    I have an '88 Corvette so I know about low ground clearance issues and I can tell you those marks are from the road and not the truck. Here's likely what happened... Plaintiff, happy with his newly restored Delorean, signs off and then takes it for a drive after finally getting it at long last. Who wouldn't? Not used to the clearance yet, he bottoms out once or twice going down the road over an uneven section of pavement. Then he sees the damage and next day decides the truck guy's insurance should pay for the fix... which is not $4k by the way. I'm willing to bet money that's how it went down.

      The insurance never offered $2400, that’s what the claims adjuster assessed the damage at. The insurance company compromised and offered $700 and then $1000. Try and listen next time.

      The weird part is, signing a waiver and noticing damages after does happen, the driver’s insurance even offered him $2400 and instead of taking it because he should have known he had a weaker case for signing a document and giving a tip, he decided to say no and come here…. Hmmmm he may be smart, but clearly not stream smart.

    The thing is no one really knows when it got damaged because he signed that document. I think the plaintiff saw the damage AFTER he got it home, so he assumed it was the truck, but there's a chance it can be something else. The defendant can freely think the same because the guy is telling him after he already left.

      He didn’t purchase the DeLorean, as he explained, it was gifted to him, partially, by his father. His mother co-owns the car, as well. He possibly used $20K of inheritance money for the restoration. But he signed a waiver and that is a binding contract.

    The defendant filed a counter just because he was sued 😆. The plaintiff is pulling strings. He has no idea what happened. If the undercarriage is fiberglass like he says then just driving would scratch it. There are so many rocks and things on the roads. He just does not have the money to fix it.

    That plaintiff was such a liar, I wonder how much of his story was even true? It definitely couldn't have been "Mint Condition" with that huge list of previously existing damage on the waiver. I have doubts as to his whole story about earning the car from his dad with good grades.
    And come on! It's INCREDIBLY obvious that he just didn't notice it happen or was too scared to bring it up until waiting a day.

    What I truly believe is that after the truck driver left and the plaintiff was checking out his car all excited about everything, is when he noticed the damage. I don't doubt the plaintiff was watching the truck driver take his car off the truck and probably came to the conclusion the damage happened when it was being driven off of the truck.

    Unfortunately I get where the plaintiff is coming, I’ve actually had multiple customers sign the delivery receipt for a shipment confirming no damages, EVEN THOUGH there were damages. They sign it and then they’d email me stating it was damaged and what to do and I would have to reach out to the carrier and they’re like, “ummm they signed this document stating no damages.” I don’t know exactly why…. But people ABSOLUTELY sign that form even though there are damages upon delivery.

      I actually got invited to be on The People’s Court for a similar situation. The guys who delivered my washer damaged a wall in my condo during the delivery. My boyfriend signed the waiver saying everything was okay with the washer. Then the appliance company refused to pay for the wall, claiming that they had a waiver. Unfortunately for them, the waiver was for the appliance, but the delivery drivers damaged a wall. We filed a lawsuit against the appliance company. That’s when The People’s Court reached out to us. We turned them down and settled out of court with the appliance company. But I always wonder what would’ve happened if we went on the show.

That would have been interesting on People’s Court, I wonder if she would have caught that and told him to pay or sided in his favor, hm. My dad was also asked to be on People’s court do to a rental issue and he declined it too haha.

      I once had a xbox repaired under warranty and sent back to me and it was suppose to be sign stating no damage and the security tape was still sealed. The driver drop it off in such a hurry knocked a planter of the porch and took off. Package was damaged and resealed. I called fed-ex and they stated it didn't need to be signed for. plug it in and it started to smoke so i called microsoft up and told them what happen and they said yes it was supposed to sign for and they will take care of it. They paid for me to send it back next day and i received another one a week later.

