    Great, informative video! I agree with your point on touchscreens not being ideal for basic car controls. Volkswagen recently changed their capacitive (touch) steering wheel buttons back to regular tactile buttons, so maybe the industry is realising.

      I personally think them changing from physical buttons to touch-sensitive buttons was a silly change in the first place since they are hit and miss to use, you can't feel them by touch like the physical buttons so you need to divert your vision off the road to see which button you are pressing. So in way, they went backwards before going back to what they originally had.

    This is a subject im passionate about and FINALLY, someone who pointed out the fact that car manufactures are using / exploiting the 'not holding' literature as a loophole! I'm pretty sure you can even select Spotify menus now on the dash! The whole reason the rule / law was made was to reduce distractions / attention divertion. Manufacturers are just mirroring the phone to the dash, so same distraction! You wouldn't walk around with a loaded gun whilst distracted so why on earth are people allowed to flick through menus on their dash. Eyes should be on the road or checking the mirrors, end of. A car is such a dangerous weapon if not respected hence we have a licence system. People may think 'yeah well if you bump into another car the metal box will protect you both and the insurer will pay out' but what if next time it's a child that runs out into the road whilst you're selecting your next playlist or typing in a search query? It's pure selfishness and a total disregard for others. I see HGV drivers using their phone in motion with their head down, It sickens and terrifies me. Car vs HGV... just don't... I don't think people appreciate how far the chain reaction of death and or life changing injuries reaches. Its not just the person you hit, its the families and the people attached to that family and to you, the driver who causes it; I'm not talking about the law side, I'm talking about how that level of guilt erodes you.
    I think the exception you made Richard e.g a route change notification whilst on a straight piece of motorway is fair. There's no cognition involved in that. It's when the brain has to think about a process other than driving that issues arise. Changes happen out there in split seconds as you know, I've seen it happen far too often with all the motorway driving I do and I've seen the effects. I still think the law is too soft, I still think it should be treated like drink driving - Instant ban. The reason I believe it hasn't gone that far is lack of evidential proof for the courts. Drink driving = roadside BT, then police station evidential BT and then court then ban. Other than a policeman's word you haven't got that hard 'hold in the hand' (no irnorny intended) data. We all have a duty to take care of each other to the best of our ability.
    Most functions are voice activated now anyway. You can say hey Google play X, navigate to Y without even touching anything or have a fancy car.
    On a lighter note, Richard I would never have guessed you're late 30's early 40's, passed in 2004? I thought you were late 20s! Having said that I get ID'd in my 30's still haha!

    I agree re the touchscreen and i think tesla already have put wipers in the screen! There should be legislation to enforce that cars need basic functionality to be accessible via physical buttons. It's not just that you have to navigate menu's, but physical buttons allow you to feel the response, or know the position of like, the wipers selector, without needing to look down. Something you can't do with a touchscreen!

    They say phones are distractions, which they are, but cars now come with enormous TV screens in the centre console 😅🙈 the Corsa GS I'm learning in has a big screen and a screen instead of dials.

    Excellent video. I use a cell phone attached to one side of small radio with blue tooth. Put on play list ,and if I get a call, have to push one button on radio, can speak no hands and callers voice comes over loud speakers. Music goes off automatically. I'm 62, learned to drive recently, live in Paraguay. Your videos helped enormouslly. Thank you Richard.

    I agree with the points made in this video. I like how rules stop people doing silly things with their phones but still allow you to use devices in holders or infotainment systems in order to have navigation and perhaps answer calls. I personally don't bother even using my phone while driving and just use a vent mount with a magnet on a cheap used £10 Garmin sat-nav off eBay which you setup before you set off. As a new driver, I wouldn't even dare to use a phone due to the punishments.

      Honestly the physical sat navs are nothing compared to Waze. It gives you real time traffic and routes you the way with the least amount of traffic, routes you around road closures, tells you have hazards in the road, warns you of speed cameras and average speed cameras, red light cameras.

    Touchscreens can stop working without warning, so should only be used for ICE systems. Easily visible, reachable and reliable buttons are best for safety features.

