You are being clever by half. Can you recall that the three remaining members of the House were duly suspended by the the speaker (before their defection) and they’ve not been recalled .
Suspension is different from dismissal...
The court can reinstate suspended members but cannot restore members who willingly dismissed themselves!
In the first place, they were not legislators since their defection. They couldn't have carried out any valid legislative act known to law. There are only three members of the Rivers State house of assembly.
