Bryan Kohberger’s Defense Demands Evidence In Idaho Student Murders Case

  • Despite the state filing its intent to seek the death penalty if Bryan Kohberger is convicted of murdering four University of Idaho students, all the defense wanted to discuss in a motions hearing Tuesday was evidence. “We disagree on when I should get discovery,” Kohberger’s attorney said in court. “It’s necessary to investigate this case and prepare Kohberger’s defense." The state fired back, claiming the defense has everything they have. Kohberger, a former Ph.D student at Washington State University, was arrested for the brutal November 2022 slayings at his parents' home in Pennsylvania after investigators say he drove cross-country to visit his family for the holidays.

    Regardless of whether you believe BK is guilty or not , the defense should absolutely have access to the officers and investigators of the case . It absolutely affects their ability to thoroughly and ethically to do a good job in this investigation.
    This should be allowed across the board in every trial . In the event there is police corruption or mishandling of an investigation.

Yes they should have it but why is no one asking why this monster hasn’t even come close to providing any alibi or exonerating evidence???? Hello???       She wants their training records. She's looking for something to smear them. Her requests are outside the scope of what she is entitled to. She's been doing this from the start when she asked for discovery of phone numbers and home addresses of surviving victims (protected witnesses). The judge has the ability to grant her request only on a showing "of substantial need in the preparation of the defendant's case ... and that the defendant is unable without undue hardship to obtain the substantial equivalent by other means" And, even then "the court may vacate or modify the order on the request of any person affected by it if compliance would be unreasonable or oppressive."

      Please, stop calling him BK. Bryan, or Kohberger is just fine. These people love to have the ego boost of people casually referring to them as acronyms as if they have some sort of infamy or notoriety. He's a narcissist. That's more apparent in this court appearance, now that he's settled in a bit. That ego is starting to show in public now.

    If that’s not provided to the defense, then later on they may argue that he didn’t receive a fair trial, & see it as a reason for appeal. Justice only comes in doing things correctly, so that they won’t have any grounds for an appeal/mistrial. The female prosecutor who spoke, made an argument of speculation on the defense’s part. I found that to be extremely unprofessional, & a very weak argument. It seems she made excuses, & nothing more. This makes the state look bad, if they keep hiding things.

      They will certainly appeal on this, if they don't get what they want. But if they aren't legally entitled to the docs, it's worthless as a basis for appeal. You don't cave to an opponent because they're going to appeal, and you don't grant access to docs without a sound legal reason.

      Correct; which he is lawfully allowed...a fair trial. It is the state's job to prove guilty so therefore, they should be sharing any and every ounce of evidence they have obtained and how they did so. Otherwise, innocent individuals end up behind bars for decades, some even permanently. There is a justice system put in place for a reason and it is to make sure that the charged are fairly found guilty beyond ANY reasonable doubt of the actual and intended accused crime.

    Why wouldn't they put all evidence on the table for everyone to see? This will be a terrible thing if they get away with concealing evidence!       It’s a murder trial and now confirmed prosecution is going for the death penalty. They must have solid evidence and they are going to hold on to it as long as legally possible. Them refusing to show their hand does not mean they’re empty handed and have nowhere to go

    Judge says dont zoom in on him...cameraman proceeds to do exactly that. Good way to get booted, keep us from watching the trial, and hopefully get fired

    Guilty or not, his attorney is absolutely right! They should have the right to have background information on the officers that were able to make decisions that are detrimental to the case. Being vigilant and aware if they even qualify to have an opinion in different areas of evidence and interviews! She is right

      One of the police officers pointed out BK's vehicle, led the FBI to BK, the same police officer was on the search, at the crime scene collecting and handling evidence and also in contact with the main witness. Something is not right

    If I was on trial for death penalty , i would want defense atty to get all the information possible. IDK if hes guilty or not but i would want a defense attorney to do her job. Just like th we State needs to do.

    That’s literally the first step any defense attorney takes, they file something called a discovery demand request which is simply to get all of the evidence the state has in the case, which is client’s constitutional right.

Nothing of what the defense after is excessive or accurately described as the kitchen sink. They're simply zealously representing their client. Brian is probably guilty, but he deserves a thorough and competent defense like everyone else.

      Prosecution does not have police training records. That's the problem. You'd have to obtain them which is no easy feat, and you had three states officers involved; ID, WA and PA.

    Pure speculation? If you interviewed witnesses, collected evidence, and told other officers to look for a certain vehicle, weapon, person, etc you are part of the case. Why would you not be expected to testify? Why would defense not expect to look into your job credentials and their work history?

    I like that the judge called out the media for only filming the defendant since that was what happened with the Daybell trial. They just want to overanalyze every little thing the defendant does.

      That trial was so awful!!! No proof & let the DA do whatever they wanted & the DA even lied to the media about “evidence” they said they had when in trial they didn’t have it. It was all to sway potential jurors. They even brought in a jail house informant who had the most ridiculous story!
      Now that man is sitting in prison on a life sentence.
      Out of all the trials I’ve watched, they got it wrong & it needs a retrial. I feel so bad for him & his family.