    Hey, I just wanted to say I really appreciate your videos.
    i really like to watch them because they are really interesting even tho I am not in a legal age to drive but I'm just hoping that it will pay off when I do start sitting behind the wheel and actually move the car.
    plus it's interesting and just fun to watch since I'm really interested in engines and gears/cars overall and I really like driving in city car driving with a wheel (sadly no clutch and gearbox :/ ).
    I also really like that your videos get filmed like we are the passengers and you are teaching us everything in real-time.
    ps: every time I see a Seat Leon I always have to think about your awesome learner car.
    also, excuse the bad English, I live in Germany so English isn't my main language.
    overall I hope great videos are still to come and I wish you all the best :)

    I also think the touch screen thing as well as to save money is so they can let you "unlock" features either for a one time fee or subscription service and rather than installing all the physical buttons into the dash such as heated seats, parking sensors, auto wipers, auto headlights etc etc they just put it all into the software.

    Some really interesting info here. A couple of grey areas my own habits bring up:
    -When are you "safely parked"? I will sometimes used my phone pulled over with the engine running. Never queueing.
    -Interesting emphasis on "Holding AND using". I will occasionally pass my phone to a passenger while driving, never looking at it or operating it.

    I've just got an ID3 and frankly, you have to pretty much do everything via a screen . Probably because its quite new to me, but in any case lots of operations require far too much screen time. I dont feel I'm driving a car anymore, I'm driving a phone

    Really informative video it really annoys me these days still seeing Drivers using their Mobile Phone while Driving I see a few while walking outside but don’t notice too many while I am out Driving though thank goodness

    Passed my test yesterday with one minor in appalling weather, instructor said I have been his best pupil yet. To anyone with a test coming up, treat the examiner like they are your friend, talk to them and the driving will come naturally. You will drive consciously but unconsciously, focusing but at the same time being able to calm yourself. I did the one route I did not want to do and it went great with no problems. Before you know it you’re in the way back to the test centre. Trust your instincts. It’s a half hour to forty minutes and it absolutely flies by. As my mother told me beforehand, you will be laughing at how stressed you are after you do it. And finally, if you’re stressed or scared before the test, then do the exam stressed or scared. Fear and adrenaline are meant to heighten your senses so use that to your advantage. Big thank you to Rich for the good advice and informative videos. Will have a good time binging them again post exam. And to everyone else, you will do fine trust in yourself and bet on yourself.

    I agree that a touch screen interface for regularly accessed functions is a terrible idea. Buttons you can touch are much safer, or a head-up display and some kind of easy interface to that. Having to look away to a screen to see menus is unsafe, Tesla.

    in Slovakia we had changes too,we also have very similar rules here about using phones and even same fine price since this year! 200 euros. (it used to be 150 before 2022) I personally dont use the phone at all most of the time while driving. I have a bluetooth handsfree installed on my car,but i dont even use that. 90% of time I just have my phone in my pocket and ignore it. Occaisonally i use it for navigation,but i do not even touch it then,because it would distract me from driving. One time, when i was stranded abroad,my phone holder did not work and i had to use my phone for navigation, so i used the bluetooth connection (i use wireless BT transmitter that plugs into the car outlet) to connect the phone to the radio,put it in my pocket and just listened to the instructions,but that was a bit annoying and inconvinient,so I bought another,but much tougher windshield holder and its very useful. I know people who use their phone and are holding it while driving even for navigation and i always get nervous about it that we would crash. It happens way too often,despite the ban.

    It totally makes sense to make mobile phone usage illegal but make it completely legal to activate the demist function (after 5 on screen steps) via your 27 inch maximum zero-glare touchscreen.

    Over here in Spain they unfortunately clarified the whole "holding" vs "touching" the phone by saying "you will lose 6 points if using in your hand, and 3 points if it isn't in your hand". so if you ever drive through Spain don't even look at your phone lol

    I work as a bus driver and my employer has implemented the use of mobile phones to be put onto a cradle. ( That sticks onto the windscreen).
    It's to be used as a tracker that also navigates bus routes for us called , (Flexi route).
    It's also to be used for communication by means of phone calls, txt messages and emails.
    Everytime I pick up a passenger I'm expecting to touch the mobile screen to confirm that I have picked up a passenger.
    The new 2022 highway code says that the use of mobile phones cradles are now illegal.?
    Can you advise?

    HIi, please make a video on secondary traffic lights. Many times you would not know that left or right lane has [ only Right turn / only left turn turn] mark on road. How to identify such situation beforehand. Thanks !

