      The 4th Amendment has no provision for: Detention, Officer Safety, Reasonable Articulable Suspicion, Exigent Circumstances, Pat-down, Pain Compliance, Taser, Deadly Force, Kidnapping, No Knock Warrant, Dogs, Wrong Address, Policing, Investigation, Inspection, Inventory, Immunity, Traffic Stops, Human Trafficking, Fascism, etc. The only practice condoned in the 4A is seizure pursuant to a warrant, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (The word "upon" means "probable cause" comes before a "warrant", not after the search.) The SCOTUS is a Private Corporation (see D&B).
      The 5th Amendment is not about Speech or Silence, it's about the use of Coercion, Threats, Intimidation, Violence, or Torture to obtain EVIDENCE / CONFESSION / COMPLIANCE.

      ---He was for not having to show ID. He was wrong about the standard however. It isn't if he committed a crime. It is if there is reasonable articulable suspicion that he did or is committing one. Terry v. Ohio.

      @@955472 Depends on the location. Texas for example only compels the showing of an ID when lawfully arrested. The majority of places however do have a reasonable articulable suspicion of a crime standard. The problem is once their observations and "investigation" dispel the concern by the alleged caller there is no longer a legitimate basis for compelling identification.

      99% of the time, they get the ID because the average citizens don't know it's a violation of their 4th amendment right, especially when the cop lies and say it's impeding his investigation. Now that these audit 📹s are out on TH-cam. These cops now have to deal with citizens who are starting to know their rights.

    "Why are you backing up?" How about this: Two complete strangers are confronting me. Both are wearing clothing that suggests that they are law enforcement officers. Both are carrying a firearm, and enough spare ammunition to engage in a running gun battle. And, based on the history of law enforcement, one of them could decide to shoot me dead on a whim, and the other will cover up what's taken place. I would be more worried about someone who does not back up, as they're either unaware of, or unafraid of the danger they're in.

    If an anonymous complaint that some unknown person does NOT like your lawful presence in public could obligate you to be detained, identified and interrogated by the police then there is no Fourth Amendment protections. ANY cop at ANY time could stop ANY one and say, "We got a complaint so, Stop, Identify yourself and Submit to questioning.
    Remember what SCOTUS Associate Justice Robert Jackson once said, _No lawyer worth his salt would advise his client to answer question of the police under ANY circumstances. The laws are too many, too vaguely written and to widely interpreted that an otherwise INNOCENT man could find himself embroiled in accusations of illegality while having no INTENT to commit any offense._

    Somewhere around 3:50 or so, the topic of a firearm ( a gun) came up. Somebody called saying he has a gun. Even if you do have a gun, fully loaded and live; It is your Constitutional Right !
    No, you don't need to get The Government's permission to carry Firearms ! No, You don't need a Firearms permit or license to carry firearms, No, you don't need a Background Check ! No, You don't need to take Firearms Safety Courses ! Taking a Firearms course is a good thing, but NOT required ! It is Your Constitutional Right to carry Firearms ! NO, The Police or Government Officials don't need to examine your firearms to see you're carrying it correctly. Those are ALL LIES from The Government !!! You Have A Constitutional Right to carry Firearms of any kind, and as many as you like. There's NOTHING The Government can do about it. NO permits required !
    Let me ask you this; When you go out and buy a shirt, do you have to get a background check ?
    You see how stupid that is ?

      Awhile back, some lady had a boyfriend. According to her; That man had a horrible tamper problem. So she decided to break it off. Yet, because she broke it off, he threatened to kill her. She was now fearful for her life.
      She decided to buy a gun for protection. But they told her; she has to go through the legal system. The background check takes about 7 days.
      She had one more day to go, and she would have her firearm. But she didn't make it ! Her ex- boyfriend caught up and shot her dead ! She had 1 more day to go, and she was killed. Her ex-b/friend shot her dead !
      It's only obvious; Your Legal Government System is NOT working !
      Personally, I would sue The Legal System over that. But all the money in the world is not going to bring her back.
      The Constitution clearly says; You have The Right to carry Firearms ! It NEVER Says: Providing You are approved by The Government System !
      Had this lady already had a firearm, she would still be with us today.
      But you're too stupid to see that !

      Never assume that a cop is telling you the truth about anything. They're trained and encouraged to lie as a pretext to manipulate people and get information. There may or may not have been a call, and if there was we can't assume anybody said anything about a gun.

    "It's making me Suspect." says the cop when the man is backing up. The problem with many cops is they are working above their mental ability. Rather than talk like a person, they have a habit of thinking about what they want to say, processing their lies, and simultaneously translating into Cop-Speak. The problem is their minds can't handle the workload and they start to misspeak and trip over their own words. This only gets worse as they deal with the nervousness of dealing with the public and the cognitive dissonance associated with either lying or violating their oaths, the law, their policies and procedures, and The Bill of Rights.

    He could have saved some time by asking 'do you have a reasonable and articulable suspicion that a crime has been or is being committed'? At that point they would have to answer no (EVEN IF HE DID, IN FACT, HAVE A GUN HE WAS OPEN CARRYING!), so then he can ask 'am I free to go' and they should answer yes, and if they dont say 'I invoke my 5th amendment right to remain silent' then go back to the previous step.

    It’s so infuriating to hear police say - go and complain. It highlights the problem. Police get away with abusing rights so many times that they don’t care if you make a complaint because nothing is done to them. It’s like a criminal being judged by his fellow gang members.
