Parental Support After 19: The Facts About Child Maintenance

  • Is child maintenance payable for a child that's 19 years of age? Well, the answer is yes, but also no. Let me explain. Child maintenance can be payable up to the age of 20 provided the child is in education. By education, we don't mean university; we mean education up to Level 3, which includes A-levels or their equivalent. If a child is 19 and attending college during an A-level course and child benefit is being paid, then the parent can receive child maintenance for that child.
    However, if that same child leaves education at 19 and then decides to go back into education, they won't get child maintenance. This is because once they leave education, child benefit stops. If the child benefit stops and the child reaches 19, it is not possible to make a new application for child benefit because the cutoff date is the 19th birthday. If you have child benefit already before their 19th birthday, then you can get child maintenance until the child turns 20.
    For instance, imagine two identical twins both 19 years old and attending college. If one leaves education, gets a job, and then returns to education after their 19th birthday, they will not get child benefit or child maintenance. However, the twin who stayed in education will continue to receive both.

    Child Maintenance Service in the the UK is a disgraceful. There are some great examples of better systems in other countries. It needs complete reform and more focus on encouraging contact, currently it allows the receiving parent to deny contact in order to get more money.. this is wrong and not good for the children involved. I always had regular contact overnight before she realised she would get more by stopping it

    Thanks for this, you answered a question just as I thought of it.
    I understand there are certain circumstances that children require financial help but in my opinion when most children leave secondary school, CMS should stop as the child should get a job and start contributing to the household.

    Also why are we paying child support for an adult.. isn’t the age a child turns an adult 18.. at least this is always what I thought. And even so at 18, why is it not paid directly to the child who is now an adult.

    Is the parent who receives the CMA get to spend the money on whatever they choose to, i.e. going on holidays shopping, restaurants, while the child gets nothing? Is there a way to prove what the money is spent on. What if paying parent has an income of 100k what's the amount going to look like and how much of that is a "Need" for the child vs "luxury".

    How do I get a case against me closed ? Or even start the process? I have 50/50 and I'm still required to pay each month.
    the other party still gets full benefits etc and I'm entailed to no support and I'm unable to work full time yet I still have a case open against me. Any information would be greatly received.

      No, the only thing that will reduce your payments is pension contributions

      Maximum end date is 20th birthday if still in college education.
