How to Get Support from Your Doctor if Believe that You Meet a Listing

  • Your best chance to win your SSD case early would be to prove to Social Security that you meet a listing.
    Social Security's listings, contained in their Blue Book of Disability Evaluations describes specific diseases or disorders that can affect 14 different body systems.
    The diseases or disorders described in the blue book are severe enough that SSA will assume that an afflicted person would not be a reliable worker.
    Since the listings rely more on objective testing, the non-attorney adjudicators who make decisions at the initial application and first appeal levels of your claim are more likely to approve based on a listing than on other theories of disability which require more medical knowledge and judgment.
    In this video I explain what you need from your treating doctor to improve your chances at convincing SSA that you meet a listing and thus are entitled to an early decision.

    Thank you Sir you have the best videos and i appreciate every single one of them and for you taking you're time making these videos for free for people to see and use the valuable information. I wish that i had run accross you're vidoes before i went into the courtroom last year in front of the judge because my old attorney didn't even prep me like he said he was going to. He was very unprofessional and you're the best attorney that I've came accross and i appreciate you looking at my information and giving me you're opinion and I'm currently in the process of signing on with a new attorney and I'm just waiting for some of my main health issues and tests to be done because when i went into court i didn't have all that and my attorney knew this because i had just started seeing a dr through the state clinic because all of my health conditions forced me to retire a few years ago and God knows i would work if i could instead of going through this process of getting disability but if i could work i truly would because i have all my life. I almost won the first time even with a bad attorney and i think it was because my age and i was almost that magic number 50 but not at the time and the judge had brought up the years that i had made most of my money and i truly believe they just didn't want to pay me my back pay and they had dragged my case out for over 6 to 7 years so i pray that i will win this time and i most definitely deserve it because i haven't ever asked for a handout in my life and it hurts my pride more than anything not being able to work and have so many restrictions. But thank you for taking the time to make each and every one of these videos because it's the best free advice I've ever heard and you deserve a 5 star rating in my book. I watch all you're vidoes as much as i can so i will be prepared for when the time comes again. I'm going to sign the nee attorney's paperwork for them to represent me ss soon as i get z very important tests done that is going to be one of the main disabilities in my case and i have to many unfortunately but i want to make sure that the test is done before i sign the papers and a court hearing would be called. I just don't want to take any chances and mess up. Thank you so much for the time and effort that you've taken out of you're one time to help educate anyone who wants to learn and be successful.       He's the best Attorney that I've ever heard of and he's giving people so much valuable information for free and people should give this man a 5 star rating because he has so many vidoes and i watch them almost everyday or any chance that i get so i will be prepared this time because my old attorney didn't prep me or anything when i went to my court hearing last year. I almost won anyways but because i had just got insurance and didn't have alot of information then like i do now. Thanks to Mr.. Ginsberg's videos i try to forever engrave them in my brain and take notes so i don't forget because i heard now that they're doing hearings on the phone but I've got to get my case started but I'm making sure that i have all my main information first before they call a hearing and it would be great if i won without a hearing. Thank you again for all you're wonderful advice.

    Telling the adjudicator that you think you meet a listing is a great idea. Do you think you could also highlight where in your medical records you think it supports you meet a listing and it would help even more? I haven't found a doctor willing to go to these lengths to help me get disability by studying the listings and writing a letter for me.

    What if your doctor refuses to write the letter because they believe they can rehabilitate you but you meet the listing? I have that with lupus but apparently my new rheumatologist thinks she can fix me and she's just circling back around and trying treatments that didn't work for me years ago. Maybe she can fix me but in the meantime I cannot work and I need help.

      Update (changed my name): My doc agreed to fill out my lawyer's form for my hearing. She obviously wasn't able to "fix" me in a year's time, not even close. I had my hearing and was able to have the form for the judge. Don't know if I won yet but I have a very good feeling I'll be approved.

    When there is no listing but your symptoms exactly equal one that is intended for a different disorder could a doctor or attorney make that kind of argument?

      Yes, you can argue that your condition is equivalent to a listing and at the same time argue that your capacity to function at work has been so reduced that you would not be reliable at any type of job.

    I wish I had thought to look for information on TH-cam when I began this long awful journey . I am at the point where my claim is waiting at the Appeal Council . Is it too late for a letter from one of my doctors to do a narrative report using the listing ? My doctor is very agreeable to helping me. I had a previous letter from her but do not see it in my list of documents . I have since sent it to an associate at my Senators office that is helping me.. I have representation that I feel has not been through after watching some of your videos. They did not do any prep work before my hearing with me. Thanks in advance for answering my question.

