    Hello, thx much for the great content. One quick question, for the tax returns, is the Form 1040(2 pages) itself is enough? or all the schedules (10+ pages) are all needed? thx again.

      Glad the videos are helpful! It is advisable to submit all the schedules - though if there are a lot of them, a transcript of the filings from IRS may be a good idea to cut down on the number of pages in your packet. They are easy to request from the IRS website.

    Quick question: If the beneficiary had a social security when he went to school in an American university thru government exchange program (more than 40 years ago), he went back home and now , as the beneficiary in an I-130 parent petitions does he have to provide this old social security number in both I-130 and /or I-485?

    Thanks so much for your great video on I-485. I am a US Citizen thru immigration, I've petition for my brother ( I-130) in Dec 2014. He is now in the U.S .visiting me. Can he apply for change of status (I-485) due to him being here instead of in his home country. Would he be qualify for this change of status?

      Hello,
      Unfortunately, the category of visas for siblings is currently processing cases with petitions filed in 2007 or earlier, so a petition filed in 2014 will not yet allow someone to begin the residency process.

      Hello,
      Applicants for adjustment of status who have no criminal records will be cleared through USCIS’s biometrics checks. Only applicants who have arrests or other criminal history will need to obtain additional records for their adjustment of status.

      Hello,
      In our experience, so long as the medical exam was properly sealed when first submitted, it is fine to re-submit the entire packet as it was returned to you.

      No need to ever send originals! Definitely send copies, but take originals with you when you attend your appointment.

      The ability to file Form I-485 at the same time as the I-130 depends on many factors. For example, for children of US Citizens or Lawful Permanent Residents who are over age 21, filing the two forms at the same time is probably not allowed.     If I am sending i-485, i-131, and i-765 all together, do I have to make multiple copies of my passport, government ID, etc. Or do I just need to provide one copy that cover them all at once

    Do we need birth certificate at the time of i485 - adjustment of status? Can we use other things like passport or school certificate instead of birth cert?

      Hello,
      In our experience, birth certificates are always required unless one does not exist. If you do not have a birth certificate (or a copy of one), you will need to provide evidence to show why it does not exist. On this website, you can look up your country of birth and see whether the US State Department has indicated if birth records are or are not available. travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html. If this website shows that birth records are available for your country of birth, you will generally be required to provide one.

      Thanks for the question, it’s a good one. Sometimes spouses of permanent residents are eligible - but only if they have maintained lawful status for their entire time in the USA. For spouses/parents/minor children of U.S. citizens, they remain eligible to file the I-485 and adjust status even if they fell out of lawful status while in the USA. I hope that makes sense!

      Hello,
      For individuals who are bringing a spouse from another country to live in the United States, the forms are different. That type of case is called “Immigrant Visa” or “Consular Processing” and generally requires filing Form I-130 and then working with National Visa Center and Department of State to file Form DS-260 and schedule the immigrant visa appointment.

    Currently I am doing my masters in USA. I have a family immigration pending which is in F4 category. PD: June 2008, approval year 2010. My aunt applied for my mother with her family. But my family didn’t get the case creation latter yet. So, can I able to do the adjust of status? Or my mother have to come to USA first then I can go for status adjustment?

      In family-based immigration cases, the principal beneficiary must complete the process of becoming a resident for the derivative/dependent beneficiaries and be eligible to apply for residency.

      Hello,
      The I-130 and the I-485 have separate fees, and the biometrics fees must also be paid in most cases. Whether or not an applicant can file the applications at the same time depends on the facts of the particular case - typically applicants for adjustment of status who are not in removal proceedings are eligible to file both applications concurrently. However, no applicant should ever pay fees twice for any petition or application unless the original petition or application is denied or revoked and the applicant needs to re-file in order to gain an approval of the case.

    I have filed I-130 online like 5 months ago and just realized I can do that concurrently. Can I file form i485 now as it has been a long time and my i130 is not approved now?I live in usa and my spuse has green card!!Please respond me as I am confused

      As the spouse of a green card holder, you may not be able to file I-485 concurrently unless you have a current valid immigration status that has not expired.

    Hi.. I have One question, I recently filed i485 and found that by mistake I haven’t answered questions 43 and 46b in the i485 form. These are one of the bunch of questions where we answer yes or no. The i485 application is delivered to the USCIS office recently. They haven’t received a receipt notice yet. Could they fix this issue somehow? What would happen otherwise, will the application gets into an issue? Any suggestions or help will be highly appreciated. Thanks 🙏🏻

      In a situation like this, USCIS might return the packet to you and ask you to fill in the missing information, or they may accept and receive your application, but then send you a request for evidence later. If you do get a receipt notice, you may want to send a letter notifying them of the error and asking them to update the form with the correct answers. We recommend keeping a copy of the correspondence you send and all the mail tracking information.

    Hi: I'm in the process to apply for my Mother with form i-130 and i-485 concurrent filing. She currently has B1/B2 Visit visa and she came to visit me here now in the USA. So I just applied for her i-130 online last week and I'm preparing her i-485 documents to mail this week. But for some personal reason my Mother needs to go back to her home country for a few months.
    So my question is:
    1. What will happen to her i-130 application I just did online and what other consequences will happen if she goes back now and comes back after a few months?
    2. Will she have any issue re-enter in the USA after a few months since I have applied for her i-130?
    3. Should I wait to file i-485 until she comes back to the USA?
    Your help will be highly appreciated.

    My mother recently arrived into the U.S with a tourist Visa. I am a U.S citizen living in NYC but due to the war in Ukraine I had to bring my mother to the U.S. My mother wasn't able to leave by airplane from Ukraine so she first traveled by land to Poland and then she took an airplane to Italy and stayed there with a relative for a couple of days before she finally come to the U.S. This is her second time in the U.S with a tourist visa. My question is, does my mother qualify to fill for an I-485? And do I also have to fill out the I-130? Or just the I-485? Also, do I have to start this process before her visitor visa expires? I am sorry for the long question and I really appreciate your time and help in answering my question.

      It is a pleasure to assist you, thank you for reaching out. Your mom will need to have her case analyzed fully by a trusted immigration attorney, but based on the information provided, I suspect that she will be able to get her residency if you file the appropriate paperwork for her. Any US Citizen petitioning for a parent will need to file Form I-130 to establish the family relationship, as well as Form I-485 to request the residency. She should remain eligible to file for her residency even if her tourist visa expires before you are able to get everything filed. Again, she should definitely consult with a trusted attorney to ensure all of the requirements are met, but I hope that this general information can give you some sense of what to expect.

      Submitting I-130 and I-485 concurrently is allowed only when the beneficiary of the petition is immediately eligible for adjustment of status.
