  • Being inside the U.S. and married to a U.S. citizen is unfortunately not enough to be sure you're eligible to adjust your status to a green card. Here are some of the most important requirements to consider.

i think a friend of my mine was wrongfully denied adjustment. the Denial letter stated the two reasons as 1. she didnt explain well enough how she came into the country, but she came into the us at age 10.
    2. was she couldn't prove that she was in the US at exactly dec 2000, but she has school and medical records from 1993 to 2015

I am a US citizen living in my spouse's country. We are both retired and married for two years. Due to her country's visa requirements my visa is not being renewed. She currently has a B1 visa but due to Covid we have not traveled to the USA. Can we effect a change of status if we now travel to the US as I must leave her country soon?

My husband is from the UK and I'm from the US. We got married in the UK in January. He is going to be attending grad school in Florida next year. We are trying to figure out if doing a petition for an alien relative is better or if he should come to the US on an F1 and then do adjustment of status once were there?

Thank you so much for your information. I have a question, can a US citizen brother adjust status for a sister? He is doing Adjustment of Status to his parents. Parents and little sister entered the US with a visa. I will appreciated if you can answer for us.

Thank you, it's quite clear until 11:19 when you suggest that being married to a US citizen doesn't make us subject to eligibility (which is essentially the fact of prioritizing everyone who stay in the US "by accident" such as the example of the MAsters student). You mention being married to a green card holder which you seem to consider is a separate group of people from US citizens who by definition hold green cards. Do you mean by this being married to a non-US national who is the holder of a green card? The term "tourist visa" is confusing also - isn't it rather an ESTA?

People get around it every time and the government is helpless against it. Asylum and then get married seems like the strategy that goes unpunished.
