What Does it Take to Meet a Social Security Listing?

  • In this video, I take a close look at Listing 1.04 which covers “Disorders of the Spine.” As you will see, a close analysis of this listing reveals that Social Security requires radiographic evidence such as an MRI or CT scan, evidence of nerve root impingement, and evidence of inflammation.
    Because spine disorders are extremely common, SSA makes it very difficult to win disability benefits based on a medical diagnosis only. This listing, like all listings, describes a medical disorder so severe that SSA will assume you cannot work. I want to show you in this video the level of impairment that needs to be shown by your medical records to win under this theory of disability.
    Of course, you don’t have to meet a listing to win disability benefits. As I discuss on my website at bit.ly/2uugGUU, there are 3 ways to win your SSDI claim - with the listing argument being only of these. So if your medical records do not support a listing.argument, you should not give up and you should continue to pursue your claim.

    I just had my hearing today and apparently so it seems that I was unaware my conditions met a listing. When my attorney opened up with that, I was shocked. I thought I was going to have to fight tooth and nail about functional capacity. The hearing went over... extremely well. A little too well, I'm concerned about how smoothly and easily it went over.

    I meet 2 listings but my local office DENIED me anyway and totally LIED on my paperwork claiming I said I only had Anxiety. I have PTSD and Bipolar I WITH paperwork and meds. Had to hire a lawyer anyway. Disgusting human beings intentionally lie.

    This was really helpful. Could you also do a video about 12.08? I also want to know about cases you've had where the client was really close to 12.08, but didn't quite meet the listing and then what was argued at the hearing?

    Big fan of the videos. I have Ankaloyding Spondylitis. My lower back is completely fused along with my hip on the left side. Was wondering if you've handled any of these cases and what the outcome was.

      You have a condition that can be imaged and a medical history documenting a severe condition. What you need to win are statements (i.e. a functional capacity form or a narrative report) discussing the specific problems you would have - i.e., specific limitations on lifting, carrying, standing, sitting, walking, impact of pain, and reliability issues such as likely missed days per month or likely need for unscheduled breaks during a workday.

      @@ssdattorney my post above and in many others have exactly what you just suggested and more and it was all ignored by the judge. And as I have been saying the alj said she would send me to their dr and continued my hearing and then she decided to send some of my records to their dr who said I didn't meet the listing. And alj explained at the supplemental hearing that had their dr seen me I'm person that then their dr would not be impartial and unable to participate in the hearing. Tell me please is that true?

    I have liver cirrhosis and i sort of meet the listing... Any clarification would be appreciated... Listing 5.05 chronic liver disease with....
    I would have met 5.05A four years ago because of esophageal hemorrhaging with blood transfusion of at least 2 units BUT it says "considered under disability for a year, thereafter evaluate the residual impairments" am I too late? Should I have applied 4 years ago?

      If you didn't apply 4 years ago, there is nothing you can do about that now. In your current application you can argue for disability both under the listing and using a functional capacity argument.

    I have a very rare neurological disorder. Its called NF2. I have benign brain tumors all over my spine and brain. I am applying due to my hearing loss. My word recognition score after brain surgery is 20% in my right ear and they cut my hearing nerve during surgery on my left ear so I will never have hearing on the left. I am 31, but according to the blue book I meet the definition of being disabled. My hearing loss is also not curable by any sort of device. Do i stand a chance for disability compensation?

      I should add I will get a cochlear implant long before a hearing. In next year. How easy is it to get disability with a cochlear implant? It seem automatic according to the blue book.

    What about Fibromyalgia? I'm in pain every day. Have you represented anyone and won with this disease? I also have GAD/Depression/IBS/Fatigue.

    How are they dealing with HIV/AIDS now? I know several people who have gotten the short form CDRs recently. These are people who are Long Term Survivors (diagnosed AIDS) who have numerous other illnesses maladies, namely from being on medications and having HIV for 30 years. They have survived but it's not a life anyone would want.