Bryan gets to peep in on nude women, but we can't look at him while he picks his nose in court and keep glancing at his attorney, which makes no sense. smh.

      The pros have done nothing wrong. The defense said as much…twice. The only thing they don’t agree on is the officer training and that is why it is going to a judge. If the judge says provide it, the pros will. I don’t understand . They’re not withholding anything.

      Did you even listen? Nobody on either side did anything wrong here. The Defense has everything the Prosecution has right now.
      The Motion to Compel is for 1) the police training records of 3 individuals. 2) a report from the FBI about how they investigated, identified, and directed the local PD to a particular suspect vehicle.
      1) the Prosecution objected to the production of the police training records based upon relevance & it potentially being overly broad and unduly burdensome. Basically, the Defense’s request is for them to obtain and produce records the Prosecution hasn’t sought yet. The Prosecution hasn’t sought them because they want a boundary to be set by the court to be sure it doesn’t ”open the door” to the Defense asking for the records of hundreds of other officers.
      2) The report is with the FBI and hasn’t been finalized yet.

    At this point the defense makes 100% sense and they are extremely fair and professional. On one hand this is a death penalty case and the defendant has a right to a fair trial, on the other hand the victims deserve justice from a fair trial and to have the right person in jail and not roaming outside murdering while an innocent person sits in jail. the prosecution is starting to look really unprofessional

    Feels like the defense is onto something regarding one of the officers, and then the Brady on top of that just makes it more fishy. Fact that prosecution keeps refusing to send records for that one officer is quite suspicious. It's not something out of the norm to request records for police and she had a whole list of valid reasons for it but the prosecution is really adamant into avoiding that from happening, strangely.

      I’d hate to be wrongfully accused in this country today.
      Everyone has their pitchforks out because of what the DA & media says instead of waiting to go to trial to hear the real evidence.
      It wouldn’t be the first time the DA put wrong info (LIES) out to the media in hopes to sway the ppl who may serve on the jury. They will remember all they heard on tv & read online even if it’s not true. Smh

    I want to see who and when the evidence locker was accessed.
    I want to compare that (above) information, to a time line of the raid at Bryan's apartment.
    It seems as though the authorities purchased a knife sheath, and registered it as being discovered at Bryan's apartment. Then they found trace evidence on that sheath, after they gained access to the original crime scene boxes.
    Who gained access to the crime scene evidence after the apartment raid?
    Was there an authority figure assessing Bryan's apartment and later accessing the crime scene evidence?

    IMO, it is way too soon to be drawing conclusions. We are getting rid bits of information. Fragments. Let the trial proceed. Try to keep an open mind, even if you are leaning one way or the other.

    Few weeks, they gonna turn in evidence 25 days before trial so defense have no time, let the state review evidence from police for more then a year but give 25 days for defense, I don’t know if is guilty or not but I don’t like when police and prosecutors behave like these.

    Hope the cops haven't stitched him up. Any tiny bit of doubt (it seems there is quite a bit)...he must be free.
    Commenters here have already convicted him. They can't think outside the square. There are many players connected to the murders and the drug house.

      I took it rather that certain police officers held certain interviews with witnesses who will likely be called and collected information that they have not been privy to yet. She basically said that they were really awesome at supplying them information in the beginning but lately they have come to a communication barrier.

      This court appearance was actually supposed to be about questioning the Grand Jury as to the reason why he plead silent. His Defense team totally forgot to ask about the Grand Jury and their training records and decided to ask about the police training records. In all honesty, Thompson would have to get training records for WA, ID and PA police since all three worked on his case. This might be hard for him to do.

    I don't buy that BK did this, at the very least, on his own. He checked all the boxes and the police needed to make an arrest. The evidence is circumstantial at best.

    IMO, the defense came in strong with logical and reasonable requests, given that, the state has already presented the evidence in question to get warrants and a grand jury indictment. Also, IMO, the prosecutor came across as daft, claiming that they could not understand why the training records for those officers were relevant. The defense lawyer explained why the records were relevant twice, and her explanation made perfect sense to me.

      Completely agree. I'm not sure the prosecutor tactics of denying the defense the information they need. If the main objective of everybody is FAIR trial, then a guy who is on trial FOR HIS LIFE should be given all the info he needs to conduct his defense (PERIOD).

      Keyword it made sense to YOU, the court will decide. Regardless they have lawfully already given her what his is untitled to BY LAW. What she is asking for is not required by law . She wants information to focus on LE & FBI because she has NO OTHER ARGUMENT. When you client is guilty, your best options is to get them off on a technicality, if that don’t work then cause as much doubt as possible which is what she is trying to do with LE who puts their life con the line for ALL of us to sleep peacefully knowing BK is in jail. Anne just stated that the prosecution HAS NOT DONE ANYTHING WRONG but the have a disagreement over evidence that’s not by law required to give.

    Before i get jumped.. hes most likely guilty.. however, due process is your right as a human. You need evidence, a trial, found guilty by a jury of your peers. These processes are in place to protect your human rights. Dont get so upset just let everyone do thier job.
