    I don't understand the registry in America, the courts say it's not a punishment but I can't see it as anything other than a punishment. The restrictions make no sense at all, creating a whole homeless community is supposed to make the public safer ? How ? The registry to me is just a tool these aweful cops use to send people back to prison, noone should be going to prison unless the committed another crime but with the registry even after your probation is over you still have to worry about going back to prison for absolutely nothing. It really sickness me and feel bad for anyone on the registry. If you did your time for your crime then you should be able to get back on your feet. I have no respect for the American justice system and absolutely no respect for the law enforcements.

    Michigan SORA had gotten ridiculous. It was one of the 14 states that attempted to comply with SORNA, but they applied the new restrictions retrospectively, violating ex post facto prohibition. I'm happy to report that the Michigan ACLU has successfully litigated the issue and won a judiciary injunction. The new restrictions, amended in 2006 & 2011, were held to rise to the level of punishment. As such, applying them retroactively violates ex post facto, rendering them unconstitutional. Furthermore, these portions of MI SORA were found to be unseverable from the rest of the statute. The litigation was a class action encompassing all registrants.

    It's awesome to see you enjoying travel and getting out away from your busy job. I need to ask a few questions/ favors that would help a lot of followers.
    First is, you speak of europe and their ways of disregarding "spent convictions" but what if your crime was also illegal in europe also? At what point in the stay is a background check done that could pose a problem?
    Second? You speak of Germany but what about other counties in europe since the path to residency, background checks and citizenship vary. If a person comes to Germany (or another country) and has let's say 5 years left on their passport, how do they stay for 10 years to gain citizenship if a warrant is issued for some silly reason from the US. Many of us are wanting to hear how your August hearing went I haven't been able to see any updates on that. My main point here is that almost every country in the world requires some form of police check or fbi report. How do we get passed that if what's on that report is serious and illegal in that said country? Please talk about other countries. I have exhausted all my resources but am getting no where. Thank you for all your support and hard work in helping others.

      @CommonSenseLaws  4 ปีที่แล้ว

      Hello again, Drig!
      As promised, I did some research.
      You are correct that Poland has a public registry. I have read an English translation of the law. Based on my reading, there are aspects which clearly violate the ECHR. However, I can only assume that no one has challenged the law in court yet.
      France, Austria, Protugal, Spain and Latvia have a watered down version of the registry, but those registries are not available to the public.
      Interesting note: Spain proposed a EU wide SOR which was roundly rejected by other governments.
      Germany, Norway, Sweden, Iceland, Belgium, Switzerland, Italy, the Czech Republic, Lithuania and Estonia have opted for rehabilitation rather than life-long punishment and/or public shame. These countries have rejected calls for sex offender registries.

      No such thing as a washed down registry. The USA has made the registry a inhumane punishment. I don't mind a private registry without restrictions I mean to be honest if you have a felony registry or not cops will see ur crime either way. This country is so fucking stupid. They make you take treatment because you slept with someone who was maybe 2 years younger and still keep you on the registry after completion but if you some 60 year old sleeping with a 18 year old then it's completely fine and don't need to have treatment or therapy? Wtf kind of law is this.

      Good morning, Giivbv,
      For example, in my home state of Florida, a registered SO cannot leave his/her home for more than 48 hours without notifying the sheriff's office of his/her own county as well as the sheriff's office of the county in which they will be staying or sleeping.
      In other words, they are required to report their movements within America. This violates Article 12(1) of the ICCPR. Additionally, if they travel to another country (such as Germany where I now live), they are required to provide the American government with a list of all the places they will visit and sleep.
