      @Xan Ostler you might want to try the C-Span archives. Years and years ago, someone had put up the audio of that session. It seemed that there were inconsistencies on the voting. The Hughes Amendment was a last minute backdoor item.

    I'm surprised it has taken since '86 for people to go after the Hughes Amendment. Hughes not only stopped any new entries into the transferable pool, but also blocked the two out remaining of three total "Amnesty Periods" that were in legislation.

    Bad thing about trying to repeal the Hughes Amendment is there will be pushback from 2A individuals as well.
    If the HA is overturned full auto owners stand to lose thousands of dollars.
    Their $45k m16s would then be worth under $5k, possibly even less.
    It's the limited quantity of available full autos that make buying one such a pricey proposition.
    I would like full auto owners to view it as not losing money, but gaining.
    Even though they will take a loss on their current inventory, they will be able to pick up other pieces for considerably less.
    You might have lost $40k, but now you can get an auto AK for $2500 instead of $30k.
    So right there you just saved $27k.

But what I don’t get with the US and it’s litigation society is why you are being taxed fora health and safety addition to your guns. The moderator / silencer or whatever you want to call it.       @@benbowditch9265 unfortunately the AFT is being deliberately vague on what they consider enough surface area to constitute a shouldering device, and word on the street is that the buffer tube itself will be considered enough simply because it extends from the back of the firearm. They're aware that people have been running bare buffer tubes for awhile and I suspect they have no interesting in allowing that to be a workaround for their bullshit. Unless you have a sharpened spike coated in poison, they'll probably be more than happy to "interpret" your hardware in whatever way scores you that felony status.

    The '34 NFA is un-Constitutional in total as MGs are militia weapons, and therefore cannot be restricted by law. That's according to the Miller decision itself. The problem with the lawful transport law in the '86 FOPA is that FED.GOV doesn't enforce it by punishing/arresting Staties that violate
    it, as they should.

    After all, Miller '39 stated the govt. can't ban individual arms of war, only crew-served and those an individual militiaman would not be expected to supply or carry/bring on his own. The Hughes amendment has been invalid all along due to lack of quorum issues, and the govt's. power to tax means that they could make the tax on MGs prohibitively high as they did w/ NFA '34 [remember, $200 was serious money in '34], not ban things outright *which removes their power to tax them by default*.

    While I fully support any action to repeal all firearms laws, I'm poor and cannot afford to have a full auto anything. I have to make each bullet count. If you can afford the ammo, more power to you! Repeal the entire nfa as well. We need to be able to be inadvertently called to serve with our own weapons, on any field of battle. Just like we were meant to. We aren't enemies, we're fellow Americans! It's our duty and should be allowed, without taxes, and any other impediment the true enemy of America would devise to disable us. God bless true Americans!

    Illinois, Fed gov VS rock island armory. Courts ruled on this already. Feds can tax not prohibit ownership. Since they no longer tax they can not prohibit manufacture or possession.

    This could actually have wide implications. Stamps and permits, basically the same thing, are used to regulate a variety of activities. Gold dredging for instance. It is often the case that stamps and permits simply aren't issued for many legal activities. Some good case law here could be beneficial for lots of folks.

      Florida banned open carry and DeSantis wants to fix Florida's terrible reputation for 2nd amendment infringements and I hope he does because if he doesn't I'm roadtripping to Florida and stopping by Texas to buy suppressor and rifle and I'm going yo go protest with them and since I'm poor in lowest tax bracket if they arrest me I get free lawyer at tax payer expense and I will sue for human rights violations

    If the stars were to align and the Hughes Amendment got struck down, I'm definitely going all out. I don't like the idea of registering but I'd love to have a select fire SBR AR-15 as a range toy(I'll have to start with a mil-spec lower and later build it up over time as I wait for approval before I drill the third hole and put in the necessary parts). I still intend to support the full repeal of the NFA so the whole registry can be burned.

