      Hello, this is not true. Apostilles are only needed in cases where one country needs to verify the authenticity of a document that originated in a foreign country (specifically when both countries are part of the Hague Convention). For instance, a birth certificate issued in the United States needs to be apostilled in order for it to be authenticated for use in the Philippines. In the case of the Legal Capacity to Marry Affadavit and the CENOMAR, both of these documents are originated and obtained in the Philippines; therefore, they do not need to be apostilled for use in the Philippines.

      Hello! I understand that local notary services were permitted during the COVID-19 pandemic under PSA Memorandum Circulars 2021-04, 2021-07, and 2022-12. However, Memorandum Circular 2023-16 discontinued the acceptance of locally notarized capacity-to-marry affidavits effective October 31, 2023.

      The spouse from the USA will want to have their birth certificate or any divorce decrees apostilled by their Secretary of State to ensure that they can be authenticated in the Philippines.

      Hello, there are several things to consider when choosing between the fiance visa or spousal visa processes. In terms of being together sooner, the fiance visa is typically the quicker option; however, the exact timeframes for each type of visa can vary greatly.

      Hello, I am really not qualified to answer this and would highly suggest that you reach out to a professional to answer this for you. However, based on my knowledge if he is an American citizen, without dual citizenship, I believe he would follow the same process as described in the video. However, since he was born in the Philippines, and would have a Filipino birth certificate, he would not need to have his birth certificate apostilled.

    Hello Philips in the Philippines. Why a foreigner need to apply a CENOMAR? The Cenomar is a Philippines document for Filipino. REPUBLIC ACT NO. 386 AN ACT TO ORDAIN AND INSTITUTE THE CIVIL CODE OF THE PHILIPPINES PRELIMINARY TITLE CHAPTER 1 Effect and Application of Laws Article 15 civil law: Laws relating to family rights and duties, or to the status, condition and legal capacity of persons are binding upon citizens of the Philippines, even though living abroad. (9a) So why we non Filipino need a Cenomar if we already provide a Legal capacity of marriage? And for the divorced man: a court decision with Apostille and if needed an English translation. IF a foreigner get divorced from a Filipina, and the Filipina don't want to inform the Philippine Marriage registration office? The Foreigner man can never remarry because his CENOMAR says: You married. But the man divorced legally years ago. A lot problem, because the Ex Filipina wife was to lazy to inform het country that the marriage was over. CENOMAR IS NOT LEGAL FOR FOREIGNERS! We can't defend or do anything against scammers if your ex Filipina don't want you to remarry? she doesn't registratie her Divorce!

      Hello! I would HIGHLY suggest contacting your local civil registrar ahead of time to schedule the counseling appointment. We made the mistake of not doing this, and found out that our civil registrar only held counseling one day a week! Thankfully we were lucky and timed it right, but if we were off by a day or two whole process would have gotten delayed by a week.

      Hello! You would follow the same process for a church wedding. The only difference is... after your have completed the marriage application process with your Civil Registrar, you would then reach out to church officials at the church you would like to hold the wedding at so that you can begin scheduling the date. Also, depending on the church, they may require additional faith based marriage counseling prior to the wedding. Taking these extra steps into consideration, I would say that a civil wedding is a slightly easier process, especially if there are constraints for how much time your fiancé has in the Philippines.

    Actually one more question regarding the tax certificate... does the resident of the US need to provide that on his behalf or is it just for his fiancé who lives in the philippines? And getting the documents Apostilled, you said their were 3, the birth certificate, the single status letter, and the passport? Just want to make sure i understood you correct.

      That is only for the Filipina fiance, and this may or may not be asked for depending on which municipality you are getting married in. As for the apostille, you only need to get your birth certificate apostilled unless you have been married previously.. then you would want to have your divorce decree apostilled as well. The affidavit in lieu of certificate of capacity to marry and your passport do not need to be apostilled.

      Hi I have a question. The template page is working again and I went ahead and printed it. The template they have has the blank areas already filled out with what they expect you to write in them such as “name” and “DOB” and “CITY/STATE/COUNTRY” etc. I just downloaded the template and used the “mark up” app on my iPad to carefully white out/erase those prefilled answers and then printed it out. Do you think there would be any problem using their printed template this way to get my affidavit at the embassy? Or do they expect you to type up your own or to write out your own? I don’t know how particular they are with this type of thing. I’d call the embassy and ask but I don’t know how to since I’m still in the states. Thanks in advance!

