It Gets Even Worse For Adobe!

  • Adobe are not having a good year. I think that is an indisputable fact at this point. Early on they pushed updates to their EULA that massively annoyed their users, leading many to cancel their subscriptions. When they went to cancel they may have been hit by heavy exit fees and a terrible process. A process so terrible and predatory in fact that the DOJ are suing Adobe for their awful business practices.
    Today in a major update, the partially redacted filling by the DOJ has become unredacted and... it does not look good for Adobe... not at all.

    I was hit by the Adobe cancelation fees, and did the following: in my profile, I changed my credit card info to a virtual card with just $1 on it. When the month payment expired, they were not able to charge the virtual card and asked me to change the payment method, which I did not.
    They menaced me to suspend my account (and they did) but it was just what I wanted 😂

      Yeah, that's why i never do services on credit cards. I always have a card that things pull from that's always empty until i transfer money into it for payments. It bypasses all of these scummy practices

      The trick is if it's convenient for cancellation, they'll make much less money. The fees encourage retention

      If it's easy for users to end subscriptions, they can't really point to growing subscription numbers to shareholders. If they're saying "Subscriptions are up 10%!" and there are news articles reporting that hundreds of thousands of subscriptions are being canceled, shareholders are going to sue them. That's why every public corporation that uses subscriptions as a revenue stream will make it extremely annoying to leave, we've seen Comcast pull these kinds of stunts 20 years ago.
      Every public corporation will end up enslaved to shareholder interests because Wall Street is so ridiculously powerful now.

      It's not that they make a lot of money off the ETFs themselves but that they lose a lot of money when someone cancels. If they can get you to cancel another subscription before theirs by making it prohibitively expensive to cancel then they can keep taking your money.
      What they don't want is for people to cancel when they don't need their software and then resubscribing when they do need it. They want you to think "I will need this eventually" and continue to pay them while you aren't actively using their software.

      @@Drazil100 Exactly. The wording used in their rebuttal is very specifically about the fees themselves as if they exist in a vacuum, rather than what the fees are aiming to accomplish, alongside what those fees represent in relation to the other tactics they use.

      it's not always viable as foss is still sometimes behind and adobe scoops up companies that look like they'll become industry standard, like allegorithmic with substance painter.
      Other 3d painting software is just not as good.

      Thanks for getting off adobe and working to lower Adobe's mindshare. I believe pirating adobe isn't a win. It still makes users dependent on adobe workflows and interfaces.

    They continue to be scummy I didn't get with a cancellation fee but when I cancelled they didn't send me a cancellation notice, they sent me a "Suspension for non-payment" notice. The language is very accusatory that I haven't paid and that they tried to contact me to pay and because I haven't they suspended my account. Real "You can't quit, you're fired!" vibes.

      Not just them, plenty of their clients don’t want to switch because other software is missing this or that so they hang on. Affinity etc need to cover these missing features asap and poach more clients.

    Yep, when I attempted to cancel, it was such a hassle and rip off (pay us 3 months subscription fee or we won't let you cancel), that I eventually reported their transaction at my bank as fraudulent and blocked them from taking any more, with a description of Adobes scam. Adobe actually had the cheek to push back against my bank, but my bank said no and took care of it. Then the 'return to adobe cloud' emails started. Like eew, no thanks. That's how I got around their exit fee shakedown.

    The "retention" thing is something a TV cable company did so badly in Israel (bordering on elder abuse), that laws were passed to absolutely crush the practice.
    Companies are forced to end any service within 2 weeks of receiving notice, usually via email, and are forbidden from contacting the client again with any offers.
    Hopefully Adobe can inspire some consumer protection laws.

    Been a Photoshop subscriber for many years now. And they don’t allow me to stop my subscription without paying the penalty. I call it a penalty because if you pay the outstanding amount for say 6 months you don’t get to use the software for another six months. They ultimately take your money and then terminate your subscription effectively immediately at the end of the month. So you have to time your cancellation perfectly or you will be at a loss losing out on the remainder of an annual monthly subscription. And this is the thanks for being a subscriber since Adobe CC started.

    I have no problem paying for good software... I have a problem with predatory proprietary practices and software that doesn't work on Linux.

      Exactly. As a kid I had to pirate Adobe software because my parents were too broke. Now I can afford to buy afford to buy Adobe software but the way Adobe treats their customers and I don't wish to financially support that kind of behavior. I will buy Photoshop as soon as they offer me option where I get to keep software for entire life for that single payment. I dont expect updates for entire life, just whatever version I got. I use it for personal use, not for business use so I don't need to always have latest version.

      @@FlameForgedSoul Dev here. Programming anything for Linux aside from command line stuff is absolute dependency hell. Stuff like Flatpack and Snap are solid attempts to rectify this, but the whole ecosystem still has their heads stuck up their rear ends. All it takes to ruin a commercial Linux program is a random library being under GPL, unable to be included in the Flatpack/Snap package because of that licensing, and having what's available in the OS being several versions ahead/behind of what you need. Meanwhile on Windows and Mac, I never have this problem. Because core APIs don't usually have breaking updates for several years to several decades.

