Unauthorized Charges on your Debit Card? Here's what to do.

  • The Electronic Fund Transfers Act says that banks cannot hold you liable for unauthorized charges made to your debit card. This means that if your debit card is lost, stolen, or counterfeited, the bank must refund you for all fraudulent charges - if you dispute them in a timely manner. In the case of a lost or stolen card, you have to notify the bank within 2 business days of learning the card was lost or stolen. In all other cases, you have to notify the bank within 60 days of receiving the statement showing the fraudulent charges.
    If the bank doesn't refund your money within 10 days (or provisionally recredit the account while they finish their investigation), you can take them to court for a refund, plus up to $1000 of statutory damages, plus costs and attorneys' fees. 15 U.S.C. 1693f.

    1. Immediately call bank to cancel your card, request a new card, and dispute the charges.
    2. Try to ask them where a transaction was made and/or where it was shipped to.
    3. Report to police, especially if you have a really good idea of who did it.

      DO initiate a DC Fraud Dispute.
      DO NOT try for information from the bank. I get asked constantly for what was purchased, which is a privacy violation. The bank does not get that information. Where it was shipped to is also a violation of privacy. The merchants may allow you that information, however, if your account with the merchant does not have the purchase they usually will not. If your account WAS used for the purchase, then they usually do allow the address and other info to be accessed by you.
      Police action is extremely rare.
      However, I DID have a gentleman assure me that the Transactional print of his fraudulent charge which did show a different name had already been read by a detective on the bank customers' transaction history, and if I could get him a printable copy of his transaction history then that detective AND a Court Clerk had assured our bank customer that they wanted to pursue this individual in a small town situation where they wanted to pursue HER because she was undesirable. Until enforcement improves you should expect constant attacks of fraud.

      Hey I need help , so I was transferring money out my pre paid disability card and accidentally put my card number instead of my account number and my routing number was correct. I’m unsure if the money is going to bounce back or just sit some where? It’s under Bank of America disability EDD and I called them this morning after making the transfer yesterday afternoon , they said it should be back but they’ll make a complaint if not and they did so but should I contact my bank as well?

      @@Jesse-ng5ij I expect the system to experience a lack of delivery availability, and switch directions, and return the money. Usually 3 days.
      Your BOA Rep is correct. There is a dispute exception for this if the money fails to return. You are inconvenienced I understand. However, this routine matter should never result in your loss.

      @@MarkH10 so what’s my best options as of right now? I wait or contact my official bank and notify them or wait til Monday and call back the Bank of America disability if I don’t receive my money after making the incorrect numbering ?(very nervous and new to this)

      @@Jesse-ng5ij You may call at any time and initiate a Dispute. I doubt that such action will accelerate the return. If the 4th business day arrives and you do not have your money, absolutely DO file a dispute. However you may at any time file it prior to the 4th day, including minutes after the realization the transfer is incorreect. If you encounter resistance, escalate to the next level and ask for a supervisor.
      In moments of significance such as this always DO elect to survey if offered in the authorization phase of the call. If the Rep refuses your request, survey, and fail the Rep. That DSAT will generate a recording review, and then if any better action is available you should get a call back, not from the Team handling supervisor escalations, but form the Reps' direct administrative supervisor.

    i noticed there was a $82 charge that I don't remember authorizing and it mentioned jeezmedia which I've never heard before. I've emailed my bank and have blocked my cards to stop any other transaction, I'm concerned that it will keep charging. Is there anything I should do?? Thanks.

    My sister got scammed from her ex boyfriend for 10 grand and he scammed her back in January and barley noticed in May they she got robbed did the police report and everything still haven’t heard back from them but from what this video is telling me is that she’s practically screwed at this point

    I am having the same issue with TD Bank I've disputed the fraud and they refuse to give me my money back , they sent me 2 letters in the mail stating that they have conducted an investigation and result into not refunding me my money back 😑.
    I called the police and they said they can't do nothing about it and I have to go to my local police station to make the claim , I've called the bank over the phone and then went in person when in the incident happened within less than 24 hrs it's very frustrating that they trust me and allow for such theft to happen in the first place .

      Write your complaint and send it to the bank, to the Compliance Office.
      Additionally, send it to the CFPB. They administrate REG E issues.