      Hello! Good to know that the template is working again. I just checked and the template is a fillable PDF, meaning you should be able to click on each field and enter your own information within the PDF viewer before printing it out. I just checked to see and it works with Adobe Acrobat. If this isn't working for you, you might try to use a different PDF viewer. Alternatively, I can send you a copy with the text removed if you shoot me an email. In general, I wouldn't be too worried about this as they aren't very strict about it. I had an outdated version of template when I went there and they just provided me a new one at the Embassy.

    I was over to the Philippines, February 2024 right after you and I’m happy you shared this information but it takes a long time says for a Filipino blogger with lawyer and such but yet it’s cheaper for lawyer over there. I’m pretty sure my paperwork together for I don’t know how to do that. I tried it once I messed it up friend of mine said better not do it again that way too many times he’s married to Philippine woman about 10 years ago. I live in the United States, my friend, my friend Relative reached out to me ago so I came to Philippines a year later now I’m hoping to get better finance going then getting married to spring 2025

      As far as I know, it is required to visit the embassy in person as the affidavit must be signed in front of the Embassy official (who serves as a witness).

      There is a phone number listed on the Secretary of State website under the section titled "Washington State Center for Vital Statistics". This section specifically mentions apostilles for birth certificates, so hopefully this can get you in contact with the right department: www.sos.wa.gov/corporations-charities/apostilles-program/apostille-document-guidelines

      Yes they are pretty strict about this. Is he from the US? If so, he will need to obtain it from the US Embassy in Manila or the US Consular office in Cebu City.

    For the Affidavit do you have to show your divorce decree and does it need to be apostilled? If so since mine was stapled and sealed by the Secretary of State do I need 2? Thanks again for the information.

      I cannot speak from experience, but from what I have researched the short answer is yes, you will want to bring your divorce decree and make sure that is apostilled (otherwise they may not be able to verify it's authenticity oversees). You only need to get the the official copy apostilled and then you can bring a photocopy or two with you in case you need to submit a photocopy when you apply for the marriage license.

      Hello, I believe that he will have to have his divorce papers (decrees) apostilled at his local Secretary of State office along with his birth certificate. He will need to bring the divorce paperwork to the US Embassy when he goes to get the Affidavit in Lieu of Certificate of Legal Capacity to Marry as they will need to document that he has been previously married.

    Hi! Watch the videos and congratulations to both of you. Have some questions though. My fiance is from Ohio and we've been dating for almost 3 years now. Planning to get married here in the Philippines as it is much less complicated and cheap compared to getting married in the US. He said as per US immigration policy (he searched thru their website) that there should be a 30-day contact. He did come here just last week for 6 days (1st time). Now, I'm currently processing my documents for me to be able to fly to Ohio and spent at least a month there just to comply to that "30-day contact". Is the "30-day contact" really a requirement in US? Any advice you can give us will be very appreciated. Thank you and wish you both all the best!

      Hello, I believe they would be dealt with during the marriage application process with your local Civil Registrar.

    Hi, I'm a little confused about having two copies of everything. Do I need to pay to have two original/certified birth cerificates and then pay to have both of those apostilled? Do I also pay to have two copies of my passport ID page notarized? Or, do I just get one certified and apostilled birth certificate and one copy of my passport notarized and then just make photocopies of those after the fact? Sorry and thank you, this is all a bit confusing for me haha.

      Hello! When I say bring 2 or 3 copies of each document with you, I just mean regular photocopies. They will want to see the originals, and may ask to hang on to a copy of two when you apply for the marriage license. So you will just need one certified & apostilled birth certificate, and a few photocopies of the birth certificate and the apostille page. Same with the passport ID page, just some regular photocopies will do. You don't need to have to it notorized.

Be sure to screenshot or print your appointment confirmation sheet immediately as your fiance will need it to enter the embassy.     Does stamp from the original copy of the American birth certificate acceptable for legal purpose? Or still needs to get it apostilled? We're so confused. Bc most of the resources they don't ask, I mean it's not indicated.. we really need your help we are so confused rn. Bc my American boyfriend is having a hard time getting an appointment with their governor's office in Hawaii.

      From my research and experience getting married there, the birth certificate needs to be apostilled to prove to the Civil Registrar's office that the certificate is authentic. I cannot tell you for certain that every Civil Registrar office will be strict about this, but you would not want to run into issues if they do not accept the birth certificate... perhaps you could contact the specific office that you plan to apply for the marriage license at and ask them if they will accept the birth certificate without the apostille?

I'm sorry we really have a lot of questions in mind. 😅 But it's just you who mentioned about apostille documents among other videos about getting married in the Philippines here on TH-cam. Your video is really detailed and so clear. This is really really a big help for us Filipino - American couple who wants to be as one. ❤️

He will simply need to bring his passport and appointment confirmation sheet to the embassy (also divorce documents if applicable) to receive the affidavit for capacity to marry.
