      In a Georgia workers' compensation claim, you can find out if the insurance company is going to pay for surgery beforehand. One way to do this is to contact the doctor's office to find out if the workers' compensation insurance company has authorized the surgery.

    Waiting on total knee replacement was told W.C. don't wanna do total knee replacement till I'm 55 they don't want to do replacement twice! Now I have back problems from limping plus when I hurt my knee 2018 at work hit right buttocks on concrete with 2 people landing on chest right leg stays constantly numb. I'm a High school Security had facet and epidural in lower back after facet injections testicles hurt. Had injections with n testicles didn't help now I need surgery to. Testicles fluids in build up in nerves.😢 Been of work since Oct 2021 nerve conduction study says radiculopathy in hands and feet , on depression meds now high blood pressure meds diabetes meds chlorestal meds depression meds 😢!!! I'm 51 now just got approved for SSDI , I keep asking if they could modify my duties they denied me had me doing extra walking while waiting on total knee approval did extra walking for month then Body shut down had to go to emergency twice myofascial pain in back n neck trigger points injections don't work.muscle lumps in back neck.Tire man tired 😩

      I am sorry to hear that you did not find the video helpful. But, I do appreciate your question and will attempt to answer it. A workers' compensation herniated disk injury does not have a certain value or worth associated with it. There are a number of factors that affect the value of a case such as the temporary total disability rate, whether someone has had surgery or whether it has been recommended, how a person recovered from the injury and what sort of ongoing or permanent limitations they have, what their permanent partial disability rating is, their age, their education, their prior work experience, and whether they are able to return to work or not. Each one of those factors and a number of others affects the settlement value of a case if an individual decides to settle.

    They stopped my wage and medical benefits, i wasn't given a disability rating Bc my attorney wasn't working with my WC doctor, so i had to hire another attorney, i didn't know i needed to ask for disability rating until i just heard you say it.       Insurance companies often try to argue that degenerative disc disease is a preexisting condition and was not caused by the work-related injury.     I had 2 surgeries and they said they have survalence in me. They are going to question me without me seeing the video first Don’t know it it’s groceries or took out garbage maybe dog for a walk. I had a work comp meniscus tear and after the surgery they see it’s not getting better and now they are saying I may need a knee replacement due to arthritis .     I been on workers compensation going into my thirteen year. I've been through hearing judge, appellate and Superior court fir catastrophic. I also was granted catastrophic by all three.     Hello , I’m 64 and still working, I got hurt at work in 2022 . I had two surgeries one to my elbow and rotator cuff surgery on my shoulder. I’ll be out of work for roughly 2 years. Then is the only witness 1 of 5 not to show his face during a Zoom testimony with the “I don’t feel so good” but I’ll just call in.     Thank you. I am in SC but i had 2 workers compensation cases on the head by 2 different employers one in 2022, and the other in 2023. Because the latter accident was the intervening accident i wasnt able to get much settlement from the first one.

    I broke my foot while at work in Iowa. I have a workcomp lawyer on it. I have been restricted from working for the last 20 days and have not received any monies. Shouldn’t I be receiving some sort of lost wages

    i returned to work for 2 days for a modified job. then they terminated the modified job because it didn't meet standards. so my employer tells me he has no modified work for me, but he says im still employed with them. what does this mean? is he waiting for my claim to close so that i can come back? what if i take another job? like remote work from home? can he later say when it was time for me to come back i couldnt? and therefore i owe WC insurance monies they paid out? or should he be terminating me because he cannot provide modified work?

I am assuming that the insurance company started paying you weekly workers' compensation temporary total disability benefits again when your employer stopped providing modified duty work. Many employers do keep you employed even when you are not actively working. if you earned money elsewhere (whether through remote work or something else), then your weekly workers' compensation benefits would likely be stopped or reduced.

But what typically happens when an employer can't offer modified work....do they keep the employee hired on or should they be letting them go?

      Thank you for your question. Many people have concerns about how their work injury will affect their ability to return to work. It might certainly come up when you apply for work in the future. Many employers do ask about past health condition and limitations, although there are laws that govern what employers can and cannot ask. If a prospective employer does not ask, I do not know of any law that requires you to disclose your limitations.
