  • The US Supreme Court has ruled that Donald Trump is partially immune from prosecution for actions taken while he was in the White House.
    The decision means the federal election interference case against Trump will return to a lower court, which will then decide how to apply the Supreme Court ruling.
    While the court ruled that the former president is immune from criminal prosecution for "official acts" taken in office, he is not immune for "unofficial acts".
    Writing the court's opinion, Chief Justice John Roberts said: "The nature of Presidential power entitles a former President to absolute immunity from criminal prosecution" for official acts taken as president.
    The document stipulates that courts would need to distinguish between what were official and unofficial actions.

      Nixon was given immunity for his role in subterfuge at Watergate - though he resigned. That was the extent of it. No jail time. Clinton did not go to prison for his official act with Monica in the White House - though he was impeached. Neither Bush suffered any penalties for getting us into unwinnable wars - just because - especially George Jr. who attacked Iraq for no reason whatsoever - Iraq who had nothing at all to do with 9/11. Obama did not have to pay for sending Iran billions of dollars in cash when there was an embargo on that country. All skated. Trump committed what Alan Dershowitz and Andrew Cuomo said was a misdemeanor, the statute of limitations which had expired years prior - but Bragg, who let illegal migrant cop beaters go free, and all those mob thieves who are stealing millions in merchandise go free without so much as a slap on the wrist, decided to make sport of Trump - for a MISDEMEANOR! . I am neither for Trump nor Biden - but fair is fair and if they can bend the law for him, they can do it for you. This is NOT a joke.

    They basically said that some actions that are demonstrated to be official have the presumption of immunity, as to what those action are is not up to the supreme court to decide as they are basically an appeals court and not the finders of the facts.
    They also stated in their ruling that they did not agree with the scope of immunity argued by Trumps lawyers.. They also stated that a president does not need to be impeached before hand.. ie if he does something that is deemed to not be an official act, he doesn't need to be impeached before he can be prosecuted.
    What happens now is the lower courts need to ask the question what is or is not an official act, and Trump can then ask for rulings to be appealed to the supreme court again.

      Any act now stated as an official act, can’t be questioned by a court and no reasoning is required. To take Nixon as an example, he’d just have to say it was an official act and that’s the end of it. No pardon required.
      If Biden was to go arrange a hit tomorrow, say the target was a “threat to the US” and it’s an official act then a court would need to prove it was a private act.

    The average citizen has no clue what those indictments actually said. They massage the law into something that was never meant to be.     It depends what you class as official. If thats all it says in the ruling it needs to be clearer and address the allegations against mr trump whether he is immune or not.If a president is found to be interfering in an election then I would not class that as an official act.I accept a president should be immune only in certain limited cases for anything else. I dont think judges should be appointed by politicians of any party. If a juror is found to be prejudiced then they would not be allowed to sit on a case so I am not sure why that would allowed for judges. Its the kind of thing you may find in a dictatorship if is not clear what is official.