    I'm completely against all these new cars with a massive ipad in the center dash... Its basically encouraging you to drive distracted. That's why I appreciate manufacturers that still make barebones cars with physical buttons for everything. You should be able to push the buttons without even having to look at them if you're familiar with your car, almost impossible with a touch screen. My 2017 elantra base model is like this and most people are surprised how simple and outdated the controls on the dash are for a 2017 model, but I love it and it was one of the main reasons I bought it. I can operate everything without ever taking my eyes off the road. The manual transmission was obviously the first main reason though haha.

    There is a lot of research currently happening in the discipline of Human Factors (a discipline that applies psychology and physiology to the design of equipment and systems - such as cars!) about alternate ways of interacting with car systems. Gesture-based interaction, for example, is heavily researched, where you use your hands to gesture. The reason why cars are turning away from physical buttons and dials is exactly as you said - it's about saving money. It also makes it much easier to change a design later on in the design process - with software, you just need to rewrite code. With physical buttons, you need to account for the buttons' functionality way earlier in the design process, and you can't easily (or cheaply!) reverse it, especially if you've started making physical prototypes, casts and molds!
    The challenge lies in recognizing what is an intuitive gesture - for example, what gesture would people adopt if they wanted to increase/decrease volume? Are the gestures more distracting than physical buttons? There may be more challenges with technical implementation, but those concerns are beyond my field :)

    I wonder if they are planning on making more features voice activated and then doing away with the physical button, and by the fact they have a touch screen button it isn't inaccessible due to disability.

    Heyo! thought I'd share a tricky part of my test that caught me out for a serious. I did my test in Launceston and on the test I was travelling down a country lane. I came to a junction and was not too sure of which way to go and so deferred to what I learnt here being "you can't fail for going the wrong way, so just do it safely and get redirected". Unfortunately for me, a little before the junction hidden in a hedge was a "road bears left" sign and there were actually faded markings on the road under the frost. I got marked on this as a serious, "failure to respond to road signs". Would be keen to hear what I should've done, as surely clarifying which direction I should go would also confirm the failure to respond to road signs? Happy to send Google maps location if requested 😊

      Going the wrong way is not a fault but failing to giveway when required is a serious fault. Without seeing the junction I can't comment.

    Using touch screens to control basic functions in a car are just as bad as mucking about on a phone. When a driver is navigating an onscreen menu trying to change something like airflow or temperature, their eyes and attention are not on the road. They really should regulate and penalize car manufacturers for these things.

    I agree with almost everything but if I'm being honest, whats so bad about recording a scenic driving video on a phone or something similar where the only risk is you having one less hand on the steering wheel. Many people already drive around with just one hand on the wheel. You're not exactly looking at the phone or away from the road while filming, so you can't even say you're distracted. Maybe slower thinking time to react but its a genuine debate I'd like to have. I'm not saying it should be legal to do so, but I think it shouldn't be as enforced as say messaging/calling someone which actually takes your attention away from the road ahead.

      I think holding a camera will be very distracting as you have to concentrate on where you are pointing it.

    Hey richard just a question, i know you constantly say gas before bite is important especially in petrol or older cars however is it just as acceptable to bring the clutch up a little bit (not all the way) add gas then lift the clutch to the biting point before the car is moving so that theres still gas set before the bite but you dont have to bring the clutch as far. Is this just as acceptable and would work in all cars? Thanks

      To clarify this isnt bringing the clutch fully up and rolling before any gas is set, this is bringing the clutch halfway up, setting gas then fully up on the clutch and moving

      Lifting the clutch to the bite point then adding gas won't work in all cars but if it does work it's acceptable. I do a combination of both depending on what car I'm driving and how fast I want to go.

      When learning to drive I don't recommend music as it's harder to talk over it. But once you have passed I can't see a problem as long as it isn't too loud. It comes down to the individual.

    I know the person that successfully appealed the offence which resulted in the law being changed. The ridiculous thing is that he wasn't even holding the phone, it was one his kids reaching across from the passenger seat and doing the filming, however all the police could see was a phone pointed at them in the side window and they convinced the judge that the driver was holding it. The other thing I notice is that the law mentions connected devices, so I suppose that if you want to video using an old fashioned camcorder then you can do that can't you?

      I'm sure holding a camcorder would still be considered careless or dangerous driving. Mobile phone use has it's own specific law, I guess because it's so common and to discourage people from using them when driving.

