Hi Connie! Excellent questions. Regarding royalties, I recommend using the royalties on net sales as this is what most companies use. Regarding your copyright info, it is always a good idea to include the copyright symbol. Your signature should definitely be on the t shirts, right next to or part of the artwork itself. If your signature is legible, you can go with just the signature itself on the artwork. If you use a stylized or illegible signature, consider either modifying your signature to make it more legible or add your name below or nearby in print. My personal signature is completely illegible, the signature I use on every painting is one I developed over time which is legible, and slightly stylized. I have a video on TH-cam discussing the ins and outs of signing your name which you may find helpful. All my best to you Connie!!

Thanks for the great information! I do have to say that it is very easy to copyright your artwork in the USA. At this point, I have already registered a number of images and it is not very expensive. A copyright stands for 70 years from the date the artwork was registered. The entire process can be done online.

Hi Charlene- there is no need to submit for a copyright notice as all original music, original writing, and original artwork created in the US is automatically protected under US copyright law. So no one is allowed to use your work whether or not you have a copyright symbol on it. Each company will have their own method/requirements/process for submitting artwork, oftentimes they have a link you can follow on their website if they are accepting submittals.

Hi Pamela! Some of my paintings which are licensed are acrylic, some are oil. The shine caught on the edges of the impasto strokes of my work is part of the look, so in my case shine is okay. I would think gouache would be the best choice if you are looking to go for a completely matte effect. Take care and have a super rest of your day

Yes, I am still licensing my work. It is a nice income stream in additon to my originals in art galleries. It's really best to have your original work professionally scanned and colour corrected. It's not that expensive to do. These days they can scan at 600dpi, or higher! Once you have that file, you can alter it to fit licensing requirements. 😊😊

That is awesome! Congratulations R C - Your licensing fee is the fee (one time only or recurring) that you charge them in order to use the design you created. The contract you sign would stipulate if it is a royalty arrangement or a sell the design for a flat fee arrangement and include all terms and conditions including duration of contract, etc.

Hi Franchesca, you do not need to created a LLC (limited liability corporation) to do art licensing as the person licensing the art. It would likely be recommended if you were the corporation or business obtaining the art to put on products, as you could be liable if something goes wrong. Great question!!

Answer: A scanner is not needed for licensing Question: Did you say that it’s only for iCanvas that the DSLR camera is needed? And that all other companies our iPhone photos are ok to use? Answer: I have several licensing deals where a DSLR camera photos are needed, a handful of them can be done with just iPhone photos. Most companies will want the larger files (10M +) that you can get with a high quality DSLR camera. Also note you will need software ( I use Photoshop Elements) to crop or resize photos to meet the company's size requirements. A tripod to keep the camera steady and ideally use a remote control button to avoid camera shake. Question: On fb do you post your art on your personal page or should it be our fb business page? Answer: Definitely use a Facebook business page as you will have much more reach and it will be viewable to anyone- even those who don't have FB accounts. I hope this info helps, Diana! Hugs to you
How about someone wants to use my image of a painting they wanna buy, to use it for a brand logo? How is this handled? I told them for printing the image on products it would need licensing.
Hi Blanca- you are correct, if a client buys your painting they own the original, but you still own the copyright to all images. They do not own rights to use the image for commerce unless you give permission to do so, which is a license.

If I put my artwork up on Zazzle and redbubble, will I still be able to license that same artwork to a company that would want a contract? Or is it less attractive to these companies knowing that the art not exclusively theirs?
Hi Rebecca! Thank you so much for your kind words. You can still license your images, even though they are available elsewhere. Things to watch out for- many companies do want an exclusive set of images just for them, others do not mind. Your licensing contract with the company will spell out the length of contract, and if it is exclusive and the territory involved. You could for example have a contract for one image with a puzzle company and also have it on beverage napkins, as long as both contracts would allow it. Hope this helps- take care

Hi Kate! Yes you can! You always own the copyright to your artwork, when you post to social media you give them permission to post your work (you are licensing it to them for social media purposes). You can sell these same images to companies for them to print your work on their merchandise, you earn royalties from this.

I am truly thankful for you sharing. I’m researching how to write a license agreement for a woman who wants to sell my art on t-shirts. I wrote an agreement that I am looking over to make sure I cover everything before I give it to her. My question for you is I am asking 5% royalties on net sales without deductions, is this better than 5% royalties on net sales? And one other question, should I ask that my Copyright Management Information, for example, Connie Koehler © 2020, be noted on all her website pages where my artwork is in the public’s eye on her website and should my signature be on the t-shirts?

Hi Kate! Yes you can! You always own the copyright to your artwork, when you post to social media you give them permission to post your work (you are licensing it to them for social media purposes). You can sell these same images to companies for them to print your work on their merchandise, you earn royalties from this.
