I live in Massachusetts and injured my back at work my surgeon has recommended spinal fusion but my WC lawyer has told me the only thing I am only entitled to get is lost wages and initial medical care covered after that the case will be closed and I am not allowed any future medical care or any type of settlement for pain and suffering or disability and if unable to work to apply for social security disability.
Thank you for reaching out. Are you dealing with a Massachusetts workers' compensation case or is your workers' compensation case being handled in a different state? It is important to know because every state has different workers' compensation laws.
Do I have to settle I went from working supporting my family myself now I'm being told my back is not curable and want to settle for not even a years work . Do I have to settle??
Thanks for your question. I am sorry to hear about your injury. In a Georgia workers’ compensation case, you never have to settle your case. Settlement is always voluntary and you have the option to choose not to settle your case.
If a client decides not to settle a back injury case, how does her WC lawyer get paid? "We don't get paid, unless you win." I have lower back and both hips in pain. Going for a 3 Phase Bone Scan, which will give us more answers. I can't afford out of pocket expenses for something, the doctors are confused about. Saying major back and hip surgery, and some saying noninvasive/minimal procedures or treatments. I am not here for the money, I want to be repaired and continue my life before this injury as usual. So again, if I am not settling, how does my lawyer get paid?
Thank you for your comment and question. I am sorry to hear about your injury. I definitely hope you are able to get treatment and get better. In many cases, workers' compensation lawyers are hired on a contingency fee contract. In a Georgia workers' compensation case, the contingency fee generally applies to a settlement or weekly workers' compensation checks. But, the lawyer should only get paid out of weekly workers' compensation checks if the lawyer did some work that resulted in you getting those checks and a judge says it took the lawyer's work to get you those checks. So, it is possible that a lawyer would not end up getting paid on your case if there was no settlement. I hope this information is helpful. Thank you for your question. When it comes to settlement, there are a lot of different factors that need to be considered. They include the type of fracture, the percentage of compression, the medical treatment and testing you need, the limitations on your ability to work, your average weekly wage, etc. When I am representing someone in a workers’ compensation case, I use all that information to complete a detailed settlement evaluation and then discuss the evaluation in detail. I am happy to discuss this further if you would like to do so. To set up a time to do that, please call my office at 770-214-8885 or email me at jason@perkins-studdard.com.
So I’m in Florida and I suffered a back injury and the MRI showed that it’s bulging disc, do you have any advice, I’m on light duty but I’m still doing full duty at my job, I feel like it’s my fault for even doing it still. But I want to do it the right way and let them take me out of work.
If you are dealing with a Florida injury, I would recommend that you talk to a Florida workers' compensation attorney. If you would like to contact my office at (770) 214-8885, I can recommend one.
Thank you for your question. I cannot really say an average settlement amount for the a workers' compensation injury that required two lumbar fusions. In a Georgia workers' compensation case, the type of injury and treatment required is one of the main factors that go into settlement. But, there are other factors that have a large influence on the amount of settlement including, but not limited to, whether you are able to return to work after your injury, how much you were earning at the time of your injury, and what future medical treatment you will need. Speaking with a workers compensation attorney after the attorney reviews all of the specific factors in your case is one of the best ways to determine what amount you should accept in settlement.
Thanks for your question. The videos in this series are about workers' compensation laws in the State of Georgia. If you injury is being handled in another state or in Canada, different rules would apply.
In Georgia, you can fight to get the treatment that you need even if the insurance company is denying it. Also, if you were terminated from your job because of your injury, you may be entitled to workers’ compensation benefits for the time you are out of work.
I am so sorry to hear about your injuries. Those sound like serious injuries. The amount that your case would settle for would depend upon a number of different factors. It is normally best to make sure you know how your injuries are going to affect you long term before exploring settlement. If you have not already, I would recommend reaching out to a workers' compensation attorney. You can set up a free consultation about your case by calling our office at 770-214-8885.

It sounds like they gave you a 6% whole body impairment rating using DRE Category II in the AMA Guides to the Evaluation of Permanent Impairment. This is generally the rating that doctor's assign if you have a bulging or herniated disc in your back or neck but do not have surgery. If you have other questions, please feel free to visit our website at www.PerkinsLawTalk.com or call our office at (770) 214-8885.