      There are ways around this when using your information online. Unless the government is involved, they can pretty much see anything. Which for the record that's also something you can solve too. If someone replies I will talk a little more about it

    And stopped the charges..
    After my situation I use my discover secure card or my capital one secure card to buy my stuff

    what if it was a green dot customer service employee that was making unauthorized transactions by duplicating authorized transactions 2 to 3 times in one transaction, how do i recover those funds when the dispute department refuses to credit the garnished amount in full

    Some people will just try to charge your card illegally remotely like a hospital location in a central location and try to steal card data that way. Actually pre paid debit cards or my wisely cards and other cards like it come with free identity theft protection actually. When the card companies see misuse they send around investigators automatically. My cards are good.

    Someone spent like a 90$ from my card while my card being at home. They spent it on an online shopping website. I don't know who got all the info because I never share this with anyone. I'm gonna go to bank tomorrow to fill a dispute form as they've said. I hope I can get a refund. So stressed omg

      Your next step is the CFPB. Go do a Search and you will find the name for this acronym, and then the first page offered is SUBMIT A COMPLAINT.
      Write up your FACTUAL NARRATIVE of events. Include copies of your transcripts or statements. I suggest you do that in an external word processing document, then possibly take pictures for downloading.
      File that complaint,
      AND
      At the same time, send copies of these documents to your Bank, addressed to the Compliance Officer. Return receipt requested.
      One or both may turn this in your favor.
      The Federal Reserve has a complaint process, and jurisdiction as well.
      When stymied, the life lesson is.....Find who they are afraid of. That list is never you or a lawyer. The suit (Regulator) who can email, call or show up and say, "show me this" gets all the attention.
      I recently called a major corporation Customer No Service - Excuses Issued Here number 5 times about their error. I then wrote them an email that I was seeking an appointment to give a factual presentation to the House Committee regulating their industry, at the State Capitol, AND I was going to prove to county officials that they failed a regulatory requirement for maintaining chain of custody on my case, and RING!! It's Corporate Counsel. "What number do you see on your phone? (yours) Keep that number and call me directly if there are any issues, 24 hours a day. This is my work cell it is always available. Your case has been fixed, and I have emailed your employer about the deficiency. If they or you have questions, you have my phone number."
      I suggest you want interest from someone who REVERSES the information stream, and calls YOU out of the blue, with information about you and your case, not you banging your head on the Excuses line.

    I called about a fraudulent charge and wanted to dispute the charges in writing and Truist would not allow me to do it. They just wanted to cancel my card right away. And I would have to wait till Monday to go in to lobby and get temporary replacement card. The charge was for a small amount so I don't know what to do because I have my bills on autopay and they all come out within the next 2 weeks.

      They cannot stop you from sending a letter. You have no obligation to talk to them on the phone at all. In fact, it can be nothing but frustration.

    My instacart account was hacked. The thief spent several thousand dollars in one day. I did everything you said. Police report, canceled card, notified instacart and went to bank with police report number. My question is will they refund all the charges the bank charged for overdraft fees etc. I left the bank not feeling very confident that they’ll refund all these fees on top of the several thousand dollars stolen.

    My little brother had a Walmart self checkout steal 100 bucks from him. He hit 100 cash back didn’t give him the money but did charge it. His bank temporarily gave the money. But then they said he owed them 100 bucks cuz they didn’t find the fraudulent activity. But the fraudulent activity was the machine didn’t give the money for the cash back but charged it. Bank of America made it look like it’s my brothers fault. But 100 dollars was successfully taken out of his bank. He never got it back. Walmart told him to contact his bank. Not sure if he worded it wrong or what, but they certainly didn’t do anything. And yes he could prove it happened. Least when it had.

    Me charged unauthorized charge through Microsoft purchase.
    on my good luck the money from Microsoft is refunded. Aprox. 400 dollar
    But from bank side there is *dynamic currencies debit card markup fee* when i asked them. they saying that fee is not be refunded because that's for international purchasing fee.
    Really my question is why would we pay that fee we didn't purchased anything. The unauthorized purchase made because of banks bad security features

    My friend sued a collector company under the FDCPA because the collector tried to collect a false debt, they accused him of a false transaction, however the federal court says that even though they were in default they cannot issue a judgment against that company because he is a not a consumer and is not a collection and there is not a transaction. I read in case law however, that my friend was involved under a non consensual transaction and he is protected under de FDCPA

    During Christmas eve. My mom and step dad both got $500 taken from their accounts and had their cards frozen. They dont know what happened and are very livid about the situation. We cant even call the bank because they're closed on holidays. Its saturday and they open on Tuesday.. Could they use that to not pay my mom and step dad back for what they lost??