    What if you're at a drive through and you're using the app of the establishment you're currently at while in a slow moving queue to load up any points you need to redeem before you even get to the payment stage. Does anything cover that?
    I'm coming at this from the opposite direction one may think as I work at a drive through establishment with an app that is glitchy as anything and I just want any excuse to stop people from using it.

      as far as I know none of the rules/laws of the road apply when you are in a drive through as its technically a private road

      @@xHypnoToad As far as I know any road in the UK that has public access considered public road in terms of laws even if in a private land so to my understanding same rules applies and using x app to get points is not an excuse at all. (US has different laws regarding private land though)

    I have exam in few days. I have been left without an instructor. My partner owns Full UK driving licence since September 2022 and I am wondering if he can drive to the test centre with me (he will drive) so I can take my exam?

      I made my first videos with the camera on my phone. I used a window mount and set it up before driving.

    My phone is kept in my zipped up coat pocket while driving,it’s also switched off. It’s not worth it,especially as I’m a new driver.

    11:11 You can use Android Auto for Android on the phone and the interface is easier to use than normal maps, specifically when moving. It happened to me once, a friend that was on the passenger seat and lost consciousness because of an asthma attack (no wheezy sound at all, I thought she was sleeping, but no, she was unconscious) and I just said "OK google, navigate to Addenbrooke's hospital" and it did it perfectly. No buttons to press, no anything. Maybe if you say "navigate" instead of "direct me", it would show you the directions without any need of pressing any buttons.

      There was an app but it seems to have gone. I can use voice activation without pressing something but when it's turned on it sometimes activates without me asking it to. I hope your friend was OK.

      @@ConquerDriving Yes, she fully recovered, thank you! Apparently it happens once a year more or less, but it was "my first time" so I freaked out "a bit". In any case, regarding the Android Auto app, I still have it installed and it switches on automatically when it connects to my car Bluetooth. Maybe it depends on the Android phone, I don´t know, but I can see it when I look for "Android Auto" on the play store.

    How do we measure experience though: I’ve only just passed my driving test (starting of last year) but I’ve been driving continuously for a good few years.. my friend passed her test ten years ago but hasn’t driven since.. yet on paper she’s the ‘experienced’ driver. In my case, I think the 6 points is unfair.

      I would measure experience by hours behind the wheel. But I understand, you could have a licence for many years without driving.

      @@ConquerDriving Does driving with an instructor count as a experience or is it driving independently by yourself? If you had two people: one has been driving consistently with an instructor for 3 years, another has been driving for 9 months to a year after passing their test.. who would be considered the more experienced driver. I’m just wondering. I live in London and I know a lot of license holders who don’t drive after passing.

      I guess that would come under "any device that sends or receives data" but it's not handheld. I would say it's still illegal but I guess the courts would have to decide.

    Totally agree with the trend to cut cost by putting everything into a touchscreen. Safety organisations should focus on that and make it part of their rating. Perhaps ease of operation category or driver focus category.

      You have to judge every situation based on its own merits. I don't check the blind spot every left and right turn, only if I feel it's necessary.

    What's your opinion on using a phone while parked but the car is idling. I can be parked, out of gear and the handbrake up. Maybe i'm idling the car to warm it up for a few minutes before i set off. Then i need to phone or message someone. I can't see it being a problem but it always makes me nervous.

      The problem is Rule 239 says you MUST have the engine off when parked. It's important to understand that the point in the mobile phone rule is to stop you using your mobile phone when driving. You can use it when safely parked.

      @@ConquerDriving To add on to my other reply....Yeah i'm all for following the rules but it isn't always safe to turn the engine on then set off straight away, sometimes i need to let the car demist a little. To say it's a MUST rule seems to be a little strong. I'm not one to take the mick, if the engine is on just before i set off or even when i pull in to pick someone up and they'll be another minute. It's not as bad as some actual driving habits out there.

    As a driving instructor like your self would you be able to use he phone when engine is off and you are using it for tutorial education purposes. Like your videos to my students or is this not allowed.

      @@nineteenninetyfive, Only if the car is secure (neutral/park with the handbrake in a safe location). As he mentioned that using a handheld phone in cars where the engine automatically switches off when stopped (i.e. in traffic or a red light) is illegal.

      Rule 239 of the highway code says you MUST switch off the engine when parked. So technically you could argue the engine must be switch off, but that's not the point in the mobile phone rule. The rule is to stop you driving whilst using your phone which is a separate rule for turning off your engine when parked. I guess the courts would not charge you for using your phone if you were obviously parked with engine running, they would be more likely to charge you for leaving the engine running when parked. But I may be wrong, the safest thing to do to protect your licence would be to switch the engine off.