      I cant wait to see that niche of beltfeds growing that is inbetween ar15 and m248. I saw one on garand thumb and it accepted a belt fed or a mag fed reload but jt was better than the m249 because the m249 you stick the mag into the side and I hear people say it always jams and never works but the one on garand thumb you could put a mag in like a Normal ar15 and it seemed like a more reliable design and makes more sense to me. You could have a 100 round nut sack and instead of fumbling around reloading a belt fed after it runs out you actually agave a reliable mag fed system still in place that isn't a wonky side feed like the m249. So you could have. Relatively middle class sized rifle and if you had two nut sacks and 4 mags you could have 420 rounds when if you had to carry all rounds in only mags it would be hard to get up over 210-240 rounds unless you were really stashing mags all over your body. But if full auto becomes recognized as always been legal again the. You're going to want to carry twice the ammo potentially because the cartels already are and if you have to use it god forbid, you would burn through ammo fast in full auto.
      A full auto akv from psa would be cool becsuse 35 round stick mags and every 3 mags is 105 rounds and you could probably stash a lot of them on you

    I think this litigation is premature, but the ATF admitted on 10/14/1985 that there are over 500,000 machineguns owned by ordinary civilians in a Newsweek article. Can anyone get this tidbit to guy challenging the Hughes Amendment? That is common use according to a Supreme Court precedent, and it will be needed evidence under Bruen for any successful challenge.

    That accelerometer battery cap does have one issue - transportation. If you have it in your car on a long road trip, that thing is going to constantly be turning your scope on, so you very well may end up at your destination with a dead battery. It's not a huge problem, but something to keep in mind.

      That's optimistic. Immature advantage of having an attorney isn't just professional expertise. It's also looking in the eye and saying I know you believe that strongly better talk when we need to stick with your winning arguments and cut the rest. In my experience this is one of the biggest weaknesses that pro se litigants have. They got no one on their side to call them on their own BS.

Moreover, there are some really good groups that assist people Pro se who keep people on point with facts and law in their cases. Individuals like Alfonso Faggiolo, or Randy Kelton who have gone through Dr Graves course and hav been doing this for a long time give sound free advice on how people should stick with facts and law. Needless to say these individuals win a lot in court, as well as get large settlements. So just because you have had poor experience with Pro se does not mean they are all bad. Because I have dealt with several lawyers over the years in which they were down right awful at their job, doing the same thing you are saying about Pro se'.

    So if being in common use is a criteria, then the Government should not be preventing common use. SBRs and short barreled shotguns are not in common use due to Government interference, but now due to the ATF, SBRs are in common use and there millions of them.

      Shoot bro honestly I like to hear that from marlin tbh. Averaging over one per day and so you know they better be flawless a d what I'm concerned about is quality of craftsmanship and quality control so if they scale up fast that can easily go out the window so slow and steady, build it up, that way you don't have 10,000 people demanding a refund. There is old marlin in my family that is very old. Has to be coming up on 100 years old and it is in very very good healthy shape and will easily go another 200 years without even having to really do much of anything to it. It would really suck to me if I bought a brand new one and it was lesser quality. Its better to build 5 that are perfect than 50 that are bust. Averaging a little over 1 per day might seem slow but if they're taking it seriously it could be a good start. If they can make 50 per month they can scale up to 100 and then the quality might suffer less than if they expand immediately to 1000 per month and crank out 4000 rifles that aren't the heirloom quality people require when they spend 1000+ on such type of rifle. People pass these things down for generations and if they bum rush it marlin will just end up down the tubes like it did once already.

    How I’d love nothing more than To see the Hughes amendment and NFA gone and I own transferable m16’s myself. Unfortunately there’s too many FUDDS especially after the Vegas shooting and I don’t see a possibility in convincing your average gun owner that full autos should be unrestricted. Hell we still somehow have red flag laws in red states!!!!

    Great job to take this to court, but awful that it isn't being done so properly with an attorney. Without an attorney to help fight this the right way, it can easily be shut down by legal trickery, and set more bad precedence for the rest of us.
