    Hi thanks for useful information Me Ramesh my wife visiting our children's in USA regularly since 2004 took 3 months extension twice in 12 no visit for genuine reasons. What is the advantage/ disadvantage for getting green card please

      Generally, a green card may be sought if the parent beneficiary intends to make the US their home. Spending too much time outside of the US after obtaining a green card raises a risk of abandonment. Scheduling a consultation with our law firm is recommended.

    Hi, my daughter is us citizen me and my husband get the DQ on August 2 2023 how long waiting the medical and interview in us embassy manila thank you very much

      Hi, there are no set time frames. Generally may take 4-9 months, but depends on case load, etc. Some cases may take even more time after DQ.

      You’re welcome. Depends, but generally wait times are 24 months or less from time of filing.

    Hi. DO I have to submit passport size pictures foreach of my moms application, I-485 and work permit and I-131?

      Yes. Generally, 2 per application.

    Madam as you advised inquiry after the lapse of processing time line if attempted is not happening.even after repetitive attempts not able to file an inquiry....can attorney like you facilitate please. In forums too this has been a topic recently....pl guide.

      If the processing time mentioned on the USCIS website depending on the service center handling your case has passed, an inquiry may be made with USCIS in writing or by calling them to follow-up. The other option is to request an expedite (if you meet the criteria) but that is discretionary and USCIS handles these on a case-by-case basis. An attorney would need to look at your documents and check the timeline for guidance. Should you need assistance, a consultation is recommended.

    Hi Could you please mention what is maximum no of days that we can request in I -864 advance parole form? For example shall we request for 12 month-360 days for I-131 form? So the intention is parents can travel back to India and comes back after spending couple of month s in India then come back to usa just before expiration of Advance parole. Another doubt is what happen if I 485 approved when parents are in India. Do they need to go to consular processing / attend interview at us embassy?

      Hi Deepa, I would recommend that you set up a consultation with our firm so you understand the process. Generally, form I-131 is used for requesting Advance Parole that USCIS gives for a validity of 1 year. You can't request it for a certain amount of time because it is a standard duration provided by USCIS. What is indicated on the form is the length of the trip they intend to take. It is not recommended that a parent spend a lengthy amount of time outside of the US once given the advance parole but typically yes, the beneficiary must return before the validity expires.

    Our case for citizenship has been denied because we were out of US for 368days.we took parole for that period...now when can we apply again..can we apply after 4 year and one day.

      It is best to set up a consultation with our firm to discuss further. Generally, residence in the US needs to be reestablished. If an application is submitted in 4 years and 6 months, a person may not be subject to show a presumption of a break in residence.

    Applied for Adjustment of Status concurrently with I485 in August 2021 but not for parole or work permit..I130 for one parent approved other parent still processing.can I file now for Parole and work permit separately now...

      Generally, a beneficiary may file for the work permit and travel document together to the filing location instructed by USCIS after the I-130 and I-485 have already been filed. Kindly check the USCIS website. And the I-485 receipt is required. Should you have any further questions, you may schedule a consultation with our firm.

    Im DACA recipient and have requested AP for a legal entry for Aug. My US citizen son will turn 21 July and therefore eligible to petition me. Does the 90day rule apply to my situation for my re-entry to the country/petition?

      Generally, if an officer determines that an applicant misrepresented their purpose of travel at the time of the application for admission then this analysis may apply. However, a consultation is recommended to discuss further.

    Madam ! My 130 is approved a month ago but I had left USA now i am in my home country . Shall my child file 485 now ? Or should i go back to USa and then file it

      The adjustment of status process is done when the beneficiary is in the U.S. and eligible to adjust. This is not available for beneficiaries who are outside of the U.S. It is recommended that you schedule a consultation to discuss this further.

      It depends on which service center is processing your petitions. You may check the general processing information on the USCIS website: egov.uscis.gov/processing-times/

    hi i petition for my dad out of status. i filed i130 but not concurrent with i485. i put n/a in his employment history since he doesnt have work permit.. did i do it correctly? advise needed.. i files by myself didnt consult lawyer tnxs

      It depends. Just because the beneficiary doesn’t have a work permit doesn’t mean they have not been employed. Unauthorized employment should be disclosed (if any). If you are handling dad’s process pro se, it is recommended that you review all instructions before filing anything further. If a consultation is required, it would be best to set one up.

      It depends on the service center processing the petitions but generally it may take 10 months more or less.