    Three things…
    1. The Plaintiff signed a waiver of no damage and obviously wasn’t too upset to not take pics of the Defendant in the DeLorean and have him a tip.
    2. The Plaintiff was offered $2500 to settle from an insurance company…which is incredible.
    3. The Plaintiff was an idiot for not taking the offer from the insurance company and walking away.

    I actually got invited to be on The People’s Court for a similar situation. The guys who delivered my washer damaged a wall in my condo during the delivery. My boyfriend signed the waiver saying everything was okay with the washer. Then the appliance company refused to pay for the wall, claiming that they had a waiver. Unfortunately for them, the waiver was for the appliance, but the delivery drivers damaged a wall. We filed a lawsuit against the appliance company. That’s when The People’s Court reached out to us. We turned them down and settled out of court with the appliance company. But I always wonder what would’ve happened if we went on the show.

      Clearly you didn't bother to listen to the judge. She clearly stated that he was just suing because he was sued. She knew what was going on. She gave him the money because the plaintiff was lying and trying to scam her court. Try to pay better attention before making assumptions. Why do you think he said WOW when she gave him the judgement? He honestly thought she would throw his counter claim out. He was surprised she didn't.

    This exact same thing happened to me at a body shop. Shop painted my car and after Inspection outside, noticed imperfections. Told shop and they supposedly would repaint. After week went back and they would not take car out of booth for inspection. Noticed same imperfections and asked to take outside to see in sun and they refused. They state to sign approval right there otherwise they will sell car in auction to force me to sign waiver.
    Sued and only won partial. Sometimes you just can't trust people.

    The transporter damaged the DeLorean when he PICKED IT UP in NY, BEFORE he drove it to FL. That's why it took him 45 minutes to take it OFF the transporter. truck. The plaintiff did NOT examine the undercarriage when the car was delivered. The transporter noted the other existing exterior scratches upon inspection BEFORE he hooked the car up onto the truck. He DID NOT SEE the damage occurring to the undercarriage as he pulled the car up because he was INSIDE the truck. He may have heard the scraping as it happened but he did NOT note undercarriage damage as it was NOT preexisting. He caused it, while pulling the car up onto the truck, and he would be foolish to indict himself if it was likely the plaintiff would NOT examine underneath when he received the car. If the transporter picked the car up with no problem, it would NOT have taken him 45 minutes to deliver the car without it scraping the undercarriage a second time.
    ***The transporter needed special LONGER RAMPS to keep such a low car from bottoming out when it was towed onto or off the truck. Few cars require such ramps and that's why he didn't have them handy when he picked up the car.***

      @@twilliams842 It's called COMMON SENSE and a knowledge of geometry, transporting vehicles, and human behavior. LONGER RAMPS are needed for safe loading and unloading low-slung sports-cars. Nose up to load or unload? Back end hits and drags on the ground unless the angle is decreased by using an extended ramp to keep the back end off the ground. Simple solution but often ignored.

    I’m pretty sure those scratches were probably already there from when his dad owned it 6 inches off the ground is very low it’s practically a low rider and any bump or entry way to a parking lot would easily rub on the bottom of the car. Plus if he thought the transporter scratched it on delivery he shouldn’t have signed the damage release form saying it was all good. This guys trying to get his car fixed after the fact if it was damaged he shouldn’t have singed the form. I don’t think the transporter did anything he even written down what he saw before he delivered it so that even points to all this being there when his dad owned it.

    Hopefully the plaintiff at least learned a lesson from this about waivers. No matter how much you “respectfully disagree” it’s still signed and agreed to.
    Don’t sign the waiver or at least write on it at the time what the damage is prior to signing.
    Once that waiver is signed with no note of damages the person who delivered is off the hook.

    Even 6 inches is very low, going over a slight hump in the road will do a lot of damage, having to put down extra tracks to get the car off the transporter sounds dodgy enough, what about when the car was put ON the transporter, did they use wider tracks? Goes to prove that people sign documents without reading them, mind you the Insurance Companies make them long-winded and several pages long with extra small print to put you off.
