Dwayne I would like for you tell me what my chances are of getting approved for pact act. I am currently in the process of filing for it. I wasn't in a combat zone but I was guarding f4 aircraft in Germany fully loaded with agent orange cannister that would leak. The aircraft were also loaded with napalm along with missles and bombs along with fuel drop tank. The aircraft were ready to deploy in the air in 10 minutes. Do I have a chance for approval in pact act. I would really like your input on this. Thanks B. Barnett.

I opted for the CSB/Redux but I gambled with the 10% less retirement at 20 years but ended up doing 30 years and still got 75% of my basic pay (High 3). Anybody who opted for it should've been briefed about the 1% decrease in COLA until you make 65 and it breaks even (catch up), so it shouldn't be a shock. After doing the calculation, the 1% less is about $50 after taxes. I'm good with that because I invested the original CSB/Redux money and the returns are more than that.

It’s a shame how difficult it is to add parents even if you’re taking care of them and it’s easier to add step children that cost less than taking care of a parent. Great information as always!!

I did have to go back and get the wording adjusted on the DBQ, but my claim for migraines DID get approved and i never went to a C&P exam. just got a fully developed claim from Dr Freeman who you recommended. thank you

I'm not saying it will ever happen or that Trump supports P2025. Nevertheless, the Project 2025 recommendation published on their website is to go back to pre-1999 and end concurrent payment. So a Retiree would not be able to get both retirement and VA compensation. My opinion is that this would be unlikely to gain support. A couple of their other VA related suggestions are mostly about access to care & cost savings through non-VA community care.

@ The supreme court ruled in favor of the veteran stating that the VA was failing at evaluating and rating cases fairly. They ruled that the “Benefit of the doubt rule” 38 USC 5107 must be followed! That is a HUGE win because think of all the other cases that weren’t given the benefit of the doubt when they had evidence of an in service injury. I wonder how they’re going to fix this for other vets. A mass audit or review would probably be needed. www.supremecourt.gov/DocketPDF/23/23-713/294539/20231229124320086_Bufkin%20Cert%20Petition.pdf
I did not elect to take the Redux retirement option as it was very clear you would not come out equally to staying with the old plan. This CSB option was presented and selected on a 4187 for those like me who fell into that REDUX generation. Yet people saw that 30k incentive to take it and did no matter how many times you showed them the numbers. If they took the 30k they can’t complain about the less COLA rate that those who didn’t take it get the full amount of.
There is spousal A & A but it's not much. You can now get your signed copy of my new book "VA CLAIMS SUCCESS - Your Guide To Maximizing Your VA Compensation Benefits": store.kmd89.com/
@Dewayne my claim made it to Step 7: Final Review from Step 3: Evidence Gathering in less than 2 weeks. But then it suddenly got sent back to Step 4: Evidence Review saying they needed more evidence review. Would you say that would typically be in favor of the veteran or not in favor? Kind of bummed because it felt so close to done, but hoping it means final reviewer found a mistake and sent it back for my benefit.
Not really, every claim is different and there is different development needed based on the veterans and what they are claiming. What if I don't have a diagnosis for ptsd, but I'm being treated for the symptoms, and the symptoms are all there and present? How strong is my case with that evidence along with buddy statements? My C&P exam went well. She said she was sorry I went through what I went through and stated she would get the evidence over right away because I've lost my job because I'm reliving the trauma because of therapy. Do I have a strong case ?
So, you are being treated with symptoms and the mental health examiner has never provided a DX. Ask her for a DX and show her evidence that shows what happened to you. That makes your case strong. @Krisputmyselffirst DO NOT file a new claim they will revaluate your whole benefits and beware then can lower it. I was 100% p&t i filled for the Pact act. They re tested me for that, ptsd. Tbi, hearing loss ect. I believe you don't get anything over 100% pay.
Good question. RVSR have nothing to do with CRSC pay. Do you want to be educated on the VA claims process, connect with us at www.kmd89.com "Don't Be Frustrated, Get Educated"
CRSC is calculated based on your Combat Percentage. So (for almost everyone) if your combat percentage is 50%, you get CRSC pays at the VA 50% rate, plus pay for dependents. That 50% VA pay is going up by a 2.5% COLA. Perhaps an increase of $25-$35 for a 50% rating; and about $100 for a 100% Combat Percentage.
@@adamrocket8656 I'm rated at 80% for CRSC but they said that maxes me out based on my time in service etc...didn't fully understand it because I technically qualified for more but they won't give it to me.
Do you have a video explaining why I would get a partial payment for backpay? I am a retiree just got moved to 100% from 80 and received a partial payment of $1700 for more than six months of backpay and I’m a little concerned.

I’ve been struggling since my first tour in 2004. I came back and everything was different. I finally got rated 100% p&t but only applied for unemployable. It’s great that I finally got it, but honestly it is too late. All I think about is not being in this world anymore. The VA has never actually helped me at all. I hope they get shut down.
Brother Dewayne, just wondering I’m already rated 100% p&t is it worth applying for the pact act? Pros and cons please, I don’t want to risk my rating also I do have in my paperwork while on deployment I was near burn pits everyday. Again the important thing here is is not to jeopardize my rating but I don’t want to lose out on money if it done risk what I already have whatsoever. Thank you for all you do.
Thanks for the support and congrats on the win. There are several pros and cons. Theres no reason to wait. It's best to apply as close to the date of EAS as possible to make linking disabilities easier. The more time that passes after leaving the military, the less likely that claim is to be approved.
We need an increase all around. 100 % disabled veterans should get paid minimum of average household income in America. 2% increase every year is too low.

Ive applied three times as a p& t veteran to my spouse who is us housebound 100 they denied it. He has 33 illinesses! Four cancers!
Spouses can't be P & T for VA compensation, you can try for spousal A & A, if they qualify.
What if you are a disabled vet, and your spouse passed away this year will you still get this increase
This is a cost of living adjustment. A spouse dying has nothing to do with that

Can you make a video on the BUFKIN V. MCDONOUGH ruling please
What is it about. Would other vets benefit from it.

Good question. RVSR have nothing to do with CRSC pay. Do you want to be educated on the VA claims process, connect with us at www.kmd89.com "Don't Be Frustrated, Get Educated"
Yes it also goes up
CRSC is calculated based on your Combat Percentage.

10% = $300
20 = $600
30 = $900
40 = $1,500
50 = $2,000
60 = $2,400
70 = $3,100
80 = $3,800