    People still use their phones anyway while driving. It's just, people that doesn't care. They think, once they have passed their driving, they can do what they want in their car because they don't have to be with an instructor. These rules are there for a reason. To keep you, other road users such as buses, cars and lorries etc and also pedestrians and cyclists safe. I only take my phone with me to show my instructor my progression on the DVSA theory test app, then it is in the pocket in the side of the door when I am on the move. Of course my instructor would be really annoyed with me if she caught me on my phone while in a car. It just isn't worth the risk.

    I never look at the sat nav screen whilst driving. Just follow the voice instructions. Things can happen whilst eyes are off the road even if only for a split second.

    Good that you cant hold or touch phone driving. There is no need for it and its proven to be a huge distraction. We dont need to look at the screen either. Google maps gives me good voice direction and i can give it voice commands too, even ask it to make a phone call. My phone sits in a door pocket closed in its wallet, blue toothed into car audio if required. All this on a basic android phone. Also the use of car touch screens is madness. In my older car i have normal controls and can adjust everything by feel, without taking eyes off road. There is no tactile feel back with a touch screen. Say you want to adjust heater. Touch the screen, LOOK AT IT to find button and press it. LOOK again to see if its done what you asked. Even worse if it involves lists or sub menus. No wonder so many are not paying attention to road nowadays. Blank touch screen as soon as car starts to move. There is no NEED for it. Its just a fast route to the cemetery.
    99% of touch screen actions should be inhibited when car moving and it would help if they restored some physical buttons and knobs for functions needed while driving.

      Not “touch” though, law clearly states ‘holding’ not touching, so if using a phone attached to console and touch it to use navigation is considered at most careless driving but not use of hand held device.
      I never use my phone at all while driving but touching is the same thing whether a phone or car screen.

    My question is what do you think about driving examiners using iPads on test? How can they be allowed to do this when my understanding of the law is that the same rules apply to people supervising learners and those who are actually driving.

      The driving examiner isn't really supervising you though (like a driving instructor would), since they are only observing how you drive without any prompts or instructions outside of directing where you need to go and what manoeuvre you have to do. They would only intervene when they feel you are creating a dangerous situation so I'd say that makes them exempt from this rule.

      @JCBarber I'd argue it's a fair exception as the examiners are safety trained and their conduct is always under scrutiny. If the candidate is doing something dangerous (I.E., if it would be dangerous for the examiner to be using the tablet) then they'd terminate the test anyway.

      It's a good point, but an exception was made to allow them to replace paper with computers. To be fair, their use isn't dangerous and no more distracting than using a piece of paper as they used to.

    My dad's car doesn't have Bluetooth, even though it has a fancy steering wheel. So, I gave him my old Bluetooth speaker. Now he can answer calls by pressing the power button.

    Seems odd that car makers install touchscreens as standard when it is proven touchscreens ansd safety don't mix..can't touch a phone but can touch a touchscreen.????.....seems counter intuitive,

    Though I’m not a major fan of my black box, here it really helps cement the idea of not using your phone whilst driving (even at lights) as using it makes your overall score lower. As long as you set up the satnav or Spotify etc before hand, you can use it passively too, so it doesn’t impede me in that regard.

      Being on a call in fact reduces attention considerably and it is dangerous, lot’s of data and research about that however someone was on a call is complicated to prove from a legal point and it’s effect on attention differs by the nature of conversation so a grey area hence legal.

      2 way radios are allowed, subject to them operating within the allowed frequency ranges of the exception made for them. My walkie talkie does, as do CB radios, the radios taxi firms use, & many others. Expect to be prosecuted for not being in proper control of your vehicle, careless or dangerous driving etc. if you give the police any excuse to do so though.

    I find it interesting that Bluetooth headsets are permitted in the rules. I get that not being able to hear isn't considered a safety-critical disability, but surely having sounds play into your ear that are actively distracting you from the road is a form of carelessness and inattention?

      The line has to be drawn somewhere. There are plenty of things we could do to make the roads safer, the safest thing we could do is not use the roads. But it's about finding a balance of convenience and safety, as rules change the balance changes with it. For some people the roads are already too safe but for others they are not safe enough. I anecdotally believe the general population are becoming more safety conscious which is why rules become more prohibitive.