    I am up a 4:00 AM because I just found out that my home care aid took it upon herself to use my Paypal debit card to buy something for herself at the gas station without my permission. I sent her to the grocery store to get 4 items for me. That was all I authorized her to do. She brought back my card and the groceries and receipt, but then told me her daughter was in the hospital and not breathing so she had to go and rushed out the door with no further explanation (her daughter is supposedly in Florida with her grandmother for the summer and we are in Georgia).
    Tonight I needed to order something online with Paypal funds and so I just happened to check my balance and caught the unauthorized charge. Now I will have to wait. Suddenly it all made sense. She probably made up the story about her daughter and rushed out of here knowing that at some point I would find out she had stolen money from me. In the morning I am going to have to call Paypal and dispute the debit and call the agency and report it.
    This woman is a licensed CNA and misusing her position. I looked up the GA. statute for elder/disabled exploitation and apparently this is a felony. I am so upset. It wasn't a large sum of money but I am on SSDI and I need all of my money to pay bills and other living expenses. I am at the lower end of the SSDI spectrum, so I don't have extra money to throw away. It is disgusting that someone whose income is probably at least 3 times what mine is would take advantage of someone they are paid to look out for. In fact the agency is even giving her money for gas in addition to her paycheck, so this is doubly heinous. I need help at home but I no longer feel like I can trust home care aids.
    Supposedly the agency does a criminal background check on these people but in my experience most are compulsive liars and fundamentally unstable people. I have had many bad experiences of various types. You'd think that people in a skilled trade like this in a helping profession would be have some level of ethics, but I'm beginning to think many go to the trouble of licensure and training just so they can exploit the elderly and disabled in a job in which nobody's looking over their shoulder!

      Yes. If you disputed the charges and provided the bank with the relevant information regarding your dispute, they still must follow the law. Call a lawyer in your area.

    Here because when I was Christmas shopping and couldn’t find my card. I sent my money to cashapp to purchase my stuff. I woke up next day everything was fine. Three days later wells fargo sent me a email saying someone took 1k out my Wells Fargo account at the atm. I’m freaking out like crazy I’m a teenager and now my account it at -1k.       I have no idea if pawn shops are better at keeping track of the information. You may have a tough time proving the purchase was fraudulent, since it was in the same city and the card was gone for 10 days before you noticed.

    I keep ordering a new card from BofA. It seems to never make it into my possession, whether it’s not having mail for two or three days, then getting notifications on my phone asking if I approve a charge!?!? HELL NO, IDK WTF IS GOING ON. And she said it wasn’t her and now they are saying she gave someone her card… what does he do. She’s trying to make her pay for it

      Requesting a new card will only help if your card number was used to facilitate the unauthorized charges. Your best bet is to write the bank a letter listing or highlighting the unauthorized charges on your statements, and explaining that they were not authorized, and requesting a refund. Keep a copy of everything.

      Call your bank and dispute this charge. This is a REG E issue.
      If they resist at all, write the Compliance Office at your bank.

      @@MarkH10 Calling is dangerous, unless you record the conversation legally, which requires that you verify the place they're calling from or specifically request permission to record the call. It's also a huge pain in the ass and usually a waste of time. Letters take about 2 minutes and a postage stamp. Phone calls can go on for hours.

      Whether or not a charge is "authorized" usually depends on state law. But in Alabama, a spouse does not automatically have a right to dispose of their spouse's assets. It may be harder to prove that the charges were unauthorized, but it can be done.

