higher. I took SS at 62 and my wife who is three years younger also claimed at 62 so the spousal amount is much less than her using her own work history. It pays to do a deep dive and research this as you could be missing out.

Every Australian gets the same pension plus rental assistance for those who don't own their own home. As a couple (home owners) we can have approximately $400k (I wish) in bank before pension reduced. I hope this does not change here. Our rents are sky high, food is sky high, utilities sky high. We moved to small country town for lower rates so we could survive if one of us dies. I hope you all do well. NOTE - this should be the same everywhere. @@gloriouslifeonwheels3621 Yes, we also have free medical and free dental. The dental is hard to get these days have to wait at least 2 years. My ex-husband worked for the USPS for many years. We weren’t married quite 10 yrs. My Social Security has been larger than his. Now with the Social Security Fairness Act there is a chance his SS could be greater. Not that it matters, I don’t qualify anyway. I’m not sure how this Fairness Act is going to play out. Time will tell....
It is same in australia. Our social security is worse cant claim on ex, deceased husband at all. All you get is 1,140.00 a fortnight but costs here are worse than usa. Rent the same though. Go for it usa.
@gloriouslifeonwheels3621 no both genders get the same amount . Get paid fortnightly men do not get more social security than women here. Singles here whether man or women get 1140.00 every 2 weeks with free drs visits. Discounts arenot much of car rego. Electric etc it is only about 20.00 a fortnight. If renting the govt gives 200.00 a fortnight extra. So monthly a single gets 2,280.00 and a couple still together gets 3,800.00 a month or 900 each a fortnight. Defence pension extra 250.00 a fortnight or 500.00 a month extra. But sadly if married to defence man for 15 years and divirce you get nothing, however the 2nd wife teceives it even though not in dafence during their marriage which sucks. Cost of living worse here 1 doz eggs 10.00 ,caged eggs are 7.00 . Fuel 2.00 a litre which is 6.00 a gallon in usa measurements. 25.00 for 10 lamb chops or 30.00 a peice of rump steak. AT leastTrump is giving you a bonus of 2500 twice in 2 pays. Workers were paying tax for a decent retirement sadly our govt are helping themselves to a system designed for us. In australua superannuation is now compulsory for all employers to pay but sadly majority baby boomers missed out. 270,000 for single and 1/2 mill for couples before pension deducted.
YEP, YEP & YEP..😢😮 I personally experienced this with SSA office. About depending on who you see or talk to on WHATEVER DIFFERENT DAY, you will get ALL SORTS OF CONFLICTING INFO about your benefits entitled or not entitled to😮😮😮😮 Something very disturbing & financially crushing to those who've worked & paid into this FARSE. A PETITION SIGNED BY CONCERNED CITIZENS TAXPAYERS NEED TO HIT THE CONGRESS FLOOR. These folks who work there for the disability, medicare & social security there needs to be a giant overhaul. You would think there would be a printed out manual for these folks to go by..
They need to change the 10-year rule if a spouse passes away. A lot of people wait till they are older to get married and it's not right if that spouse had the quarters to get Social Security
I lost 3 months of Social Security because they overpaid me. Now they want their money back. So no money. I’m pulling my annuity in order to live. Ugh!! Got the teardrop trailer though!
File an appeal. I heard there is a provision where you can demonstrate a hardship and you may not have to pay back over payments that weren't your fault or fraud.
I asked to make payments. I was originally told I could. When I asked I was told Social Security already set things up to withhold the money so there is nothing I could do. I mentioned losing my house. The answer was that there is nothing that they can do. I spoke to supervisor and she’s the one that said too bad. She blamed me.
Also... If your husband dies and you are alone with children. You can get on Social Security because of children. So you will get a check and you will get a check for each child. You will receive the check until they are 18 years old. After they are 18 you will no longer get a check for yourself. Not sure how many years you would have to be married to your husband. If you get married, you will still get a check for just the children but not for you.
I had a situation with the IRS where they were telling me that I owed a substantial amount in taxes, which I did not. But they could not tell me why and did not have the records as they said they had been purged. They said since their records showed I owed that amount I needed to pay it. I guess that nonsense works with some people who get scared and pay. I told them I would see them in court and for them to explain to a judge how I owed money they could not explain and had no records for.The next thing I knew I rec'd a letter saying the matter was closed. Simply crazy!
