They get away with these letters because they are legal. They shouldn't be, but they are. They have to be, otherwise Capita would have had their collars felt. In no way, though, are they moral or decent but since when did a company like Capita ever care about morality or decency? They do it on the edge of a crime and have lawyers who if you take em to court will ensure you pay £100 k plus for the privilege so you will end up so in debt your life ruined. Hence why people don't do it. MPs just don't care

      Malicious Communications Act 1988
It Illegal to ""send or deliver letters or other articles for the purpose of causing distress or anxiety"
Someone just need the money to fight them in court over it, Under the TV licensing legislation, they are allowed to inform people about the law.......but the Malicious Communications Act means they are not allowed to cause distress by doing so.

    • @anonnemo2504

@@Tommy-he7dx Capita will have some professional, not "barrack room" lawyers, who advise them that their letters break no laws. These letters are wrong, of course, but many things that are wrong are also legal.
Any money spent challenging them in court would most probably be wasted.

Right on point re warrants. Another Interesting point here… if the interview is under caution, are they not offering access to PACE codes, free legal advice, etc.? Failure to do so would usually render the interview inadmissible. No one is obliged to say anything. If they are referring to the caution, they should make this clear - as part of the caution - “You do not have to say anything …”

I think they had to have a bloke in the back to manually turn the probably equally fake antenna menacingly. I remember from somewhere someone saying they got a very close look into the back of one of the vans, and it had plenty of equipment, but just random looking stuff, some even totally irrelevant, and nothing properly connected, just to look 'technical' enough through the darkened windows if caught stationary. I believe some of the hand-portable kit, with the smaller yagi antenna, was the real deal though, useful for close-up detection of the frequencies that CRT tellies generated to create the picture.

I replied that I had no idea as I did not have a TV ( I am probably the only occupier without a licence.) I suggested that that he should ask the house manager. I later discovered that she sent him away with a flea in his ear. I have not had a TV for over 20 years and got fed up with returniing the letters so now I bin then unopened. It happened to me a few years ago. I had a goon visit and i was a fool and invited her in to chat. I showed her i didn't have my tv tuned into live broadcast and she got me to sign something. I thought that would be the end of it.....a few weeks later i get summoned to court for watching tv without a licence. I had a recording of the goon's entire talk to me and i took this with me. Good job i did as stuff was indeed added to the form i had signed. Stuff that i had unplugged the aerial when i saw her arriving. This was a lie. But i said that i didn't watch live broadcast and so unplugged the aerial lead. I showed her. She changed it later to i unplugged it when i saw her arriving. Lucky i made the recording and the judge dropped all charges.
My advice is when a goon calls either don't answer or tell them you are not interested and close the door. Do not get into a conversation with them. Do not let them in and most important ....DO NOT SIGN ANYTHING

You can withdraw their "implied" right of access to your property in writing.
After you serve the notice, because they don't have police or bailiff powers, they can not legally enter your property as that would be trespassing.
And because they're trespassing, any "evidence" they obtain would be thrown out of court because it was illegally obtained.

I would bet my life that they DO KNOW that you receive pension credit because Capita and all the government departments have reciprocal info sharing arrangements. I know this because when my mother died, who had a free over 80 licence at that time it only took them six weeks to start sending the harrassment letters to her address. Capita had got the info from DWP. My local MP, Andrew Gwynne, brought this up in parliament but was basically fobbed off.

Let’s face it, it’s probably the last few years of public service broadcasting as we know it, less and less people are watching live Tv, especially BBC and ITV etc, it’s just not how we consume our tv viewing anymore, a serious debate needs to be had around Tv licensing, broadcasting in general, and revenue streams, even SKY are seeing falling subscribers over the past number of years, Tv is just becoming out of date medium with younger generations, who are certainly not interested in anything BBC pump out across the airwaves.

Watch your Chanel and followed your advice.

    Goon : “ Hello are you Mr ******* “
    Me : “ who are you “
    goon : “ I’m from TV licensing ( producing his ID )
Me. : No thank you not interested ( and closed the door )

I havent had a TV license for over 4 years.... Orginally i informed them i didnt one but i still got the odd letter.
Eventually i got a letter to ask if my circumstances had changed & did i require a license, i noticed that my name had been removed & was replaced by To the Legal Occupier... i didnt respond.
Since Jan 2023 i have been receiving 2+ letters a month, sometimes 2 arrive at the same time. They are all addressed to the legal occupier, all have bold red writing on back & front of envelope & all make it clear to anyone who see's them what they are about.
I have finally received the same letter informing me that an offical investigation would commence.... i have of course ignored that as well.
What annoys me more than anything is how they are entitled to use the LAW to threaten, intimidate & scare often vunerable people into paying for somthing that the LAW say's they don't need, this makes no sense... in effect the law makrs it clear when a tv license is needed, the TV licensing do mention that in the small print at the end of the letter, yet THEY have the right to obtain permission from the LAW & with that warrant in hand & accompained by the police they have the legal right to enter my home, if i refuse to comply I will be arrested.... all of this WITHOUT any evidence of any LAW having been broken🤷🏼‍♀️
Is it just the TV Licensing that are WRONG in behaving this way or is the law that covers the issue as much or imo more to blame?
If/when they come to gain entry with their warrant & pet police officers in tow & i'm not home, will they break in?
Notice i ask will they & not can they, it seem's to me that they can do anything they want, the LAW is with them regardless of wheter i've broken the LAW or not..... that's what worries me

Thanks to you Jon, I cancelled my TV licence years ago. I spend the £13 per month on You Tube Premium instead, so I can watch thousands of films, and many American real crime channels, free of charge, without adverts.
I still get a monthly threat-o-gram but I shred them. EDIT. No, I don’t work for YT! But I often see comments from viewers complaining about adverts, who don’t realise that you don’t actually have to put up with YT ads.

    • @Torthrodhel
      @Torthrodhel 11 หลายเดือนก่อน

I mean, it's still nonsense that YT pushes ads in the first place, let's not just forgive them that. Didn't start off with any ads whatsoever. Premium might as well just be the in-house ad blocker. Its existence more-or-less disproves any actual argument for the need for ads to exist on the platform to begin with. They wouldn't be sponsoring their own sabotage now would they? It's a racket just as much as the TV licencing junk is (just a more normalized type of racket). Both designed to mentally bombard you into submission to opt into protection from that bombardment. I hate both with a passion, although the TV licencing playing law enforcement cosplay is particularly disgusting and does absolutely take the cake. You're going with the lesser devil, and I can respect that. I'm just allowing myself to be subjected to harassment, and I'm not entirely sure that's the healthy choice. I might even follow your example at some point, have been thinking about it on and off.
I don't think it's a no-brainer for everyone though, and people absolutely still have the right to moan about it regardless.

You should have read out the last bit on that letter... It is the bit I find most amusing...
If you have complied and informed them that you don't need a t v license, they reserve the right to bang on your door and check (so they're basically saying they don't believe you: they're calling you a liar).
Now, the ONLY reason for I have for telling them I don't need a TV Licence is to prevent them from coming round and banging on my door...
The very fact they have stated in the letter that they will STILL come round and bang on my door basically makes telling them I don’t need a licence quite pointless 😂😂😂
