The man had a court order to not be on that property. I would assume while an investigation of some sort occurred "code violation". The man was positively IDed and was in violation of the court order. He was given a chance to leave and refused. This officer did nothing wrong. You as an officer should know that.

If you were a cop for 38 years, then you certainly should be able to recognize that there is something missing from the description of the video. The officer positively identified the man and still ordered him off the property...that should tell you something.
Without a warrant, the cop is trespassing.
There can be exigent circumstances that allow a cop to come onto a property or even in a house - such as 'hot pursuit', potential destruction of evidence, or preventing immediate harm to somebody. But those obviously don't apply here.

actually if you look the case up the officer was in the right with this one the owner was not aloud to be on the property case of a court order. the case started in 2001 and was still going on in 2013. ecf.ksd.uscourts.gov/cgi-bin/show_public_doc?2008cv2069-104 Basically he had a truck dealership license and was running a junkyard. The biggest thing was the leaking trucks on the ground. He brought this on him self with not complying with the new rule that went in to affect in 2000 and also the junkyard was never permitted to be there. Parts yes but not full trucks.

The second was, to never ever unduly antagonize or irritate someone much older than yourself. The moment I saw the Trooper make the old man get on the ground for no good reason, I thought to myself, "The Trooper has his best years still in front of him, but the old man already has them behind him". A sure recipe for bearing the brunt of some ones rage and retribution, without a whole lot to keep them in check.

Also His legal troubles pertaining to his land starting 20 years ago in 2001... this was over an issue that started in 2005 or 2006. This video is from 2009, the original lawsuit wasn’t even filed until 2011... it took until 2015 before a decision was made and a new lawsuit asking for $300,000 was filed.

At no time did I hear the man arrested inform the Troop that he was the property owner.
And there is much history to this confrontation that is not known. The OP should have provided this instead of just the short interaction shown. Poor communication all round.
Why would he need to inform him he was the property owner? If he was being told to leave the premises, the LEO had to of been given authorization by the property owner to remove the unwanted person. Had he done that, he'd know the name of the person, and thusly, upon being shown ID would've recognized his blunder. Instead he doubled down, performed a false arrest, and likely cost his county tax payer dollars to settle. Remember, you're not required to assist in an investigation. They're trying to prove your guilt, you don't have to prove your innocence. Everything this officer had was hearsay from an alleged call. No tangible evidence which could've been used to convict other than refusal to leave a premises that the man owned, making it an unlawful order.

That cop seemed like he had no idea what the hell he was doing. He probably just finished snorting the same coke that he took from some real criminal.
If you hear the trooper he says the old man isn't allowed on the property, but doesn't want to say the old man's name because he doesn't know it. He also asked for the ID before saying the man's name. He stated his supervisor told him that the man wasn't allowed on the land but if that's the case he should have a name and should state the name then ask for IDs to verify if that is the same person. He is using word play to get the ID to see if he can make an arrest.

There were 2 court orders - an order allowing the clean up company to clean up the property and temporary restraining orders against this guy and his father to keep them off the property while the cleanup took place. The orders were issued in court when this guy and his father were there with their lawyer. LEOs don't have to carry duplicate copies of every court order issued in their state. All they need to know is that the orders were issued.

Exactly, how can they arrest someone for being on their own property. Treating the older gentleman like that. Cop catches the wrong back woods fellow. And could easily come up missing. If its like the elders I grew up with that carried pistols or shotguns everywhere. Its a possibility. Grandma don't have to see very well to take out 3 cops with a double barrel.
@Pierre LeDouche If my place gets robbed I will call the police but not expecting anything from them. Next door neighbor got robbed a few years ago, took anything of interest in the house and two vehicles and the cops wouldn't come out to take a report and would also not take a report over the phone or if the neighbor went in to do it, in other words they did nothing. Neighbor got one rig back because the cops found it parked illegally and ticked the shit out of it then towed it total bill before he found out they had it was over two grand, the cops didn't know it was stolen, duhhhhh they wouldn't take a report of what was stolen, dumbasses.
@Pierre LeDouche Their claim is they are just to busy to get into small things like that, they only got maybe 40,000 dollars or so counting the vehicles. The cops around here, Eugene Oregon area don't even show up unless it is a violent crime or has to do with drugs, major amounts not the down the block drug dealers they knew about but never bothered with. Lost one of the drug dealers because they couldn't pay their rent and the other because I called their parents who's house they were living in and mom and dad didn't want to lose their house to the cops when/if they grab their mid-40's sons.

He should have told him he was trespassing on private property. That unless he showed a court order warrant he would have to leave or he would be sued along with the police department for sending him there to violate his rights. The law states that unless a policeman has a warrant supplied by a judge or have probable cause (suspicion of illegal activity is happening) he cannot order someone off their own property or arrest someone for not leaving his own property. I smell a major lawsuit if the man files one against them. As far as arresting someone for not putting down the camera the law states that anyone has the right to record all police actions as long as they do not interfere with the officer doing his job. I'm starting to think this officer doesn't like his money or his job. He has not been trained properly to do his job correctly. What he should have done is to go get the warrant and then come back and do his duty or if there was no warrant not to go on the property to start with.

From my understanding after checking a few articles about this incident, there was a court order and he was aware of it. Apparently the city had been trying to evict him from the property for a couple years (possibly unlawfully). So whether that court order was lawful is still up for debate. But it had something to do with his junkers leaking oil and antifreeze as well as being a general eyesore. Some reports stated that the city tried to negotiate with him about the business practices (leaking chemicals, etc) and Lambeth filed several unsuccessful lawsuits rather than negotiate. Being this old, I don't feel like digging anymore, but it seems like it was a case of "fighting city hall", and we know how that turns out if you don't have more money for lawyers than the city.....
@@JR-ur2gg From what I found out, tes there was a court order but there was no warrant for search or arrest and they are required to show that warrant to the person before entering someone's property. this is to protect both sides involved. the old man could have shot the policeman dead for unlawfully trespassing on private property. The police man had no right to tell the person filming to stop or to hand cuff him when he didn't. The policeman was not doing anything in a lawful matter. He needs to find a different job or get the proper training. The old man should have complied with the court order to clean up his property. there are many places that have done the clean up without incident. This however doesn't give the policeman the right to trespass without having an arrest order or search order signed by a judge.

@@deere3321 The full story is he lost 8 years of court ballet and he didn't' have the right permits to do what we was doing there. In 2009 they was a judgement to clean the property up and he was ordered not to be on the property. This is also a case where he was asked to clean it up years ago and deiced to fight and not do anything to improve the place.

The Cops and the State of Kansas won this issue. Stupid old man lost for being unreasonable. It was about clearing up all the rusty trucks and machinery on his property. As a former Police Officer I have picked up individuals on out of State warrants WITHOUT the warrant in hand and booked them into the county jail. Why do you think that there are computers? And if someone is wanted on an OUT OF STATE warrant, and they want that individual return say to the State of California, say on a murder warrant, you are telling me that they have to let the suspect go and wait for the warrant to be mailed or have the Trooper drive all the way to California to get the warrant? WRONG!! As long as a Police officer had knowledge of a warrant, he has to take the individual into custody and the Sheriff of said County has to hold him until he is picked up by the agency that issues the warrant. Go to Law School before you make a fool of yourself again. You are wrong. Contact one of your city officials and ask them. Now there are different types of warrants.
