In my family there's a story about how my great-grandparents were expecting to inherit a homestead from an old blind neighbor who was their good friend. After the blind man died, his lawyer inherited the land. And why did the lawyer inherit the property? Because the old blind guy couldn't read what he was signing, of course! The blind guy trusted the lawyer. My great-grand parents were very angry about the whole situation, but they couldn't do anything about it.
What he did is criminal! Complete elder abuse what a shame… Lock him up and give the woman her home back. I got so upset hearing him discussing a lease, the nerve of him 😤

Unfortunately a contract is a binding document regardless if you didn't understood it at the time you signed it. Saying you did not understand a document is not going to uphold in court at all. It is best to never have signed it. If you have an elderly parent or grandparents, please tell them to never sign a document, even at a doctor's office especially if they're the type that doesn't read or understand things. A reasonable doctor or lawyer or real estate agent will wait if you tell them and will not pressure you to signing anything until it is fully understood. Your first clue to a bad person is if they pressure you to sign something even if you say you want to wait.

If any person or lawyer tricked someone out of their home, the agreement should be null void. He should be disbarred and jailed. It wasnt notarized , there was no witness , he claims he made a deal "for his client" who happens to be his wife/ex wife , he claims the house wasnt already up for sale which it clearly was , this is straight up fraud , theft and elder abuse , how could the judge allow this ? If a court can somehow rule that a person is too insane to understand they murdered someone (in some cases) they should most definitely be able to understand an elderly lady not understanding what she was signing after all she has gone through the past few months.

Sadly this happens all the time. I worked in home health nursing with an elderly client who signed a 5 yr contract for an expensive home security system that she didnt need. She had a tiny dilapidated home that literally had nowhere to even install anything. Her daughter was able to get them to cancel the the contract but she was still on the hook for an amount that was equivalent to one yr. of services. This 93 yr old lady lived alone and had dementia and clearly didnt know what she was signing. They spot an easy mark and take advantage of them. This is cruel.
Doesn't she need to actually sign the deed over in front of a notary? It just sounds bizarre to me that someone could write up one of this quitclaim deeds and initial it themselves and somehow take ownership of the property with no other witnesses or the deed being notarized.

The thing is the county recorded the deed. That's what most likely the initial ruling declared it valid. But of course there are other motions and civil proceedings that will challenge the validity of the recording and appeal the judges ruling. I have a strong hope she will ultimately prevail.

Partial consideration is enough to fulfill the terms of their contract. I assume the 8,000 withheld somehow relates to her rental payments she agreed to in a separate lease agreement
All due respect, this is why we as children need to have our parents financial POA properly set up before they get older. Their bills become out of hand, they get behind, by that time someone has to spend weeks if not months digging them out. Or they do something like this and look for someone to help dig them out, and take full advantage. My father was an economist, has zero debt and even his property taxes were behind, he couldn’t process income taxes years before he passed, he couldn’t handle complex phone calls. No diagnosis in terms of cognitive deterioration, it just becomes More and more overwhelming and complex. So help them early folks, so this isn’t a YOU issue in the future.

Three things : she had already made a contract with a legal realtor , and there were no witnesses , and he has not finished paying her . How could any Judge rule that this paper he wrote be legal ? The laws are in place to prevent this sort of crime .

The town department where this quit claim deed was filed should not have accepted the quit claim deed and record it without the notary seal. Maybe office personnel should be looked at.
Get that lady an attorney with the local Legal Aid Office and file a lawsuit not just to get her home back but also pain and suffering due to the fraud. And the judge needs to be investigated to confirm if he receives any kickbacks or has some other type of financial interest with these scammers. 🤬

There should be a Law stating that Elderly, Disabled and other Vulnerable People should be appointed an Attorney to evaluate, explain and act in their best interests before signing any Agreement, to prevent this sort of exploitation.

this literally happened to my next door neighbor as well. When i moved to where i live now there was this sweet old lady (in her 80s) that lived next door. I mowed her lawn for her for nothing and shoveled snow in winter. Used to go over and do all kinds of minor repairs to her house as well. Then one day this guy shows up and offers to buy her house for 25K with the condition she could live there rent free until she died. She passed away about 1 year later. She left everything she owned to the church she attended. When the church found out what this guy did they filed a complaint alleging elder abuse. A court ruled he took advantage of a sick and dyeing elder person and awarded the house to the church. The church then turned around and sold the house for 250k. I later did find out this guy had done this to a couple of elder folks and he ended up in jail for like 5 years for Fraud. At least in the state where i live it is against the law to take advantage of the elderly.

If a court can somehow rule that a person is too insane to understand they murdered someone (in some cases) they should most definitely be able to understand an elderly lady not understanding what she was signing after all she has gone through the past few months.

Sadly this happens all the time. I worked in home health nursing with an elderly client who signed a 5 yr contract for an expensive home security system that she didnt need. She had a tiny dilapidated home that literally had nowhere to even install anything. Her daughter was able to get them to cancel the the contract but she was still on the hook for an amount that was equivalent to one yr. of services. This 93 yr old lady lived alone and had dementia and clearly didnt know what she was signing. They spot an easy mark and take advantage of them. This is cruel.
There should be be laws to protect the elderly and people who are mentally unable to understand do to intellect and or language barriers 😢

Doesn't she need to actually sign the deed over in front of a notary? It just sounds bizarre to me that someone could write up one of this quitclaim deeds and initial it themselves and somehow take ownership of the property with no other witnesses or the deed being notarized.

The thing is the county recorded the deed. That's what most likely the initial ruling declared it valid. But of course there are other motions and civil proceedings that will challenge the validity of the recording and appeal the judges ruling. I have a strong hope she will ultimately prevail.

Unfortunately, that's how quit claim deeds look in Michigan. He claims it was for his wife's company since he was the notary on the document. If it was his company, there would be a conflict of interest. I believe that is why they are having a hard time in court with it.
They need to take this to their local DA for criminal charges. There are specific depts within the DA that deals with elder fraud, etc.

The town department where this quit claim deed was filed should not have accepted the quit claim deed and record it without the notary seal. Maybe office personnel should be looked at.

There should be a Law stating that Elderly, Disabled and other Vulnerable People should be appointed an Attorney to evaluate, explain and act in their best interests before signing any Agreement, to prevent this sort of exploitation.

this literally happened to my next door neighbor as well. When i moved to where i live now there was this sweet old lady (in her 80s) that lived next door. I mowed her lawn for her for nothing and shoveled snow in winter. Used to go over and do all kinds of minor repairs to her house as well. Then one day this guy shows up and offers to buy her house for 25K with the condition she could live there rent free until she died. She passed away about 1 year later. She left everything she owned to the church she attended. When the church found out what this guy did they filed a complaint alleging elder abuse. A court ruled he took advantage of a sick and dyeing elder person and awarded the house to the church. The church then turned around and sold the house for 250k. I later did find out this guy had done this to a couple of elder folks and he ended up in jail for like 5 years for Fraud. At least in the state where i live it is against the law to take advantage of the elderly.
Sorry but elderly people should know better. A house is worth hundreds of thousands of dollars not twenty five thousand dollars.