I get mostly SSDI with a small SSI top-up from the state of California. Only my SSDI got the COLA increase of 2.5% The SSI got zero. Does anyone know why? With no SSI raise and a $10 reduction in food stamps, my actual COLA is 1%.
This it’s true those workers are not doing a good job it’s scary because I’m going to deal with that and yes yes they make yuo wait for hours on the phone and they aren’t nice and yuo can’t be rude because they will not help yuo
I need to file against my ex husband. We were married 34 years. We never divorced but we have been legally separated for 13 years. He gets double what I get. Every penny would help.
if you are divorce, you must be married for at least 10 years in order to collect. you need to be married at least a year if your spouse pass away to collect
There are a number of exceptions tonthe required length of marriage if your spouse dies such as if it was aj accidental death.or if they were on active military duty. It pays to check the current rules.
My ex is almost 2 years younger than me. First I claimed under my own name, now under his, since he is turning 62 this month. I was approved. Yes, you have to wait until he is 62, but can apply a month or so before his 62. They will want to see both an original copy of marital paper and divorce paper. If you lost, you have to go online to vital records, and buy new ones. You can not show photocopies...have to be originals or replacement ones. It took 5 months to get a replaced divorce certificate since I did not remember date of divorce or have the document original number.
Is it true that if you make over half of your ex spouse income you don't qualify to get the ex spouse benefits? That's what l was told, can anyone answer that question for me?
My understanding 8s that you can still collect on your ex's SS if it would result in a larger benefit payment than yours. If I were you I would insist on applying under you ex's ajd if they deny your claim consult with a SS attorney. Get the denial in writing!
I think there may be an exception to the 10 yr requirement if you are widowed before 10 yrs. But people in that circumstance need to check it for themselves.
Your ex does have to have a Amount of SS that is twice that of yours, in order for you to get 1/2. you have to be divorced over 2 years, and be over 60, and you have to apply for your own first..
My understanding is that the amount you would receive filing under you ex's simply has to be more than you would receive otherwise. But I am not an expert so I strongly urge people to check the SS website and still insist on filing under ex's if his earnings and benefit is greater getting an approval or denial in writing. If denied consult with a SS attorney to possibly file an appeal.
They denied my friend same amount of time married 9 years 7 and 1/2 months must be married 10 years. Even after contracting ss lawyer he told her same thing.
I think thats not totally correct… if u r still married, u can collect on d husband benefit after being married a year. However if u divorced d husband, u can only collect on husbands if u were married 10 years n has not re-married n husband s still alive. If husband passed away, i am not sure on wife eligibility
Please tell your friend Survivors benefits can be collected after being married for 9 months and as early as age 60. If someone is trying to collect on an exspouses benefit, they DO need to be married for at least 10 years.

YEP, YEP & YEP..😢😮
I personally experienced this with SSA office. About depending on who you see or talk to on WHATEVER DIFFERENT DAY, you will get ALL SORTS OF CONFLICTING INFO about your benefits entitled or not entitled to😮😮😮😮
Something very disturbing & financially crushing to those who've worked & paid into this FARSE.
It really is an example of government at the absolute worst!!
They need to change the 10-year rule if a spouse passes away. A lot of people wait till they are older to get married and it's not right if that spouse had the quarters to get Social Security
I think you only need to be married two years when spouse dies to get SS.
There are exceptions if you are widowed!
Unfortunately, you have to hire an attorney who specializes because social security will never give you a straight answer.
I have to agree.
Also... If your husband dies and you are alone with children.
You can get on Social Security because of children.
So you will get a check and you will get a check for each child.
You will receive the check until they are 18 years old.
After they are 18 you will no longer get a check for yourself.
Not sure how many years you would have to be married
to your husband. If you get married, you will still get a check for just the children but not for you.
If you had seen the committee meeting with the head of SS you would really be outraged!
Glad I didn't see it. I probably would have blown a gasket🤣
The IRS is the same way. You can talk to 2 or more different people there and get different explanation from each one.
