As we move through the month, there are several important changes and key dates to be aware of, especially if you’re involved with the Child Maintenance Service (CMS) or receiving child benefits. In this video, I’ll cover everything you need to know-from the termination of child benefits on August 31st, to the process of reporting that your child has left education, and the impact this can have on your child maintenance payments.
    We’ll dive into why CMS cases close when children finish their education and how you can stay ahead by submitting reports via the CMS portal. I’ll also explain why arrears may appear, why the CMS might not be working as quickly as expected, and what to do if you're still being asked to pay child maintenance even though your child is heading off to university (or has already left for college or higher education).
    The video will also explore some common issues: how arrears are calculated, why it’s essential to understand whether you're paying in arrears, and how to address large payments that may come due at the end of your CMS case.     One situation I would advise to be aware of is if the receiving parent doesn’t reply to child benefit letter so the award ends, but then they call them up and get the award reinstated and backdated. If the child benefit doesn’t get backdated then if the receiving parent wants child maintenance they will need to open a whole new case, but if it gets reinstated then CMS will reopen the case. This means you could get told the case is closing as child leaving full time education because HMRC tells CMS that child benefit ended, but then is reopened under a mandatory reconsideration because CHB gets reinstated

    Who do you complain to about the lie of speaking to the RP. I’ve had 3 rejections saying they have spoken to the RP and they have given evidence that my child is still in education. 2 of the 3 letters were as you said on a Sunday. My young adult has started a HNC course at the college which doesn’t qualify for CB. But every man and their dog is overlooking this. HNC is not eligible for CB on the gov website. Where do I go from here

    Do you know how many hours a child has to be at college to be classed as still in full time education and required to pay CMS?

      More than 12 hours per week (not including breaks and lunches)

      12hrs per week, but its something that people complain is ignored.
