Assuming that Dad has been declared the father since he is court ordered to pay child support, the next step is to determine whether Dad has any way to stop you from going on vacation out of the country. Do you need a passport that he refuses to sign consent? If he is supposed to do something that he refuses, you may need to have the issue addressed by the court.
@@FloridaFamilyAttorney I have no contact at all with him. But I know that both parents need to go in person to renew my daughter's passport. If both parents can't go then atleast a notarized letter. But i have no contact with him. I don't know what other solution i have in this situation.

Hi! What if my child (who is a US citizen) lives in another country with her mom (Chile). Do I provide child support according to these calculations or do we use the chilean child support system? (also my daughter will get her chilean citizen very soon). Long story short, we were both immigrants, had a daughter in the states and then separate, and she went back to Chile with my daughter.
First, you need to know if there is an order requiring you to pay child support. Is it a Florida order or a Chile order? Child support is calculated and ordered by the court. WHat do I do, if a Child Support agency managed to garnish my wages, without a contract or undertaking, without giving me due process and no warning WHATSOEVER??? There is no contract in place. I am in Florida and the agency is in California. ALso, the agency sent my employer a fake withholding order, where the case worker typed his name in all caps where the judge was supposed to sign, so there is no competent judge's wet-inked signature.
That's very upsetting news. That is NOT how it is supposed to work. Unfortunately, it sounds like you have to handle this matter in California though. I would suggest contacting a California attorney through the state bar agency. Ask the attorney to determine whether the order was obtained administratively or through the court system. Then, you will know what division you have to go back through and show that you were not given proper notice of any proceeding. There are different requirements for different divisions. I wonder if the order that you think is fake is simply a conformed copy because conformed copies only have the judge's name stamped on it. I wish you luck.

But the state added back pay up to 24 months. The child mom applied for public assistance which started the case. My question is, is it legal to calculate back pay during the time he was receiving SSI?

Your husband needs to FIGHT...I'm guessing there was NO paternity test and his SSI was garnished because of a CONTRACT he hasn't signed, and in my book, this is FRAUD 🙄
The woman who filed for public assistance opened a Title 4-D child support. The title 4-D child support program is voluntary. Your husband does not need to be in this program if he does not consent or give jurisdiction.

Can paid chd support directly to the recipient?
Yes - but I would not suggest it or recommend it. In most situations, it is better to go through the state disbursement unit.