      @@RickSanchez-ig3lp Pffft, I only use snap or flatpak if the developer makes me. Anyway, that's solveable. Mac's inherently condescending design and Windows' desire to monopolize everything before making everything worse? That's not.
      No, a lot of stuff works under Wine. And if it works under Wine really well, I am OK with supporting the software. What I have an issue with is proprietary, control-freak BS like Windows Presentation Foundation (WPF), which is why some software like Articy Draft (and more) will never run well on Linux.

      Maximizing shareholder value is one of the absolute worst modern business practices. Businesses are supposed to base decisions off of operating in perpetuity, but MSV basically toss all that out in favour of generating as much money as it can in the immediate present.
      Cultivating a loyal consumer base by developing consistently reliable products, properties, and services? Screw that! Gouge and exploit your consumers at every turn because you have either sold your stock or been hired by for another c-suite position at a different company, so what do you care about consequences 5-10 years down the line.

    Unfortunately if you do freelance/contract work for big companies, you can't leave. I started thinking about how I could switch away from Adobe when they introduced generative AI for more than spot repairs but I have to be able to share files with corporate clients, so unless they all decamp en masse from Adobe, I'm stuck. And Adobe knows this. They've spent the last two decades turning us into a captive audience.

      Exactly this. And their competition was so stupid when it came to B2B sales. Adobe stuff used to be able to be slipstreamed super easily into a IT department Windows image for mass deployment and installation, while stuff like Corel and Serif absolutely required manually clicking "next" on a setup wizard. It did not scale at all.

I led the switch of the paper I worked at from offset printing to 4 color printing when InDesign was new and where ID linked right into the interpolation software, Quark didn't even have a way to export in a readable format. And this was not early days for 4-color by any means. It wasn't that Adobe was special and great, it was that their competition often was just that much worse.

    Nearly two days to cancel prescription, persistence pays, In the end I told them the truth, I had cancer and was dying and wanted to cancel so my wife didn’t have to pay when I passed. Still had to insist on cancelling. For those concerned I am surviving while on Chemo.
    What a shamozle to have to go through this cancellation.

      I wish we could use those in professional settings, but they absolutely suck at GUI. I am a FOSS programmer and I run Kali Linux as a daily driver. But I have to use Microsoft and Mac for some of the niche stuff. I am thinking about making my own software since NVidia has come on board with drivers for linux.

    They like to hide the cancellation page. When you do cancel, the fee is half of the remaining balance and you lose the ability to use it to the end of the subscription date! Horrible company!

    If Adobe keeps giving you the runaround and refuses to let you cancel, then you contact your back or credit card company and you tell them to block all future payments to Adobe. You explain to them that you have tried canceling and keep getting a runaround, and that no further payments to Adobe are authorized by you.

    I will not forgive Adobe for squandering the Macromeida products. Fireworks was the worst casualty as I have yet to use software just as good as it (Affinity Designer 2 is close, while Krita is catching up). I'm not even sure if they support Flash/Animate anymore.

    this is almost as bad as those phone companies that make you CALL them to troubleshoot when your PHONE DOESN'T WORK, rather than using their chat option online, which for some reason does not cover account issues.
    or maybe HP and DELL (and many other computer companies) who have MULTIPLE departments for various nuanced issues, and one department cannot figure out how to fix a problem, so they bounce you to the next one, which says they don't handle that sort of problem, and sends you back to the first.

    I had been thinking of cancelling due to their recent change to their terms of service, and had been playing around with some alternatives to Photoshop and Lightroom. I recently looked up when my subscription would renew for the year, and noticed that it was happening at the end of this month. So even though I'd rather have more time to get familiar with the replacement software, the timing of my subscription lit a fire under my butt to just go ahead and cancel it so I don't have to deal with any of this ETF BS. The process didn't seem all that bad, it maybe had a few too many screens to click through to verify that I was really sure I wanted to cancel. But then again, the timing of my cancellation was fortunately not going to invoke an ETF.

    5:30 early cancellation fees like this are so weird and pointless. it's not like adobe was a hired wedding planner who bought a bunch of stuff to prepare, only to have the wedding cancelled. it costs adobe literally nothing, and there's nothing adobe needs to be 'reimbursed' for, if you cancel the subscription, so who cares if you cancel? it's just greed on adobe's part. "that balances benefits to customers and commitment" like adobe is your angry ex-fiancee who thinks you owe her something because you realized it wouldn't work out, ahead of time. so weird.