      If the other person is a joint account holder they can do anything with that money, and that account. They can close it, and that is what you should do unless you have a joint account which is a channel of payment of Child Support.
      When you state the person is unauthorized I doubt it. I think you mean that at some point you had personal agreements with your spouse that the joint account H was for the Husband, and joint account W was for the Wife.
      Then, when things turned bad, one went to the accounts and transferred all monies to an individual account setup for the purpose. That is what I usually see.
      The bank cannot tell you what actions others take, specifically.
      For instance. I had a husband say Joint account monies transfer to my son's Teen Account. Why? Stop it?
      Investigation revealed that the wife was on both accounts and had setup the transfers automatically.
      I could ONLY say to him that "A legitimate account holder, who has such authority IS making these transfers. You must check with the other account holder."
      Now, if I am making erroneous conclusions, and it turns out that your account does NOT have a joint account holder, then you need an Affidavit of Fraud regarding that transaction. No one, no matter how close, can take money out of your account they are not styled as a joint account holder on.

    Thanks for the informative video Mr. Judson. I have a question ill keep the story short on TH-cam. I had a debit card Fraud dispute with Capital one bank. From what I can see they basically didn’t do much of an investigation and declined my fraud dispute. I had a Lawyer send them a letter which they received, they did not reply to him just to me saying they declined the claim. The representatives I’ve talk to lately have been rude and not helpful. They say they cannot answer a lot of the questions I ask pertaining to there investigation. The dilemma I’m having is there’s still funds in the account and there saying there’s no way i can access my funds till the investigation is over. Which makes no sense to me since they already completed there fraud investigation. Do you know why they would be holding my funds? It’s upsetting there holding my money and wont give me a time frame when I will get my funds. Any information you would advise?

      3 months is not too late to use this information in your case, and also this information I include is useful for others.
      **First, in your comment you are confused. The case is NOT declined (closed), AND open, holding your money until the investigation is over.**
      (What you said indicates your accounts are locked in CREDITSONLY status by the Fraud Department for 3 business days and 1 hour. If they are not released in 3 business days, then you want a supervisor, or whatever name they assign to initiate a Front Door work order to release or respond to the status.)
      In such cases we have some evidence of what will not work. Clearly your bank is not afraid of you. Not afraid of your lawyer. So, Whom exactly is it that the bank IS afraid of and will respond to? It is exactly as described in his video above, the suits. The regulators. Now is the time to complain in writing to your State Banking Regulators by whatever name they will be referred. Also, complain in writing to the FDIC, the CFPB, and the Federal Reserve.
      When the phone flow reverses, and you get what I have had....a Corporate Attorney called ME unannounced, then you will know you are getting results.
      An additional source of pressure will be offering your testimony to the State Committee regulating banking. Include your desire to testify in each piece of written complaint. Not because the FDIC or CFPB can assist you at the State level (recall they are Federal only), but because at some point your complaint to these Feds will reach the bank, and they will understand you intend to act with State legislators.
      Your State Representative also needs to hear from you in writing with these points. The Rep has staff who deal with all kinds of consumer issues, and especially those in highly regulated environments like finance.

      Hey I need help , so I was transferring money out my pre paid disability card and accidentally put my card number instead of my account number and my routing number was correct. I’m unsure if the money is going to bounce back or just sit some where?     What if your account closed and a refund was issued to the account? The bank never notified me that the money was sent. The bank cooperate office confirms that they received the money but no idea to where it went after they received it. They can only see my last 3 months. The branch confirmed that the never received the funds but the HQ did. The merchant filed a fraudulent claim against the bank for the fact that I never received the refund. I called regions HQ and they can't seem to find my account even though its closed was told only the branch would have access. The manager at one of the branch emailed me a letter confirming that since to account been closed no funds was deposited to the account. However with HQ confirming they received the funds and they can't explain where it went after they received it is confusing. I also have proof from the merchant that the funds was sent to the bank. Honestly I believe regions scam me my money.

      @@JudsonECrumpPC no if you dont report after 2 days you pay 50 after 2 days no report you pay 500. After 60 days you are responsible for all of it. Credit cards 50 if they get the card usually credit cards dont charge you period. Credit cards have superior protection and also no money has left your bank account. Most credit cards have extended warranty etc. That debit cards will never have. The fair credit billing act for credit cards is much better than Efta. Go look it up on TH-cam.

      @@bionicwoman9884 Yeah, but the 2 day time limit is from the date of discovery of the charges or the loss of the card. The vast majority of people in my experience report the same day they notice the card is missing. More importantly, however, with a debit card, an oral dispute counts. Not so for credit cards. They require written notice. Almost everyone who has fraud on their account impulsively calls the bank as soon as they notice something is wrong. Those that do so with credit cards have basically no legal power to take action against the bank if they screw up their investigation after an oral dispute. Debit card holders can take action against the bank even for screwing up an oral dispute.

