the trust principles are pretty straightforward, the part no one talks about are the parties. how do you thread the needle so your trust isn't classified as a scam trust? do you use the strawman, the living man, the trust itself as the parties or do you bring in a third party trusted individual? but with the individual estate which is what most people are trying to secure you wouldn't want to give anyone POA in your estate for many reasons, so you would have to play all parties somehow without arousing suspicion from the public. that's the discussion i haven't seen in the "patriot" circle.

A casual review of the subject (online, e.g.) will reveal claims that these trusts are a fraud, but not only does Case Law support the use of this "device," but A) MUCH of this VERY negative point of view (POV) originates with the IRS, by no means an objective, reliable source of information on a subject like this, and B) attorneys tend to frown on the idea, either on the basis of ignorance, or as the corporation form will yield them MUCH more in the way of legal fees...and on your dependency on them...over many years. Moreover, lawyers tend to support the "status quo" and are, as a matter of fact, "officers of the court," and may not be very inclined to "rock the boat."

The Express Trust is a trust ... wherein the trustee is empowered by the settlor to do ... whatever the settlor may do for himself as an individual sui juris. If you look in the 2006 version of Weiss' document, it says: "The Express Trust is a private contract for the holding of a divisible property interest accepted by one at the offer of another, having full power to do whatever he may naturally do for himself as an individual sui juris, for the benefit of a third party of his choosing." The Express Trust is a private contract … accepted by [the trustee] at the offer of [the settlor], [the trustee] having full power to do whatever [the settlor] may naturally do for himself(the settlor) …, for the benefit of [the beneficiary] of his (the trustee's) choosing. So the trustee chooses the beneficiary?
