      I agree, it's not the best recording, however you can rest assured that you don't miss anything important just from reading the slides

    Very informative and helpful however there are a few errors. It was the third driving lesson in Nettleship not the first and in Bolam, the doctor also didn’t give relaxant drugs along with restraining the patient. The facts I believe are relevant and should be clear.

      Thanks for the comment. For a level study the focus is the rule of from of the case, in fact students should be discouraged from quoting the facts as they're not important for the exam but are simply required to have a grasp of the case in context. So long as they have that then all is well.

      Sarah Harwood I understand hence agreed with the relevancy of the content however I only wrote that to ensure others understanding the facts of the case better. Some books have facts starting in a different way hence people may confuse it.

    thank you very much! very useful. Just one note guys. The standard is hypothetical, it is not that of the "average man" (which could well be a low standard sometimes). The standard is that of the "reasonable man" also in a society where no one is reasonable.

      Absolutely agree, the reasonable person is a very troubling concept because they never make mistakes , they never misjudge or misread a situation and they somehow remain entirely levelheaded in even the most stressful situation. I think the man on the Clapham Omnibus is actually pretty infallible , in a way that none of us real people are! I'd certainly never claim to be a real life reasonable person. I agree it can be too high a standard at times, but is it designed to be aspirational?