What if they'd promised to fix it, but didn't follow through? You would have no legal recourse, because your dispute wasn't in writing. That's what I'm trying to say here.

      Technically, the bank is obliged to provide you with all documents and information they relied upon in processing your dispute. If the conducted an actual investigation into your dispute, then they should have some contact with the merchants where the charges were paid. However, that is not always the case. If you end up in litigation, then yes, you can definitely force them to turn over the information they have on the merchant. And you can subpoena the merchant to find out the details of the transaction.

      They may have footage of the withdrawal on camera, but they won't likely release it to you unless you're in a lawsuit. If you have been the victim of an unauthorized ATM withdrawal, you should contact a lawyer immediately.

      If the dispute was not written, you could try again in writing. If that doesn't work, then gather your documentation, proof of the fraud and damages, and call a lawyer in your area.

    Well someone stole $800 and bought furniture and they said they disputed but the other people denied it apparently so they never helped me!       In the US we have a REG E, which covers unauthorized access of Deposit Accounts through electronic means.
      I am sure you have similar in the UK. Dispute with your bank. Have them issue a new DC, and expedite it and waive any fees as a customer service courtesy.
      In the US you will handle this all over the phone.

    They deleted me again!
    So this is what I figured out, my smart phone has a virus. My own phone has a virus in it, so that when I call a legitimate phone number, that phone call is re-routed and the call goes to a scam artist. So, I thought I was talking to a legitimate business, but instead I was talking to a scam artist who was impersonating that business.
    Has this happened to anyone else?

      Puffy, most banks are able to track the transaction down to the merchant who authorized the transaction. If they cared to do it, they could potentially catch the fraudsters and sue them or refer them to the authorities for prosecution, but they don't usually do that. Unfortunately.

    It wasn’t stolen but I did something dumb, I paid for a subscription on a website I thought was legit based on impulse. I put my info in it. It was 3 am and I was being stupid(I’m smart with my money regularly). Anyway it showed a charge for 119 dollars and I was terrified. I turned my card off and all that. And I don’t know what to do.       It depends on the law of the jurisdiction where you are, where the ID thief is located, where the bank account is located, and where the unauthorized charges were made.

    Someone uses my Card from another country I honestly don't know how they got my Card info but i believe they lived in India , I keep getting monthly charges from Netflix and other App subscription. They even tried to use it to send money using World Remit good thing my bank cancelled the transaction ,I already talked to my bank bc i can't just cancel my card that easy. Is there any possibility to track them down?

      If they're international, tracking them down will be very difficult. You can report to Interpol or the FBI, but they have bigger fish to fry. Just make sure you check your statements regularly and write your bank if you see any bogus charges. Keep records of everything!

      Dispute, and a normal bank will cancel the card to protect themselves and the customer if you alledge fraud. Forget the sentiment and protect yourself as much as possible. A customer service centered bank will send your new card EXPEDITED and WAIVE the fee.
      Perhaps 1 in 10,000 people know how to block their DC. Do you? Block and keep it blocked, only unblocking at the point of purchase.
      I understand 1 use in India seems unusual.
      My personal record for taking a DC dispute is over 70 transactions, (each with a 90 second recording...this single call took about 3 hours) with fraud on 5 continents. Malta, Ukraine, UK, HK all happen very, very often.

      No. No finding them. File your dispute claim.
      Another DC Function you appear to not know about and use is BLOCK/UNBLOCK card.
      Go into your Bank App.
      Go to the checking account, and then to the card. Some banks have a different path, but this is a Visa/MC function, and they issue all DCs in the US.
      Once you find the Card you will find a list of functions like, nw card, change PIN, Travel Notification, and etc. The one you want is BLOCK/UNBLOCK. This happens immediately. If your card is blocked any transaction will be declined.
      Currently, with 60 minutes in a day, and 24 hours, your card info is filed and useful everywhere you use it 1440 minutes in a day. If you instead, maintain your DC as BLOCKED, then ONLY when you open the card at the conclusion of a transaction or at a POS - Point of Sale will the card information be useful. Immediately after the sale BLOCK it again. Using this method your card vulnerability reduces to mere minutes a day maybe 14-24 on a busy day, and your accounts security is more of your accomplishment. You benefit also, because you will incidentally read your balance. IF a different channel is used to debit your account you will know it.

    need direction , someone used debit card info and made Many transactions at or near locations I have used my card in the past. Because the transactions happened at the same location. bank denied claim. I never seen or notice these transactions until recently. one withdraw a month didn't notice but now this past month six in one day multiple days. Filed police report ,went to address for ATM that were used . Not legit business nor public access. Refiled dispute with bank and yet have not spoken to investigator from bank.

