    Fair Dealing
    Source: www.gov.uk/gui...
    Certain exceptions only apply if the use of the work is a ‘fair dealing’. For example, the exceptions relating to research and private study, criticism or review, or news reporting.
    ‘Fair dealing’ is a legal term used to establish whether a use of copyright material is lawful or whether it infringes copyright. There is no statutory definition of fair dealing - it will always be a matter of fact, degree and impression in each case. The question to be asked is: how would a fair-minded and honest person have dealt with the work?
    Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
    does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
    is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used
    The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.
    Source: www.bl.uk/busi...
    The concept of fair usage exists within UK copyright law; commonly referred to as fair dealing, or free use and fair practice. It’s a framework designed to allow the lawful use or reproduction of work without having to seek permission from the copyright owner(s) or creator(s) or infringing their interest.
    Fair dealing law is not only applicable to text-based works; it applies to musical, dramatic, artistic, literary and typographical works too. However, it does not cover the copyright of printed music.
    As an exception to British copyright law, fair dealing is governed by Sections 29 and 30 of the Copyright, Designs and Patents Act 1988, which outlines three instance where fair dealing is a legitimate defence:
    If the use is for the purposes of research or private study;
    If it is used for the purposes of criticism, review or quotation;
    Where it is utilised for the purposes of reporting current events (this does not apply to photographs)
    A statutory definition for fair dealing does not exist; it will always be a matter of fact, degree and interpretation in every fair dealing case. Nor is there a percentage or quantitative measure to determine fair dealing. The Intellectual Property Office lists the key factors used to determine the validity of whether a particular dealing with a work is fair as follows:
    Has the use of the work impacted negatively on the market for the original work? If the creator or owner has lost potential revenue through the re-use of their work, it is not likely to be fair.
    Was it reasonable and necessary to use the amount of work that was taken?
    The Copyright, Designs and Patents Act 1988 also outlines the potential fair dealing defences that permit the use of copyright works without permission from the author(s) or creator(s) under UK copyright law.

    This about people not knowing INITIALLY...meaning just hearing the songs on the radio for the first time when they came out there was no way of knowing they were British artists. For most of them the assumption would have been they were American, but not all of them. Just because you have known for a while now that they are British DOES NOT CHANGE THAT 😂 its irrelevant! And it doesn't mean you can just claim you would have known from first listen too lol. A couple could be questioned, Eurythmics - Sweet Dreams maybe, but it really does apply for these songs overall!

Its definitely easier to spot something once you are looking too or when you already have the information and actually know lol like the actor Idris Elba in The Wire, ive heard some americans say that once they knew he wasnt American you could actually hear but before they were fooled by it.

    Funny. 30 Rock did a live show where Jenna played Dusty Springfield and she played her with a Kentucky accent “Howdy Yall I’m Dusty Springfield!”

    Player is a bit of a stretch. Only one of the members was a Brit. Most Black UK artists until more recent times born in the Caribbean or Africa and were part of the mass emigration to Blighty in the 1950s and 60s. Joan Armatrading (St. Kitts & Nevis)... Eddy Grant (Guyana) ... Carl Douglas and Errol Brown (Jamaica)... to name a few.
    It's hard to pinpoint what to call The Bee Gees. They were kids when they relocated from Isle of Man to Australia and were only there about ten years when they returned to the UK to begin their recording career. They said they "felt" Australian, but many of my Aussie friends insist they're Poms. Olivia Newton-John also relocated to her native Britain to begin her international career. Both were always included on those various "British Gold" compilation LPs of the 70s and they're rarely included on the many "Greatest Aussie Acts of the 70s" videos we see on TH-cam.
    So, do Australians consider either to be dinky-di Aussies?

      @@daveadam435 So am i...that changes nothing about the example i gave though lol you still wouldnt have just known when you first heard it. Youve just let the fact that because you know they are british NOW (probably because you are) tell you that everyone would have known from the get go lol. Sorry for the long replies its just some people really arent understanding 'initially' properly with this!

      @@Media_Ranker I'm 65. There's a distinct difference in America and British music. Songs and styles. When you've been listening to it as long as me it's easy to tell. ... Them songs don't sound remotely American or any other nationality for that matter. ... How old are you ??

      @@daveadam435 There are British styles of music of course that doesnt mean any song made by a Brit is immediately in a British style does it. That can apply for one or two here perhaps, the Eurythmics maybe, but again there is no way in hell you heard Return Of The Mack on the radio when it came out and thought Mark Morisson was British lol you had absolutely no reason to and thats the point of this overall. Like i said theres a couple that can be questioned but claiming you instantly just knew these were British artists on first listen...you are lying you know you are lol. And yes, to use the same example, Return Of The Mack sounds completely American

    I was really surprised when I found out that Peter Gabriel and Paul Rodgers were British and not American. Especially Paul Rodgers, who sang one of the most American-sounding songs ever, All Right Now.
