What if po naka-20 years of OCEN na po ako but I am in bad faith (so supposedly 30 years dapat ako para maka acquire ng ownership) can I still have the land titled even if hindi pa po ako ang owner? You’re correct. A foreigner may inherit the land. But since the couple did not have a child, the foreigner spouse will inherit together with the parents and/or siblings of the deceased Filipino spouse. The estate should be settled as soon as possible in order to distribute the estate to the heirs. Also, that will save them from late payment penalties on the estate tax.
@@TheHowsofLaw so am I correct in assuming if the foreigner spouse dies (more common), the wife must still divide the estate among mandatory heirs, leaving her homeless also ( assume the house and lot are the only assets)?
No. If it is the foreign spouse who died, the Filipino wife has no obligation to subdivide the property because as the only Filipino citizen between the two spouses, she solely owned the lot. The lot or half of it will not form part of the estate of the deceased foreigner spouse because he owned nothing of it when he was alive thus, nothing can be transmitted by him to any heir upon his death.
As regards the house, if it was co-owned by the couple, 1/2 of it becomes the deceased (foreigner’s) estate (as the other half belongs to the surviving spouse, in her own right),and subject to distribution to the Filipino wife and the deceased foreigner’s other heirs such as his own descendant (not of or with this wife) or ascendant or the siblings of the deceased. Now the wife as co-owner of the house (and a big part of it - more than half is hers) cannot be ejected from the property.
@mythdiaz6596 The foreigner spouse cannot co-own the land, just the house. Improvements are not covered by the prohibition against foreign ownership of lands.
I have 2 buildings on 1 title lot 2 10159...I have since found out there is another title with water access carriage way that isn't registered with nswlrs ...council says they want the carriage way but some documentation for lot 2 10159 shows the title as being 1/323681 its prime mixed use town central land with a fee simple title I believe....can you help....