      It's possible, but not easy. If you dispute a transaction, and the bank denies your dispute, you can send a written request for all information they used to process your dispute. Their communications with the merchant should be included. But often, you don't get that information until you've taken them to court.

      If you have a genuinely unauthorized charge and you dispute it with the bank in time, then yes, they are required to give your money back. As for the thief, you can sue them yourself if you can find them. If not, then you can report them to state, local, and federal law enforcement and hopefully they'll be prosecuted.

      It's your account. If you write your bank a letter asking them for information relating to the transactions, they have to respond. Also, you can instruct them not to honor any future transactions to that merchant. There are lots of articles about how to dispute these charges.

      Dispute the charges as unauthorized.
      Put in a STOP PAYMENT on all future recurring charges, naming the merchant name.
      Get a new DC.
      With your new DC, stop leaving it UNBLOCKED. Ask your bank rep sending the card to show you how to BLOCK the card.

      Dispute all fraud or unknown charges to your bank. There is no time limit. Do it now....stop reading, and pick up your phone.
      Never allow them to send anything regular mail, the USPS is failing. Just forget them
      instead, request an Expedited delivery, and for the bank to waive the fees. If that is an issue. That is your first indication it's time to shop your banking account to a bank that will give great service.
      Dispute your charges NOW. You are owed your money back, and dispute is the path to that.

      No. An unauthorized ACH is covered by the EFTA. You have the same dispute rights.

    How do I pursue the person that stole my card info? Someone decided to run up a tab on amazon AND a marriot in TX on my dime... and Im not feel very forgiving today. Will the bank pursue it for me? Do I have to find the person myself? How do I press charges? I want this thief to learn a lesson. The audacity of people just baffles me.. i could barley afford groceries for my 4 children today because of this person.

      The bank will probably not pursue it. I've never seen them do that. You can report to the police in the area where the fraudulent charges were made. They may be able to track them down. Otherwise, you can file a lawsuit against a fictitious party and subpoena the records of the merchants where the fraudulent charges were made. They may have video footage or other evidence. It's a huge pain in the ass, but I always encourage people to go hard after these criminals.

I’m planning on filing a report. Will it even go anywhere though? He has a past criminal record. Will they at least put out a warrant of some kind?

      @@austinbonde9041 I have no idea. It's entirely in the hands of law enforcement. However, I would recommend reporting to every potential authority: the state AG's office, the local police/sheriff, the CFPB, the FTC, and the FBI.

      Dispute all unauthorized charges. Protect yourself from future fraud and unauthorized use.
      Open your bank app.
      find your card.
      "Block' or 'Temporary Block' on that card.
      remove the block as you use it, then immediately put the block right back on it.
      If anyone at the bank says anything other than "I'll dispute this immediately', when you want to dispute a charge, then write up a complaint.
      Submit it to the bank in writing to the COMPLIANCE OFFICE, and
      the CFPB who regulates and enforces Sec:1005.1 or also known as REG E.

      You can dispute that with your bank. They're supposed to conduct an investigation. You can also write the merchant directly and ask them where they got the information and why they charged you.

      If it is the same merchant, you can write your bank telling them not to authorize any further charges by that merchant. However, if it is random charges, you're probably the victim of ID theft, and you need to close the account and get a new card number. May want to reset all your passwords and make sure you have good antivirus protection on your phone and computer as well.

    I'm a victim of online payment fraud i try to order a food online but the transaction is incomplete then i discontinued my order then after 2 days when i check my account i lost my 1000dollars and i checked my account summary or records that i purchased something i didn't know.. i already report it to my bank immediately.       Yes it matters. Almost all civil actions have a statute of limitations. For EFTA cases, it is 1 year from the date of the violation.