👍😍
I get mostly SSDI with a small SSI top-up from the state of California. Only my SSDI got the COLA increase of 2.5% The SSI got zero. Does anyone know why? With no SSI raise and a $10 reduction in food stamps, my actual COLA is 1%.
You need to check this with SS directly as it is my understanding that both SSI and SSDI should grt COLA.
This it’s true those workers are not doing a good job it’s scary because I’m going to deal with that and yes yes they make yuo wait for hours on the phone and they aren’t nice and yuo can’t be rude because they will not help yuo
It is a sad and disgusting situation!
I need to file against my ex husband. We were married 34 years. We never divorced but we have been legally separated for 13 years. He gets double what I get. Every penny would help.
Absolutely file on his to see if it would help!
Get a Grant!
I draw my husbands social security but I took it at 62 and only get half
There is a deduction for taking SS early. I don't know how it impacts drawing against a spouse's SS.
When i found out and they denied mine even my husband work longer and make double of mine 🤦🤦
I always say file and get their response in writing. Then speak with a SS attorney and file an appeal if they were wrong.
if you are divorce, you must be married for at least 10 years in order to collect. you need to be married at least a year if your spouse pass away to collect
There are a number of exceptions tonthe required length of marriage if your spouse dies such as if it was aj accidental death.or if they were on active military duty. It pays to check the current rules.
You can only
????
My spouse is 1 year younger than me, so I assume I can't file until he is age appropriate?
My ex is almost 2 years younger than me. First I claimed under my own name, now under his, since he is turning 62 this month. I was approved. Yes, you have to wait until he is 62, but can apply a month or so before his 62. They will want to see both an original copy of marital paper and divorce paper. If you lost, you have to go online to vital records, and buy new ones.
You can not show photocopies...have to be originals or replacement ones.
It took 5 months to get a replaced divorce certificate since I did not remember date of divorce or have the document original number.
@Emma.E.Emerson ok, not divorced but thank you.
@@92Tulips Yes, same if married, husband has to be 62. 🌻
Check on thr website or Google it. There is some pretty good information online too.
You can only claim on ex after ten years marriage, people just go to the government sight and read the rules.
I definitely recommend checking out the SS website.
Yes you can claim on spouse or ex spouse but you had to be married for 10 years.
I think there may be an exception to the 10 yr requirement if you are widowed before 10 yrs. But people in that circumstance need to check it for themselves.
Its cause they mostley work from home and they dont care😮
Your ex does have to have a Amount of SS that is twice that of yours, in order for you to get 1/2. you have to be divorced over 2 years, and be over 60, and you have to apply for your own first..
My understanding is that the amount you would receive filing under you ex's simply has to be more than you would receive otherwise. But I am not an expert so I strongly urge people to check the SS website and still insist on filing under ex's if his earnings and benefit is greater getting an approval or denial in writing. If denied consult with a SS attorney to possibly file an appeal.
I think they don't train people on purpose.
Now that is an interesting thought🤔
What of you were married for 9 years and 7 months? I never remarried.
They denied my friend same amount of time married 9 years 7 and 1/2 months must be married 10 years. Even after contracting ss lawyer he told her same thing.
I believe you would be out of luck unless you were widowed. But I am not an expert. I suggest you check with an expert.
You have be married at least 10 years to get any kind of benifits from your husband
And you cannot be remarried.
It's good to know these things❤
I think thats not totally correct… if u r still married, u can collect on d husband benefit after being married a year. However if u divorced d husband, u can only collect on husbands if u were married 10 years n has not re-married n husband s still alive. If husband passed away, i am not sure on wife eligibility
@@bfdee1603 an ex spouse can collect survivor benefits when the exspouse passes
@@bfdee1603 She was marry to him when i pass away and they said 10 years.
You can be remarried under certain conditions!
no i have a friend who husband died a couple months before there 10 years so she can not get anything
Please tell your friend Survivors benefits can be collected after being married for 9 months and as early as age 60. If someone is trying to collect on an exspouses benefit, they DO need to be married for at least 10 years.
@@VTLovesSFRight. 9 months I heard. We have to as seniors keep educating ourselves .❤
I am told there is aj exception to the ten year rule if someone is widowed. Tell your friend to definitely apply!!
I have heard it is even less than 9 months in the case of being widowed.