      Penny, I would defer to your AC lawyer about how to use this evidence and whether it would be considered by the AC. I don't do much AC work anymore and the procedures do change so I am not the best person to ask about this.

    what do we do if we qualify for more than one listing? i can see qualifying under 12.02, 12.04, 12.06, 12.08, and 12.15 w/medical documentation and objectional (QEEG) for 12.02

      You can argue that you meet one or more listings. You can also argue that you meet a listing and you meet a grid rule and you have less than sedentary functional capacity. You do not have to choose just one argument.

    So I have Pulm arterial hypertension, with my pulmonary artery pressures that fluctuate between 60-85. The listing says “3.09 Chronic pulmonary hypertension due to any cause (see 3.00L) documented by mean pulmonary artery pressure equal to or greater than 40 mm Hg” so since I have a pressure greater than 40 would I have good chances of being approved without a hearing? I have multiple echocardiogram and mri and xrays and right heart catheter tests to back up my claim

    Jonathon, my original cardiologist for 13 years has retired and I have a new one . However I have had the same physicians assistant who has joined with my new cardiologist. The p.a. knows my situation best and will work with me if I decide to apply for ssdi. Will the p.a.'s opinion be valid in the judges eyes? Thanks

    I lived on the street for 15 years due to mental health issues. I got off the streets in 2015 and have been trying to get SSI SSDI. SSDI was denied because I timed out will my SSI i also filed be denied as well. I just got the SSDI denial. Will the SSI one come separately? I'm 54 years old.Havent worked in 15 years due to homelessness for mental health.I aslo am blind in right eye traumatic cataract and left eye has traumatic cataract but can see 20-100 vision in that one.

      Conkuur a person with mental disease does not know about his or her mental illness therefore you are not a mental case therefore you do not qualify but don't give fight till the death good luck with your case

      Wow. I believe you are speaking of the people whom are on the farthest side of the mental illness spectrum. Unfortunately most people do not inderstand that regular people suffer from mental illness. People think oh he is mental he cant work or hes mental he is crazy or he is mental he is handicapped, or he is mental and doesnt live a normal life and is not capable of understanding anything. Yes these are true but not for everyone. People with mental illness are often treated poorly and unfairly. This is sad. Educate yourself as today there are many oulets to help. And help needs to be accessible to everyone in need. The ones whom are older and dont understand and are not aware or in denial or uneducated as most are about mental disabilities and have lived life differently than most. Or they are gone baby gone so gone they cant comprehend day to day life. You must be talking about these people. Those are the ones whom dont know they are mentally insane. And have not had help in anyway. This is sad. Or they are kids or young adults whom have parents that are unaware or know nothing about the wide range of mental disabilities that make life so much harder or are in denial "not my kid" and the kids grow up having no idea they have issues which makes life incredibly hard to understand and the capability of living it is a challenge. Those are the ones whom dont know they are mentally challenged and find out later in life they are and so are their parents as it is hereditary. But there is a big gap between them and all of the rest of people whom have mental disabilities on the spectrum. Those are the ones whom have realized something is different, then come to terms with it, then accept it, then figure out how to live and cope with it, and learn all about it and go to a therapist, and a medicine doc, and have your family and friends understand, and when you confide in others and they throw it back in your face and treat you different and learn you cant trust others so you keep it a secret, but it always rears its ugly head at all the wrong times and controlling the beast is the hardest thing to do but at times can be accomplished, while keeping jobs is a challenge due to an episode or just someone finding out and firing you over it as you are seen as "crazy" or a liability. As you try your hardest to succeed you fail often. But you try over n over and succeed because you can. FYI: there are a ton of people with mental disabilities that do know that they are which is half the battle and suffer through life just trying to live it. EDUCATE YOURSELF AND EDUCATE YOUR PEERS. There is a lot of misconstrued information on mental health and everyone handles their beast in different ways and are on different levels of the spectrum. Do not judge anyone, for you know not the battle they are silently suffering or about the one they live publically through episodes. Unfortunately with many mental health illnesses, they are usually visable at one time or another or are all the time or one has worked really hard at not showing it to live the life they want to live. Peace. Love. Hope. Kindness.

      Most people living with a mental dissability know. And in order to get financial assistence, you must have a doctors note stating your mental illness and medication list as well as a note from your therapist and regularly visit and discuss life, challenges, and solutions, and goals, etc. the first step is You realizing You need help. Take care.