    Considering that Adobes own employees are known to hate these business practices it makes sense that even Executives are speaking out against them. They obviously don't like this either.
    At this point, Adobe should just concede and comply with whatever changes need to be made to get out of this. Then they need to worry about earning their users trust back and the best way they can do that is to either release updates for Adobe CS6 that will provide all updates and enhancements that the subscription versions have, drastically reduce the price of the subscription, or preferably both.
    Yeah it will hit their bottom line but the trust they'll gain from their employees and users again will be more than profitable in the long-term.

This same problem is running rampant in the games industry right now, layoffs and closures happening everywhere not because no money is being made but because these companies MUST be able to show records of growth to investors so they don't pull their support.

    I didn't have a huge amount of difficulty canceling my adobe subscription, but I do remember the upsell, the different colored UI buttons to catch me off guard, and other traps. I guess I'm just used to seeing these kinds of patterns now so it bothers me less? Kind of grim.

    Adobe's response doesn't even address the issue. The issue is the undisclosed termination fee and complex process acting as a deterrent for people looking to unsubscribe. They only mention the direct revenue from the termination fee as being a low percentage. That revenue is from when the deterrent fails. The issue here includes additional revenue from the subscription itself that people who would've unsubscribed are still paying.

    I tried to cancel my subscription. I was shocked to find out that there was a cancellation fee of $143 USD. That is about $1148 in my currency. The minimum wage is about $20.50. So I'd have to work a 7-day week at 8 hours a day to spend 87% of my earnings just to cancel a subscription that was supposed to be MONTHLY. The fact that it was a year-long obligation was not made very clear when I subscribed.

    I left Adobe in the dust years ago and I'll never look back. I'm not surprised. We all knew this is exactly what was going on. This just confirms it. The FTC will likely not do anything near strong enough to change things. So none of this is going to make any lick of difference. The best way for things to change is for everyone to stop using their products. Which we all know is not going to happen. Or if executives face charges of some kind, which they won't. It's a nothing burger in the end. We might see a month of memes and and then eventually everyone will forget. Adobe will go back to raking in the $$ and no one will care.

They could be fined 40 billion and brush it off like it never happened within two years by raising prices (again) and layoffs. Odds are though whatever fine they are hit with will only be in the hundreds of millions. Essentially loose couch change.
      Unless someone goes to jail, which will not happen, nothing will matter in the end. It sucks, but it's how it is.

And the follow up ETFs being such a small part of their revenue just sounds like "we can stop whenever we want", and then they aren't...     Glad the DOJ is doing their job, but the likely outcome is that Adobe gets a [small] fine and makes the cancellation process less egregious. They still have the legal right to charge termination fees if you cancel before your next renewal date, so those probably aren't going away. They still make the market-leading software, so unless/until that changes, companies & professionals just have to eat the cost (it is tax-deductible, at least).

    I hope it get really bad for Adobe. Ten years ago, for days, I went through their cancelation run around. Fortunately the person on the phone offered to upgraded me to a new plan, which I took and then immediately cancelled. So no early termination fee. I also promptly killed my credit card and obtained a new one. I haven't been near another Adobe product since.

      Subscription models are too lucrative. A single purchase software is better in the long run, but companies like Adobe only conceptualize things in terms of short-term gains thanks to being slaves to maximizing shareholder value.

      GIMP isn't doing great right now - it lacks both in functionality and convenience. But other graphics editors - much better that GIMP and much less scary than Photoshop (arguably some of them may outperform Photoshop in various applications) do exist.
      The reason why Photoshop is the industry standard is simple - in the past it was genuinely the best raster graphics editor in the world and most studios started using it exclusively. Nowadays, it lives on remnants of this past reputation and on companies and individuals that can't switch from Photoshop for various reasons. For example - the proprietary .psd format that Photoshop uses for the projects and that acts as a vendor lock-in tool

      I switched to Affinity products, even the download and install and activation is so much more user friendly. I was using Gimp and Inkscape as well, but they are still a bit clunky.

    was long time Maya user, loved it to bits, was forced out cause of the Autodesk acquisition, the subscription plans are just theft, as they make you pay almost full price every year for just cosmetics and plugins, that most of the time you (with a bit of knowledge) could build yourself in python. Adobe is a criminal enterprise and I'm so excited finally is taken to court

    I had a license a looooong time ago when we used to buy licenses. Never went to a monthly subscription. Working happily with Davinci Resolve Studio, Inkscape, Gimp, Krita, Audacity, Topaz Labs. More than enough for my production needs.

When asked why they didn’t just make the early cancellation fees more visible and the whole contract more transparent, they said, we can’t just put all the information in the world up front or in hover over pop ups. That would just confuse the user too much. And we can’t just show the cancelation fee, because it’s actually complicated. It depends on things like how long they have left on their subscription.”
    I don’t know why they waste their time spitting out word garbage that no one is going to eat.

    i've used ps since before it even had layers. i switched to affinity photo 2 and will never use ps again. there's some big muscle memory differences but i'm adapting just fine and not really missing ANYTHING from ps. this is just capitalism doing what capitalism does.
